041561-Special Called Session MINUTES City Commission, Sanford, Florida, April 296 1 . The City Commission of the City of Sanford, Florida, met in Special Called Session at the City Hall in the City of Sanford, Florida, at 3:00 o'clock P. M. on April 15, 1961. Williams Meeting called to order by the Chairman.~ On motion of Commissioner Crapps, seconded by Commissioner Wilson and unanimously carried, the Commission approved the waiver of the requirements of 24 hours written notice. Commissioner Wilson next introduced Resolution No. 943, and after being read in full moved its passage and adoption. Seconded by Commissioner McDonald and carried by the unanimous vote of the Commissimn. Said Resolution No. 943 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, SUPPORTING AND APPROVING THE PLANS FOR THE CON- STRUCTION OF STATE ROAD 46 FROM FRENCH AVENUE TO INTERSTATE HIGHWAY 4 WHEREAS, it has been brought to the attention of the City Commission of the City of Sanford, Florida that plans have been completed for the construction of SR 46 from French Ave., west to Interstate Highway 4., and WHEREAS, the plans have been reviewed by the City of Sanford, Florida, NOW THEREFORE, BE IT RESOLVED BY the City Commission of the City of Sanford, Florida that the plans are hereby approved, and IT IS FURTHER RESOLVED by the City Commission of the City of Sanford, Florida that all efforts be directed to immediate construction of said project as a vital necessity for the ease and convenience of the traffic flow. Seconded by Commissioner McDonald and carried by the unanimous vote of the Commission. Said Resolution No. 944 being in words and figures as follows: A. RESOLUTION OF THE CItY COMMISSION OF THE.CITY~OFSANFORD,, ~FLORIDA URffINGffHE LEGISLATIVE DELEGATIONREPRESENTING THE ~CITY OF.SANFORD AND SE'~NOLE COUNTY TO OPPOSE HOUSE BILL ~8~9,,COMMONLY CALLED COUNTY CODE. WHEREAS, it has come to the attention of the City Commission of the City of Sanford, Florida, that House Bill 489 was introduced in the House of Representatives Tuesday, April 11, 1961, WHEREAS, said bill provides in part that a county may levy a county-wide tax in order to provide services, currently municipal services, outside municipal limits which would have the effect of taxing properties within municipal limits, which properties are presently MINUTES City Commission, Sanford, Florida, ~pril 15 at 3 P.. M. 139 paying for municipal services, in order that the same service can be furnished to properties outside municipal limits, and ~tEREAS, said bill would also empower a county to grant,franchises for utilities both within and without municipalities, thus usurping powers presently granted to municipalities ,grid rendering meaningless present municipal utility systems, and WHEREASi the Citiy Commission of the City of Sanford, Florida deems the ability to tax municipal properties for projects and purposes outside of municipalities and from which said municipalities receive no benefit an unfair and undue burden upon property ownership within said municipality, NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida that the Honorable Mack N Cleveland, Jr., Sta~e Representative, The Honorable Gordon V. Frederic] State Representative, and the Monorable Bernard Parrish, State Senator, constituting the legis- lative ~eSega~i~nt~e~resenting:the City of Sanford, Florida, be and they are hereby requested to oppose the passage of HouseBill 489 in its present form. BE IT FURTHER RESOLVED that this resolution be spread upon the minutes of the City Commission of the City of Sanford, Florida and copies thereof delivered to each of the above mentioned. Commissioner Higginbotham next introduced Resolution No. 945, and after being read in full moved its passage and adoption" S86onded by,jCommissioner Wilson and carried by the un- animous vote of the Commission. _ ~ ', Said Resolution No. 945 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF ~tE CITY OF SANFORD, FLORIDA OPPOSING ANY COUNTY-WIDE DRAINAGE TAX IN SEMINOLE COUNTY, FLORIDA WHICH INCLUDES PROPERTIES WITHIN THE CORPORATE MUN!ICIPALITIES. WHEREAS, IT has come to the attention of the City Commission of the City of Sanford, Florida that there is proposed for introductiOn into the State Legislature a bill authorizing the County Commission of Seminole County, Florida to establish a county-wide drainage tax within said county, including properties within corporate municipal limits, and WHEREAS, the City Commission of the City of Sanford, Florida feels that the levy of such tax upon properties within corporate limits of the City of Sanford, Florida places an undue burden on said property inasmuch as the said tax revenues derived therefrom benefit prop- erties other than within said municipality and in most instances will benefit a small minority percentage of the county area at the expense of a majority percentage of the county area,,r!. !:.~ ~.: '.,~,'~, NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida that the legislative delegation representing the City of Sanford, Florida, be and they are here- by urged to oppose any county drainage tax levy in Seminole County, Florida which is not re- stricted to the areas directly benefited, and in any event that the City of sanford, Florida be / 140 MINUTES City Commission, Sanford, Florida, April 15 at 3 P.
