050861-Regular Session MINUTES City CommiSsion, Sanford, Florida, May 8 a.t 8 P.M. 19_6,1_ The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. The first order of business being a Public Hearing to consider rezoning the property as proposed and described in the following legal "Notice" published in the Sanford Herald on April 21, 1961. NOTICE OF PUBLIC HEARING ON PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING. ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on May 8, 1961, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: The property bounded on the North by McCracken Road, on the West by Grapeville Avenue, on the South by 16th., Street, and on the East by Lot I and Lots 5 thru 15, Dixie Subdivision and Lot 93, Mo M. Smith's Subdivision, is proposed to be zoned R-3 (Single-Family) District. Said property being more particularly described as lots 73, 74, 75, 76,~77, 78, 88, 89 and 90, M. M. Smiths Subdivision. (b) The property abutting 25th Street (Geneva Avenue) on the South and lying between Elm Avenue and Myrtle Ave., is proposed to changed to C-N (Commercial-retail-Neigh- borhood Shopping) District. Said property being more particularly described as Lots 1 a~d 15, Block 3, Dream- wold 2nd Section,. All parties in interest and citizens shall have an opportunity to be heard at said hearing 1961. The Chairman then announced that the Commission would be glad to hear from anyone in favor of, or against rezoning the property as proposed and described in the foregoing notice. There being no objections registered, Commissione~ Higginbotham moved that Lots 74, 75, 76, 77, 88, 89 and 90, M. M. Smith's Subdivision of the property described in paragraph (a) be zoned as advertised:, and authorized the City Attorney to prepare an Ordinance pertaining to same. Seconded by Commissioner Wilson and carried. After discussion, Commissioner Higginbotham moved to table action on rezoning the property described in paragraph (b) pending further discussion with the Zoning and Planning Commission. Seconded by Commissioner Wilson and carried. Recommendation next submitted by the Zoning and Planning Commission to Zone Lot 73, M.M. Smith's Subdivision to C-N (Commercial-neighborhood-shopping) District, and ~o moneoLot 78, M. M. Smith's Subdivision to R-4 (Multiple-family) District, and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson:and carried, a Public Hearing was authorized to be held on June 12, 1961, to consider same. MINUTES ' ' May 8 at 8 P. M. City Commission, Sanford, Florida, 61 A. R. Bowling, 416 Orange Avenue, spokesman for a group of residents in this neighbor- hood, next appeared to request the Commission to close an open ditch south of 6th Street abutting his property and further complained~of the dust caused from this unpaved street. The City Manager was authorized to investigat~ feasibility of filling the ditch. F. Murphy, 410 Orange. Avenue, next requested information for paving Orange Avenue and was informed that engineering reports had'be~n made several times on this street and were available at the City Manager's Office. E. E. Doty, lr3 Country Club Road,.next appeared to request:more police patrol for speeding vehicles in this neighborhood. County~¢ommissioner Ted Williams, next appeared to offer the co-operation of the Board of County CommisSioner and suggested a joint meeting of the City and County Commissioners to further this spirit of co-operation. On motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, John Fitzpatrick and Howard Mouteith were next re-appointed as members of the Commission of the Housing Authority of the City of Sauford, with terms to expire May 20, 1965. Request next submitted from the Trustees of the General Sanford Memorial Library for an additional appropriation' to cover expenses and'equipment for micro-film as follows: Cabinet $ 235.00 Viewer 525.00 Transportation 175.00 $ 933. O0 After consideration and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, a transfer of funds for aforesaid request was authorized from Contingency Account No. 8150 to Library Account No. 8078. The City Manager reported that Police Car No.. 27, 1960 Ford, had been involved in a wreck and was a total loss and further that Strickland-Morrison, Inc., had offered to replace this vehicle on the basis of their bid awarded on October 24, 1960, in the amount of $3,354.83, less discount of $504.84, net $2,850.00, less insurance claim of $1,375.00 for a net replacement cost to the City of $1,475.00. Afger discussion, Commissioner Higginbotham moved to authorize replacement of the aforesaid vehicle due to the emergency, and in consideration that this is the same type ~hicle at. the same price as the last sealed bid awarded, and to transfer funds from the Contingency Fund to cover the net replacement cost. Seconded by Commissioner Wilson and carried. On motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, minutes of special ~eeting of April 17 and regulsr meeting of April 24, 1961, next approved. Request next submitted from John Krider, manager of the Seminole County Chamber of Com- merce, for funds for lighting material and installation expense for two signs advertising Sanford and Seminole County, and after consideration and on motion of Commissioner Wilson, seconded by Commissioner Crapps and carried, the CommiSsion authorized installation of one sign at a cost of $135.00. Consideration next given to proposed Legislative bills and action taken by the Commission as follows: 1. Opposed SB 466-re: Tort action against municipalities. ® Opposed SB 525-prohibiting employees from any outside or supplemental jobs. Favored HB 1016-setting ~nterest rates on municipal real estate liens at 8%. Favored HB 1128-includes violation under-state statues, Section 843.01, of resisting arrest with violence to municiPaim~police officer while en- forcing state law. Favored HB 1447-Prohibiting officials or employees of governments or students from participating in any public demonstrations which may result in public violence. 7. Opposed HB 1512-property exempt from taxation - re hospitals. 8. Favored P~ 1531-prohibiting obstruction of public sidewalks,streets, etc. 9. Opp. os~}~ 1649-municipalities to conform to state requirements on sale and redemption of tax certificates. 10. Favored HB 9168-improved method of affixing stamps re - cigarette tax. 11. Favored SB 427-provides from emergency sale of materials and supplies to counties and municipalities. 12. Favored SB 698-defines value of stock in trade. Request next submitted from representatives of the City Police Department to lease a sit, on City owned property east of Mills Creek on Seminole Boulevard on which to construct a Club House and firing range. After consideration and on motion of Commissioner Higginbotham,seconded by Commissioner Wilson and carried, the Commission authorized the lease with the provision that in the event of disuse by the Association or termination by the City, that the City would reimburse the Association for any improvements remaining upon said leased site. Request next submitted for street light at the intersection of 14th Street and shepherd Avenue, and for fill dirt to be put in the low section', and for better drainage to be installed, and said request was turned over to the City Manager for study and recommendations. Request next submitted to rent the City?,~s low-boy v~hicle, for moving heavy equipment, and same was denied on the basis that this would be in competition with private business which was available for this service. The City Manager next reported that the new production well drilled in accordance with specifications and bid awarded to Central Florida Well Drillers Company, would only produce 579 gpm with a 10-foot draw down, instead of the bid requirement of 1,000 gpm, however, that this well could be utilized with a 500 gpm pump. After consideration, the Commission authorized negotiations for payment with the aforesaid company on a percentage of performance. After discussion and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, the Commission aut}~orized installation of sewers by the City forces at Fairlane Estates Subdivision upon payment in advance for proposed extensions. Request next submitted to vacate and abandon a utility easement located in Lots 69 througt 72, San Lanta Third Section, and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, a Public Hearing was authorized to be held on June 12, 1961, to consider same. A.£'ter. discussion and on motion of Commissioner Higginbotham , seconded by Commissioner Crapps and carried, the Commission authorized the purchase of a 170 HP gasoline engine for the standby auxiliary fire pump in the. amount of $750.00. Further consideration next given to the rental of the Civic Center to religious organi- zations and after discussion of the various complaints received, the Commission directed that it would not be rented to any church or religious sects for any use.
