081461-Regular Session MINUTES City Commission, Sanford, FlOrida, ~[ugust I/~::at 8 P. M. 19. The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida,'at 8:00 o'clock P. M. on August 14, 1961. Present: Commissioner Joe B. Baker, Mayor " J.H. Crapps " Earl Higginbotham " Thomas S. McDonald " A.L. Wilson City Attorney W. C. Hutchison Jr City Manager W. E. Knowles City Clerk H. N. Tamm, Jr., Deputy Clerk Rosa Rotundo Police Chief R. G. Williams The meeting was called to order by the Chairman. A. B. Peterson, Civil Defense Director for Seminole County, appeared to commend the Commission for their action in authorizing plans to be prepared for a ~i~il Defense Shelter for Municipal Headquarters and recognized City Manager Knowles ~nd Police Chief Williams for their continuous cooperation with his office with work in Civil Defense. The next order of business was a Public Hearing to determine whether or not the 1960-61 City Occupational License No. 326, issued to Mrs C. H. 0IIiff, d/b/a The Palms, to engage in the business of a rooming house at 420 West First Street, should be revoked because of viola- tions of the Building Code. E Ambrose Olliff, Jr., attorney representing the owner, next appeared and referred to his letter of August 14, 1961 to the Commission outlining his clients position as one of full cooperation with a desire to make all necessary alterations and repairs, and also that they were! trying to obtain from the Florida Hotel and Restaurant Commission information as to what alter- ations and repairs were 'necessary to bring the property within the standards of said Commission. Commissioner McDonald pointed out that the Commission had been both tolerant and lenient regarding the condition of this building and so far had only received promises to correct the condition and therefore moved to revoke the license and same died for lack of a second. After further discussion Commissioner Crapps moved to prohibit occupancy of the building by other than the caretaker for the balance of the fiscal year and to withhold issuance of a new license until the building is repaired and meets the requirement of the Florida Hotel and Restaurant Commission and the City Building Code. Seconded by Commissioner Wilson and carried over the dissenting vote of Commissioner McDonald. Jack Trim, next appeared to present a proposed lease of the City pier and boat basin for a Marina, and after discussion same was referred to the City Attorney for approval. The next order of business being a Public Hearing to consider rezoning the property as proposed and described in the following legal "Notice" published in the Sanford Herald on July 25, 1961. NOTICE OF PUBLIC HEARING ON PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FL~RID~ The property abutting Sixteenth Street on the north and Grapeville Avenue on the west in proposed to be zoned R-3 (single-family) District. Said property being more particularly described as Lots 12, 13 and 24 (less the E 100 ft of Lot 12), of Block B, M. M. Smith's Second Subdivision. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 B!cicck P. M. on August 14, 1961, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida. MINUTES City Commission, Sanford, Florida, August 14 at 8. Pi M. Tamm, Jr. As City Clerk of the City of Sanford, Florida The Chairman then announced that the Commission would be glad to hear from anyone in favor of, or against zoning the property as proposed and described in the foregoing notice. There being no objection registered, Commissioner Higginbotham moved that the property described in the foregoing notice be zoned as advertised, and authorized the City Attorney to prepare an Ordinance pertaining to same. Seconded by Commissioner Wilson and carried. Request next submitted by Alberta Webber for Transfer of liQense to sell beer and wine f¢ consumption on premises from Bertha Lee Walker, d/b/a Busy Bee Cafe, 1114 West 12th Street, and on motion of Commissioner Wilson, seconded by Commissioner Higginbotham and carried, same was approved on recommendation of the Chief of Police. Request next submitted by Melvin Siskind, d/b/a Army-Nayy Surplus Store, 310 Sanford Avenue, for permit to sell pistols, revolvers or other small firearms which may be concealed on the person, and on motion of Commissioner Higginbotham, seconded by Commissioner McDonald and carried, same was denied on the recommendation of the Chief of Police and City Manager. Consideration next given to the proposed revised zoning ordinance and after discussion same was held for further review. Letter next submitted from residents of Wolfer's Lake View Terrace Subd., requesting theJ area to be designated as an area for annexation to the City, and'on motion of Commissioner Wilson, seconded by Commissioner Higginbotham and carried, same was approved and the City Manage~ and City Attorney were authorized to designate an area so as to be contiguous to the City and prepare a petition for annexation for same. Consideration next given to agreement with Lee Brothers Plumbing Company regarding sale of Lots i thru 5, Blk 1, Tr 9 and Blk l-N, Tr 10, Traffords, for sum of $13,333.00, said sale based on an agreement for construction to begin within one year. Due to construction not havin~ begun, the Commission under date of September 1, 1960., authorized to refund the purchase price within 13 months and to refund 1960 taxes on said property. Pursuant to said action, Commission Higginboth~m moved to refund said sum from the Public Projects Fund. Seconded by Commissioner Crapps and carried. On motion of Commissioner Higginbotham, seconded by Commissioner Crapps and carried, current invoices and payrolls next approved, as evidenced by General Fund Florida State Bank Vouchers Nos. 2946 thru 3005, General Fund Sanford Atlantic National Bank Vouchers Nos. 6275 thru 6432, and Water and Sewer Revenue Fund Sanford Atlantic National Bank Vouchers Nos. 493 thru 501. On motion of Commissioner Higg~nbotham, seconded by Commissioner Wilson and carried, the Commission authorized purchase of a 5 KW Federal Government surplus generator from the Utility Department Budget for the proposed Municipal Headquarters Civil Defense shelter. The City Manager was next authorized to request the County Commissioners to exempt from County Taxes those inprovements within the City which would qualify as Civilian Defense Shelters After discussion and on motion of Commissioner Higginbotham, seconded by Commissioner MIN'UTES City Commission, Sanford, Florida, August 14 at 8 P. M. 19 61_ 177 1 Crapps and carried, the Commission authorized installation of a water line on City property to service, fire sprinkler system for warehouse of W. A. Adams on Commercial and Holly Avenues, provided that Mr. Adams would pay all costs involved. The City Attorney reported a ruling had been received from the Deputy Commissioner of the Florida Industrial Commission, Workmens Compensation Division, in the case of a former employee, Wesley Petty, that his condition was compensatory$ and on motion of Commissioner Higginbotham,~seconded by Commissioner Wilson and carried, the City Attorney was authorized to appeal the ruling to the Industrial Commission.. M. on September 7, 1961 to sit as a Board of Equalization to receive the 1961 Tax Roll as prepared by the Tax Assessor. There being no further business the meeting was adjourned until 8:00 o'clock P.
