082861-Regular Session MINU'T:ESi City Commission, Sanford, Florida, August 28 at 8 P.M. .19_6_! The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on August 28, 1961. Present: Commissioner Joe B. Baker, Mayor " J.H. Crapps " Earl Higginbotham " Thcs. S. McDonald A.L. Wilson City Attorney Wm. C. Hutchison, Jr. CityManager W. E. Knowles City Clerk, H. N. Tamm, Jr. Deputy Clerk Rosa Rotundo Police Captain Arnold S. Williams The meeting was called to order by the Chairman. R. F. Sheddon, manager of the Southern Bell Telephone Company, appeared to answer any inquiries pertaining to the rate increases as proposed by his company. Wm. Leffler & Wm Bush, Engineers, next appeared to discuss the preliminary report pre- pared by Leffler & Bush, and Clark, Daily & Dietz, on the sewage treatment plant. After discussion, Commissioner Higginbotham moved to accept the preliminary report as presented and to authorize the City Manager to submit an Application for Federal Grant for Sewage Treatment Works to the State Board of Health in the amount of $139,440.00, based on the engineers estimated costs of $464,800.00 for a primary treatment plant with a capacity of 4 million gallons per day, and further to authorize the City Attorney to prepare a supplement~to the original contract to designate that Leffler & Bush, and Clark, Daily & Dietz will be re- tained as engineers for the proposed treatment plant in t~.~vent the aforesaid $139,440.00 is approved and made available to the City. Seconded by Commissioner Wilson and carried over the dissenting votes of Commissioner Baker and Commissioner Crapps. COmmissioner Baker stated that he had not had sufficient time since receipt of the preliminary plans to determine the advisability of the City approving a three or four million gallon per day plant. Commissioner Crapps stated that he favored withholding further action until the funds were made available through the application for the federal grant. Jack Trim next appeared with further reference to a lease of the City Pier and Boat Basin for a proposed Marina and the City A~ttorney pointed out that the lease as presented did not conform to the provisions as requested by the Commission. Mr. Trim was requested to in- corporate the suggested provisions and resubmit the lease to the Commission. Request next submitted by the Board of County Commissioners for use of part of the City Storage and distribution of Federal Donated Surplus Commodities to Needy Persohs. Commissioner Higginbotham moved to deny the request due to the use now being made of the property, and same died for lack of a second. Commissioner Crapps moved to table action on the request until it could be determined if the County Canning Kitchen would be available for this use or until a lease agreement could be worked out as to the hours and days of use desired, and same died for lack of a second. Moved by Commissioner McDonald to deny the request and recommend to the County Com- mission the use of Hopper Academy or the Canning Kitchen. Seconded by Commissioner Higgin- botham and carried. After consideration Commissioner Higginbotham moved to recind action of August 14, 1961 authorizing repurchase of Lots I thru 5, Blk 11, Tier 9 and Block l-N, Tier 10, Traffords, for sum of ~13,333.00 from Lee Brothers Plumbing Company, and to extend the previous agreement to start construction by them within one year, with the provision of a 30-day call period if the City deems the property as being needed for another use, or if Lee Brothers Plumbing Company desires to utilize either of the aforesaid parcels of property, valuations would be established on pro-rata basis of purchase price to appraisal price. Seconded by Commissioner Wilson and carried. Request next submitted by the Florida State Bank to contract for use of City Street Sweeper to maintain their parking lot, however, due to this use being on private property, moved by Commissioner McDonald to deny the request. Seconded by Commissioner Crapps and carried After consideration Commissioner McDonald moved to authorize the City Attorney to prepare an Ordinance for adoption of the Zoning regulations, as amended, and submitted by the City Planner, George Simon and approved by Zoning and Planning Commission. Seconded by Commissioner Wilson and carried over the dissenting vote of Commissioner Crapps. Commissioner Wilson next introduced Ordinance No. 759, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA AMENDING ORDINANCE NUMBER 362 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN (SINGLE-FAMILY) DISTRICT. and same was placed on its first reading and ~d in full. Commissioner Wilson then moved the waiver of the requ'[~ement of the second reading of Ordinance No. 759, and that same be placed onilitsTinal passage and adoption. Thereupon the question recurred on the w~iver of~,tB~ second reading, the roll was called and the vote stands as follows: Commissioner Baker Yea " Crapps Yea " Higginbotham Yea " McDonald Yea " Wilson Yea Said Ordinance No. 759 was then placed on its final passage and adotpion, the roll was called and the Vote stands as follows: Commissioner Baker Yea " Crapps Yea " Higgiubotham Yea " McDonald Yea " Wilson Yea Thereupon the Chairman announced that the City Commission of the City of Sanford,Florida, by unanimous vote had passed and .adopted said Ordinance No. 759, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NUMBER 362 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMEND- MENT PLACING CERTAIN TERRITORY IN R-] (SINGLE- FAMILY) DISTRICT. Consideration next given to the proposed 1961-62 Budget. Mayor Baker reported that a reputable tractor service person had submitted an estimate to repair the Parks Tractor for $509.00. On motion of Commissioner ttigginbotha~, seconded by Commissioner Crapps and carried, i82 MINUTES City Commission, Sanford, Florida, Ahgust 28 a't 8 P. M. 61 transfers were authorized to remove said tractor replacement and to appropriate for the repair of the present tractor in the proposed budget as follows: Reduce - Parks-Equipment Account No. 4126 Increase - Parks-Equipment Repairs Acct No. 4419 Increase Contingency Account No. 8150 $2,700.00 60O.00 2,100.00 There being no further amendments to the proposed 1961-62 Budget, Commissioner Higgin- botham moved to authorize the City Attorney to prepare an Ordinance for adoption of the 1961- 62 Budget as amended. Seconded by Commissioner McDonald and carried. The City Attorney next reported that a deposit would have to be advanced to pay for a transcript in the case of Wesley H Petty -vs- City of Sanford being appealed to the FlOrida Industrial Commission, and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, same was approved.
