100961-Regular SessionMINUTES City Commission, Sanford, Florida, October 9, at 8 P. M. 19 6~1 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on October 9, 1961. Present: Commissioner Joe B. Baker, Mayor " J.H. Crapps " Earl Higginbotham " Thomas S. McDonald " A.L. Wilson City Attorney Wm. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Deputy Clerk Rosa M. Rotundo Police Chief R. G. Williams The meeting was called to order by the Chairman. Applications for exempt license due to hardship next submitted and action taken as follows: John R. Gilleon, Orlando, Florida, fruit tree sprayer, re- quested exemption due to being an amputee and on motion of Commissioner Wilson, seconded by Comissioner McDonald and carried, same was approved. Miss Mary McMahon, operator 'of a Beauty Parlor in her home at 309 Park Avenue, requested an exemption~ due to age and ability to only work part time, and on motion of Comm., McDonald, seconded by Commissioner Higginbotham and carried same was denied. Bob Jones, 1101 Olive Avenue, merchant, requested exemption due to ill health and also being over 80 years old, and on motion of Commissioner Crapps, seconded by Commissioner Wilson and carried, same was approved. John Daniels, 804 Celery Avenue, Peddler of produce, requested an.! exemption due to his age and having to care for his invalid wife, and further stated that he grew approximately one half of the produce he offered for sale, and on motion of Commissioner McDonald, seconded by Commissioner Higginbotham and carried, the Commission authorized a merchant license - handling pro- duce in the amount of $7.50, Howard Long next appeared in the interest of Mrs. Zula E. Kamman, his housekeeper, and stated that she had fallen on the sidewalk on First Street and was still under a physicians care. The medical bills have amounted to approximately $150.00, and he requested the Com- mission to authorize payment for same, and after cor~deration the request was denied, William Kirk next appeared to request approval of a plat of Golden Gates Sub- division on W 16th Street and stated that he would pay the City $2,500.00 towards the expense of installing water and sewer lines to service the thirteen lots in the plat. Commissioner Higginbotham moved on the acceptance of the Plat and to authorize the installation of said water and sewer service upon receipt of the $2,500.00. Seconded by Commissioner McDonald and carried. Ambrose Olliff, Attorney for the owners of the Palms, 420 W First Street, next appeared to thank the Commission for their patience pertaining to condemnation of said struc- ture, and stated that the owners were still considering hiring a contractor to remodel the building. - Letter next submitted from the Central Florida Well Drillers Company requesting pay- ment in the amount of $6,504.50 for drilling exploratory well and two observation wells at the Municipal Gol.~ Course, and on motion of Commissioner Higginbotham, seconded .by Commissioner McDonald and carried, payment was authorized from the Renewal and Replacement Fund upon satis- factory completion in accordance with the terms of the contract and on approval of the consult- ting engineers, Leffler and Bush, and on approval of the City Manager. Request next submitted by Jack Trim for a license to sell alcohOlic beverages for consumption on premises at the proposed Sanford Mar Marina at the Municipal Pier, and on motion of Commissioner Higginbotham, seconded by Commissioner Crapps and carried, same was approved. Request next submitted by Price J. Angel, d/b/a Angels, 2503 Sanford Avenue for transfer from H W RaWls, of license for sale of beer and wine for consumption on premises, and on motion of Commissioner Higginbotham, seconded by Commissioner McDonald and carried, same was approved. CommissionerMCDonald next introduced Ordinance No. 765, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED AS FOLLOWS: BEGINNING AT THE INTER- SECTION OF THE CITY LIMITS LINE AND THE WEST RIGHT OF WAY LINE 0F~WOODLAND DRIVE NORTH OF 0NORA ROAD; THENCE WEST ALONG THE CITY LIMITS FOR A DISTANCE OF 537.8 FEET: THENCE NORTH A DISTANCE OF 405 FEET; THENCE EAST A DISTANCE OF 537.8 FEET; THENCE SOUTH ALONG THE WEST RIGHT OF WAY LINE OF WOODLAND DRIVE A DISTANCE OF 405 FEET TO THE POINT OF BEGINNING; PROVIDING AN EFFECTIVE DATEFOR SAID ANNEXATION AND FOR THE RIGHTS AND PRIVILEGES FOR CITIZENSHIP IN THE CITY OF SANFORD, FLORIDA. and same was placed on its first ~eading and read in full. Commissioner Higginbotham then moved on the waiver of the requirement of the second reading of Ordinance NO. 765, and that same be placed on its final passage and adoption. Commissioner Higginbotham next introduced Ordinance No. 766, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA AMENDING CHAPTER 14-13, THE CODE OF THE CITY OF SANFORD, FLORIDA, 1954, ITEM 9 THEREOF, BEING THE SCHEDULE OF OCCUPATION AND LICENSE TAX APPLICABLE TO ALCOHOLIC BEVERAGES, SAID AMEND- MENT ESTABLISHING THE SCHEDULE OF LICENSES ACCORDING TO CHAPTERS 561.34 AND 561.35, FLORIDA STATUTES 1959, AND AS THEREAFTER AMENDED, AND ESTABLISHING THE AMOUNT OF SUCH LICENSETAX IN MI. NUTES City Commission, Sanford, Florida, October 9, at 8 P. M. REPEALING THE PROVISION OF CHAPTER 4-21, THE CODE OF THE .CITY OF SANFORD, FLORIDA 1954, AS AMENDED, INSOFAR AS THE SAME IS IN CONFLICT. and same was placed on its first reading and read in full. Request next submitted to vaCate the North/South alley, north of Lots 4 and 10, Park View Subdivision and south of 27th street betWeen Oak Avenue and Park Avenue, and on motion of Commissioner Wilson, seconded by. Commissioner Crapps and carried, a public hearing was authorized to be held on November 13, 1961, to consider same. On motion of Commissioner Wilson, seconded by Commissioner Higginbotham and carried, minutes of regular meeting of September 26, 1961, next approved. Commissioner Higginbotham moved that the regular meeting of Monday October 23, 1961, be set for Thursday, October 19, 1961, at 1:30 P.M. due to the Commissioners attending the Florida Municipal League meeting in Jacksonville. Seconded by Commissioner Crapps and carried. After discussion and on motion of Commissioner Higginbotham, seconded by Com- missioner Wilson and carried, Southern Water Contractors were granted a temporary extension of time on their contract for installation of well field pump No. 61-1 and water line booster, due to delay in delivery of material from manufacturer. After considerable discussion and on motion of Commissioner Higginbotham seconded by Commissioner McDonald and carried, the City Attorney was authorized to negotiate up to $3,500.00 for a full settlement regarding claim of Wesley Petty under Workmens Compensation Laws. On motion of Commissioner Wilson, seconded byCommissioner McDonald and carried, the City Attorney and City Clerk were authorized to enter safe deposit box No. 177 at Sanford Atlantic National Bank. There being no further business the meeting adjourned.
