031262-Regular Session MINUTES City Commission, Sanford, Florida, March 3.2 ,at 8:00 P.M. .19. 62_ The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P.M. on March 12, 1962. Present: Commissioner J. H. Crapps, Mayor " Joe B. Baker " Earl Higginbotham " Thomas S. McDonald " A.L. Wilson City Attorney William C. Hutchison, Jr. City Manager W. E. Knowles Deputy Clerk Rosa M. Rotundo Police Chief R. G. Williams Absent: City Clerk H. N. Tamm, Jr. The meeting was called to order by the Chairman. Duke Shaulbert appeared to further discuss the proposed route of the bus franchise which wgs presented at meeting of February 26, 1962, and same was taken under advisement. The next order of business was a Public Hearing to consider the condemnation of the buildings or structures in accordance with notices authoriZed at regular meeting of February · ~2:~ i[962, to owners of property as follows: Report 62-1, 705-707 W. 9th Street, rear portion of Lot l, Block ll, Tier 10, A. C. Martins Addition to Sanford. Report 62-2, 801 & 803 W. 9th StreeZ, Lot l, Block ll, Tier ll, A. C. Martins Addition to Sanford. Report 62-3, 904 & 908 Holly Avenue and 3 unnumbered units in rear of 904 & 908 Holly Avenue, Lot 2, Block ll, Tier ll, A. C. Martins Addition to Sanford. Report 62-~, 816 W. 10th Street and 2 unnumbered units, that fraction of W 1/2 of Block ll, Tier ll, lying E of RR R/W, A. C. Martins Addition to Sanford. Report 62-5, 701-707 W. 10th Street, Lot l, Block 12, Tier 10, A. C. Martins Addition to Sanford. Report 62-6, 711, 715 & 717 W. 10th Street, Lot 6 Block 12, Tier lO, (less W. ~ ft.), A. C. Martins Addition to Sanford. Report 62-7, 1009 & 1009 1/2 Holly Avenue, Lot 7, Block 12, Tier 10, (less W. ~ ft.) A. C. Martins Addition to Sanford. George Fadeous, Attorney for Kleanthis Ares Estate, next appeared in regard to pro- perty on the Report Nos. 62-1, 62-2, 62-3, 62-4, and requested a delay of action at this time as the estate is in litigation. He also stated that he felt that his clients would have the buildings removed. After considerable discussion, Commissioner Baker moved that the buildings and structures covered by the aforesaid Reports 62-1, 62-2~ 62-3, 62-4, be condemned and owners given a Notice of 90 days to repair or remove the buildings or structures or give a just. cause why they are not removed or repaired, and after the 90 days Notice to authorize the City to remove the buildings or structures and levy a lien against the property for the cost of removal. Seconded by Commissioner McDonald and carried unanimously. After considerable discussion, Commissioner Baker moved that the buildings or structures covered by the aforesaid Reports Nos. 62-5, 62-6, 62-7, be condemned and owners given a Notice of 90 days to repair or remove the buildings or structures or give a just cause why they are not removed or repaired, and after the 90 days Notice to authorize the City to remove the buildings or structures and levy a lien against the property for the cost of removal. Seconded by Commissioner McDonald and carried unanimously. Loomis Leedy, Fiscal Agent for the City, next appeared and submitted a schedule for the retirement of the proposed bond issue for the sewage treatment plant. After considerable discussion, Commissioner Higginbotham moved to authorize the City Attorney and the Fiscal Agents to prepare an ordinance to authorize the sale of $200,000.00 bonds necessary to MINUTES City Commission, Sanford, Florida, March~.. M, _1962 _ a schedule for the retirement of Refunding Series "B" (Water) Bonds by the maturity date of September 1, 1977. Seconded by Commissioner McDonald and carried. Plans next submitted for the renovation of the old county jail to be used for the Police Station. After discussion, Commissioner Wilson moved to authorize a transfer of $12,000.00 from the Contingency Account No. 8150 to Police Department Building Repairs and Maintenance Account No~ (2221). Seconded by Commissioner Higginbotham and carried. The City Attorney next reported that the State Law requires that a registered architect approve the plans for any public building. Request next submitted by Harry Almond, for transfer of license for sale of beer and wine forcconsumption on premises from Inez Cook, d/b/a Cooks Corner at 2617 Park Drive, and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried same was approved on the recommendation of the Chief of Police. On motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, the Commission authorized the pur6hase of 30 new automatic Park-O-Meters at a cost of $46.50 each to replace old parking meters, A flag of the United States, which was flown over the Federal Capitol and is to be used at the Civic Center, was presented to the City Commission from Congressman Herlong, and on motion of Commissioner Wilson, seconded by Commissioner Higginbotham and carried, the Commission authorized a letter to C°ngressman Herlong in appreciation of same. After discussion and on motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, consideration of installation of nineteen Street lights from Primary School west to Roosevelt Ave. and from 16th Street to 18th Street, was tabled for further study. On motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, the City Attorney was authorized to prepare a resolution supporting a proposed legislative bill for the addition of three cents to the cigarette tax, and with funds collected within the City to be returned to the City. On motion of Commissioner Baker, seconded by Commissioner McDonald and carried over the dissenting vote of Commissioner Higginbotham, the City Attorney was authorized to pre- pare a resolution supporting the proposed legislative bill for the addition of one cent per gallon to the gas tax with funds collected within the City to be returned to the City. On motion of Commissioner Wilson, seconded by Commissioner Baker and carried, the minutes of February 26, 1962, were next approved with a correction to reflect the adoption of Resolution No. 956. On motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, the City Clerk and the City Attorney Were authorized access to the safe deposit Sox #177. On motion of Commissioner Baker, seconded by Commissioner Wilson and carried, current invoice and payrolls next approved, as evidenced by General Fund Florida State Bank Vouchers Nos. 3310 thru 3343, General Fund Sanford Atlantic National Bank Vouchers Nos. 7501 thru 7630, and Water and Sewer Revenue Fund Sanford Atlantic National Bank Vouchers Nos. 543 thru 5~8. On motion of Commissioner McDonald, seconded by Commissioner Higginbotham and carried a transfer of $1,500.00 was authorized from the Contingency Fund account number 8150 to Refuse Repairs.and Maintenance of Equipment account number ~919. MINUTES City Commission, Sanford, Florida, March 12 at 8:O0 P.M. On motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried, a transfer of $8,000.00 was authorized from Utility Department Surplus to Water Extensions accoUnt number 9129. After considerable discussion of the abandonment of a junk car on vacant Lots i and Block 9, Tier 8, Traffords, the City Manager was authorized to have the same removed by the City due to the same creating a health and safety menance to the public. After discussion, and on motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried, the City Manager was authorized to accept a note from W. A. Adams in payment of his account for the extension of water services in the amount of $1,319.92 due September 6, 1962, without interest, and further authorized that all other notes would bear 6% interest. On motion of Commissioner Wilson, seConded by Commissioner Higginbotham and carried over the dissenting Vote of Commissioner McDonald, a statement of October 5, 1961, to George Maffett for laying a sewer line in amount of $3/!/!.52, was authorized to be settled in the amount of $200.00. On motion of Commissioner Wilson, seconded by Commissioner Higginbotham and carried, a letter of appreciation for the donation of palm trees was authorized to be sent to Mr. and Mrs. Edward Smith, 824 Catalina Drive and Mr. and Mrs. H. H. Fortner, Jr., 826 Catalina Drive. On motion of Commissioner Baker, seconded by Commissioner Wilson and carried, a Public Hearing was authorized to be held on April 9, 1962, to consider proposed changes and amendments to the Zoning Ordinance as follows: (a) To amend Article XIII, M-L Light Industrial District, Section 1, Paragraph (1), to prohibit construction of new one, two and multiple family dwellings. (b) To amend Article XiV, Non-conforming uses, Paragraph (2), to permit a building housing a non-conforming use to be reconstructed or structurally altered in an M-1 Light Industrial District. Request next submitted from property owners requesting the paving of Bay Avenue and Locust Avenue from 7th Street to First Street, and on motion of Commissioner Baker, seconded by Commissioner McDonald and carried, the City Manage~ was authorized to inform the pe- titioners of the City's policy of each of ~he abutting property owners to pay one-third of the cost of construction, and the City tom pay the other One-third. On motion of Commissioner McDonald and carried, street lights at Celery Avenue an~ Willow Avenue and Celery and Bay Avenues were next authorized to be installed. ~ ~ ~ There being no further business the meeting adjourned.
