042362-Regular Session MIN!UTES City Commission, Sanford, FlOrida, The City Commission of the City of Sanford, Florida, met in regular Session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. The Chairman announced that the first order of business was a Public Hearing to consider the zoning the property as proposed and described in the following legal "Notice" published in the Sanford Herald on April 5, 1962. NOTICE OF PUBLIC HEARING ON PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing.will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on April 23, 1962, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida. (a) The property abutting Sanford Avenue on the East at the intersection of Onora Road is proposed to be zoned C-1 (Neighborhood-Commercial) District. Said property being more particularly described as that portion of Lot A lying east of that certain utility easement extending northeasterly from the northeast corner of Lot 8 to Lot 7, all in Block 4, Rosalind Heights Subdivision and all of the south 544.5 feet of the North 577.5 feet Of the west 179 feet of the east 229 feet of Section 12, Township 20 South, Range 30 East. (b) The property lying north of Onora Road and abutting Palmetto Avenue and Mag- nolia Avenue is proposed to be zoned R-lA (One Family Dwelling) District. Said property being more particularly described as that portion of Lot A lying west of that certain utility easement extending northeasterly from the northeast corner of Lot 8 to Lot 7, and Lots 8 through Lot 12, all in Block 4, and Lots 7 through Lot 18 of Block 6, all in Rosalind Heights Subdivision. The Chairman then announced that the Commission would be glad to hear from anyone in favor of, or against the zoning as described in paragraphs (a) and (b) in the foregoing notice. J. A. Russell, 5050 S. Magnolia Avenue, appeared and requested that property des- cribed in the foregoing notice, paragraph (b), be zoned R-2 (Two FamilY) or R-5 (MultiPle Family) instead of R-lA (One Family). After discussion same taken under consideration and Mr. Russell was requested to present his proposal to the Zoning and Planning Com- mission for their study and recommendation. Seconded by Commissioner Baker and carried. The Chairman announced that the next order of business was a Public Hearing to consider vacating, closing and abandoning a portion of a street in accordance with the following legal "Notice" published in the Sanford Herald on April 5, 1962. NOTICE OF PROCEEDING FOR VACATING,CLOSING AND ABANDONING A PORTION OF A STREET. TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on the 25rd day of April, 1962, at the City Commissioners' Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to that portion of a street hereinafter described to-wit: (a) That portion of Holly Avenue lying north of of the north right of way line of Fulton Street. (b) That portionof Maple Avenue lying north of the center line of Gabbett (Water) Street. Persons interested may appear and be heard at the time and place above specified. There being no objections registered, and after consideration, ~ommissioner Higginbotham moved that the portions of streets be closed, vacated, and abandoned as described in the foregoing notice, paragraphs (a) and (b) and to authorize the City Attorney to prepare anOrdinance pertaining to the same. Seconded by Commissioner Baker ~nd carried. The City Manager next submitted the following tabulation of bids which were opened publicly at 2:00 o'clock P. M. on April 18, 1962, for the construction of a Primary Sewage Treatment Plant in accordance with the specifications in the invitation for bids published in the Sanford Herald on March 22, 1962. Philip Logan attorney for the Seminole Transit Company next appeared, with reference to the proposed bus franchise, and after considerable discussion Commissioner Baker mo~ed to authorize the City Attorney to amend the ordinance for the second reading with an addendum to Section 6 defining Jitney as a motor vehicle capable of carrying seven passengers and the driver. Seconded by Commissioner McDonald and carried upon roll call vote as follows: Commissioner Crapps Naye " Baker Aye " Higginbotham Naye " McDonald Aye " Wilson AY~;e The Building Inspector and the Fire Chief next submitted reports of inspections of buildings or structures found to be in delapidated, unsanitary or unsafe condition as follows: Report 62-10, 614 & 618 E. lOth Street, 910, 914, 914~, & 918 Hickory Avenue, Lots 2, 3, and 4, Block ll Tier C Trafford's Map of Sanford. Report 62-11, 812, 814, 816%, & 816~ Pine Avenue, Lot 3 and N. 20 ft, of Lot 4 Block 10, Tier B, Trafford's Map oI' Sanford. Report 62-12., 801 & 803 Cypress Avenue, 505 & 507 East 8th Street, Lot 5, Block 10, Tier B, TrafI'ords Map of Sanford. Report 62-13, 411 & 413 Pine Avenue, S. 68.8 ft. of Block 19, lying West of Pump Branch, Chapman & Tuckers Addition to Sanford. After discussion of each of the aforesaid reports numbers 62-10 through 62-14 and finding each building to be considered unsanitary, unsafe or delapidated, Commissioner HcDonald moved to hold a public hearing on May 14', 1962, to condemn same, and authorize a Notice to be placed upon each structure, and directed by registered mail, to the last known address as shown by the tax assessment rolls of the City, a notice to the owner of the property involved of the findings of the Commission and of the proposed public hearing. Seconded by Commissioner Baker and carried over the dissenting vote of Mayor Crapps. On recommendation of the City Manager and on motion of Commissioner Higginbotham, 'seconded by Commissioner Baker and carried, salary reclassification was authorized~ as follows: Frank Bines from 3-C ($46.52/ week) to 5-A ($50.02/ week). ,' The City Attorney then announced that the proposed amendments to .the zOning ordinance eonsidered at the public hearing on April 9, 1962, were already included in the present zoning ordinance and no amendments were necessary. Commissioner Higginbotham moved that the list of deliquent real estate taxes be posted at the City Hall and Courthouse and a notice to be published four times in the paper for the tax sale on Nay 29, 1962, at lO:00 o'clock A. M. Seconded by Commissioner Wilson and carried. On motion of Commissioner Higginbotham,. seconded by Commissioner Baker and carried, minutes of regular meeting of April 9, 1962, and regular adjourned~meeting of April 16, 1962, next approved. J. Wallstedt. After discussion Commissioner McDonald moved that no further emergency salary advances would be allowed to employees. Seconded by Commissioner Baker and carried over the dissenting vote of Commissioner Wilson. After consideration, Commissioner Higginbotham moved to authorize the City Manager to work with the Fiscal Agent and Engineers to prepare a scale for sewer rates necessary to provide funds to retire the bonds under Ordinance No. 77~ and to operate the proposed sewage plan~ and to authorize the City Attorney to prepare an ordinance for same.
