N. 19. 62 The City Commission of the City of S&uford, Florida met in regular session at..the City Hall in the City of Sanford, Florida, at 8:00 P. Mi. on July 23, 1962. Present: Commissioner J. H. Rotundo Police Chief R. G. Williams The meeting was called to order by the chairman. The first order of business being a Public Hearing to consider vacating, closing and abandoning a portion of Twenty Fourth Street in accordance with the following notice pub- lished in the Sanford Herald on July 6, 1962. NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABANDONING A PORTION OF A STREET. TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on the 23rd day of July, 1962 at the City Commissioners' Room at the City Hall J_n the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any ri~;ht of the City and. the public in and to that portion of a street hereinafter described to-wit: That portion of Twenty Fourth Street running west from the east line of Lot 10, Block 2, Wynnewood, extended, to a line 10 feet west of the east line of Lot 3, Block 2, Wynnewood, extended, however,~retaining a 14- foot alley along center line of said street. Persons interested may appear and be heard at the time and place above specified. City Commission of the City of Sanford, Florida By: s/ H. N. Tamm, Jr. City Clerk The Chairmsm then announced that the Commission would be glad to hear from anyone in favor of, or against closing, vacating and. abandoning that portion of a street as described in the foregoing notice. Miss El!alee Kirchhoff appeared to object to closing that portion of the street abutting property unde~ her ownership described as Lots 9 and I0, Block 2~ Wynnewood, stating, however, that she did not object to closing the remaining portion of the street as advertised. Commissioner Baker moved to desy the request to close that portion of Twenty Fourth Street as advertised, and same died for lack of a second. Commissioner ~ilson moved to close 'that portion of Twenty Fourth street running west from the east line of Lot 8, extended, to a line 10 feet west of the east line of Lot 3, extended, all in Block 2, Wynnewood, and to retain a 14 foot alley along the center line of said street, and to authorize the City Attorney to prepare an ordinance pertaining %o the same, and to authorize the removal of the "Dead End" sign at Metlonville Avenue and Twenty Fourth Street. Seconded by Commissioner McDonald and carried over the dissenting vote of Commissioner B~<er. Karlyle Houshotder appeared to submit a report of the accomplishments of the Chamber vommerce for the past year and to request t~,e Commission to consider am_ appropriation of at least $10,000.00 to be included in the City's budget for the next fiscal year. M. 1962 Andrew Carraway appeared an(~ recommended that t' e City Commission take legal steps to form a Sanford Port Au. thority to develop dock and terminal facilities, and also sub- mitted a list of names of citizens willing to serve on such a project. Commissioner Higginbotham moved to authorize the City Attorney to investigate and determine the necessary action for the City to undertake to form a Port Authority. Seconded by Commissioner McDonald and carried. Request next submitted by Lee Mansfield for City to vacate an alley between Lots 10 and 11, Rose Court, and after consideration, Commissioner McDonald moved to authorize a public hearing to be held on August 13, 1962 to consider sa~ne. Seconded by Commissioner Higginbotham and carried. After discussion, Commissioner Higginbotham moved to authorize the transfer o£ ~1,900.00 from Contingency Account (~8150) to Street Materials Account (~-725) to pro- vide for the paving of Thirteenth Street from Persimmon Avenue west to the City Limits and. a traffic island at the intersection of Commercial ,Street a~:~d Oak Avenue. Seconded by CommisSioner Wilson and carried. On a motion of Commissioner Higginbotham, seconded by Commissioner McDonald and carried, a salary reclassification was authorized as follows: John T. Fortier from 16-C ($76.OZ~/week) to 16-D (~79.71/week) The City Manager next reported that the Canford Housing Authority had deducted from their annual shelter rent payment to the City an amount for power for street lights located on private property of the Authority and had refused to remit the full .amount of payment in accordance with former agreements. A£ter discussion, the Commission authorized the City Attorney to inform the ~an_ord~ f Housing Authority to comply with their agreement with the City and to make remittance in full. Letter dated July 18, 1962 next submitted from Dr. Jess C. Dietz of Clark, Daily, and Dietz, engineers for the Sanford Sewage Treatment ~Plant, outlining the functions re- garding General Supervision and Resident Engineering or Resident inspection for said pro- ject, and on motion of Commissioner McDonald, seconded by Commissioner Higginbotham and carried, same was approved. Commissioner Baker next introduced Ordinance No. 777, AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE ~MBER 771 OF SAID CITY, AS AMENDED, SAID 0RD~iN~fCE BEING A ZONING PLAN WIthIN THE CITY OF SANFORD, FLORIDA, SAID ~,~ENDMENT TRANSFERRING CERTAIN TERRITORY IN R-5(ONE AND TWO FYJSILY DWELLING) ~ISTRICT, TO A R-6 (MULTIPLE F~ILY DWELLING) DiSTRZCT. BE IT ENACTED BY THE PEOPLE OF T~IE CITY OF SANFORD, FLORIDA: SECTION 1. That Ordinance Number 771 of the City of Sanford, Florida, passed and adopted February 26, 1962, as amended, said ordinance being the Comprehensive Zoning Ordinance of the City of Sanford, regulating and restricting the location and use of buildings, structures, land and water for trade, industry~, residence or other purposes, be and the same is hereby mmended as follows: The property bounded on the North by Eighth Street, on the East by Mulberry Avenue, on the South by Eleventh Street and its extension, and on the West by Cloud Branch, more particularly described as Lots 1 through 11 inclusive, Block 10, Tier 20, E. R. Commissioner Baker then moved on the waiver of the requirements of the second reading of Ordinance No. 777, and that same be placed on its final passage and adoption. Seconded by Commissioner Hi~ginbotham. M. , August 13, 1962, and the City Clerk was authorized to send second notices to the above mentioned property owners. On motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, the Commission authorized an appropriation of $150.00 to be included for consideration in the budget for next fiscal year for a used two-way radio for the City Manager's car. On motion of Commissioner Baker, seconded by CommiSsioner Higginbotham and carried, a salary reclassification was authorized as follows: Robert Kelly from 23-D (~9904/week) to 23-E ~02.04/week) On recommendation of the City Manager and on motion of Commission Higginbotham, seconded by Commissioner McDonald and carried, payment was authorized of Statement #3 in the amount of $849.19, submitted by Clark, Daily, and Dietz in accordance with agree- ment dated July 11, 1961, and based on the contractors Estimate No. 1, dated June 30, 1962, fr6m"Texas~:HidWest Contracting Co., Inc. The City Manager reported that the Federal Civil Defense Agency in Atlanta had re- turned the City's application for an emergency control center after 10 months and further stated that their action indicated no federal interest in defense and that the handling of this material on the federal level was disgraceful. After discussion and on motion of Commissioner Wilson, seconded by Commissioner Baker and carried, the Commissioned autho- rized that a letter be sent to the President of the United States John F. Kennedy to notify him of the type of services received. After discussion~ the Commission next authorized the City Manager to employ Sidney M. RiChard, Jr., as a Utility Department Supervisor in Grade 23-A at an annual salary of ~4526.00. On motion of Commissioner Higginbotham, seconded by Commissioner McDonald and carried,'the Mayor was authorized to execute a written consent of the City of a lease to E. R. Meadors from San Alee Harbor, Inc., subject to all terms an? conditions of a lease now existing between San Alee Harbor, Inc., and the City. Commissioner Baker moved to authorize the City to provide the labor and equipment for the proposed First Street Beautification Program, if the merchants participate one hundred per cent.
