082762 MINUTES City Commission, Sanford, .Florida, Augt!_st 27, The City Commission of the City of Sanford, Florida, met in regular session at City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on August 27, 1962. Present: Commissioners J. H. Crapps, Mayor " Joe B. Baker " Earl Higginbotham " Thomas S. McDonald A.L. Wilson City Attorney Wm. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief R. G. Williams The meeting was called to order by the Chairman. Letter next submitted from John M. Fitzpatrick, C.a.A., setting forth, a proposal to perform the annual audit of the records of the City for a three year period, in the amount of ~$2,750.00 per year, and on motion of Commissioner Higginbotham, seconded by Commissioner ~icDonald and carried, same was approved. O0 The City Manager reported that the bid of Knight Life Insurance Company in the amount of ~1~,359.77 was figured on an incorrect formula and should have read $18,560.27 when figured on ~he specified unit credit basis. After discussion and on motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried, the low bid of Travelers Insurance Company in the amount of $16,991.88 was accepted for furnish- ing an Insurance Group Pension system. On motion of Commissioner McDonald, seconded by Commissioner Wilson and carried, the Commissioner next authorized payment of Statement No. 4 in the amount of ~?19.6~, submitted by Clark, Daily & Dietz, in accordance with agreement dated July 11, 1961 for engineering services £or the sewage treatment plant, and based on the contractors Estimate No. 2, dated August 1 1962 from Texas Mid West Contracting Company~ Inc. Request next submitted by James H. Triplett for Lot 11, Park View Subdivision, to be designated as an area from which an annexation petition would be received, and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, same was approved. On motion of Commissioner Wilson, seconded by Commissioner Higginbotham and carried, Commissioner Baker was authorized to attend the meetings of the Seminole Association of Communities and further to appoint an alternate to attend with him. Ordinance No. 779, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING~ VACATING, AND ABANDONING OF A PORTION OF EAST TWENtY-FOURTH STREET IN THE CITY 0F SAN~ORD, FLORIDA. Placed on its first reading and read in full at the regular meeting of August 13, 1962 was next placed on its final passage and adoption. MINUTES City Commission, Sanford, Florida, August 27: J. R. Darby, 132& E 2&th Street, next appeared and. objected to the proposed action. Wil~on Commissioner^next reported that Hrs. J. A. Riser, 2400 Summerlin Avenue, had telephoned him and objected to the closing. After discussion, Commissioner Baker moved to deny the request for the proposed closing and not to adopt Ordinance 779. Seconded by Commissioner ~cDonald amd unani- mously carried. Recommendation next submitted by the Zoning and Planning Commission to rezone as follows: (a) District R-2 (One and Two ~amily Dwelling) to District R-3 (Multiple Family Dwelling) the north side of Celery Avenue for a depth of 350 feet from Mellonville Avenue to the west boundary of Hayfair Section, ~irst Addition. (b) District R-1 (one Family Dwelling) to C-1 (Neighborhood Commercial), the south side of Celery Avenue from Douglas Avenue to the east City Limits. After discussion and on motion of Commissioner Higginbotham, seconded by Com- missioner McDonald and carried, a public hearing was authorized to be held on Sep- tember 2&, 1962 to consider same. Letter next submitted by Seminole County Engineer, Wm. Bush, Jr., outlining estimated cost of ~77,000.00 for material for the.proposed reconstruction of W 25th Street, with the City participating one-third of the actual material cost, and after discussion and on motion of Commissioner Higginbotham, seconded by Commissioner H6Donald and carried, same was ~proved. Consideration next given to the extension of a lease entered into by the City with the owner, Mr. Fred Williams, of ~arking Lot No. ~, and after discussion the Commission authorSzed an extension on a participating revenue basis of 40% to the City and 60~ to the owner. Commissioner McDonald next introduced. Resolution No. 962, and after being read in full moved on its passage and adoption. Seconded by Commissioner Baker snd carried unanimously. Said Resolution No. 962 being in words and figures as follows: A RESOLUTION 0r ~E CITY 0~ SAN~0RD, FLORIDA, OPPOSING COUNTY UTILITY ~RANCHISE DIRECTIVE AS PRESENTLY PROPOSED. WHEREAS, the County Commission of Seminole County, 71orida is proposing to adopt a county utility franchise directive regulating sanitary sewage installations and facilities outside the corporate municipalities, and WHEREAS, the City of Sanford, Florida, pursuant to statutory and charter pro- visions at the present time has over 800 sanitary sewage customers which would be covered by proposed directive and WHEREAS, the said directive in providing for a 2 per cent annual gross revenue tax together with the administrative procedures for application and compliance is, in the opinion of the City Commission of the City of Sanford~ Florida, an unwieldy, cumbersome, expensive and prohibitive proposal for any applicant to follow, and ;~EREAS, it is felt by the City'Co~mission that compliance with such proposed directive will defeat rather than encourage orderly and expanded sanitary sewer facilities in the county. Commissioner Higginbotham then moved on the waiver of the requirement of the second reading of Ordinance No. 780, and that same be placed on its final passage and adoption. On motion of Commissioner Higginbotham, seconded by Commissioner McDonald and carried, minutes of regular meeting of August 13, mud special meeting of August 20, ~1962, were next approved. Letter next submitted from Z. J. Lee, Vice-President of the Atlantic Coast Line Railroad Company, expressing his company's interest in obtaining use of any municipal constructed dock and warehouse facilities, s_nd on motion of Commissioner Baker, seconded by Commissioner McDonald and carried, the City Manager was authorized to inform Mr. Lee of the appreciation of his support and that his re,nest would be given every considera- tion in the event of the construction of a dock and terminal facility. On motion of Commissioner McDonald, seconded by Commissioner Baker and carried, use of the Civic Center for business purposes was authorized under Rental Classification MINUTES City Commission, Sanford, Florida, Auo~ust 27, 19-6_2~ carried, the City Attorney was authorized to prepare a Resolution in memorial o£ the death of Mrs. Abbott Low Dow, daughter of General Henry S. Sanford. On motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried, the sum of ~?,000.00 for land reappraisal was eliminated from the 1962-63 Budget and the City Tax Assessor was authorized to proceed with a reappraisal utili- zing city personnel, within a two year periOd.
