100862 MINUTES City Commission, Sanford, Florida, October 8., 1962 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. October 8, 1962. Present: Commissioner J. H. Crapps, Mayor " Joe B. Baker " Earl Higginbotham " Thomas S. McDonald " A.L. Wilson City Attorney Wm. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief R. G. Williams The meeting was called to order by the Chairman. A report was submitted by the Committee appointed by the Commission at the regular meeting of September 10, 1962, with the members of the Downtown Merchants Association. Said report being a study of the downtown shopping area problems, and recommendations were submitted as follows: 1. It is recommended that diagonal parking be established on the south side of First Street from Oak Avenue to Sanford Avenue and.~parallel parking to be left as is on the north side from Oak Avenue to Sanford Avenue, moving the center line north to an appropriate distance to allow two lanes of east bound traffic~ Metering the additional parking spaces, and limiting the traffic speed t° 15 miles per hour. The above to be put on a trial basis to study feasibility of such a traffic program. 2. It is also recommended that Third Street be made a thru street from Sanford Avenue to French except Park Avenue which is to be installed a traffic light moved from Second and Park to Third and Park, with No Parking on either side between Sanford Avenue and Oa~ except on Sundays. This recommendation a to be/permanent installation. 5; It is recommended that the City Commission give the Merchants Permission to set potted plants on the sidewalk for beautification at points selected by the Merchants Association for best effect. 4. The Committee requested that this committee not be dissolved, but allowed to continue study of other possibilities for the betterment of the community. And further, that all downtown building be inspected bY the Fire Chief and Building Inspector. After consideration and on motion of Commissioner Baker, seconded by Commissioner Higginbotham, same was approved over the dissenting vote of Commissioner McDonald. Com- missioner McDonald further stated that he approved the recommendations of the Downtown Merchants Committee, except for the installation of diagonal parking on First Street. Mrs. Henry Russell appeared pertaining to Reports Nos. 62-31 and 62-36 and re- quested a 90 day period in which to comply with the condemnation notice. Parties having interest in parcels 62-&2 and 62-43 next appeared and requested 90 days and 6 months respectively to comply with condemnation notice. The City Manager reported that the owners of property had complied with con- demnation notices as follows: 62-29, 62-38 and 62-45. There being no objections registered as to aforesaid Reports 62-28, 62-30, 62-32, 62-33, 62-34, 62-35, 62-37, 62-39, 62-40, 62-41, 62-4~, and 62-45, and after discussion, Commissioner McDonald moved that the buildings and structures covered by the aforesaid reports be condemned and the owners given a notice of 60 days to repair or remove or give a just cause why they are not repaired or removed, and after the 60 days Notice to authorize the City to remove the buildings or structures and levy a lien against the property for the cost of removal. Seconded by Commissioner Baker and carried. Commissioner McDonald moved to rescind action as to Reports 62-29, 62-38 and 62-45 and further that the buildings and structures covered by Reports 62-31, 62-36, 62-42~ and 62-~3 be condemned and the owners given a Notice of 90 days as to Reports 62-31, 62-36, 62-~2 and 6 monthS.as to Report 62-43, to repair or remove the buildings or structures or give just cause why they are not removed or repaired, and after the respective 90 days and 6 months notices, to authorize the City to remove the buildings er structures and levy a lien against the property for the cost of removal. Seconded by Commissioner Baker and carried. The next order of business was a public hearing to consider vacating, closing and abandoning a portion of Oak Avenue extended and a pOrtion of an alley in accordance with the following notice published in the Sanford Herald on September 21, 1962: NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABANDONING A PORTION OF A STREET AND AN ALLEY TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of sanford, Florida, at 8:00 o'clock P. M. on the 8th. day of October 1962, at the City Commissioner's!:, Room at the City Hall in the City of Sanford, Florida, will consider and determine · whether or not the City will close, vacate and abandon any right of the City and the pUblic in and to that portion of a street an~_ an alley hereinafter described, to-witi~:~ (a) Oak Avenue, extended, south of 27th. Street and abutting Lots i through 6, Park View Subdivision. (b) That certain north-south alley lying between Lots i through 3 and Lots 7 through 9, Park View Subdivision. There being no objection registered, Commissioner Higginbotham moved to close that portion of a street and an alley, however, to retain a 14 foot utility easement in the aforesaid alley and to authorize the City Attorney to prepare an ordinance per- taining to same. SecOnded by Commissioner Baker and carried. Mrs. Camilla Bruce, Registration Officer of Seminole County, next appeared to further explain the actual mechanics of the joiht City and County election to be held on November 6, 1962. Consideration next given to complaints received pertaining to the operation of produce peddlers setting up w~yside stands on vacant property and not in accor- dance with applicable sanitary, plumbing, electrical and building code requirements, and after discussion and on motion of Commissioner Baker, seconded by Commissioner McDonald and carried, the Commission directed that all produce markets, open air markets or wayside stands will hereafter be required to meet proper standards. Request ~ext submitted by Robert Miller to relocate the loading space from in front of ll5 So. Park Avenue to ll8 So. Park Avenue, and on motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, same was approved. Request next submitted by L. A. Berry for a permit for a dancing license at 2565 Park Drive in accordance with Section 18 Paragraph 11 of the City Code, and on motion of Commissioner Higginbotham, seconded by Commissioner McDonald and carried, same was approved. John Burton, owner of the Valdez Hotel, next appeared to request an amendment to Section 4 Paragraph 2-B of the City Code to read "60-rooms" instead of "lO0-rooms" and same was taken under advisement. Request next submitted by Riada Corporation, owner of property at 27th Street and oak Avenue, to install a privately owned sewage lift station and to connect same to the City Sewer System, and after discussion and on motion of Commissioner Baker, seconded by Commissioner Higginbotham aad carried, same was approved. On motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried, salary reclassification was authorized as follows: Joe T. Hickson from 21-D $¥618.00 to 21-E $~776.00. Commissioner Baker next introduced Ordinance No. 786, entitled: AN 0RDIN~CE OF THE CITY OF S~NFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD~ FLORIDA THE AREA DESCRIBED AS FOLLOWS: LOT 11, PARK VIEW, ACCORDING TO PLAT THEREOF RECORDED IN PLAT BOOK 3, PAGE 89, PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA. and same was placed on its first reading and read in full. Commissioner Baker then moved the waiver of the requirement of the second reading of Ordinance No. 786, and that same be placed on its final passage and adoption. On motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, minutes of regular meeting of September 24, 1962, were next approved. Tamm, Jr., Director of Finance was next appointed as Acting City Manager during the absence of the City Manager from October 21 through 23, 1962. Request next submitted by RObert Shepard Eot the refund of $17.50 for can- cellation of 1962-63 License No. 294, and On motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, same was approved. The City Attorney next reported that a proper Quit Claim Deed had been received from the heirs o~ General Henry S. Sanford for the vacated Atlantic Coast Line Rail- road mainline right of way from 13th street to 25th street and on motion of Com- missioner Higginbotham, seconded by Commissioner Wilson and carried, payment of $3,330.00 was authorized for same from the Public Project Fund. On motion of Commissioner Higginbotham, seconded by Commis~ioner Wilson and carried, payment of $50.00 was authorized to Albert N. Fitts, Attorney, fOr services rendered as Municipal Judge on OctOber 8, 1962.
