Cit~ Commission, Sanford, Florida, November 26 at 8 P M 1962 The City Commission of the City of Sanford, Florida, met in regular session at' the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. Consideration given to letter of November 20, 1962, from R. C. Covington, Director of the Florida Development Commission setting forth the findings of the Department of Health, Education and Welfare of the U. S. Government that the old U. S Post Office Building had been declared Surplus Property and was available at public benefit discount for library purposes to the City, and further stipulating that if the City desired same, that application muSt be submitted by November 28, 1962. Francis Roumillat, member of the Merchant,s Association's Post Office Committee, and John Krider and Bob Crumley, appeared to support the Commission's desire to have said property returned to a commercial use, but in view of the ramifications of contacting all of the Health, Education and Welfare Departments of County, State and Federal Agencies to solicit their support for such commercial use, it was recommended that the Commission formally file for use of said property by the City. After further discussion Commissioner Higginbotham introduced Resolution No. 967, and. after being read in full, moved on its passage and adoption. Seconded by Commissioner McDonald and carried unanimously. Said resolution No. 967, being in words and figures as.follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SA~ORD, FLORIDA, MAKING APPLICATION TO THE DEPARTMENT OF HEALTH, EDUCATION AND WELFARE FOR THE OLD UNITED STATES POST OFFICE BUILDING LOCATED AT SA~0RD, FLORIDA (GENERAL o~RVIC~ ADMINISTRATION CONTROL NUMBER G~FLA~583), FOR PUBLIC LIBRARY PURPOSES. W~HEREAS, certain real property owned by the United States, located in the County of Seminole, State of Florida, has been declared surplus and is subject to assignment for disposal for educational or public health purposes by the Secretary of Health, Education and Welfare, under the provisions of Section 203(K)(1) of the Federal Property and Administrative Services Act of 19~9 (63 Stat. 377), as amended, and rules and regulations promulgated pursuant thereto, more particularly described as follows: United States Post Office Building, Sanford, Florida GSA Control Number G-Fla-583 WH~R~ASW ~ , City of Sanford, Florida needs and. can utilize said property for Public Library purposes in accordance with the requirements of said Act ~i and the rules and regulations promulgated thereunder; [ NOW THEREFORE, BE IT RESOLVED, that the City Commission of the City of Sanford, ii Florida shall make application to the Secretary of Health, Education, and Welfare for and !! secure the transfer to it of the above-mentioned property for said use upon and subject to su( excep ions, reserva , , , ag , , a as the Secretary of Health, Education, and Welfare, or his authorized representative, may require in connection withthe disposal of said property under said Act a~.d the rules and MINUTES City Commission, Sanford, Florida, November 26, at 8 P Fi 1962 _ regulations issued pursuant thereto; and BE IT FURTHER RESOLVED that the City Commission of the City of Sanford, Florida has legal authority, is willing and is in a position to assume immediate care.and maintenance of the property, and that J. H. Crapps, Thomas S. McDonald, Earl Higginbotham, A. L. Wilson and J. B. Baker, as the City Commission of the City of Sanfor~, Florida, be and they are hereby authorized for and on bdhalf of the City of Sanford, Florida, to do and perform any and all acts and things which may be necessary to carry out the foregoing resolution, including the preparing, making, and filing of plans, applications, reports, and other documents, the execution, acceptance, delivery, and recordation of agreements, deeds, and other instruments pertaining to the transfer of said property, and the payment of any and all sums necessary on account of the purchase price thereof or on account of fees or costs incUrred in connection with the transfer of said property for surveys, title searches, appraisals, recordation of instruments, or escrow. After discussion and on motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried, the low bid of Strickland Morrison, Inc. for furnishing two one-half ton pickups in the amount of $2,991.40, was approved. After discussion and on motiom of Commissioner McDonald, seconded by Commissioner Baker and carried, the bid of Superior GMC for furnishing one three-quarter ton pickup in the amount of $1,850.00, was approved. W. A. Morrison, owner of Strickland Morrison Ford Agency, appeared to object to the specifications for bids on the two long wheel base dump trucks, stating that the Ford product was excluded because of the requirement of a 300 cubic inch displacement engine, After considerable discussion, Commissioner Baker moved to reject all bids for the aforesaid dump trucks and to authorize advertisement~.~ for rebids on a minimum engine piston displacement of 285 cubic inches. Seconded by Commissioner McDonald and carried. After discussion and on motion of Commissioner Baker, seconded by Commissioner Wilson and carried, the low bid of Florida Oxygen Service for furnishing two resuscitators in the amount of $6~0.00, was approved. After discussion an~ on motion of Commissioner Higginboth~m, seconded by Commissioner Baker and carried, the low bid of Robson Sporting~Goods for furnishing one motor scooter in the amount of $1,022.50 was approved. After discussion and on motion of Commissioner Baker, seconded by Commissioner McDonald and carried, the bid of Hood Tractor Company for furnishing a six foot flail type rotary mower in the amount of $482.00 was approved. Commissioner Baker next introduced Ordinance No. 792~ entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ~ENDING CHAPTER 5, THE CODE OF THE CITY OF SANFORD, FLORIDA, 1954, AS AMENDED, SECTION 5-21 THEREOF, VICIOUS OR FEROCIOUS DOGS. and same was.placed on its first reading and read in full. Commissioner Wilson then moved the waiver of the requirement of the second reading of Ordinance No. 792, and that same be placed on its final passage and adoption. Seconded by Commissioner McDonald. Thereupon the question recurred on the waiver of the requirement of the second reading, the roll was called and the vote stands as follows: Commissioner Crapps Yea " Baker Yea " Higginbotham Yea " McDonald Yea " Wilson Yea Said Ordinance No. 792 was then placed on its final passage and adOption, the roll MINUTES City Commission, Sanford, Florida, November 26 _~_t 8 ? _wi_ .19~02_ Commissioner Crapps Yea " Baker Yea " Higginbotham Yea " McDonald Yea " Wilson Yea Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote had passed and adopted said Ordinance No. 792, entitled: ANiORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMenDED CHAPTER 5, THE CODE OF THE CITY OF SANFORD, FLORIDA, 1954, AS AMENDED, SECTION 5-21 THEREOF, VICIOUS OR FEROCIOUS DOGS. On motion of Commissioner Wilson, seconded by Commissioner Higginbotham and carried, salary reclassifications were authorized as follows: J. T. Bennett from 21-C ($4,500.O0/year) to 21-D ($4,618.00/year) H. D. Faint, Jr. from 21-C ($4,500.O0/year) to 21-D ($~,618.00/year). On motion of Commissioner Wilson, seconded by Commissioner Baker and carried, the City Attorney was authorized to prepare a Resolution of appreciation to the Atlantic Coast' Line Railroad Company for the deed to the 8" water line from Thirteenth Street to Lake Jennie. Consideration next given Section 256 of the City Code pertaining to license for Rummage Sales, and after discussion, Commissioner Higginbotham moved to exempt local churches for sales for a three-day period, and further stipulated that no food sales would be permitted outside of buildings. Seconded by Commissioner Baker and carried. Consideration next given to City Tax Certificates against vacated railroad right-of- way between Thirteenth street and Geneva Avenue, which was purchased by the City on October 8, 1962, from heirs of General Henry S. Sanford. Commissioner Baker moved to cancel 1960 Certificate No. 103 assigned to the City and to redeem 1961 Certificate No. 84 purchased by ~the Atlantic Municipal Corp. Seconded by Commissioner Higginbotham and carried. Consideration next given to Certificate of Condemnation No. 62-11, ~ated April 25, 1962, to Leola Brown, owner, 812 Pine, and NO. 62-22, dated July lC, 1962, to H. L. Duhart Estate, owner, 909 Sanford Avenue, and No. 62-25, dated July 10, 1962, to H. L. & A. E. Duham~ Estate, owner, 406 Locust Avenue, and on motion of Commissioner Baker, seconded by Commissioner McDonald and carried, the Commission~authorized a 60 day extension of time, for removal or repair of the condemned dwellings. Petition next submitted to extend West Fourteenth Street to Southwest Road across a ditch, and Commissioner Baker moved to authorize the City to install a culvert if the property owners would furnish the materials. SecOnded by Commissioner McDonald and carried. Request next submitted by City Employee E. W. Dinkins to borrow lO0.00 to pay a hospital bill, and on motion of Commissioner Baker, seconded by Commissioner Wilson and carried, same was approved with repayment to b~ made by a salary deduction of $15.00 per week. Consideration next given to 1962 City Taxes on the following property donated to the City by Chase and Company: Lots 6, 8, 10, 12, & 14, Block A, Celery Avenue Addition, Lots 6, 8, 9, ll, 12, 13, & 14, Block B, ~elery Avenue Addition, Lots 9, lC, ll, 12, 13, & 14, Block C, Celery AVenue Addition, Lots 7, 9, ll, & 13, Block D, Celeryi"~venue Addition. After discussion, Commissioner Higginboth&m moved Zo authorize the City taxes on the foregoing property to b~ cancelled. Seconded by Commissioner Baker and carried. Consideration next given to the farming activities in the Academy Manor area, and after discussion, Commissioner Higginbotham moved that inasmuch as this was a non conforming use that existed prior to zoning, therefore the use could continue. Seconded by Commissioner Baker and carried. Commissioner McDonald moved that the Commission reconsider and approve the petition from Lee Mansfield, owner of Lot 10 Rose Court Reptat, to grow nursery stock at said location however, refraining from any local sales. Seconded by Commissioner Higginbotham. Commissi6ner Baker moved to table the above motion for further consideration at the next regular meeting. Seconded by Commissioner Wilson and carried over the dissenting vote'o£ Commissioner McDonald. The City Attorney next expressed the opinion that the accounts receivable of Ruben Wallstedt in the amount of $703,35 and the City of Orlando in the amount of $429.52 were uncollectable in so far as the items for which they were incurred~ and on motion of C ' ' seconded by Commissioner McDonald and carried, same were authorized to be ommlss~oner Baker~ written off as a bad debt. Consideration next given to the balance of the accounts receivable of Allen-Orlando, Inc in the amount of $900.00 for testing of the water for pollution by them, and on motion of Commissioner HcDonald, seconded by Commissioner Baker and carried, the City Attorney was authorized to proceed with the necessary steps to insure collection. . Consideration next given to the balance of the accounts receivable of Ted Williams in the amount of $2,160.21 for furnishin~ sewer outside the City limits, and on motion of Commiddioner McDonal. d~ seconded by Commissioner Baker and carrie~, the City Attorney was ~., authorized to give H. N. Cleveland, Jr., attorney for Mr. Williams, a notice that ten days after adjournmsnt of the special legislation, action would be taken to insure collection. Upon recommendation of the Chief of ~olice, and on motion of Commissioner Baker, secondet[ by Commissioner Wilson and carried, installation of a street light at Eleventh Street and [ Jessamine Avenue, was authorized. On motion of Commissioner McDonald, seconded by Commissioner Hi~Kinbotham and carried, a donation of $100.00 to th~ Firemen's Benefit was authorized. ~n motion of Commissioner McDonald, seconded by Commissioner Higginbotham and carried, a transfer of $1,820.00 from Water Department Contingent Surp!us Account No. 9850 to Water Department Workmen's Compensation Account No. 9391, was authorized, same having been left out of the current budget.
