012863 MINUTES. City Commission, Sanford, Florida, January 28 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P, M. on January 28, 1963. Present: Commissioner Thomas S. McDonald, Mayor " Joe B. Baker " J.H. Crapps " H.L. Raborn " A.L. Wilson City Attorney Wm. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Deputy Clerk Rosa M. Rotundo Police Chief R. G. Williams The meeting was called to order by the Chairmsm. Kenneth W. McIntozh, Attorney for the Sanford Pipeline Company, Gerald Rausch, President of said Cempany, and H. Barrow, Treasurer of Standard Southern Corporation, ~ appeared to support their request for a lease for a pipeline in accordance with the proposal submitted to the Commission of'December 7, 1962. Mr. McIntosh stated this company had expended about $15,000.00 for engineering fees for the proposed installation and that plans and spepifications for the pipeline were ready to be submitted to the Commission for their approval and further tha~ a firm commitment hadbeen 'made for the purchase of land for a site for the construction of storage facilities and a pumping station. Mack N. Cleveland, Jr., Attorney representing five of-the Atlantic Coast Line Railroad Brotherhoods, appeared to object to the granting of a lease to the Sanford ~ipe- line Company and advised that the Commission must be concerned with the effects this pipe- line will have on the local ecomomy~and taxpayers. George A. Speer, Jr., Attorney for the Atlantic Coast Line Railroad Company, next appeared to object to the granting of a lease to the Sanford Pipeline Company and further pointed out that the street right-of-way is dedicated for public use and that the aforesaid operation, was a private concern. Captain Robert M. Ware, Commanding Officer of the Sanford Naval Air Station, presented a prepared statement outlining the advantages of the pipeline operation as saving in transportation costs of about $33,000.00, easier quality control, more efficient use of the facilities, additional storage capacity, improving the emergency capability of the base, and to enhance safety and simplify the handling of fuel during delivery. Further objections to said pipeline operation were entered by Atlantic Coast Line Railroad representatives and employees, i Commissioner Wilson next stated that it had not been established to his satis- faction as to just what costs and savings were involved and to which portion of the route each interest was referring, and that he would object to proceeding further with any lease until disclosures of all facts had been established. After further consideration, Commissioner Baker moved to continue to negotiate the lease with the S~Uford Pipeline Company. Seconded by Commissioner McDonald, and same was not authorized on the dissenting votes of Commissioner Crapps, Commissioner Raborn and Commissioner Wilson. Dr. Jesse C. Dietz of Clark, Daily, and Dietz:, engineers., appeared to discuss and recommend water improvemen%s and to outline possible water shortages in the near future with the continued growth rate this area is now experiencing. M. 19.6~ _ (b) Construction plans and specifications in accordance with section 111 (a) and (b) of Agreement. for Consulting Engineering Services dated July ll, 1960, for water improve- ments for the following items: 1. Well Field 2. Treatment Plant 3. Transmission Lines ~. Storage Facilities Seconded by Commissioner Baker and carried. Consideration next given to the condemnation of the buildings or structures in accordance with notices authorized at regular meeting of January 8, 1963 to owners of proPerty as follows: Report No. 62-~6 300, 308, 310 French Avenue with 5 outbuildings, -Lots i thru 5 inclusive, Block 5, Tier 9, Trafford's 62-~7 808 Maple Avenue, Lot 2, Block 10, Tier 10, Trafford's 62-~8 806 1/2 and 808 1/2 Maple Avenue, Lot 7, Block 10, Tier 10, Trafford's 62-~9 1008 Holly Avenue, Lot 2, Block 12, Tier ll, A. C. Martin's Subdivision 62-50 lll2 Maple Avenue, Lot 5, Block 13, Tier 10, Trafford's H. B. Sandlin appeared and requested 90 days to repair a dwelling covered by Certificate of Condemnation Report No. 62-50, and on motion of Commissioner Crapps, seconded by Commissioner Baker and carried, same was approved. There being no objections registered as to aforesaid Reports 62-46 thru 62-49, and after discussion, Commissioner Baker moved that the buildings and structures covered by the aforesaid reports be condemned and the owners given a notice of 90 days to repair or remove or give a just cause why they are not repaired or removed, and after the 90 days Notice to authorize the City to remove the buildings or structures and levy a lien against the property for the cost of removal. Seconded by Commissioner Crapps and carried. F. Stewart Helmly next appeared to request the rental of the Civic Center by the First Church of Christ Scientist for a series of lectures, stating that after holding some lectures tha~ the Commission had recinded use by Churches two years ago and w~as requesting reconsideration of the action. After consideration, Commissioner Baker moved to extend the action of the Comm- ission of July 28, 1961 permitting use of the Civic Cen~er by religious organizations for social f~ctions and conventions ann to provide for said use for religious services or related to religious services, and further to authorize a review and study of the following: 1. Rental charges of the Civic Center 2. Uses of the Civic Center 3. Types of rentals utilizing the facilities Seconded by Commissioner Wilson and carried. Jake Zorian, Maitland, next appeared and stated that he was interested in building a Marina at the City Pier and Boat Basin and requester an agreement for 180 days for an engineering study, and after discussion, Commissioner Wilson moved to grant an exclusive agreement for period of 180 days, provided that the engineering plans would be turned over to the City if he is unable to build the Marina. Seconded by Commissioner Crapps and carried 'gver the dissenting vote of Commissioner McDonald. Dr. Vincent Roberts requested permission to permit construction of an addition to his home across a utility easement, and Commissioner Baker moved that same be approved, MINUTES :. C. sewer line with lO" cast iron pipe under the addition and extended l0 f~et to the outside of the foundation. Seconded by Commissioner Wilson and carried. Request next submitted from James Long for an exempt license due to poor health and over 65 years old, and on motion of Commissioner Baker, seconded by Cemmissioner Wilson and carried, same was denied. Request next submitted from Williwm Kirk to vacate that l~O feet of Grandview AVenu~ South abutting Lot 98 on the south and lying east of Lilly Court in Rose Court, and on motion o~ Commissioner Crapps , seconded by Commissioner Wilson and carried, a public Hearing was authorized to be held on February 25, 1963, to consider same. Consideration next given to action of the Commission on October 28, 1957, author- izing payment to Elizabeth Joan Daffron of Workmen's Compensation. in the weekly amount of $~.81, as the alleged widow of Hubert Roy Daffron, employed as a Fireman and killed in the line of duty on October 27, 1957. City Attorney Wm C. Hutchison, Jr. next recommended that based on the ppinion rendered on September 24, 1962, by the Circuit Court in the case of Daffron vs. the Board of Trustees of the Firemen's Relief and Pension Fund, the City cease payments to said Elizabeth Joan Daffron. After discussion and on motion of Commissioner Baker, seconded by Commissioner Wilson and carried, the Commission authorized the discontinuance of the aforesaid payments and further authorized the City Attorney to inform Elizabeth Joan Daffron of this action. After discussion, Commissioner Baker moved to authorize the City Attorney to prepare a Resolution to be presented to the Legislative Delegation directing their atten- tion to the need for regulations to protect public water supply well fields from pollution, Raborn infiltration and depletion. Seconded by Commissioner/and carried. The Chairman announced that the next order of business was a Public Hearing to consider the rezoning of the property as proposed and described in the following legal notice published in the Sanford Herald on January ll, 196~: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M., on January 28, 1963, to consider the following changes and amendments to the Zoning Ord- inance of the City of Sanford, Florida: (a) The property ~ned in District R-2 (One and Two Family Dwelling), located at the northeast corner of the intersection of Laurel Avenue and Ninth Street, is propose~ to be changed to C-1 (Neighborhood Commercial) District. Said property being more particularly described as Lots 9 and 10, Block 10, Tier 7, E. R. Tra~ford's Map of Sanford. All parties in interest and citizens shall have an opportunity to be heard at said hearing. By order of the City Commission of the City of Sanford, Florida, this 8th day of January, 1963. H. H. There being no objections registered and after discussion, Commissioner Crapps moved that the property be rezoned as advertised and to authorize the City Attorney to prepare an ordinance pertaining to same. Seconded by Commissioner Raborn and carried. On motion of Commissioner Baker~ seconded by Commissioner Raborn and carried, minutes of regular ann~al meeting o~ January 8, and regular meeting of January l~, 1963, were next approved.
