Knowles " City Clerk H. N. Tamm, Jr. Deputy Clerk Rosa M. Rotundo Police Chief R. G. Williams The meeting was called, to order by the Chairman. O. Douglas Stenstrom, Attorney from the firm of Stenstrom,.Davis and McIntosh, appeared to support the request by the Sanford Pipeline Company for an agreement in accordance with the proposal.submitted to the Commission on December 7, 1962, and further reviewed the developments of the Company and actions of the Commission since that date. Captain Robert M. Ware, Co~mmanding Officer of the Sanford Naval Air Station, next presented a "check off list" setting forth the monetary and operational advantages of a barge/pipeline delivery system over the present type deliveries of JP-5 jet fuel from Jacksonville. C. R. Crosson, Office of Director of Navy Supply, Washington, D. C., next appeared to recommend a barge/pipeline operation and stated that it was the responsibility of his office to supply fuel for Nkvy!'and Ma~ine~se anywhere in the world at the C. heapest costs and set forth estimated savings by using the proposed barge/pipeline facilities as follows: $12,500.00 Rental of Storage Facilities 5,~200.00 Labor-Jacksonville Terminal 12,000.00 Cleaning Costs-30 barges @ $400.00 each ~.~,441.00 Transportation Costs $ ,141.O0 Total Savings Karlyle Housholder, Attorney, stated he appeared as a citizen of Sanford and as a member of the Armed Forces Committee of the Seminole County Chamber of Commerce and that in view of all the facts presented and upon the request of the Navy, the City mus~ permit the installation,.ofl.the pipeline facilities. Francis Roumillat, next presented a resolution from the Executive Committee of the Seminole County Chamber of Commerce in support of the proposed pipeline operation. Mack N. Cleveland, Jr., Attorney representing five of the Atlantic Coast Line Railroad Brotherhoods, appeared to object to the City granting a lease to said pipeline company and pointed out the effects of such an operation in diminishing the revenue of the railroad company, could adversely affect employment. George A. Speer, Jr., Attorney for the Atlantic Coast Line Railroad Company, also appeared to object to said proposed agreement and stated that the company had filed a fair rate from Jacksonville of 33.26 cents a barrel and that the i'igure of 42.41 cents used in computing the estimated savings was incorrect. Commissioner Raborn read an opinion from the City Attorney setting forth that the City has the right to grant a ~ranchise to business to operate on public right of ways, ~nd~ further s~atea that this had removed the objection he had to the operation of pipeline facilities. After further consideration, Commissioner Baker moved to continue to negotiate an agreement with the Sanford Pipeline Company, Seconded by Commissioner Raborn and carried over the dissenting votes of Commissioner Wilson and Commissioner Crapps. Request next submitted from Erris Green, 1226 West 13th Street, for an exemption due to physical handicap and undue hardship for a barber license, and after consideration and on motion of Oommissioner Baker, seconded by Commissioner .Wilson and carried, same was approved. John Burton, owner of the Valdez Hotel, next appeared and requested that Section ~-2 (b) of the City Code regulating the hours for the sale of alcoholic beverages at hotels of more than 100 rooms, be amended to provide for hotels with 50 rooms or more and exclud- ing Sunday sales. ~ter discussion, Commissioner Baker moved that the request be denied. Seconded by Commissioner Wilson and carried over the dissenting votes of Commissioner Raborn and Commissioner Crapps. Request next submitted from C. C. Flowers for transfer of license for sale of beer and wine for consumption off premises, from 1201 West First Street to 805 West Third Street, and on mOtion of Commissioner Wilson, seconded by Commissioner Crapps and carried, same was approved on recommendation of Chief of Police. Request next submitted by Juanita Green, 501 French Avenue, for license for sale of beer and wine for consumption off premises and on motion of Commissioner Baker, seconded by Commissioner Crapps and carried, same was denied on recommendation of Chief of 'Police. Request next submitted by Mrs. W, L. Holcom~e for a refund of City License No. 1005, dated December 21, 1962, stating that Mr. Holcombe had died on January 5, 1963, and that she was unable to carry on the business of a fish peddler, and on motion of Commissioner Baker, seconded by Commissioner Wilson ~d carried, same was approved. Estimate No. 6 next submitted in the amount of $70,126.61 covering work completed and material of job site to February l, 1963 on contract with Mid West Contracting Company, Inc., dated May9, 1962, for construction of the Sewage Treatment Plant, and on motion of Commissioner Baker, seconded bY,Commissioner Crapps and carried, payment was authorized from the Construction Trust Fund of 1962, on approval of the City Manager, and stipulating that the checks to be drawn as ~oint payees, to the contractor and to the suppliers for unpaid delinquent accounts. Letter next submitted from K. W. McIntosh, Attorney representing Mr. L. D. Plante, Oviedo, setting forth his interest in building a Marina at the City Pier and Boat Basin and requested an option for an agreement immediately Following the 180 day agreement given to Jake Zorian on January 28, 1963, and after consi~erable::discussion, Commissioner Raborn moved to advise Mr. Plante that the Commission would be happy to discuss the Marina after the expiration of the agreement or sooner if the option is terminated. Seconded by Commissioner Crapps and carried. Consideration next given to note receivable dated March 23, 1962, and due January 23, 1963, of William Gracey in the amount of $100.13, plus interest, and after discussion Commissioner Crapps moved that a registered notice be mailed to him request- ing a reply before the next regular meeting. Seconded by Commissioner Raborn and carried. Request next submitted from Jake Adams for another 90 day extension of his note MINUTES City Commission, Sanford,, Florida,_Pebrua_r~_ll in the amount of $1,519.72 plus 6% interest, which was due December 6, 1962, and after discussion, Commissioner Crapps moved to authorize an extension of 90 days and to no.tlfy~him that this would be the final extension. Seconded by Commissioner Raborn and carried. Request next submitted from Sam Lawson for another 6 months extension of his note in the amount of $1,503.26 plus 6% interest, which was due December 22, 1962, and after discussion Commissioner Crapps moved to authorize the extension of 6 months and to notify him that this would be the final extension. Seconded by Commissioner Raborn and carried. Consideration next given to the past due balance of the accounts receivable of Academy Manor, Inc., in the amount of $5,000.00, and Commissioner Baker moved to authorize the City Attorney to notify the Attorneys for said account to submit pleadings or funds by the next Commission meeting. Seconded by Commissioner Raborn and carried. Commissioner Crapps next introduced Ordinance No. 793, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NUMBER 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT TRANSFERRING CERTAIN TERRITORY IN R-2 (ONE AND TWO FAMILY DWELLING DISTRICT) TO C-1 (NEIGHBORHOOD COMMERCIAL DISTRICT). Commissioner Crapps then moved the waiver of the requirement of the second reading of Ordinance No. 793, and that same be placed on its final passage and adoption. Seconded by Uommissioner Baker. Thereupon the question recurred on the waiver of the requirement of.the second~read~ the roll was called and the vote stands as follows: Commissioner McDonald Yea " Baker " " Crapps " " Rab OrB " " Wi 1 s o n " Said Ordinance No. 793 was then placed on its final passage and adoption, the roll was called and the vote stands as follows: Commissioner McDonald Yea " Baker " " C r app s " " Raborn " " Wi 1 s on " Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote had passed and adopted said Ordinance ~o. 793, entitled: AN ORDINANCE.OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINt~CE NUMBER 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT TRANSFERRING CERTAIN TERRITORY IN R-2 (ONE AND TWO FAMILY DWELLING DISTRICT) TO C-1 (NEIGHBORHOOD COMMERCIAL DISTRICT). Commissioner Baker next introduced Resolution No. 971, and after being read in full, moved on its passage and adoption. Seconded by Commissioner Wilson and carried. Said Resolution No. 971, being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, REQUESTING THE SEMINOLE COUNTY LEGISLATIVE DELEGATION TO INVESTIGATE AND PURSUE THE FEASIBILITY OF GENERAL LEGISLATION TO PROTECT MUNICIPAL WATER SUPPLY. WHEREAS, the problem of satisfactory and uncontaminated municipal water supply areas throughout the State of Florida is becoming increasingly difficult, and WHEREAS, there is at the present time no effective control method for munici~ MINUTES City Commission, Sanford, FlOrida, Feb~n~? ]1 a~ 8 P. M, palities to protect water supply areas from contamination as a result of.population encroachment because of inadequate controls of sewage and waste disposal, and WHEREAS, it is prohibitively expensive for minicipalities to secure through purchase or otherwise sufficient land areas so that water supply systems can be protected, NOW, THEREFORE, be it resolved by the City Commission of the City of Sanford, Florida that the Seminole County Legislative Delegation be, and it is hereby urged to investigate and pursue the possibility of statewide legislation providing an effective method for municipalities to control areas surrounding municipal water supply systems to prevent water supply contamination. BE IT FURTHER RESOLVED that this Resolution be spread upon the minutes of the City Commission of the City of Sanford, Florida, and copies delivered to the Legislative Delegation. Crapps As the City Commission of the City of Sanford, Florida The next order of business was the discussion of the expenses and revenues of the operation of the Civic Center, and Commissioner Baker moved that it be tabled until the next meeting. Seconded by Commissioner Wilson and carried. On motion of Commissioner Crapps, seconded by Commissioner Baker and carried, minutes of regular meeting of January 28, 1963, were next approved. H. N. Tamm, Jr., City Clerk, next stated that there was an error in the minutes of special meeting of December 7, 1962, in recordi~gi th:at Commissioner ~o'ecBaker was present and not recording Commissioner A, L. Wilson .as being absent, both Commissioners having been absent from said meeting. Said Commissioners concurred with the correction. After discussion of the insurance due orr:Seminole Memorial Library, Commissioner Baker moved to transfer $228.85 from Contingency/Accoun?N°. 8150 to Memorial Library Account No. 8078. Seconded by Commissioner Wilson and carried. On motion of Commissioner Baker, seconded by Commissioner Wilson and carried, current invoices and payrolls next approved, as evidenced by General Fund Florida State Bank Vouchers Nos. 3853 through 3919, General Fund Sanford Atlantic National Bank Voucher Nos. 9437 through 9622 and Water and Sewer Revenue Fund Samford Atlantic National Bank Voucher Nos. 629 through 641, Construction Trust Fund of 1962 Sanford Atlantic National Bank Voucher Nos. 46 through 84 and Florida State Bank Voucher Nos. 41 and 42. Commissioner Raborn moved to table the motion until, the next meeting. Seconded by Commissioner Crapps and carried. Commissioner Wilson moved that the City Manager and Building Official be authorized to attend the Florida Industrial Commission Safety Conference in Orlando¢i Florida February 15, 1963 and to transfer $30.00 from Contingency Account No. 8150; $15.00 to City M~nager Travel Expense Account No. 1207 and $15.00 to Engineering Travel Expense Account No. 5007. Seconded by Commissioner Baker and carried. Consideration next given to the repairs needed by the Check Protector in the Fin&uce Office, and after discussion, Commissioner Baker moved to authorize the purchase of a new machine for $179.50 with trade, and to authorize the transfer of $100.00 from Contingency Account No. 8150 and $79.50 from Finance-Office Expense Account No. 1~06 to Finance Office Furniture and Equipment Account No. l&12. Seconded by Commissioner Wilson and carried. Request by Lee Brothers Company, owners of Block 1N Tier 10, property located in the proposed City Industrial Park, submitted to exchange certain properties and vacated street right of ways so that their property would conform to the tentative Site City Development Plan presented by the Industrial Park Board and approved by the/Commission on March 26, 1962. After consideration, Commissioner Baker moved to authorize the City Attorney to proceed with the preparation of an ordinance in accordance with action of the Commission at public hearings held on March 26, 1962, and April 23, 1962, and to prepare necessary deeds pertaining to the aforesaid exchange of properties.
