The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P.M. on April 22, 1963. Present: Commissioner Thomas S. Rotundo Police Chief R. G. Williams The meeting was called to order by the Chairman. Consideration given to the condemnation of the buildings or structures in accordance with notices authorized at regular meeting of March 25, 1963 to owners of property as follows: Report 62-46 300, 308 & 310 French Avenue with 5 outbuildings. Lots i thru 5 inclusive, Block 5~ Tier 9~ Traffords. Telegram next submitted from Mrs. Helen Brock, owner, requesting a delay of condemnation proceedings and after discussion and there being no other objections registered as to aforesaid Report 62-~6, Commissioner Crapps moved that the buildings and structures covered by the aforesaid reports be condemned and the owners given a notice of 90 days to repair or remove or give a just cause why they are not repaired or removed, and after the 90 days Notic~ to authorize the City to remove the buildings or structures and levy a lien against the property for the cost of removal. Seconded by Commissioner Baker and carried. The next order of business being a Public Hearing to consider vacating, closing and abandoning a north-south alley of 17th Street between Park Avenue and Magnolia Avenue in accordance with the following notice published in. the Sanford Herald on March 22, 1963. NOTICE OF PROCEEDING FOR VACATING, CLOSING A~D ABANDONING AN ALLEY TO W~0M IT MAY CONCERN, you will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P.M. on the 8th day of April, 1963, at the City Commissioners' Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, Vacate and abandon any right of the-City and the public in and to that alley hereinafter described, to-wit: That certain north-south alley lying north of Seventeenth Stree~ between Magnolia Avenue and Park Avenue in Block C, Markham Park Heights as recorded in Plat Book l, Page 78, Seminole County Records. TAMM, JR City Clerk There being no objections registered, CommisSioner Baker moved to 6lose, vacate, and abandon that portion of the aforesaid utility easement lying west of the east line, and its extension, of the westerly 43 feet of Lot 21, Block 2, Wyunewood Subdivision, and to authorize the City Attorney to prepare an ordinance pertaining to same. Seconded by Commissioner Raborn and carried. Recommendation next submitted by the City Manager for an addendum to the Sewage Treatment Plant contract with Texas Midwest Contracting Company to authorize an electric Motor driven travel hoist for loading chlorine cylinders in lieu of a manual travel hoist in the amount of $407.00, and after discussion, CommissiOner Crapps moved on the approval of same. Seconded bY Commissioner Wilson and carried over the dissenting vote of Commissioner Baker' Request next submitted by Virginia Jones for a license for a dance hall at 405 East Fourth Street, and 'after consideration, Commissioner Bake~ moved to authorize same for a trial period, with the stipulation that if the license is revoked within the first 60 days the license fee would be refunded. Seconded by Commissioner Crapps and carried. Herbert Preston and D. C. McCoy, operator of the McCoy Deluxe Cleaners, ll09 W. 13th Street, next appeared as spokesmen for a group of residents and businessmen regarding the traffic~ and condition of the vacated Atlantic Coast Line Railroad mainline right-of-way from Thirteenth Street southwesterly to Sixteenth Street and also Sixteenth Street, and stated that the dust was objectional and requested that right-of-way be closed or stabalized and also that Sixteenth Street be stabalized. Eitel Smith, ll07 W. 13th Street, also appeared to support the aforesaid request. After consideration, Commissioner Crapps moved to approve the request to sta- balize both sections and to authorize the transfer of $500.00 from the Contingency Fund to Street Materials Account No. 4725, for the purchase of clay for same. Woodruff for an extension of 90 days of notes due the Utility Department on April 5, 1963 and July 5, 1963, each in the amount of $261.25, and on motion of Commissioner Crapps~ seconded by Commissioner Raborn and carried, same was approved. Consideration next given to note of W. A. Adams, dated March 6, 1962, balance remaining of $1,219.72, plus 6% interest, and after discussion, Commissioner Crapps moved to authorize same to be set up on twelve monthly payments plus interest, first payment to begin May ll, 1963. Seconded by Commissioner Wilson and carried. Consideration next given to the note of Sam. Lawson, dated June 22, 1962, in the amount of $1,503.26, plus 6%interest, and after discussion Commissioner Raborn moved to authorize same to be set up on twelve monthly payments plus interest, first payment to begin May ll, 1963. Seconded by Commissioner Wilson and carried. Daniel Calhoun, 412 Pine Avenue, next appeared to request a transfer of a Taxi license from Mark Sanders, and on motion of Commissioner Baker, seconded by Commissioner Wilson and carried, same was approved on the recommendation of the Chief of Police. Consideration next given to a proposal submitted by the Gulf Life Insurance Company, carrier of the City's group medical, hospital and life insurance policy for employees, said proposal offering additional life insurance coverage for clerical and supervisory personnel in amounts of $3,000.00 or $5,000.00 at the monthly rate of 85¢ per thousand. After discussion, CommiSsioner Baker moved to authorize the aforesaid additional coverages upon the request from the employee for said premium to be deducted from the payroll. Seconded by Commissioner Crapps and carried. Sponsors of the Babe Ruth Baseball League were reported to have pledged $660.00 for clay to convert the stadium for baseball, and requested the City to provide the labor and equipment to make the conversion and to authorize use of the field for night games. The City Manager submitted estimated costs of the aforesaid as follows: 3 loads of clay 3 doz. replacement bulbs Electricity, etc./game, 34 @ $25. City labor and Equipment To~al $ 660.00 77.48 85O.OO · 6,50.00 $2,237'4~ After discussion, Commissioner Crapps moved to authorize the conversion with the sponsors contributing the $660.00 for the clay, and to authorize the transfer of $500.00 ~ ~m from the .Contingency Fund to account No. 4~ff, Reia~s ~4a&-Ma~nt~z~ce, and to authorize scheduling of as many night games as this sum would cover, and further to schedule additional night games provided the sponsors would pay the expense of said games. Seconded by Commissioner Wilson and carried over the dissenting vote of Commissioner Baker. Loomis Leedy of'the firm of Leedy, Wheeler and Alleman, Fiscal Agents for the City, next submitted three schedules of bond retirement and interest for a 30-year, $900,000.00 bond issued to finance the proposed water improvement program. Mr. ~eedy further stated that the schedules were based on an interest rate of 3 3/4% and sale at 3% discount.. After discussion, Mr. Leedy was asked to work with the City Manager to prepare a schedUle of bond interest and retirement, utilizing the revenue from the Florida Power and Light Franchise Tax after the retirement of the Public Improvement Revenue Certificates and also to make recommendations for an increase in the Water Rates. No Action-HB 392-authorizing public officials to use facsimile signature and seals 6. No Action-HB 363-prohibiting grocery stores, drug stores, or service stations from selling alcoholic beverages 7. No Action-HB 351-prohibiting repairs to damaged vehicles prior to notice to law enforcement authorities 8. No Action~SB 97-providing for registration books used by Municipality and County to be opened for County registration even though closed for Municipal elections 9. Favor-For Cities over 50,000 population-HB IlO-candidates for municipal office to file contributions and expenditures 10. FavOr-HB 81-permiting 12% interest on Municipal tax certificates ll. Favor-HB 180-providing Municipal officers and state officers may hold stock or be an officer or director of a- bank without disqualifying such bank as a depository. 14. Oppose-SB 142-obstruction of Public sidewalks, streets and highways Consideration next given to a policy of the City to issue one job permits to master electricians who have qualified themselves at another City but have not passed the examination with the City of Sanford. The aforesaid one job permits being issued only on jobs which are highly technical and for which there is no local master electrician qualified to perform. After discussion and on motion of Commissioner Baker, seconded by Commissioner Raborn and carried, the Building Official was authorized to adhere strictly to the Electric Code as adopted, and to notify all parties of interest of such action. Recommendation next submitted from the Zoning and Planning Commission to recind their recommendation submitted at regular meeting of March ll, 1963, to permit pet shops in C-1 (Neighborhood Commercial) District, and after discussion, Commissioner Wilson moved to table action of the regular meeting'of April 8, 196~, authorizing the City Attorney to prepare an ordinance for same. Seconded by Commissioner Baker and carried. On recommendation of the City Manager, Co~missioner Raborn moved to authorize the transfer of $2,3~6.6~ from Sewer Extension Materials-Hunt Account No. 9529-H to Water Extension Materials-Hunt Account No. "~9~29-H, and in General Fund Budget to eliminate the anticipated $10,000.00 transfer from Utility Department Budget and charge same to Contingency Fund and in Utility Department Budget to eliminate the $10,000.00 expense for said transfer and to credit same to Water Extension Materials--Hunt Account No. 9329-H. N. 19:. 63 On motion of Commissioner Wilson, seconded by Commissioner Crapps and carried, the City Manager was authorized to attend the annual City Manager's Short Course, April 28 through May l, 1963, in Daytona Beach, Florida, and to attend the Public Works Directors and Administrators meeting in Winter Park, Florida, from May 9 through May ll, and the Finance DireCtor was appointed~cting City Manager for the same time. 1963, Consideration next given to the treatment of subterranean termites at the Civic Center and bids submitted as followst Orkin's Exterminating Co., Inc. - Orlando $795.00 Wal~er Chemical and Exterminating Co., Inc. - Orlando 800.00 Art Brown Pest Control Service - Sanford 840.00 After discussion, sa~e was held for further information. ReCommendation next submitted from the Zoning and Planning Commission to amend Article VI, R-3, Multiple Family Dwelling District and Article IX, R-6 Multiple Family Dwelling District, to reduce the front yard requirement for one and two family dwellings from 25 feet to 20 feet, and on motion of Commissioner Baker, seconded by Commissioner Crapps and carried, a Public Hearing was authorized to be held on May 13, 1963, to consider same . Consideration next given to the revocation of the occupational license #279, issued to Mrs. Pauline Owen, d/b/a West Side Grocery, 515 Elm Avenue, for the sale of beer and wine for consumption off premises, and after discussion CommiSsioner Baker moved to authorize a Public Hearing to be held on May 13, 1963, to consider same. Seconded by Commissioner Raborn and carried over the dissenting vote of Commissioner Crapps. Commissioner Baker next introduced Resolution No. 973, and after having been read in full, moved on its passage and adoption and authorized the Mayor and City Clerk to execute~ same. Seconded by Commissioner Wilson and carried. Said Resolution No. 973, being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA URGING ALL GOVERNMENTAL BODIES, AGENCIES' CIVIC ORGANIZATIONS AND INDIVIDUALS TO SUPPORT THE PROPOSED NAVIGATION DISTRICT IN AID OF OBTAINING CONSTRUCTION OF A CANAL BETWEEN THE ST. JOHNS RIVER AND THE INDIAN RIVER WHEREAS, The construction of a canal between the St. Johns River and the Indian River has been contemplated for many years and such canal in the opinion of the City Commission would provide a vital link in an effective comprehensive waterway system for the State of Florida, and more particularly Central Florida, adding greatly to the con- tinued promotion of defense, industrial and trade facilities, together with expanding opportunities for tourist and trade promotion; and WHEREAS, there is presently pending legislation to 'establish a navigation district in order to help effectively promote the construction of such facility and the City Commission feels that the passage of such legislation is a material Step toward obtaining the completion of such project; NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that all governmental bodies, agencies, civic organizations and individual citizens be, and they are hereby urged to support the establishment of a navigation district in aid of the construction of such proposed canal. BE IT FURTHER RESOLVED, that this Resolution be spread upon the minutes of the MINUTES City Commission, Sanford, FlOrida, April 22 at 8 P. M. On motion of Commissioner Baker, seconded, by Commissioner Wilson and carried, ~ regular meeting of April 8 and adjourned regular meeting of minutes of/APril 10, 1965, were next approved.
