072263 MINUTES' City Commission, Sanford,. Florida, July 22 at 8 P. M. The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8~00 o'clock P. M. on July 22, 1963. Present: Commissioner Thomas S. Joe T.~Hickson Absent: Commissioner A. L. Wilson City Manager W. E. Knowles Police Chief ~. G. Williams The meeting was called to order by the chairman. George Andrew Speer, Attorney, member of the Henry Shelton Sanford Museum and Library Association, appeared and stated that a provision of Mrs. Dow's will granted the Association privilege to any and all remaining items of her fathers estate. Mr. Speer further stated he had made a trip to Connecticut to examine numerous articles that the Association would like to obtain, howe~er, funds were not available for packing, transporta- tion and insurance to cover shipment to Sanford. After discussion, Commissioner Baker moved to appropriate up to $500.00 in the 1963-6~ budget for the aforesaid costs. Seconded by Commissioner Raborn and carried. John Fox, Realtor, next appeared to represent Mr. Brass of Brass Motor Company, after diScuSsion in regardto City owned property in Block 15, Chapman and Tuckers Subdivision, and/same was held for further consideration at the next meeting. E. H. i~Monk" Bennett, 407 Magnolia Avenue, next appeared and offered for sale four pool tables for the sum of $800.00 and estimated that it would cost about $450.00 to recondition them. Mayor McDonald reported that the Recreation Director had informed him that they were not needed at this time and the offer was declined. The next order of business being a Public Hearing to consider vacating, closing and abandoning a portion of~a north-south alley, north of Fourteenth Street between Locust Avenueand Hickory Avenue in accordance with the following notice published in the Sanford Herald on July l, 1963. NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABENDONING AN ALLEY TO WHOM IT MAY CONCERN, you will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'cloCk P. M. on the 22nd day of July, 1963, at the City Commissioners' Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to that alley hereinafter described, to wit: That portion of a certain north-south alley lying north of Fourteenth Street between Locust Avenue and Hickory Avenue and abutting Lot 2 on the east, Block 4, San Lanta Subdivision as recorded in Plat Book 3, Page 80, Seminole County Records. There being no objections registered, Commissioner Baker moved to close the alley as advertised and to retain same as a utility easement, and tO authorize the City Attorney to prepare an ordinance pertaining to the same. Seconded by Commissioner Cri~pps and carried. Adkisson, Fern Park, next submitted a request for an exempt peddler's license due to disability, and on motion of Commissioner Raborn, seconded by Commissioner Baker and carried, same was denied. Miss Jeanette E. Laing, oWner of property at 806~ Maple Avenue, 808 Maple Avenue, 808~ Maple Avenue, and 1008 Holly Avenue, covered by Gertificates of Condemnation Nos. 62-47, 62-48 and 62-49, dated February 9, 1963, and 90 day extension dated May 13, 1963, next sub- mitred a request for an;.. additional 90 day extension. ~ter consideration, Commissioner Baker moved to deny same. Seconded by Commissionel Raborn and carried. Consideration next given to cost of $63..52 to redeem County Tax Certificates sold for taxes for years 1959 and 1960 on Lot 16, South Pinecrest, Second Addition. This property having been annexed to the City on September 14, 1959, and ~ot 16 having been deeded to the City on June 13, 1960, for use as a street right-of-way. After discussion, commissioner Crapps moved to authorize the City Attorney to handle same. Seconded by Commissioner Baker and carried. Consideration next given to request submitted by Be~nie Boozer for a license for the sale of beer and wine for consumption on premises at 1003 W. 13~ Street, and on motion of Commissioner Baker, seconded by Commissioner Raborn and carried, same was tabled. Ordinance No. 80~, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 4, SECTION 4-1 THEREOF, THE CODE OF THE CITY OF SANFORD, FLORIDA, .1954, AS AMENDED, SAID SECTION DESIGNATING THE ZONES IN WHICH INTOXICATING LIQUORS MAY BE SOLD, SAID AMENDMENT ADDING ANi~ ADDITIONAL AREA TO SAID ZONE~ plied on first reading and read in full at regular meeting of July 8, 1963, was next placed on its final passage and adoption. M. 19.65 Gommissioner Raborn next introduced Ordinance.No. 805, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTION 4-20 OF CHAPTER ~, THE CODE OF THE CITY OF SANFORD, FLORIDA, 195~, AS AMENDED, SAID SECTION PROVIDING FOR THE NUMBER OF ALCOHOLIC BEVERAGE LICENSES TO BE ISSUED AND PROVIDING FOR A FIVE HUNDRED FOOT RULE, SAID AMENDMENT INCLUDING BEER ~ND WINE LICENSES WITHIN SHE SAID FIVE HUNDRED FOOT RULE LIMITATION. and on motion of Commissioner Raborn, seconded by Commissioner Baker, and carried, same was placed on its first reading and read in full. On motion of Commissioner Baker, seconded by Commissioner Crapps and carried, minutes of regular meeting of July 8~ 1963, were next approved. Request next submitted for transfer of license for sale of alcoholic beverages for consumption on premises and hotel license from Valdez Hotel, Commercial Street and Park Avenue, to John ~urton, IV, and upon recommendation of the Chief of PoliCe~ Commissione~ Baker moved to authorize same. Seconded by Commissioner Crapps and carrie~. Gommissioner Grapps next introduced Resolution No. 978, and after having been read in full moved on its passage and adoption and to authorize the Ma~or and City Clerk to execute same. Seconded by Commissioner Baker and carried. Said Resolution No. 978, being in words and figures as follows: RESOLUTION WHEREAS, W. A. Adams has applied to the Florida Public ~tilities Commission for authority to extendhis existing certificate authority to domicile motor vehicle equipment at Sanford,. Florida for the purpose of transporting household goods and furniture to, from and between all points and places in the State of Florida, and WHEREAS, said W. A. Adams has substantial warehouse facilities and equipment located in ~anford, Florida, specifically warehouse facilities at 200 North Holly Street, 200 Norg.h Laurel Street and 200 North Elm Street, Sanford, Florida, and WHEREAS, W. A. Adams has been engaged in the movement of household goods as an agent for another carrier out of Sanford, Florida, and WHEREAS, Sanford and Seminole County have experienced a substantial increase in population, and WHEREAS, W. A. Adams is a well established, competent local Sanford business ma~ and the result of granting him authority t~ domicile equipment in Sanford would not have an adverse effect on the existing certificate holder with equipment domiciled in S,nford or the two carriers with equipment domiciled in Sanford because W. A. Adams has been until recently serving Sanford as an agent for another carrie~ and is presently serving Sanford out of DeLand, and WHEREAS, W. A. Adams could better serve Sanford and Seminole County if authority were granted him to domicile equipment in Sanford, NOW, THEREFORE, · BE IT RESOLVED that the City of Sanford, Florida, acting by its duly authorized City Council in regular course of business at a regularly assembled meeting pursuant to a regular agenda a~d with opportunity for all to be heard on this question, after full discussion thereof, hereby endorses the application of W. A. Adams for authority to domicile motor vehicle equipment at Sanford, Florida for the purpose of providing intrastate trans- portation of furniture and household goods to and from the City of Sanford, and further that MINUTES City Commission, Sanford, Florida, July 22 at 8 P. M..19 65 a representative of this body be authorized to attend the public hearing on said application in support thereof, to testify at said hearing on behalf of said Council and to introduce this resolution in evidence, and further that a copy of this resolutionbe forwarded forth- with to the Florida Public Utilities CommiSsion in Tallahassee, Florida, IN WITNESS WHEREOF, this resolution has been signed by the Mayor and attested by the City Clerk of this body and the official seal of the City of Sanford, Florida has been affixed. Seconded by Commissioner Raborn and carried. Request next submitted from Joe Davis, Attorney for BurnuP & Sims, Inc., 201N. Maple Avenue, to close, vacate and abandon Maple Avenue from Gommercial Street north to Fulton Street, and on motion Of Commissioner Baker, seconded by Commissioner Raborn and carried, a public hearing was authorized to be held on August 26, 1963, to consider same. Consideration next given to the action of the Commission at special meeting of July 18, 1965, authorizing the obtaining of options on approximately 1,O00 ~o 1,200 acres of land south of the City Limits for an additional site for the proposed university as authorized by the 1963 State Legislature. Commissioner Baker moved to authorize the Mayor to proceed with negotiations with First Research Corporation for a field study of the aforesaid property not to exceed the sum of $350.00, contingent upon receipt of the above options.
