The City Co~mission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on August 12, 1963, Present: Commissioner Thomas S. Williams Absent: Commismioner M. L. Raborn The meeting was called to order by the Chairman. John Fox, Realtor, next appeared to represent Mr. Brass of Brass Motor Company, in regard to City owned property, Lots 8 through 12 and Lots 20 through 24 of Spurling's Plat of Block 15, Chapman & Tucker Subdivision, and requested approval of an offer to purchase the aforesaid property for $5,000.00. After considerable discussion, Commissioner Crapps moved to authorize the sale to Mr. Brass with a net receipt to the City of $5,000.00, and stipulated that the City would not make payment for stamps, reCording fees, sales commission nor title evidence. Seconded by Commissioner Wilson and carried over the dissenting vote of Commissioner Baker. Mr. Fox excused himself from the meeting and upon his return reported that Mr. Brass had accepted the offer. Next order of business being a Public Hearing to consider vacating, closing and abandoning portions of streets in a~cordance with the following notice published in the Sanford Herald on July 16, 1963. NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABANDONING PORTIONS OF STREETS. TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on the 12th day of August, 1963, at the CitY Hall in the City of Sanford, Florida, will consider and determine whether or not the City w$11 close, vacate and abandon any right of the City and the public in and to those portions of streets hereinafter described, to-wit: That portion of Third, Fourth and Fifth Streets lying between the west right-of-way line of Persimmon Avenue and the west City limits line ~anning along the North and South Quarter Section line of Section 26, Township 19 ~outh, Range 30 East. CITY CLERK George Mdson, Attorney for Sunstand, Inc., owners of the property abuttingthe aforesaid streets next appeared and explained its use for proposed industrial purposes and requested the Commission to approve vacating the streets. There being no objections regi* stered, Oommissioner Baker moved to close the streets as advertised, and to authorize the City Attorney to prepare an ordinance pertaining ~o same. Seconded by Commissioner Crapps and carried. ~. J. Davis, Jr., Attorney, next appeared regarding a transfer of a taxicab license from Lillie Harris to ~ennie Booze~. After discussion, Commissioner Baker moved on approval of same, contingent that no criminal record exists against petitioner Bennie Boozer or in does the event that same/exist, to withhold the transfer until such charges are disposed. ': Robert Crumley, Chairman of the Industrial Park Board, next~eported that the City Industrial Park had been named the "Lake Monroe Industrial Park", amd further requested the Commission's approval of the following items: 1. Cooperation of the City Manager and Engineer to prepsre minimum engineering data on parcels of land within the Park. 2. Consideration of paving Fulton Street from French Avenue west to the west boundary of Lot 10. 3.Listing of industrial park property for sale by local Realtors, and setting a gross sale price to include realtors commission. 4. To request the Chamber of Commerce to put up a large sign to advertise the aforesaid site, and to urge the preparation of a brochure supporting this park in their annual advertising schedule. On motion of Commissioner Baker, seconded by Commissioner Crapps and carried, the Commission approVed the above request and further authorized upon the receipt of the $5,000.00 from the sale of property to Brass Motor Company, that these funds woul~ be set up in the Public Project Funds for the purpose of developing the "Lake Monroe Industrial Park". The City Attorney next ~eported that it was the opinion of the County Attorney that the County Tax Certificates held by individuals against Lot 16, South Pinecrest, Second Addition, could be cancelled, and the principal refunded. The City Attorney stated that this left in question the interest owed the individuals and after discussion, Comm~g~ioner Crapps moved to authorize payments by the City of the interest if it is found necessary to do so in order to clear the aforesaid certificates. Seconded by Commissioner Wilson and carried. Consideration next given to request of Joseph A. Brooks d/b/a Cook's Corner, 2617 Orlando Drive, for a license for the sale of intoxicating liquors for consumption on premises, and after discussion no action was taken by the Commission. On motion of Commissioner Wilson, seconded by Commissioner Crapps and carried, the Commission next designated the regular meeting of September 9, 1963, as the date on which the Commission will sit as a Tax Equalization Board to receive the 1963 Tax Roll as prepared by the Tax Assessor. On motion of commissioner Crapps, sedonded by Commissioner Wilson and carried, Robert Karns was next appointed to the Board of Adjustment to serve a 3 year term. Estimate ~o. 12 next submitted in the amount of $3,911.86 covering work completed and material on job site to August l, 1963, on contract with Texas Mid West Contracting Company, dated May 9, 1962, for construction of the Sewage Treatment Plant; and on motion of Commissioner Crapps, seconded by Commissioner Wilson and carried~ payment was authorized from the Construction Trust Fgnd of 1962 on the approval of the City Manager and stipulated that the check be drawn as joint payees to the Contractor and to the assured bonding company, Great American Insurance Company and further authorized the transfer of $4,000.00 from the Renewal & Replacement Fund to ~he construction Fund to cover same. On motion of Commissioner Crapps, seconded by Commissioner Baker and carried, an advertisement was authorized in the Florida Municipal Record in t~e amoun~ of $~2.00 to express appreciation to t~e Governor and Legislature Zor ~heir suppor~ to provide financial relief to municipalities. Request next submitted by the Kiwanis Club of Sanford for use of the Civic Center on September 7, 1963~, under the same terms and conditions as last year, to hold an auction and fish fry, and on motion of Commissioner Crapps, seconded by Commissioner Wilson and carried, same was approved. Petition next submitted by the Bellmeade Development Corporation for annexation of a portion of the Amended Plat of Druid Park south of 27th Street and east of Orlando Drive, and on motion of Commissioner Wilson, seconded by Commissioner Baker and carried, the City Attorney was authorized to prepare an Ordinance for aBnexation of s~ame, and further, upon completion of the aforesaid annexation, to cooperate with the installation of storm S MINUTES City Commission, Sanford, Florida,_ Au_gl~_st sewers handling off site flows, an~ also upon receipt of an east-wes~ easement across said property, to ~urther authorize the City to install water and sanitary sewer lines in said easement to the 0uilding site. Ordinance No. 805, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTION 4-20 OF CHAPTER 4, THE CODE OF THE CITY OF SANFORD, FLORIDA, 1954, AS AMENDED, SAID SECTION PROVIDING FOR THE NUMBER OF ALCOHOLIC BEVERAGE LICENSES TO BE ISSUED AND PROVIDING FOR A FIVE HUNDRED FOOT RULE, SAID AMENDMENT INCLUDING BEER AND ~INE LICENSES WITHIN THE SAID FIVE HUNDRED FOOT RULE LIMITATION. placed on first reading and read in full at regular meeting of July 22, 1963, was next placed on its final passage and adoption. After being read in full, the roll was called and the vote stands as follows: Commissioner McDonald Yea " Baker " Crapps " Wilson " Thereupon, the Chairman a~ounced that the City Commission of the City of Sanford, had passed and adopted said Ordinance No. 805, entitled:: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTION 4-20 OF CHAPTER 4, THE CODE OF THE CITY OF SANFORD, FLORIDA, 195~, AS AMENDED, SAID SECTION PROVIDING FOR THE N~BER OF ALCOHOLIC BEVERAGE LICENSES TO BE ISSUED AND PROVIDING FOR A FIVE HUNDRED FOOT RULE, SAID AMENDMENT INCLUDING BEER AND WINE LICENSES WITHIN THE SAID FIVE HUNDRED FOOT RULE LIMITATION. Commissioner Crapps next introduced Ordinance No. 806, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING THE PORTION OF A NORTH-SOUTH ALLEY LYING NORTH OF FOURTEENTH STREET BETWEEN LOCUST AND HICKORY AVENUE IN THE CITY OF SANFORD, FLORIDA and on motion of Commissioner Crapps, seconded by Commissioner Wilson and carried, same was placed on its first reading and read in full. Consideration next given to the request submitted by Bennie Boozer for a license for the sale of Beer and Wine for consumption on premises at 1003 West 13th Street, and after discussion and on motion of Commissioner Baker, seconded by Commissioner Wilson and carried, the request was denied. After discussion the City Manager was next authorized to prepare a general outline of the policy of the City pertaining to the extension and charges for water and sanitary sewer facilities. COmmissioner Crapps moved that pursuant to a request of the Seminole County Board of Public Instruction to authorize the City to proceed with the construction of Mangoustine Avenue from 13th Street to 16th Street and to participate with said Boa~d on the construction of 16th Street in front of the Goldsboro Elementary School. Seconded by Commissioner Wilson and carried. On motion of Commissioner Baker, seconded by Commissioner Wilson and carried, the City Manager was authorized to advertise for bids for cast iron pipe for City work on water mains. Consideration next given to notes receivable from W. A. Adams and Sam'Lawson, and the City Manager was authorize to notify each that the City expected payment in accordance with ~he terms of the note. The City Manager was next authorized to obtain emtimated cost for bringing the City Code up to date. G. W. Simmons, 420 Oak Avenue, next appeared to request a license to operate a taxicab an~ same was taken under advisement. On motion of Commissioner Baker, seconded by Commissioner Wilson and carried, a payment of ~2,000.00 was authorized to be made to Wm. C. Hutchison, Jr., City Attorney, for fees to date in the case of Saxon vs City of Sanford. On motion of Commissioner Baker, seconded by Commissioner Wilson and carried, the City Manager Was authorized to notify the First Research Company, Inc., Miami, Florida, that their services would not be required in the preparation of a report on a proposed University site south of the City and further to authorize ~he City Manager and Building Official to prepare a report to be submitted to the State Board of Control on the aforesaid site in October, 196~.
