After consideration of the aforesaid reports Nos. 63-62 through 63-85, and after discussion, Commissioner Baker moved that the buildings and structures covered by the aforesaid reports be condemned and the owners given notice mntil January l, 196~, to repair or remove or give a just cause why they are not repaired or removed, ~nd after January 196~, to authorize the City to remove the buildings or structures and levy a lien against the property for the cost of removal. Seconded by Commissioner Crapps and carried. The next order of business being a Public He,ring to consider vacating~ closing and abandoning a portion-of Maple Avenue between Commercial Street and FUlton Street in accordance with the following notice published in the ~anford Herald on August 7, 1~63. NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABANDONING A PORTION OF A STREET TO WHOH~IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on the 26th day of August, 1963, at the City Commissioners' Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to the portion of the street hereinafter described~ to-wit: That portion of Maple Avenue extending from'the north ri~ht-of-way line of Commercial Street to the south right-of-way line of Fulton. A. Edwin Shinholser, owner of property abutting Maple Avenue, and S. J. Davis, Attorney for Burnup and Sims, Inc., appeared and requested the City to vacate the easterly 27 feet and the westerly 5 feet of Maple Avenue from the north right-of-way line of Commercial Street to the south right-of-Way line of Fulton. There being no objections registered, and after discussion, Commissioner Crapps moved to authorize the City Attorney to oreoare an Ordinance oertainin~ to same in aceordane~ MINUTES. Doudney, Surveyor, next presented a plat of the First Section of Lake Monroe Industrial Park, as approved by the Industrial Park Board. Commissioner Baker moved on the acceptance of the plat, with utility easements, and further to authorize the Mayor and City Clerk to execute same, and to be recorded in the official records of the County Clerk. Seconded by Commissioner Crapps and carried. Commissioner Wilson next introduced Resolution No. 979, and after being read in full, moved on its passage and adoption. Seconded by Commissioner B. aker and carried by the unanimous vote of the Commission. Said Resolution No. 979 being in words and figures as follows: A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, REQUESTING SALE OF COUNTY OWNED LANDS TO THE CITY OF SANFORD. WHEREAS, Seminole County heretofore on the 8th day of November, 1949, conveyed to City of Sanford, FIQrida, the following described property in Seminole County, Florida, to-wit Lots 10, ll, 12,,13 and the North 91.75 feet of Lots 22 and 23, and the North 155.7 feet ~of Lot 24, of Pace Acres, according to plat thereof recorded in Plat Book 3, page 21, Beminole County Public Records, pursuant to the authority of House Bill No. 1015 enacted by the 19~9 session of the Florida Legislature, and WHEREAS, said conveyance was subject to conditions and reservations requiring that the same not be offered for ~ale by said City and that the same should be used for public athletic and recreational purposes, and that in the event of failure of either of the fore- going, said property would revert to the County, and WHEREAS, the City has hertofore conStructed on a portion of said property a muni- cipal stadium which is and will be used for public athletic purposes, and WHEREAS, Bernarr MacFadden Foundation, Inc., a non-profit New York corporation, has requested the City of Sanford to sell and convey to it for the sole'and express purpose of locating a boys' preparatory school emphasizing naval activities to be located on that portion of the above-described property not presently utilized by said municipal stadium and adjacent parking, and WHEREAS, the City Commission of the City of Sanford, Florida, has found that the land which said Bernarr MacFadden Foundation,i~iInc., desires to purchase is not necessary for public recreational facilities nor for municipal government, and that the establishment by such non-profit organization of said boys' military preparatory school is necessary ~and desirable in promoting community interests, upgrading the a~ea and promoting the interests of Seminole County, and that the City desires to acquire all of the legal and equitable title to said property for the express purpose of conveying the same to the Bernarr MacFadden Foundation, Inc., NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that the County Commission of Seminole County, Florida, be, and it, is hereby re- quested to convey the above-described property to the City of Sanford pursuant to the provisions of Chapter 125.38, Florida Statutes, for the purpose hereinabove set forth, and in consideration thereof the City of Sanford, Florida, will pay unto Seminole County the sum of Fifteen Thousand and O0/100 Dollars ($15,000.00) out of and from the proceeds re- ~ceived by said City from said Bernarr MacFadden Foundation, Ind., as the same are received on a proportionate basis. M. ._19_63 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABAN- DONING THE PORTION OF A NORTH-SOUTH ALLEY LYING NORTH OF FOURTEENTH STREET BETWEEN L~CUST AVENUE AND HICKORY AVE~UE IN THE CITY OF SAh~0RD, FLORIDA. On motion of Commissioner Raborn, seconded by Commissioner Crapps and carried the following street lights were authorized to be installed after adoption of the 1963~64 bUdget: (1) at corner of Cypress Avenue and 8th Street (1) on San Car~os between #~ and 7~ Streets (2) at Mulberry Avenue and 15~ Street Request next submitted by Sam Lawson for further extension of original note dated June 22, 1960, execdted in the amount of $1,603.$8, current balance now being $1,000.00, for sewer extensions in St. John Village Subdivision. After consideration Commissioner Baker moved on the approval of an extension for one year with interest of 6 per cent. Seconded by Commissioner Wilson and carried. After discussion, and on motion of Commissioner Crapps, seconded by Commissioner Raborn and carried, the City Manager was next authorized to negotiate for costs of con- struction of a Butler Sype building to replace the park department building sold tb the Bernarr MacFadden Foundation. Request next submitted from Postmaster, Miss Cecile Heard, for the City to pave the area in front of the Post Office, and after consideration, Commissioner Crapps moved to authorize the City to furnish the labor provided the Post Office Department would furnish the materials. Seconded by Commissioner Raborn and carried. Request next submitted from Pinecrest Shopping Center for extension to their south property line of the zone for the sale of alcoholic beverages. After discussion, and on motion of Commissioner Baker, seconded by Commissioner Crapps and carried over the dissenting vote of Commissioner Wilson, the City Attorney was authorized to prepare an ordinance pertaining to same. On motion of Commissioner Raborn, seconded by Commissioner Baker and carried, the City Manager was authorized to advertise for bids to replace the International TD-15 Crawler Tractor used for the land fill operation. Invoice next submitted by the First Research Corporation, Miami, Florida, in the amount of $380.04, for out of pocket expenses and services rendered to review the Lake Ada area south of the City for a proposed site to be submitted to the State Board of Control for the possible location of a University authorized by the State Legislature. Mayor McDonald reported that it had been his understanding that the out of pocket expenses were not supposed to amount to over $50.00, and therefore, he felt payment should be made in the amount of only $350.00. After discussion and on motion of Commissioner Baker, seconded by Commissioner Raborn and carried over the dissenting vote of Commissioner Crapps, payment was authorized in the amount of $350.00 for the aforesaid statement. Recommendation next submitted by the Zoning and Planning Commission to rezone Lot l, Robinson Addition and Lots 26 and 27, A. D. Stendiford's Subdivision from M-1 (Light Industrial District) to R-5 (1 and 2 Family Dwelling District) and after discussion, Commissioner Wilson moved to authorize a Public Hearing to be held on October 14, 1963, to consider same. Seconded by Commissioner Baker and carried. The Zoning and Planning Commission next submitted a recommendation to enforce the ordinances prohibiting commercial signs being located on public property and further reviewed the progress of the City on the Capital Improvements Program as submitted in George Simons'~ MINUTES City Commission, Sanford, Florida, August 26 at 8 P. Ft. 19_6:5 _ City Planning Report dated March, 1961, and specifically urged the remodeling of the Old Post Office Building for use as a Public Library. After discussion and on motion of Commissioner Wilson, seconded by Commissioner Crapps and carried, same was taken, under advisement, and also authorized a letter of ~ommendation be sent to said Zoning and Planning Commission. Consideration next given to a request to adopt an ordinance to require all retailers of Communist made products to obtain a special license and to designate each store as an outlet of such, and on motion of Commissioner Crapps, seconded by Commissioner Wilson, and carried, same was taken under advisement. On motion of Commissioner Crapps, secOnded bY ~Commissioner Wilson and carried, minutes of regular meeting of August 12, 1963, were next approved. Request next submitted by the Sanford Naval Academy for the assistance of the City to remove several Austrailian Pine trees located in their parade grounds and to utilize same in the School Board's parking lot located across Mellonville Avenue. After discussion, Commissioner Crapps moved on the approval of the request, provided that such work would be done only with the approval of the School Board. Seconded by Commissioner Wilson and carried. After consideration, Commissioner Baker moved to install parking meters at the southwest corner of Second Street and Park Avenue and the southwest corner of Commercial Street and Park Avenue. Seconded by Commissioner Wilson and carried. After discussion, Commissioner Baker moved to authorize the City Attorney to prepare an ordinance authorizing the City Manager or Police Chief to designate bus routes in the City. Seconded by Commissioner Crapps and carried. There being no further business the meeting adjourned.
