032364-Regular Session MINUTES City Commission, Sanford, Florida, March 23 at 8:00 P. Fi. 19,64- _ 533 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on March 23, 1964. Present: Commissioner A. L. Wilson, Mayor " Joe B. Baker " James H. Crapps " Earl Higginbotham " PI. L. Raborn, Jr. City Manager W. E. Knowles Police Chief R. G. Williams Absent: City Attorney Wm. C. Hutchison, Jr. City Clerk H. N. Tatum, Jr. The meeting was called to order by the Chairman. The first order of business was the consideration of the addition of another man to the Fire Department to complete the Kelly day schedule, and after discussion, Commissioner Higginbotham moved to authorize same, to become effective immediately. Seconded by Commissioner Crapps and carried. Loomis Leedy, fiscal agent of the firm of Leedy, Wheeler and Alleman, next appeared to review an ordinance for the issuance of revenue certificates for the proposed water improvements program. Commissioner Higginbotham next introduced Ordinance No. 831, entitled: AN ORDINANCE SUPPLF~ENTING AN ORDINANCE ENTITLED "AN ORDINANCE AUTHORIZING THE CONSTRUCTION OR ACQUISITION OF ADDITIONS, EXTENSIONS AND IMPROVE- MENTS TO THE COMBINED WATER AND SEWER SYSTEM OF THE CITY OF SANFORD, FLORIDA, AND AUTHORIZING THE ISSUANCE OF $1,175,000 WATER AND SEWER REVENUE CERTIFICATES FOR SUCH PURPOSES," AND ~R0VtDIN~G FOR THE ISSUANCE OF $F800,000 WATER AND SEWER REVENUE CERTIFICATES, SERIES 1964. and same was placed on its first reading and read in full. After discussion, Commissioner Higginbotham moved that City water and sewer utilities be furnished to customers requesting the services outside the City limits upon the original established policy of said customer signing an annexation petition, and all costs of extensions to be paid by the customer. Seconded by Commissioner Baker and carried over the dissenting vote of CommiSsioner Raborn. Commissioner Raborn stated that he was opposed on the basis that the motion did not include a stipulation that the property must be contiguous to the City limits~- . Consideration next given to the tabulation of bids submitted by the City Manager at regular meeting of March 9, 196~, for furnishing 300 feet of curb and gutter forms, and after discussion, Commissioner Higginbotham moved on the acceptance of the bid of State Tractor and Equipment Company for furnishing 300 feet of curb and gutter forms for the sum of $2,870.00, because these forms will be interchangeable with the County's and also meet State Road Department specifications, and further, authorize the transfer of $3,000.00 from Engineering Salary Account No. 5001 to Street Department Equipment Account No. 4726. Seconded by Commissioner Crapps and carried. On motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried, the Commission next authorized a transfer of $15,000.00 from Street Resurfacing Account No. 4781, and $5,000.00 from Public Projects Fund Appropriated Surplus Account No. C 298, derived from the sale of a portion of Block 15 of Chapman and Tuckers Addition, said transfer making a total of $20,000.00 to Street Material Account No. 4725 for the Capital Improvement of reconstruction of 13th Street, westerly from French Avenue. On recommendation of the City Attorney, Commissioner Crapps moved to accept the deed from the School Board to the sewer lift station site at the Seminole High Schoo~ property on Lake Jennie. Seconded by Commissioner Higginbotham and carried. Letter next received from General Services Administration accepting the City's bid of $8,011.&9 for the vac~ut property next to the old post office building on East First Street, and after discussion, and on motion of Commissioner Higginbotham, seconded by Commissioner Crapps and carried, balance of the payment in the amount of $7,210.3¢ was authorized from Contingency Account No. 8150, and further authorized transfers as follows: $3,500.00 ~from Debt Service Reappraisal Account No. 8200-1lA 'to Debt Service Administrative Salary Account No. 8200-10 $3,500.00 from Finance-Salary Account No. 1401 $.3i500 O0 from Finance-Reappraisal Account No. 1~20 $7,000200 to Contingency Account No. 8150 Consideration next given to request for two street lights on East 2&th Street, between Mellonville Avenue and Bel-Air Boulevard, and on recommendation of the Chief of Police, Commissioner Higginbotham moved to authorize the same. Seconded by Commissioner Crapps and carried. Request next submitted by Mrs. L. B. Place for a license for sale of beer and wine for consumption, on premises on 20th Street and Hardy Avenue, and on recommendation of the Chief of Police, and on motion of Commissioner Higginbotham, seconded by Commissioner Crapps and carried over the dissenting votes of Commissioner Baker and Commissioner Wilson, same was approveS. Request next received from George Seymore for a salary advance of $100.00, to be repaid $10.00 per week, and on motion of Commissioner Higginbotham and carried, same was approved. Ordinance No. 829, entitled: AN 0R~INANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SUBSECTION (B) OF SECTION 4-2 ESTABLISHING HOURS AND DAYS OF SALE OF ALCOHOLIC BEVERAGES, THE CODE OF THE CITY OF SANFORD, FLORIDA, 195~, AS AMENDED, SAID AMENDMENT PROVIDING AN EY~E~PTION FOR HOTELS HAVING MORE THAN FIFTY ROOMS. placed on its first reading and read in full at the regular meeting of March 9, 1964, was, on motion of Commissioner Higginbotham and seconded by Commissioner crapps, next placed on its final passage and adoption. After being read in full, the roll was called and the vote stands as follows: Commissioner Wilson Naye " Baker Naye " Crapps Yea " Higginbotham Yea " Raborn Yea Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 829, 'entitled: AN ORDINANCE OF THE CITY OF SAi~ORD, FLORIDA, ~dENDING SUBSECTION(B) OF SECTION 4-2 ESTABLISHING HOURS AND DAYS OF SALE OF ALCOHOLIC BEVERAGES, THE CODE OF THE CITY OF SANFORD, FLORIDA, 195~, AS AMENDED, SAID AMENDMENT PROVIDING AN EXEMPTION FOR HOTELS HAVING MORE THAN FIFTY ROOMS. Commissioner Crapps moved to authorize the City Attorney to prepare an ordinance controlling the hours for sale of alcoholic beverages by bars within the City, excluding hotels, said ordinance' amending the City reEulations to coincide with the regulations for MINUTES City Commission, Sanford, Florida, March 23 at 8 P. M. bars outside the City and within Seminole County. Seconded by Commissioner Higginbotham and same failed to be carried over the dissenting votes of Commissioner Baker, Commissioner Raborn and Commissioner Wilson. Ordinance No~ 850, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, PRESCRIBING RATES TO BE CHARGED FOR WATER FURNISHED BY THE CITY OF SANFORD AND REPEALING ORDINANCE NUMBER 525, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN COKFLICT HEREWITH. placed on its first reading and read in full at the regular meeting of March 9, 196~, was, on motion of Commissioner Higginbotham and seconded by Commissioner Crapps, next placed on its final passage and adoption. After being read in full, the roll was called and the vote stands as follows: Commissioner Wilson Yea " Baker " " Crapps " " Higginbotham " " Rab orn " Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 830, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, PRESCRIBING RATES TO BE CHARGED FOR WATER FURNISHED BY THE CITY OF SANFORD AND REPEALING ORDINANCE NUMBER 525, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. The City Manager next reported that two more complaints had been placed to his office pertaining to the debris on property at 501~ Celery Avenue, owned by Mrs. Elsie Menendez, and further that no action had been taken pursuant to the notice to have it cleaned by March 15, 1964. After discussion, Commissioner Baker moved to proceed with final 5 day notice to clean up the debris, and if same is not complied with, to issue a warrant for her arrest to appear before the Municipal Judge to explain her action. Seconded by Commissioner Raborn and carried. The City Manager next submitted the following tabulation of bids, which were opened publicly at 2:00 o'clock P. M. on March 20, 196~, for an air conditioning and heating Unit:f6r the police station in accordance with the specifications in the invitation for bids published in the Sanford Herald on March 16, 196~. Seconded by Commissioner Higginbotham and carried. On motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, minutes of regular meeting of March 9, 196~, were next approved. Said Resolution No. 990 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, AUTHORIZING THE~YOR ~3D CITY CLERK TO EXECUTE A CONTRACT DESIGNATING THE COUNTY COMMISSION OF SEMINOLE COUNTY, FLORIDA, AS THE AGENT OF THE CITY IN CONTINUING PLANNING PROGRANS PERTAIN- ING TO FEDERAL AID HIGHWEY PROJECTS. BE, lIT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, that the Mayor and City Clerk be, and they are herebY authorized to execute the contract pertaining to the City of Sanford, Florida wherein the City designates the County Commission'~o£ Seminole County, Florida, as its agent participating in continuing planning programs pertaining to Federal Aid Highway projects, provided, however, that this resolution is expressly condi- tioned upon the representation that there will be no cost or special liability to the City. Tamm~ Jr. City Clerk Consideration next given to the request of the Electrical Board to give qualifying examinations quarterly, and after discussion, the City Manager was authorized to contact other cities and to determine if they are on a quarterly basis, and if so, to use same for the City. Earl B. Givens of Southern Gulf, Inc., requested the City to permit his company to connect the sewer from Ravena Park Subdivision to the City's sewer system, at a flat cost per connection per month. The City Manager was authorized to negotiate with Southern Gulf Utilities for the City to take,over the sewer collection system, if feasible. Request next submitted from Harold Johnson, Attorney for Susan M. Jones Estate, with regards to condemnation Report No. 63-81, covering 1607, 1609, and 1611 West 13t~ Street, Lot 8, Georgia Acres, and requested an extension of time, and after discussion, Commissioner Baker moved to authorize an extension of 60 days from April l, 1964. Seconded by Commissioner Raborn and carried. Consideration next given to ~e signing of a Subordination of Mortgage Agreement between the City of Sanford and Florida State Bank, with regards to the property at north- east corner of Celery Avenue and Mellonville Avenue, sold to Bernarr MacFadden Foundation, Inc., and after discussion, Commissioner Raborn moved to authorize the Mayor and City Clerk to execute same on the approval of the City Attorney and City Manager.
