The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M,' on June 22, 196~. Present: Commissioner A. L. Williams Absent: Commissioner Joe B. Baker The meeting was called to order by the Chairman. Wm. H. Stemper, Acting President, and John M. Fitzpatrick, Secretary, of Sanford Industries, Inc., appeared to present a check in the amc,nut of $1,616.37, and read a resolution pertaining to same. ~aid Resolution being in words and figures as follows: RESOLUTION WHEREAS, SANFORD INDUSTRIES, INC., has heretofore been dissolved by proclamation of the Governor of the State of Florida, and WHEREAS, after the payment of all Costs and expenses there remains in the treasury only the sum of $1,616.37, and WHEREAS, it is impractical if not impossible to disburse pro-rata the said monies to the many persons holding stock in said corporation, and WHEREAS, it is in keeping with the purpose and intent of said corporation, its stockholders and directors, that said money be utilized in aiding the further industrial development of Banford, Florida, now therefore BE IT RESOLVED this day that said funds, to-wit, $1,616.37 be disbursed to and paid over to the City of Sanford, Florida, to be utilized by Said City in promoting industrial development. Stemper next submitted a request from Brookfield Mills Company to adjust their 1963 Personal Property Taxes, inasmuch as this company was in the process of moving out of the City on January 1, 1963, and had completed their transfer of all personal property from the City by January 18, 1963. On motion of 0ommissioner Higginbotham, seconded by Commissioner Crapps and carried, the Tax Collector was next authorized to cancel the assessment for the aforesaid taxes in the amount of $278.10. Mr. Stemper next reported that the paving of the alley in the rear of 1919 South French Avenue baa been completed at a cost of $336.00, and requested the City to participate in the costs. After discussion, Commissioner Orapps moved to authorize payment for ~ne above in the amount of $136.00. Secondea by Commissioner Higginbotham and carried. N6ttce is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M., on June 22, 19~, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: Property is proposed to be rezoned from R-2 (one and two family dwelling) District to R-5 (one and two family dwelling) District described as follows: Lots 1,2 and 3, Block 8, Tier 15 and that portion lying north of the Atlantic Coast Line Railroad right-of-way of Block 8, in Tiers 15 through 20, inclusive, and the south one-half of Block 7, in Tiers 16 through 20, inclusive, all in Plats of Seminole Park ~and Town of Sanford as recorded in Plat Book 1, pages ll_2, ll~, llS, ll6 and ll7, and Plat Book 2, Page 75, ~eminole County Records. Tamm, Jr. As City Clerk of the City of Sanford, Florida The Ohairman then announced that the Commission would be glad to hear from anyone in favor of or against the rezoning as advertised in the foregoing notice. There being no objections registered snd after discussion, Commissioner Higginbothammoved that the property be rezoned as advertised and to authorize The City Attorney to prepare an ordinance pertaining to same. Seconded by Commissioner Raborn and carried. Hal Washburn appeared to request' reconsideration of his petition for a permit to dredge part of Lake Ada across City owned property west of Highway 17-92. H~. Washburn reported that tests had been made of the Lake bottom and that no marl existed, and further, that his contractor reported that all Sediment would settle out of the lake in three to four weeks. Tommy Peterson reported that the State Road Department had made test borings of the area and that these should be made available prior to any decision. After consideration, Commissioner Raborn moved that the previous action of the Commission in denying the request be upheld subject to more information being furnished by Mr. Washburn's engineer. Seconded by Commissioner Crapps and carried. Request next received from Gordon Sweeney to designate the alley between First Street and Second Street and Park Avenue and Magnolia Avenue as one-way traffic, and after discussion, Commissioner Higginbotham moved to designate same one-way from Park Avenue to Magnolia Avenue and to install appropriate signs. Seconded by Commissioner Raborn and carried. Letter next received from Harold Johnson, Attorney for Charles and Susan Jones Estate, requesting extension of 60 days on property covered by Certificate of Condemnation No. 6~-81, dated August 15, 1963, pertaining to 160?-1611 West 15th Street, and after discussion, Commissioner Crapps moved to authorize an extension to August l, 196~, and providing that if the building or structure is not repaired or demolished by August l, 196~, to authorize the City to demolish same without further notice. Seconded by Co~issioner Higginbotham and carried. MINUTES City Commission, Sanford, FlOrida, June 22 at 8~.P.M. 19.6Zl-' Consideration next given to the ~nnexation properties contiguous to the City and containing fewer than ten owners, and after discussion, Commissioner Higginbotham moved to authorize the City Attorney to prepare an ordinance of intent to annex. Seconded by Commissioner Raborn and carried. Commissioner Raborn next stated that this should be a continuing program in all areas surrounding the City. The City Manager next reported that Wm. Hemphill had stated that he was not able to serve on the Civil Service Board due to conflicting meeting dates. Commissioner Raborn moved to authorize the City Manager to inquire of a member whose term is to expire, to determine if he would consider a reappointment to the same position if the City Commission so authorized the reappointment. Seconded by Commissioner Higginbotham ogd carried. Commissioner Crapps next intoduced Resolution No. 993, and after being read in full, moved on its passage and adoption. Seconded by Commissioner Raborn and carried by the un,nimous vote of the Commission. Said Resolution No. 993 being in words and figures as follows: A JOINT RESOLUTION OF THE CITY COMMISSION. OF THE CITY OF SANFORD, FLORIDA, AND THE BOARD OF COUNTY COMMISSIONERS, SEMINOLE COUNTY, FLORIDA, COMMENDING CAPTAIN ROBERT M. WARE,USN, COMMANDER NAVAL AIR STATION, SA.NFORD, FLORIDA. WHEREAS, CAPTAIN ROBERT M. WARE has since November, 196~ been stationed at Sanford Naval Air Station, Sanford, Florida, and in command thereof, and WkI~REAS, during the period o~ time in which me has been stationed at Sauford, Florida he has inspired unparalleled accomplishments in the Station's development, pre- paredness and safety, during which time the ASA Vigilante Weapon System was introduced into fleet operations and based at Naval Air Station, Sanford, and more recently the introduction of the 1t~-5C Reconnaissance System, and in addition thereto demonstrated a dedicated leadership in the recent Cuban crisis, and WHEREAS, CAPTAIN ROBERT M. WARE during his period of service in Sanford, Florida, worked diligently toward the successful continuance of Naval Air Station, Sanford, as an active operating facility of the United States Navy to the extent that all citizens of Sanford and Seminole County are deeply indebted, and in addition thereto., has worked dili- gently and unceasingly to develop the finest military relationship that has heretofore existed between the people of the City of Sanford, Seminole County, and the Naval Air Station, to the degree that the feeling of cooperation and friendship which exists stands as a model for Armed t~Orces installations everywhere, and WHEREAS, CAPTAIN ROBERT M. WARE has personally played a vital role in community life' through his efforts in civic organizations and many worthwhile community pro~ects as the result of which during the period of his command national and international recognition has been given to the City of Sa~£ord and Seminole County, and WHEREAS, CAPTAIN ROBERT M. WARE will soon retire from naval service and it is the feeling of the City 0ommission of the City of Sanford, Florida, and the Board of County Commissioners of Seminole County, Florida, that such retirement will be felt by all of the people in this area, and it is their desire to make known to the people of Sanford, Seminole County, and the personnel of the United States Navy, the outstanding record of contribution MINUTES City Commission, Sanford, Florida, June 22 at 8 P. WARE be, and he is hereby commended for his outstanding contribution, and that there be expressed herewith the sincere appreciation of the City Commission and Board of County Commissioners and the people of the City of Sa~ford and Seminole County for his efforts, and that by these presents he receive a token of our best wishes for the future and his early return. Consideration next given to the types of meters for the parking lot at the corner of First Street and Park Avenue, and after considerable discussion, Oommissioner Higginbotham moved to take up sufficient four hour meters and replace .with non productive meters from the outlying areas, and install same on the parking lot, and to enforce the fine of $2.00 for second offense parking violations. Seconded by Commissioner Crapps ~d carried. Commissioner Higginbothammoved go put hot asphalt paving on the above parking lot. Seconded by Commissioner Orapps and carried, Commissioner Crapps moved to transfer $1,500.00 from Contingency Account No. 8150 to Street Department Materials Account No. $725-C to provide for construction of the above municipal parking lot. ~econded by Commissioner Higginbotham and carried. Request next received from Carraway and McKibbin Insurance Agency for the City to pave their property next to the parking lot at First Street and Park Avenue and providing for payment of materials, and on motion of Commissioner crapps, seconded by Commissioner Higginbotham and carried, same was approved. Request next received for the City to pave the alley behind the Sanford Herald and west of Burpee Seed Company with the property owners paying for the materials and the City furnishing the labor and equipment, and on motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried, same was approved. Commissioner Crapps moved to authorize a transfer of $300.00 from Capital Improve- ment Program Account No. 8191 to Street Department Materials Account No. $725-B for plantings for the sidewalk from First Street to Commercial Street next to the library building. Seconded by Commissioner Higginbotham and carried. Consideration next given to a request to establish a public relations plan for city functions, and after discussion,_Commissioner Higginbothammove to deny the request. Consideration next given to action of the Commission at regular meeting of June 8, 196~, authorizing the City Attorney to prepare an ordinance to rezone that area west of Mellonville Avenue, east of the railroad, north of 2$th Street and south of Grove Manor, and after discussion, Commissioner Raborn moved to table same, Seconded by Commissioner Crapps and carried. Request next received from Mr. and Mrs. Warren Turman, 26~1 South Myrtle Avenue, for ~B~exation and water service, and after discussion, Commissioner Crapps moved t° accept an annexation petition and to extend water services provided the petitioner pay the cost of materials. Seconded by Commissioner Higginbotham and carried over the dissenting vote of Commissioner Raborn. Consideration next given to letter from Florida State Road Department stating that if the City desired a traffic survey to establish the need of traffic controls at Third Street and French Avenue and at Ninth Street and French Avenue it would be necessary to submit a resolution requesting same. On motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried, the City Attorney was authorized to prepare a resolution pertaining to same. Commissioner Higginbotham mOved to authorize ~he Mayor to send a letter of thanks to Dr. Edwin Epstein for the donation of a 3~ ton air conditioning-heating unit to be used in the Fire Department office. Seconded by Commissioner Crapps and carried. On motion of Commissioner Higginbotham, seconded by Commissioner Crapps and carried, payment of statements number ~, 5 and 6 from Clark, Die,z, Painter and Associates in the amoun~ of $52,855.61 for the Water Improvement Program was authorized. The City Manager next reported that t~e family of Stella Knigh~ was in ~he process of making arrangements to construct a home for her on property proposed to be purchased from the City as follows: East 1/2 'of Lot 5, Block lC, Tier C, E. R. Trafford's Map cZ Sanford Merle Warner, Real Estate Agent, next appeared and requested a varismce to open a real estate office in his home at 708 South Park Avenue. He stated that at the time he purchased this home that a real estate office was permissible, but under Zoning Ordinance No. 771, passed February 26, 196~, said occupation had been deleted. After discussion, he was referred to the Board of Adjustments and Appeals. Letter next received from the Governor's office requesting that the City join in the July #th ringing of bells at l:O0 o'clock P. H., and after discussion, the Mayor aud City Clerk were authorized to execute a proclamation for same. After discussion, and on motion of Commissioner Crapps, seconded by Commissioner Higginboth,m and carried, Commissioner Raborn was authorized to represent the City at the American Municipal Congress held in Miami, Florida, July 25 through 29, 196~. On motion of Commissioner Higginbotham, seconded by Commissioner Raborn and carried, minutes of regular meeting of HaY,..~25, 196~, were next approved.
