The City Gommission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on September 14, 196~. Present: Commissioner A. L. The Chairman announced that the first order of business was a Public Hearing to consider amendments to the Zoning Ordinance, as proposed and described in the following legal notice published in the Sauford Herald on August 28, 196~. NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on September 14, 196~, to con- sider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: Proposed "Conditional Use" addendum to the Zoning Ordinance to provide for Agricultural Uses in all zones. (a) To provide for production of Agricultural products. (b) To provide for construction of greenhouses and other buildings or structures normally associated with the production of agricultural products. Several residents of the Rose Court Subdivision appeared to protest action to permit any agricultural use of property in a RiAA (Single Family Dwelling) District. W. M Philips, 2009 Lilly Court, appeared to present a petition with forty-seven signatures of property owners from the above subdivision, protesting the proposed amendment. P. H. Logan, Attorney, stated that he proposed to construct a home on Grandview Avenue, which abuts vacant property that could be used for agricultural purposes under the amendment, and therefore, opposed the adoption of the amendment. After considerable discussion, Commissioner Crapps moved to deny the proposed amendment. Seconded ~y Commissioner Baker and carried. The next order of business was a Public Hearing to consider rezoning of the property as proposed and described in the following legal notice published in the Sanford Herald on August 28, 1964. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on September 15, 1964, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: MINUTES City Commission, Sanford, Florida, September 1~4 at. 8 Po Fi. 19~ 6# That property lying east of Palmetto Avenue and north of Onora Road is proposed to be rezoned from R-2 (One and Two Family Dwelling) District to R-3 (Multiple Family Dwelling) District. Said property being more particularly described as follows:'- Lots 8 through 12, inclusive, Block #, and that portion of Lot A, Block #, lying west of a certain north/south utility easement, all in Rosalind Heights as recorded in Plat Book 3, Page 47, Seminole County Records. Chester Ott, 113 E. Onora Road, appeared and objected to the proposed rezoning, and stated that this was a bread-down of the Zoning Ordinance. rezoning. John Russell, 3030 South Fiagnolia AVenue, appeared and objected to the proposed Wm. H. Stemper, Realtor, next appeared in support of the proposed rezoning, and submitted pictures of the type of multiple family dwelling units which would be constructed by Fir, Coucher on the aforesaid property. He further stated that there was sufficient play area to the rear of the proposed construction to properly provide for any child~en:~of the tenants, and further, that he anticipated the average rental to be around $100.00 per month. After discussion, Commissioner Higginbotham moved that the property be zoned as advertised, and to authorize the City Attorney to prepare an ordinance pertaining to same. Seconded by Commissioner Raborn and carried. The next order of business was a Public Hearing to consider the rezoning as proposed and described in the following legal notice published in the Sanford Herald on August 17, 196~. NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby giventhat a Public Hearing will be held at the Commission Room in the City Hall in the Oity of Sanford, Florida, at 8:00~16~1ock P. M. on September 14, 1964, to con- sider the following changes and amendments to the Zoning Ordinance of the Oity of Sanford, Florida: To amend Article XI, C-1 Neighborhood Commercial District, Section l, Uses Permitte*, Paragraph (31), to delete dry cleaning operation. To amend Article XII, G-2 General Commercial District, Section l, Uses Permitted, to add Paragraph (12)to provide for the operation of a dry cleaning and laundry establishment. Willie DeBoles appeared with regards to Condemnation Report No. 64-119, and requested 90 days time to demolish the structure at lO19 Persimmon Avenue, and on motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried, the request was approved. Rodger C. Quesnel next appeared regarding Gondemnation Report No. 6~-12#, and reported that the structure covered by the aforesaid report had been demolished, and after same was verified by the Building Official, L. J. Risner, the Commission~?authorized said report to be removed from further consideration. Robert E. Mooney next appeared with regards to Condemnation Report No. 6#-126, and requested 90 days to repair the structure at ll6 Laurel Avenue, and on motion of Oommissioner Crapps, seconded by Commissioner Baker and carried, the request was approved. Professor Harper L. Douglass next appeared as spokesman for the Trustees of Trinity H. E. Church regarding Condemnation Report No. 6~-12~, and requested 90 days to repair or demolish structure at the NW corner of the intersection of Sixth Street and Sanford Avenue, and on motion of Commissioner Crapps~ seconded by Commissioner Baker and carried, the request was approved. After consideration of Condemnation Reports Nos. 6~-103 through 6~-126, excepting the above mentioned reports, Commissioner Crapps moved that the buildings or structures covered by these reports be condemned and the owners given notice of 90 days to repair or remove or give just cause why they are not repaired or removed, and after 90 days to authorize the City to remove the buildings or structures and levy a lien against the prop- erty for the cost of removing. Seconded by Oommissioner Higginbotham and carried. Commissioner. Higginbotham moved that the regular meeting of the Commission be temporarily adjourned ~or the Commission to sit as a Tax EqualizaTion Board, and to call the Tax Equalization Board in~o session. The Commission then proceeded to sit as a Tax Equalization Board and to receive any complaints or objections on the 196~ Tax Roll as prepared by the Tax Assessor and submitted at that time. There being no objections registered, and on motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried, the Commission then approved the 196~ Tax Roll and adjourned as a Tax Equalization Bo~rd. Commissioner Raborn moved to call the adjourned regular meeting back into session. Seconded by Commissioner Higginbotham and carried. Request next submitted for the installation of a street light at the intersection of Oak Avenue and 20th Street, and on motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, same was approved on the recommendation of the Chief of Police. Letter next submitted from the Sanford Housing Authority with reference to con- tracts for utility services executed by the City, and stating the Attorney for the Housing Authority interpreted the action of the Commission in increasing the water rates by Ordi- nance No. 830 as being a Special Rate increase instead of a General Rate increase, and ~herefore, the Housing Authority was not subject to same. Higginbothammoved to authorize the City Attorney to notify the Sanford Housing Authority that said agreement would be terminated at the end of the current period. Seconded by Commissioner Baker and carried. The City Hanager next reported that pursuant to Commissioners authorization at regular meeting of August l~, 196~, that he had contacted the owners of property under consideration for the extension of Glenway Drive, and they had expressed a willingness to donate the necessary right-of-way, upon the rezoning of the abutting area for a proposed development by Shoemaker Construction Company. After consideration, Commissioner Crapps moved to authorize the City to open 2~th Street, west of Mellonville Avenue. Seconded by Commissioner Baker, and same failed to carry over the dissenting votes of Commissioner Higginbotham, Commissioner Raborn and Hayer Wilson. Commissioner Higginbotham next moved to hold a Public Hearing on October 12, 196~, to consider rezoning from Rl~ (Single Family) District to RiA (Single Family) ~istrict, a~ portion of property owned by Mrs A, K. Shoemaker, Sr., and Hrs. Margaret Bowers, located in subdivision of Section 31-19-31 of Dodd, Lord & Dean Subdivision. Said property to be in a plat to be submitted, and said rezoning to cover ali lots except the northerly Tier of ~ lets abutting Cottage Hill Subdivision and Grove Manor Subdivision. Seconded by commissioner Raborn and carried over the dissenting votes of Commissioner Baker and Commissioner Crapps. Estimate No. l, in the amo~tUt of $12,5~6.36, next submitted by the Meridith Corporation for'materials on dob site and work performed to September l, 196~, on Contract "A",, dated June 12, 196~, for Well Construction for the Water Improvement Facilities, and on motion of Commissioner Rabern, second~ by Commissioner Higginbotham and carried, payment of same was authorized from the Const~action Trust Fund of 196~, on approval of consulting engineers, Clark, Dietz, Painter & Associates, the City Engineer and the City Manager. Clark, Dietz, Painter & Associates, Consulting Engineers, next submitted corrected copy oF Estimate Nos. 5 & 6,.covering work on fluoridation equipment design and realign- ment of 25th Street transmission lines for Water Treatment Facilities, same being the mmount of $5~1.0~, and on recommendation of the City Hanager and on motion of Commissioner Baker, seconded by Commissioner Raborn and carried, payment of same was authorized from the Construction Trust Fund of 196~. The City Manager next submitted p~yroll costs, in the amount of $999.55, for extra work by City forces as a result of Hurricane Dora, on September 8 and 9, 196~. Commissioner Baker moved to authorize payment of same, and further, to commend the City personnel for the outstanding work performed during the hurricane and for the man, er in which the City streets and parks were cleared after the hurricane. Seconded by Commissioner Crapps and carried. The City Manager next submitted a recommendation that the Refuse Division be put on a straight work week throughout the year, and in lieu of regular holidays~ to be allowed ~ weeks vacation; and after discussion, and on motion of Commissioner Baker, seconded'by Commissioner Higginbotham and carried, same was authorized to be put into effect immediately. On motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, B. L. Perkins and W. M. Philips were next reappointed to the Beard of Adjustments / MINUTES City Commission, Sanford, Florida,- SePtember l~ at-8 P. Fi. Supply ~o. -- Orlando for terms of 3 years each, beginning Fiarch l~, 1964, and September 8, 196~, respectively. Commissioner Baker moved to have the Commission~notified 3© days prior to the expiration of the terms of each member of the appointive boards, and prior to any notice to the individual of said expiration. Seconded by Commissioner Crapps and.carried. The City Attorney next submitted an agreement from the Seminole County BOard of Public Instruction, proposing to lease for $2,500.00 the Memorial Stadium for 17 football games, to be played by local schools during the fall season, and after discussion and on motion of Commissioner Higginbotham, seconded by Commissioner Raborn and carried, the Mayor was authorized to execute same. The City Attorney next submitted an easement from R. B. Riser and Kate M. Rise~ on property as follows: The West l0 feet and the North l0 feet of the West 90 feet of the followingz Begin 6~ chains East of the SWcorner of Sec 35, Twp 19~, Rge 30E, run thence N 12~ chains, thence W~ 8 chains, thence S 12~ chains, thence E 8 chains to beginning (less N 15 ft previously reserved for road). On motion of Commissioner Higginbotham, seconded by Commissioner Raborn and carried, payment ~r the aforesaid easement in the amount of $1,000.00 was authorized from the Construction T~st Fund of 196~. Consideration next given to property foreclosed by the City from S.tella Knight, and on which she had been permitted to dwell until the structure was condemned by the City,. and further, that Bessie Knight Wilbur had agreed to construct a dwelling for said party, provided the City would convey the property for this purpose. Said property being the East 1/2 of Lot 5, Block lC, Tier C, E. R. Trafford's Map of Sanford. After discussion and on motion of Commissioner Raborn, seconded by Commissioner Higginbotham and carried, the Mayor and City Clerk were authorized to execute a Quit Claim Deed to the aforesaid party, with the stipulation that such action would be conditioned on construction for the purpose out- lined, and such construction would be culminated within one year or the property would revert to .theCGity. Request' next submitted by Sarah Mae Bass for an extort&ion of 60 days on Certifi- cate of Condemnation No. 6~-9~, date4 June lC, 1964, covering property at 1219.W. 8th Street, and on motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, same was approved. Request next submitted by Jeannette Laing for an extension of 60 days on Certifi- cate of Condemnation No. 64-90, dated June lC, 196~, covering property at 804 Holly Avenue, and on motion oY Commissioner Baker, seconded by Commissioner Raborn and carried, same was approved~ Commissioner Crapps nex~ introduced Resolution No. 9~7, and after being read in full, moved on its passage and adoption. Seconded by Commissioner Raborn and carried by the unanimous vote of the Commis~ion. Said Resolution No. 997 being in words and figures as follows: A RESOLUTION OF THE CITY OF SANFORD, FLORIDA APPROPRIATING ~NEXPENDED CASH SURPLUB-ON HAND AT THE END OF THE FISCAL YEAR 196~-196~ TO THE DEPARTMENT OF GENERAL GOVERNMENT OF SAID CITY FOR THE FISCAL YEAR 196~-1965 FOR USE/FOR THE ORDINARY PURPOSES IN OPERATING EXPENSES OF SAID CITY. WHEREAS, the City Commission of the City of Sanford, Florida, deems it necessary, expedient, and for the best interest of said City that any unexpended cash s-~rplus as of MINUTES City Commission, Sanford, Florida, September l# at 8 P. FI. 591 September 30, 196#, of the oDe~a~ing revenues of said City for the fiscal year 1963-196~ be appropriated for the ordinary Purposes and operating expenses of said City in the budget for the fiscal year 196~-1965~ NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that any unexpended cash surplus as of September 30, 196~, of operating revenues of said City for the fiscal year 1963-196~ be and the same is hereby appropriated to the Department of General Government of said City for the ordinary purposes and operating expenses of said ~ity for the fiscal year' ~96~-1965, and said cash surplus shall be in- corporated in the budget of revenues and expenditures of said City for said fiscal year 196~-1965 for the ordinary purposes and operating expenses of said City. Seconded by Commissioner Higginbotham and carried by the unanimous vote of the Commission. Said Resolution No. 998 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, ADOPTING A BUDGET OF REVENUES AND EXPENDITURES FOR THE CITY OF SANFORD, FLORIDA, FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 196~ ~ AND ENDING SEPTEMBER 30, 1965. WHEREAS, in accordance with Section 62 of the Charter of the City of Sanford, Florida, the City Manager of the City of Sanford, Florida, has made and submitted to the City Commission of the City of Sanford, Florida, an estimate for budget of revenues and expenditures of the City of Sanford, Florida, for the fiscal year beginning October 1,196~, and ending. September 30, 1965, such estimate or budget having been made with particular application to the various departments of the City, a tz~ae copy of which is hereto attached and by reference made a part of this Resolution, and WHEREAS, each and every item contained and set forth in said budget prepared by the City Manager has been carefully considered by this Commission, N~ THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that said budget as prepared and submitted by the City Manager to the City Commission' be, and the same is hereby adopted as the budget of the City of Sanford, Florida, for the fiscal year beginning October l, 196~, and ending September 30, 1965. BE IT FURTHER RESOLVED that upon collection of any revenues of said City, the City Clerk shall allocate from each dollar collected and received, the several amounts to the respective funds for purposes for which the same are hereby authorized and ,.appropriated. FI. 605 Commissioner Crapps next introduced Ordinance No. 839, entitled~ AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, DECLARING ITS INTENTION TO ANNEX TO THE COR- PORATE LIMITS OF THE CITY OF SANFORD, FLORIDA, AND TO MAKE A PART THEREOF AT THE EXPIRATION OF THIRTY (30) DAYS FROM THE EFFECTIVE DATE~'OF THIS ORDINANCE THE EAST 250 FEET OF LOTS AND 4, AMENDED PLAT OF DRUID PARK, AS THE SAME APPEARS IN THE OFFICE OF THE CLERK OF THE CIR- CUIT COURT, SEMINOLE COUNTY, FLORIDA, PURSUANT TO THE PROVISIONS OF CHAPTER 171.04, FLORIDA STATUTES, 1963. and on motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried, same was placed on its first reading and read in full. After discussion, Commissioner Higginbotham moved to authorize J. G. Chapman, Architect, to prepare working plans and drawings for construction of an additional recrea- tional facility, not to exceed a total cost of $68,000.00~ to be paid for oUt of future capital improvement funds. On motion of Commissioner Raborn, seconded oy Commissioner Crapps and carried, current vouchers and payrolls were next approved as evidenced by General Fund ~lorida State Bank Vouchers No. 8413 through 8587, General Fund SanI'ord Atlantic National Bank Vouchers No. 9153 through 9210~ and Water and Sewer Revenue Sanford Atlantic National Bank ¥ouchers No. 815 through 839. On motion of Commissioner Ra0orn~ seconde~ 0y Commissioner Higgin0otham and carried., minutes of regular meeting of August 24, 1964~ werenext approved. On motion of Commissioner Higginbotham, seconded by Commissioner Crapps and carried, transfer of $2,475.00 was authorized from Account No. 9850 to Account No. 9107, to provide for Commission Expense Account. Request next submitted by S. J. Davis~ Attorney, for the Garden Club, for a Quit Claim Deed to further delineate a certain utility easement held by the City in Lot Sunland Estates Subdivision, and after consideration and on motion of Commissioner Higgin- botham~ seconded by Commissioner Baker and carried, the Mayor and City Clerk were authorized to execute same. Estimate No. 2, in the amount of $69,848.46, next submitted by the Cambron Con- struction Company, Inc., for materials on job site and work performed to August 31, 196~, on Contract "C", dated June 29, 196#, for Main Transmission Lines for the Water Improvement Facilities; and on motion of Commissioner Raborn, seconded by Commissioner Higginbotham and carried, payment of same was authorize from the Construction Trust Fund of 1964, on approval of the consulting engineers, Clark, Dietz, Painter & Associates, the City Engineer and the City Manager. On motion of Commissioner Baker, seconded by Commissioner Crapps and;carried, Finance Director H. N. Tamm, Jr., was appointed acting City Manager during the absence of the City Manager W. E. Knowles from the City from September 27 to October l, 1964. On motion of Commissioner Higginbotham, seconded by Commissioner Crapps and carried, the meeting was adjourned until 8:00 o'clock P.
