First order of business was a request submitted by the Church of Christ for the ~-~ installation of a street light at 1400 West 17th Street, and on recommendation of the Chief ~ of Police and on motion of Commissioner Crapps, seconded by CommissiOner Higginbotham and carried, same was approved. Herbert Cherry, Realtor, next appeared to submit a request from the Good Samaritan Home, 80~.M~berry Avenue, to close and vacate an east-west alley intersecting their property. The City Manager reported an estimated cost of $1,961.~0 to reroute the sewer.now located in said alley. After discussion, the City Commission authorized the City Manager to meet with Herbert Cherry and the architect for the Good Samaritan Home to determine if alter- nate plans could be designed. Commissioner Baker next introduced a Resolution authorizing an agreement with the Atlantic Coast Line Railroad Company, and after being read in full, moved on its passage and adoption. Seconded by Commissioner Higginbotham and carried. Said Resolution being in words and figures as follows: RESOLUTION Be it resolved by the City Commissioners of the City of Sanford, Florida, in regular meeting assembled that the MAYOR-COMMISSIONER of said City be, and he hereby is, authorized I to enter into an a~eement with the ATLANTIC COAST L~NE RAiLROaD COMPANY. ~d t~ ~ ~m~ on behalf of said CITY, Whereby said Railroad Company grants unto said City the right or licens~ to install and maintain, for the purpose of water mains, lines of cast iron pipe across the rights of way and underneath tracks of said Railroad Company at Sanford, Florida, as more particularly described in said agreement, which agreement is dated September l, 1964, a copy of which agreement is filed with these City Commissioners. James Graham Chapman, Architect, next submitted a contract for working plans and drawings on a proposed recreation center, and on motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried,, the Mayor and City Clerk were authorized to execute said contract, after the elimination of the paragraph pertaining to a method of arbitration, and including a provision for all tracings and drawings to be the property of the City. Maurice Connell & Associates next submitted a contract for designs and specifica- tions on the proposed Lake Front Development. On motion of Commissioner Higginbotham, seconded by Commissioner Raborn and carried, the Mayor and City Clerk were authorized to execute said contract~ after the elimination of the paragraph pertaining to a me~hod of arbitration, and including a provision for all tracings and drawings to be ~he property of the City. Commissioner Higginbotham then moved on the waiver of the requirement of the second reading of Ordinance No. 840, and that same be placed on its final passage and adoption. Commissioner Higginbotham next introduced Ordinance No. 852, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, DECLARING ITS INTENTION TO ANNEX TO THE CORPORATE LIMITS OF THE CITY OF SANFORD, FLORIDA, AND TO MAKE' A PART THEREOF AT THE EXPIRATION OF THIRTY (30) DAYS FROM THE EFFECTIVE DATE OF THIS ORDINANCE, LOTS 28 THROUGH 37 INCLUSI~,E, AMENDED PLAT OF DRUID PARK, AS THE SAME APPEARs IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT, SEMINOLE COUNTY, FLORIDA, PURSUANT TO THE PROVISIONS OF CHAPTER 171.04, FLORIDA STATUTES, 1963. and on motion of Commissioner Higginbotham, seconded by CommiSsioner Raborn and carried by the unanimous vote of the Commission, same was placed on its first reading and read in full. After discussion, Commissione~ B&ker moved to notify each property owner whose prope; is included in any Ordinance of intent to annex, after same has been placed on its first reading; and further, to send each property owner a copy of the Legal Advertisement, upon the adoption of an ordinance of the intent to annex. Commissioner Higginbotham next introduced Ordinance No. 843, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINanCE NUMBER 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLA2~ WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT TRANSFERRING CERTAIN TERRITORY FROM R-2 (ONE AND TWO FAMILY DWELLING) DISTRICT, TO R-3 (MULTIPLE F~ILY DWELLING) DISTRICT. and on motion of Commissioner Higginboth,m, seconded by Commissi0ner'Raborn and carried by the ~muamimous vote of the Commission, same was placed on its first reading and read in full. Mr. CouCher,.owner of the aforesaid property, next appeared' in support of the proposed ~oning, and said he proposed to construct 12 apartments initially at a cost of approximately $75,000.00. On motion of Commissioner Raborn, seconded by Commissioner Baker and carried, further action on Ordinance No. 855 was tabled until the next regular meeting on October 12, Commissioner Higginbotham next introduced Ordinance No. 8#1, entitled: ANORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ARTICLES XI AND XII OF ORDINANCE 771 OF SAID CITY, AS AMENDED, BY ELIMINATING DRY CLEANING OPERATION IN C-1 (NEIGHBORHOOD COMMERCIAL) DISTRICT, AND PERMITTING OPERATION OF DRY CLEANING AND LAUNDRY ESTABLISHMENTS IN C-2 (GENERAL COMMERCIAL) DISTRICT. and same was placed on its first reading and read in full. The City 'Manager next reported that John Abrahams, Water Plant Superintendent, and J. L. Dunn, Parks Superintendent, would retire from the City on October l, 196~, and after discussion, the City Attorney was authorized to prepare resolutions of commendation for their service. Request next submitted by Isadore Morgan, d/b/a Morgans Place, 121g West 13th Street, for the transfer to Ocie Morgan of a license for the sale of beer and wine for consumption on premises; and on motion of Commissioner Higginbotham, seconded by Commissioner Crapps and carried, same was approved on the recommendation of the Chief of Police. The City Manager next reported that he had received a telephone call from H. L. Hunt COmpany in Dallas, Texas, stating they were considering having a representative appear before the Commission to request special consideration in their water rates for their plant. on South Sanford Avenue; and after discussion, Commissioner Baker moved that the standard rate for consumers outside the City Limits would apply. Seconded by Commissioner Higginbotham and carried. After discussion, the Chief of Police was authorized to check the ownership of cars utilizing the City parking lot at Second and Oak Avenue, and report to the Commission. Check next submitted to the City. from the Florida Power & Light Company, in the amount of $231.05, for the interrupted service in street lights~ from hurricane "Dora". The Sanford Chamber of Commerce nex~ submitted a statement, in the amount of $~16.~3, for expenses incurred in the statewide promotion of Florida Conservation Week to be celebrated in Sanford; and further, requested a contingency account in the amount of $500.00, for further anticipated expenses. After discussion, Commissioner Baker moved to approve payment of $~16.#3 for monies expefided to date. Seconded by Commissioner Crapps and carried over the dissenting vote of Commissioner Higginbotham. Commissioner Crapps next introduced Ordinance No. 8~4, entitled: AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, MAKING IT UNLAWFUL FOR ANY PERSON TO MISTREAT, INJURE, KILL OR MOLEST ANY CITY POLICE DOG OR TO INTERFERE WITH THE FUNCTIONS OF SUCH POLICE DOG. and on motion of Commissioner Crapps, seconded by Commissioner Raborn and carried by the unanimous vote of the Commission, gaid Ordinance No. 8~?I was placed on its first reading and read in full. On motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried, the City Attorney and City Clerk were next authorized access to safety deposit box No. 177 in the Sanford Atlantic National Bank, for the annual audit. On motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, minutes of regular meeting of September 10, 196~, and adjourned regular meeting of September 15, 196~, were next approved. MINUTES City Commission, Sanford, Florida, September 28 at 8 P.M. 1964. . 611 Consideration next given' to truck traffic on First Street west of Oak Avenue, and same was referred to the Chief of Police and City Manager for investigation. Consideration next given to the use of a portion of the second floor of the City Hall by the Sanford Chamber of Commerce; and after discuSsion, and on motion of Commissioner Higginbotham, seconded by Commissioner Raborn and carried, said organization is to be notified that at the end of 90 days they will be expected to vacate the City Hall, and that in the future the City Hall would house only those functions pertaining to City business. Commissioner Baker next outlined the need of a bus line for local transportation, and further, stated that of 56 bus lines in municipalities in Florida that only six were owned and operated by the municipalities. After considerable discussion, Commissioner Baker moved to investigate the feasibility of obtaining services of a bus line in the City of Sanford, and further, to contact Mr. C. W. Elrod, owner of the Yellow Cab Company and holder of a bus line certificate from Florida Railroad Commission, to determine if he would be interested in operating such a facility, and if not, to contact existing independent firms in other mmuicipalities, to determine if 'they would be interested in such a proposal. Seconded by Commissioner Raborn and carried. On motion of Commissioner Baker, seconded by Commissioner Cr~pps and carried, payment to Seminole County was authQrized, in the amount of $1,792'.89, for their prorata share of monies received from the Bernarr MacFadden Corporation, on mortgage on properties of the Sanford Naval Academy. There being no further business, the meeting adjourned.
