Fla. :. · ; The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sa~ford, Florida, at 8:00 o'clock P. H. on Dedember 28, 196~. Present: Commissioner A. L. Wilson, Hayor " Joe B. Baker " J.H. Crapps " Earl Higginbotham " H.L. Rabor~, Jr. City Attorney Wm. C. Hutchison, Jr. City Manager W. E. ~owles City Clerk H. L. Whelchel Deputy Clerk Rosa M. Rotundo Police Chief R. G. Williams The meeting was called to order by the Chairman. James Graham Chapman, Architect, next appeared a~d submitted the completed plans and final working drawings and specifications for the pre.posed recreation center, a~d pre- senSed'i a statement for $780.00 for the balance due on the contract for the completed pla~s. After discussion, and on motion of Commissioner Crapps, seconded by Commissioner Higgin- botham and carried, payment of $780.00 was authorized upon approval of the City Manager. Ke~ueth W. HcIntosh, Municipal Judge, next appeared and tendered his resiguation, due to his election as Prosecuting Attorney for the County, and thanked the City Commission, City Manager, City Attorney, the Clerk's Office and the Police Department for their co- operation. Commissioner Higginbotham moved to accept his resignation with regrets, and to authorize the City Attorney to prepare a resolution commending Judge McIntosh, seconded by Commissioner Raborn and carried. Consideration next given to the closing hour for bars selling alcoholic beverages for New Year's Eve; and on motion of Comm~.ssioner Higginbotham, seconded by Commissioner Crapps, and carried over the dissenting votes of Commissioner Baker and Commissioner Wilson, the bars were authorized to remain open until 2:00 o'clock A. H., to coincide with the Hayfair Inn and the Valdez Hotel. Commissioner Higginbotham moved that in the interest of making it fair and equal, that the City Attorney be authorized to prepare an ordinance authorizing restaurants seating 200 or more and serving alcoholic beverages be allowed to remain open until 2:00 o'clock A. H., to coincide with the Valdez Hotel and the Hayfair I~u. Seconded by Commissioner Crapps, and failed to carry over the dissenting votes of Commissioner Baker, Commissioner Raborn, and Comm~:ssioner Wilson. Commissioner Baker further stated that the State and Federal Government say that liquor is, and can be dangerous and needs control; and that the hours the City is allowing are sufficient; a~d that the Commission has a responsibility to the citizens of S~uford, and these citizens, as a .group, have not requested this extension of time. Commissioner Raborn further stated that changes in the ordinance to permit 2:00 o'clock A. M. closing for these places would set a further separation in the closing hours, and that a 2:00 o'clock A. H. O~.er&l~ closing is not the feeling of the people. Reverend R. J. Boyi~gton next appeared and asked if an early closing for the other establishments would not be better, and requested that the Commission consider this from a Chistian view. Commissioner Raborn moved to table the discussion until a recommendation f~om the counties and cities from the south of Sanford could be obtained, and to work for a unified time, and same died for lack of a second. Commissioner Crapps further stated that he agreed with the Reverend that the::¢ Commission represents the people, but the Commission cannot regulate their religious or moral obligations. The only thing the Commission can regulate is business hours, a~d from a mercenary standpoint, the Commission should not discriminate between legal business houses in the City, and others outside the City. Commissioner Crapps moved to authorize the City Attorney to prepare an ordinance to conform with Seminole County's closing hours for places serving liquors, seconded by Commissioner Higgonbotham, and same failed to carry with thedissenting votes of Commis- sioner Baker, Commissioner Raborn and Commissioner Wilson. Request next received for a transfer of $1,687.00 from Contingency Account No. 8150 to Police Equipment Account No. 2256, for purchase of police cars, and on motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried, same was authorized. Clark, Dietz, Painter & Associates, Consulting Engineers, next submitted State- ment No. 8-A, covering specialized engineering services during the construction of water storage t~ks for the Water Treatment Facilities, same being the amount of $589.50, and on recommendation of the City Manager, and on motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried, payment of same was authorized from the Construction Trust Fu~d of 1965. Consideration next given to the adoption of a revised issue of the Plumbing Code, and after discussion, Commissioner Baker moved to authorize the City Attorney to prepare an ordinance pertaLui~gto same, seconded by Commissioner Raborn ex~d carried. Commissioner Baker next introduced Ordinance No. 856, entitled: AN ORDINANCE OF TEE CITY OF SANFORD, FI~RIDA, ANNEXING TO SAID CITY AND Y~_KING A PART THEREOF THE EAST 250 FEET OF I~TS l, 2, 3 and $, AMENDED PLAT OF DRUID PARK, AS THE SAME APPEARS IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT, SEMINOLE COUNTY, FLORIDA, PUR- SUANT TO THE PROVISIONS OF CHAPTER 171.05, FLORIDA STATUTES, 1963. and same was placed on its first reading and read in full. Commissioner Baker then moved on the waiver of the requirement of the second reading of Ordinance No. 856, and that same be placed on its final passage and adoption. Seconded by Commissioner Higginbotham and carried. Commissioner Baker next introduced Resolution No. lO0~, a~d after being read in full, moved on its passage amd adoption. Seconded by Commissioner Raborn and carried. Said Resolution No. lO0~ being in words and figures as follows: A RESOLUTION OF THE CITY OF SANFORD,~: FLORIDA, CHANGING THE NAME OF LINCOLN STREET AS PRESENTLY DEFINED WITHIN THE CITY OF SANFORD, FLORIDA, TO GROVE MANOR DRIVE. WHEREAS, there presently exists within the City of Sanford, Florida, in Grove Manor, a street defined and named as Lincoln Street, and WHEREAS, upon request of interested parties it is deemed desirable to change the name of said street, NOW ~REFORE, BE IT RESOLVED by the City Commission of the City of Sa~ford, iFlorida, that Lincoln Street, as the same is presently defined within the City of Sanford, Florida, will henceforth be named a~dknown as Grove Hanor Drive. Judge Vernon Mize next introduced a ResolutiOn endorsing the establishment of a Oommunity Junior College, and after being read in full, Commissioner Higginbotham moved on ~ts passage and adoption. Seconded by Commissioner Crapps a~d carriedl, unanimously. RESOLUTION WHEREAS, the Board of City Commissioners of Sanford, Florida, is aware of the tremendOus growth of Sanford and Seminole County, Florida, the population of Sanford and Beminole County being predicted to be in excess of lO0,O00 people by 1970, and WHEREA~~, approximately ~00 graduates of the Sanford High Schools in 196& have no ipublic higher educational facilities available to them within a reasonable commuting dis- ~ance of their homes, and WHEREAS, many of the capable students of Sanford and Seminole County who are not ·ttending college because of financial or other reasons would pursue higher educational training if local facilities within commuting distance of Sa~ford were available, and WHEREAS, the lack~.of such opportunity creates a great cultural gap in cur com- i mun ty and society, MINUTES City Commission, Sanford, Florida December 28 at 8 P. NOW, THEREFORE, BE IT RESOLVED that the Board of City Commissioners of Sanford, Florida, go on record'as endorsing a~d supporting the establishment of a Community Junior College in Seminole County, and BE IT F~ RESOLVED that the Board of City Commissioners of Sa~ford, Florida, pledges complete cooperation with the Seminole County Board of Public Instruction, the State Junior College Board, the Florida State Board of Education, the BOard of County Commmissioners of Seminole County, Florida, and the State Legislature, in an effort to establish a Community Junior College in Seminole COunty. Vernon PIize, Jr., be contacted a~d asked if he would be in position to accept appointment as PIunicipal Judge of the Ciiy of Sanford, Florida; Commissioner Raborn seconded, and same was carried. Consideration next given to a street right of way for the southerly extension of Glenway Drive to Twenty-fourth Street from its present terminus in Cottage Hill Subdivision, and after discussion, Commissioner Higginbothammoved to authorize the roughing in of the 60 foot right of way when the deeds are received by the City from Hrs. A. K. Shoemaker and Mrs. PIargaret Bower. Seconded by Commissioner Baker and carried. There being no further business, the meeting adjourned. ATTEST: PIAYOR
