The City Commission of the City of Sanford, Florida, met in regular session at the
City Hall in the City of Sanford, Florida, at 8:00 o'clock P. H. on September 13, 1965.

The Chairma~called the meeting to order.
The first item of business was a request to transfer funds within the Maintenance
Division accounts for general maintenance a~d repair work on the General Sa~ford Hemorial
Library.
It was moved by Commissioner Higginbotham, seconded by Commissioner Baker and
carried that $400.00 be transferred from the Christmas Lights Account No. 4682 to Building
Maintenance Account No. 4621 for this purpose.
Next u~der consideration was an application from Charlie Hampton requesting a~0occu-
pational license to operate a taxicab.
After some discussion, it was moved by Commissioner Higginbotham, seconded by
liCommissioner Baker a~d carried to de~y the request. It was the consensus of opinion that
u~til such time that taxicab rules and regulations were drawn 'ap a~d put into effect for a
certain criteria to follow, it was recommended that these requests be held in abeyance.
Whereby the City's Zoning a~d Planning Commission, under public hearing on
iSeptember 2, 1965, had denied a request of Mr. C. J. Hixon to rezone from R-5, residential
one and two family dwelling district, to C--2, General CommerCial, a ~2-foot piece of prop-
i]erty on the west side of Hulberry AvenUe, north of West l~th Street, his request for an
iiappeal of the denial was next submitted to the Commission for consideration.
and Mr. Hixon stated that this property.is an area of ~2 feet wide by 51 feet in depth
adjacent to the north of the commercial property that is the site of the Hixon Furniture
Store at the corner of Mulberry Avenue a~d West 13th Steeet. He further stated that he was
contemplating the operation of a used car lot, and had obtained a permit to construct a
structure for an office on that portion already zoned commercial; but, would require the
i}additional rezoned to commercial in order that there would be sufficient space

ia which to park Cars. Therefore, he had proceeded with tearing dow~ an old garage and
!iputting up a chain link fence.
No one appeared at this meeting with regard to opposing the request.
It was~moved by Commissioner Higginbotham, seconded by Commissioner Crapps a~a
carried that through the proper legal advertisement and notice to the surrounding property
owners that a Public Hearing for the rezoning of the south ~2 feet of the east 51 feet of
Lot 8, Robinson's Survey, be held by the City Commission at the next meeting of September 27,
1965.
Consideration was next given to a request of a~ appeal by Mr. A. B. Peterson, Sr.,
pertaining to the rezoning denial by the Zoning and Plan~ing Commission of the property of
~Mr.} Howard L. Hughes at Sarita Street a~d 25th Street.
Mr. Peterson, representing Mr. Hughes and Mr. Wesley S. Woodson, stated that Mr.

with Lots ll and 35 and Lots l0 and 35 zoned R-lA residential. Mr. Wesley S. Woodson is
proposing the'construction of a $53,000.00 Burger Chef structure on the property in question,
requiring the rezoning to commercial, whereby the~firm contemplated an 80-foot set back from
French Avenue to facilitate the drive-in off-street parking and the building~itself to be
60 feet in depth.
Appea~i~g in behalf of the rezoning appeal was Mr. Don Witt of 613 West 25th Street,
property owner of a residence-situated on Lot 33 and west one-half of Lot 35, due west of
Mr. Hughes' property. He opposed the rezoning due to lights and noise that would be created.
Mrs. Esther (James Clay) Williams~ owner of vacant Lets 12 and the west one-half
of Lot ll, appeared and voiced objection to the rezoning on the basis of blowing trash,
garbage cans at thenew alley easement abutting her property, noise and lights. Hrs.
Williams, herself, resides to the south of her vacant property a~d the property under the
rezoning appeal on Iroquois Avenue in the Dreamwcld Subdivision.
Commissioner Crapps stated that Hr. Jimmie Terwilliger, who lives to the south of

this location and just beyond 300 feet, had stated to him that he was/opposed to the re-
zoning, but felt that consideration should be given to a recommendation to the proposed
purchasers to situating the building on the eastern portion of the property, rather than
placing it on the westerly portion.
Where~ the Zoning Ordinance requires fencing only if two pieces of property, one
in a commercial zone and one in a residential zone, abutt as a common property line, the
Commission suggested that Mr. Peterson converse wither. Woodson regarding the placement of
a four to six-foot fence along the westerly portion of the property to alleviate the factor
of blowing trash, unsightly garbage containers, and the glare of automobile headlights,
from the abutting residences to the west of this property. The rezoning being predicated
on the placing of fencing. It was also suggested to Mr. Peterson that a layout sketch of
the construction on the property would be most helpful.
After a lengthy discussion, Commissioner Higginbothammoved that through the proper
legal advertisement and notice to the surro'~uding property owners that a Public Hearing for
the rezoning of east 15 feet of Lots ll and 35, Lets l0 and 35, Block 9, Dreamwo~d, be held
by the City Commission on September 27, 1965. Motion was seconded by Commissioner Baker
and carried.
A Public Hearing was scheduled for this date regarding the previous request cf Mr.
A. B. Peterson, Sr., for the abandoning of the south one-half of the public alley abutting
Lets 6 through 9-A and Lot lC, Block 9, Dreamwold, due to the fact that the north one-half
had already been abandoned by the City on the request of Hr. Hughes in 1955. Mr. Hughes,
in turn, deeded te the City a 15-foot public alley easement on the westerly portion of the
east one-half of Lots ll and 35. Mr. Peterson pointed out that the alley abandonment would
be essential in the ccmmercial'construction of the Burger Chef on Mr. Hughes' property.
There was no objection voiced regarding the request for closing of this south portion of the
alley.
Whereby the vacating request to abandon the public alley, plus the cost of reloca-
ting the sewer line in this alley is to be borne by Mr. Hughes and this being predicated on
the rezoning of the property, it was moved by Commissioner Higginbotham, seconded by Commis-
sioner Baker and carried that'the public~hearing on the vacating reqUest be tabled until the

Included in the above discussion concerning rezoming requests presented to the
Zoning a~d Pl_~ing Commission, it was moved by Commissioner Baker, seconded· by Commissioner
Higginbotham and carried that copies of the minutes of all future., meetings of the Zoning and
Plau~ing Commission be forwarded to the City Com_missio~ in, order that they might keep abreast.

The above motion also included that the Zoning, and Pla_~ing Commission study the
Zoning Ordinance on the present requirement of fences where residential property and com-
mercial property or zoning abutt with recommendation for amending the requirement where there
is a public easement or right-of-way.
Commissioner Crapps next i~troduced Resolution No. lOll,, and after being read in
full, moved on its passage and adoption. Seconded by Commissioner Baker and carried by the
u~animous vote of the Commission.

OF REVENUES AND EXPENDITURES FOR THE CITY
OF SANFORD, FLORIDA, FOR TEE FISCAL YEAR
BEGINNING OCTOBER l, 1965, AND ENDING
SEPTEMBER 30, 1966.
WHEREAS, in accordance With Section 62 of the Charter of the City of Sanford,
Florida, the City Ha~ager of the City of Sanford, Florida, has made and submitted to the
City Commission of the City of Sanford, Florida, an estimate for bUdget of revenues and
expenditures of the City of Sanford, Florida, for the fiscal year beginning October l, 1965,
and ending September 30, 1966, such estimate or budget having been made with particular
application to the various departments of the City, a true copy of which is hereto attached
and by reference made a part of this Resolution, and
~, each and every item contained and set forth in said budget prepared by
the City Ha~ager has been carefully considered by this Commission,
NOW, ~FORE, BE IT RESOLVED by the City Commission of the City of Sanford,
Florida, that said budget as prepared and submitted by the City Hanager to the City Commis-
sion, be and the same is hereby~adopted as the budget of the City of Sanford, Florida, for
the fiscal year begiuning October l, 1965, and ending September 30, 1966.
BE IT FURT~ RESOL'fED that upon collection of a~y revenues of said City the Clerk
fshall allocate from each dollar collected and received, the several amounts to the respective
?~fu~ s for purpose~ for which the same are hereby authorized and appropriated.
BE IT FURTHER RESOLVED that this Resolution shall become effective as of the first
.~tday of October, A.D. 1965.

It was brought to ~he Commission's attention that ~r. Ernest Southward had requested
consideration of a~uexation of his property on the east side of Virginia Avenue, just north
of Second Street in order that he might receive City utilities, but ,~=eximg to be restricted
to the portion of the property that he builds his residence on; not to include that portion
of the property that a local contractor would be building houses on for future sales.
It was moved by Commissioner Higginbotham, seconded by Commissioner Crapps and
carried that the property, at the above mentioned location and owned by Mr. Southward, be
approved for a~uexing to the City on the basis that the a~exing is applicable only to the
:i
property where his futUre .residence will be situated and after signing of the proper petition
the City utility of water only will be made available to this residence.
Consideration was next given to a verbal request of Hark Sanders for occupational
City license for the operation of a taxicab.
It was pointed out that due to Hark Sander's drivers license being revoked several
years ago, he had t,~rned over his City occupational license to a party by the name of Calhou~
to operate under.
After lengthy discussion on this matter and the proposed rules and regulations to
be drawn by the City for these taxicab operators to be licensed under, it was moved by Com-
missioner Baker, seconded by Commissioner Higginbotham, with Commissioner Crapps opposing, to
itable the request until these regulations were adopted.
