122765-Regular SessionMINUTES I 169 '" · City Commission,.Sanford, Florida December 2~ at 8 P.M. 1965 The City Commission of the City of S~uford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. H. on December 27, 1965. Present: Commissioner H. L. Raborn, Jr., Mayor " J.B. Baker " J.H. Crapps " Earl Higginbotham " A.L. Wilson City Attorney Wm. C. Hutchison, Jr. City Manager W. E. Kuowle s City Clerk H. L. Whelchel Police Chief A. S. Williams The meeting was called to order by the Chairman. The first item of business was consideration of a request from Kenneth H. Leffler of the law offices of Hutchison and Leffler, for the City to repair and/or install sidewalks a~d curbs on the southeast;corner of Park Avenue and F~jtton Street for the Park-Fulton Building under construction at present, with the law firm agreeing to pay for the cost of materials used. After discussion, Commissioner Higginbothammoved that authorization be granted for the City to furnish the labor and equipment with the property owner paying for all material cost, as requested, seconded by Commissioner Crapps and carried. Clark, Dietz, Painter and Associates, Consulting Engineers, next submitted State- ment No. 6013, dated December 10, 1965, covering engineering services on agreement, dated July 27, 1965, for consulting engineering services for Lakef~ont Development, Hari~a. This statement consisting of all work done from beginning date of agreement through December 10, 1965, in the amount of $7,996.37, of which the amount requested at this time was a part payment of $5,000.00, leaving a balance due of $2,996.37; and on recommendation of the City Manager, Commissioner Wilson moved to authorize the partial payment from the General Fund, with reimbursement to said fund upon the sale of the revenue certificates of the Lakefront Development Project bond issue when sold, seconded by Commissioner Crapps and carried. Request next received from Jerry Jernigan and E. C. Harper, Jr., local businessmen, for the need of a street light at the north side of Second Street between Park and Magnolia Avenues at the alley entrance. On recommendation of the City Manager that consideration be ?given to an overall program of downtown lighting system, rather than on the baSis of mid- i!block single unit spot lighting, Commissioner Crapps moved to hold the individual street i!light request in abeyance until the City Commission reviews the coming budget for 1966-67, il and an overall study of the downtown lighting program for Commercial Avenue, Second Street 'and Third Street could be presented at this time, seconded by Commissioner Wilson a~d carried. Letter of resignation next resubmitted by Dr. W. Vincent Roberts as Chairman of the Civil Service Commission, requesting that he be relieved of his duties persuant to taking office as a City Commissioner; and on motion of Commissioner Higginbotham, seconded by Commissioner Crapps and carried, the resignation was accepted. Consideration next given to the appointment to the Civil Service Board to fill the vacancy now create~. Commissioner Baker then moved to appoint Donald R. Jones to the Board to fill the vacancy and unexpired term caused by the resignation of Dr. W. Vincent Roberts, with the appointment to be effective December 27, 1965, expiring July 13, 1966, Completing the unexpired two year term of Dr. Roberts. Seconded by Commissioner Higginbotham and carried by the unanimous vote of the Commission. Commissioner Higginbotham next introduced Resolution No. lO17, and after being ,iread in full, moved on its passage and adoption. Said Resolution No. 1017 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, SUPPT.MMENTING COMPULSIVE RETIREMENT OF CITY ~LOYEE PERSONNEL AS HERETOFORE ESTABLISHED IN RESOLUTION~R 1008 ADOPTED MARCH 22, 1965. WHEREAS, the City Commission did on March 22, 1965, bYlthe adoption of Resolution No. 1008, establish compulsory retirement at age sixty-five for department heads, division superintendents, police department officers and fire department officers, and WHEREAS, in<order to see that the residents of the City, as well as employees of the City, receive the maximum benefit from employment, and that the interests of the public and the City are best served through it employment program and the incentives provided thereby, it is deemed necessary and desirable to expand those employees of the City not presently covered, NOW THERE~RE, BE IT RESOLVED by the City Commission of the City of Sanford, Florids tha~rsaid Resolution No. 1008 be amended by including therein all employees of the City except laborers. BE IT FURTRER RESOLVED that Parag~Dh ~ of said Resolution be deleted in its entirety, and in lieu thereof the following inSerted: "~. Employees desiring to continue work for the City of Sanford after reaching retirement age may submit a written request for such continued employment to the City Commission through the office of the City Manager. Such request shall be made on an annual basis. The City Commission, if it deems that it will be in the best interests of the City, such employee and all personnel in the department affected by subh employee may approve such request and continued employment, provided, however, that such approval on any single application shall not extend for a period exceeding one year." BE IT FURTHER RESOLVED that this Resolution be spread upon the minutes of City Commission and the same shall become effective January l, 1966. Baker As the City Commission of the City of Sanford, Florida Request for continued employment with the City was next received from James T. Hardy, Sr., who is above the age of 65 years. On recommendation of department head Police Chief A. S. Williams, and City Manager, and after consideration, Commissioner Higginbotham moved that the application request for continued employment of James T. Hardy, Sr., be approved, seconded by Commissioner Wilson and carried. Request for continued employment with the City was next received from Everett H. Craft, sanitary landfill operator of the refuse division, who has reached the age of 65 years. On the recommendation of the refuse superintendent and the City Manager for disapproval, and after consideration, Commissioner Baker moved that the request for continued employment be denied on the basis that it would not be in the best interest of the City of Sanford; seconded by Commissioner Higginbotham and carried. Discussion next given to upgrading the City's accounting processes with electronic data processing. Fla. -, ,~ ' J: ,.. ',., , that the two old Burroughs billing machines are slow and require constant repairs, and that increased utility billing has created a bottleneck in the work process. It was noted that data processing would eliminate the. need to replace this type of billing machine and would be of great assistance to the finance department, as it would be used for tax and license billing, payroll, budgetary accounting, and preparation of monthly fiscal reports, as well as other reports deemed necessary. After discussion, Commissioner Wilson moved to proceed with the investigation of this type of equipment, checking further into when the equipment would become obsolete, and obtaining a firm cost with no commitment for purchase at this time. Seconded by Commissioner Baker and carried. The City Manager next submitted the following tabulation of bids which were opened publicly at 2:00 o'clock P. On motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, the minutes of regular meetings of November 22, a~d December 13, 1965, and special meeting of December 8, 1965, were next approved. Discussion next given to the request of Alix of Miami, Sanford Plant, now owned as a division of Johnatha~Logan, recognized as one of the largest garment manufacturers in the United States, requesting water and sewer lines be placed at their plant on South Orlando Highway 17-92. After discussion, Commissioner Wilson moved that upon signing the proper annexation petition that water only be furnished to the said property line under the:~following conditions: l, The City would run a 12-inch water line south of east side Highway 17-92 from present stub-out provided for such line. 2. Alex of Miami to pay an amount equal to the cost of an 8-inch line only, ru~ning the same distance, not to include the cost of installation. 5. Alex of Miami to pay all cost involved in tapping a~d bringing the desired 8-inch cast iron line across Highway 17-92 to their building, including the cost of a water meter installation. 4.That until such time as the property was legally amaexed to the City, Alix of Miami would pay the outside City limit rates on the utility. · The above motion was seconded by Commissioner Higginbotham and carried. On recommendation of the City Manager, Commissioner Crapps moved to approve the cost of purchasing one new 6-inch water meter to keep in stock in case one of the three now in service should mai-function, seconded by Commissioner Higginbotham and carried. Orl,n~ln. ~la. out the City, and the pavement repairs to jack the curb sections would be extensive and expensive and was not feasible at this time, seconded by Commissioner Baker and carried. Consideration next given to a request of John H. Gainey for an exempt City occupational license fee of $50.00 of the $75.00 fee charged for an embalmer and funeral director at the location of 900 Locust Avenue, doing business as BurtOn's Funeral Home. The request was based on John H. Gainey being a disabled veteran with ten per cent disa- bility; but, it was learned that he was not receiving disability compensation end had not been for the past ten years, and he was advised by the Chairman that he did not qualify for the requested exemption. Commissioner Higginbotham next introduced Ordinance No. 880, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEYT~G TO AND INCLUDING WITHIN TEE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, TEE AREA DESCRIBED HEREINAFTER, IN ACCORDANCE WITH TEK PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. and same was placed on its first reading and read in full. Commissioner Higginbotham then move~ on' the waiver of the requirement of the second reading of Ordinance No. 880, and that same be placed on its final passage and adoption, seconded by Commissioner Wilson. Thereupon, the question recurred on the waiver of the second reading, and the roll was called and the vote stands as follows: Commissioner Raborn Yea " Baker " " Crapps " " Higginbotham " " Wilson " Said Ordinance No. 880 was then placed on its final passage and adoption, the roll was called smd the vote stands as follows: Commissioner Raborn Yea " Baker " " Crapp s " " Higginbotham " " Wilson " Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote had passed and adopted said Ordinance No. 880, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF T~ CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER, IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. Consideration next given to the vacancy in the job position of combined Public Works Director-City Engineer, which has been advertised, and at present eight applicants have responded. After disCussion~of the list of applicants, Commissioner Baker moved 'to authorize the City Manager to check and further negotiate with James C.
