The City Commission .of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on January 24, 1966. Present: Commissioner M. L. L. Wilson, Mayor Police Chief A. S. Williams The meeting was called to order by the Chairman. Appearing in behalf of a request to purchase City property located at the corner of Fulton Street and Poplar Avenue was James Blythe, represented by realtor T. W. Mero. Legal description of the property being Lots 1, 2 and 3, Block Y, St. Gertrude's Addition to Town of Sanford, Florida, consisting of approximately 396 by 330 feet or three acres. Mr. Blythe's intended use of the property is a cold storage and trucking operation. An appraisal had been requested from a qualified independent appraiser; but!, his figures were not available for the meeting,'and~:it~ was recommended by the Chairman that any action be deferred until this information could be presented at the next meeting. Next under discussion was several areas as to the feasibility of annexing them to the corporate limits of the City,. due to City utilities surrounding them with one of the areas being contiguous on several sides. The areas being as follows: (a) Area north of Onora Road and south of 27th Street on the east side of of Highway 17-92, including a major portion' known as Dr. Adams' property. (b) Area south of 27th Street west of Sanford Avene. Considerable discussion of interest evolved around the area shown as item (a) above. Under the present City law of petitioning for annexation by signature of the property owners, the City Commission::recommended that the City Manager write to property owner Dr. Alfred N. Adams of Daytona Beach, Florida, as to any favor of signing a petition to annex his property, described as Lots 8 through 18, Amended Plat of Druid Park, Seminole County, which would then allow the annexation by majority of signatures. Discussion was next given to recommendations:Of the City Zoning and Planning i Co~mission for the zoning of newly annexed property to the City limits as follows: , (a) Johnson residence, 108 W. 27th Street, described as W ½ of Lots 359, 361 and 363, Frank Woodruff's Sflbdivision, to be zoned R-1 (Single Family Dwelling) District. (b) Property located at southwest corner of 27th Street and Highway 17-92, described as: Beg. 24' N 3208' E of most Sly cor. of Lot 42, run N 57054' W 150' N 32° 8' E 101.3' E 131.91' SEly on curve 53.29' SWly on road 150.2' to Beg. Amended Plat Druid Park; to be zoned C-1 (Neighborhood Commercial ) District. (c) Property located at southeast corner of Onora Road and Highway 17-92, described as: South 67' of Lot 38, all of Lot 39, and north 33.4' of Lot 40 (less the east 339.4') Amended Plat of Druid Park~ to be zoned C-1 (Neighborhood Commercial) District. (d) LeRoy Robb Construction Company property, 2800 block of Sanford Avenue, described as Lots 25, 26, 27, 31 and 32, Park View; to be zoned C-1 (Neighborhood Commercial ) District. ! (e) 2800 b~ock of Sanford Avenue, described as Lots 33 through 36, and Lots [ 43 through 48, Park View Second Addition; to be zoned R-2 (One and Two i Family Dwelling) District. Commissioner Baker moved to authorize a public hearing on February 14, 1966, to ;consider rezoning the above described property, notifying the property owners within the ~ areas. ' '"' ' " Submitted next for consideration was the following tabulation of bids for furnish- ing:.of two-way radio equipment per specifications in the invitation to bid, as advertised in the Sanford Herald on January 6, 1966, and publicly opened in the City Commission Room of the City Hall at 2:00 P. M. on January 21~ 1966. BID TABULATION Motorola $3,571.00 Radio Corporation of America 3,685.00 General Electric 4,269.50 After discussion and on recommendation of the City Manager that interchanging would mean an added cost on parts of $149.05~ Commissioner Baker moved to approve and accept the bid of the Radio Corporation of America! RCA, in the amount of $3~685.00, for furnishing one high frequency Police Base Unit, one low frequency Public Works Base Unit, two telemotes, and two mobile units with one each for the Street and Water Distribution departments. Seconded by Commissioner Roberts and carried. After consideration and on recommendation of City Manager~ Commissioner Baker moved on approval of payment of Statement No. 6013, dated January 19, 1966, in the amount of $3,109.22, as submitted by Clark, Dietz~ Painter and Associates for engineering services for December, 1965~ in accordance with Schedule of Ra~es as outlined in Agreement dated July 27, 1965, on Lakefront-Marina Development Project. Seconded by Commissioner Roberts and carried. A letter was next submitted from Municipal Judge C. Vernon Mize, Jr., advising that appearance bonds regarding: ~ City of Sanford vs. Barry McCray - Case No. 72969 City of Sanford vs. Marguerite Smith - Case No. 72926 were erroneously estreated in the Municipal Court, and requested that consideration be given to setting aside the above named bond estreatures. Commissioner Baker moved to set aside the estreature order until final disposition of the cases. Seconded by Commissioner Roberts and carried. On motion of Commissioner Baker, seconded by Commissioner Roberts and carried, authorization was next given for the transfer of funds in accounts as follows: $180,00 from Account No. 4801, Salary Account for Director of Public Works~ Public Works, to Account No. 4812, Public Works~ Furniture and Office Equipment, for a work table and chairs. $150.00 from Account No. 9301~ Salary Account, Director of Public Works, Utility Department, Water Distribution, to Account No. 1209, City Manager, Miscellaneous, for photo slides. $180.00 from Account~No. 9301, Salary Account, Director of Public Works, Utility Department, Water Distribution, to Account No. 9112, Utility Administration, Furniture and Office Equipment, for desks. Next brought %o the attention of the Commission was a note due at Florida State Bank on January 29, 1966, in the amount of $50,000.00, borrowed for the financing of off- street parking at First Street and Park Avenue. After discussion, Commissioner Higginbotham moved to pay $25,000.00 plus interest on the due date, and authorized the Mayor and City Clerk to execute a note extending $25,000.00 at an interest rate not to exceed 3½% per annum for one year. Seconded by Commissioner Roberts and carried. M. 19 66 CoMmissioner Higginbotham moved that the Mayor and the City Clerk be authorized to negotiate with the Sanford Atlantic National Bank for a two-year loan in the amount of $14,900.00, to be paid at $7,450.00 per year plus interest~ not to exceed 4% per a~num. Seconded by Commissioner Roberts and carried. Discussion was given next to prior action of the Commission regarding the purchase of the Sunland Estates water system. In working out the negotiations on the bill of sale and final payment figures, it was found that additional monies other than previously reported were due the City, caused by the method of reporting the December total amount of the sewer charge collected on the City's sewer system rather than the total amount billed by J. Brailey Odham's personnel. Under the prevailing circumstances, a request was then presented from the owner of the system, J. Brailey Odham, for reconsider, ation to allow him a six-month note in the approximated amount of $6,176.30, instead of the previously approved $5,000.00, which would allow the payment and clearing of the additional unreported City sewer charges and also include the amount due the City for the January sewer charges. After lengthy discussion, Commissioner Baker moved to approve that the City of Sanford allow J. Brailey Odham a Promissory Note for a period of six months from the closing date of sale in the amount of $6,000.00, with an interest thereon at the rate of six percent (6%) per annum. Motion to include that any remaining monies owing to the City to be paid in cash at the time of signing the official documents for the sale and transfer of the system to the City of Sanford. Seconded by Commissioner Higginbotham and carried. On motion of Commissioner Higginbotham~ seconded by Commissioner Roberts and carried, the minutes of January 14, 1966, were approved. The City Manager next brought to the Commission's attention a hazardous situation involving the new installation of railroad caution lights in the center of the highway on the newly widened 25th Street project, State Road 46'; and on the basis of safety that con- sideration be given to requiring the proper authorities to erect overhead suspension caution signals or a blinking caution light mounted on the signal poles, east and west. Commissioner Roberts moved that the proper resolution be drawn up and forwarded to the Florida State Road Department~ citing the hazardous condition as outlined; that the proper authorities be required to either erect overhead suspension caution signals or remove completely the existing railroad warning lights from the center of the highway. A copy of the resolution to be forwarded to the Atlantic Coast Line Railroad. Seconded by Commissioner Baker and carried. The Sanford-Seminole Art Association submitted a request for more adequate lighting at their location of a City owned building on Oak Avenue and Fifth Street. Commissioner Higginbotham moved to table the request until the City Manager could make a further study regarding their lighting needs. Seconded by Commissioner Baker and carried. On a proposal of the City Manager and after discussion~ Commissioner Baker moved on the creation of a new position in the Police Department of a detective sergeant of a reclassification of an individual in the present allotted personnel, with a salary increase of $220.00 per year or for the remaining eight months of a $147.00 increase. Motion include that this individual not be allowed to handle traffic work as a plain-clothes man. Seconded by Commissioner Higginbotham and carried. (a) Moved by Commissioner Baker to approve the creation of a position of Training Officer in ~the Fire Department with a salary increase for the remaining eight-month period at a cost of'$82.00. Seconded by Commissioner 'Roberts and carried. (b) Moved by Commissioner Higginbotham to approve the creation of four (4) new positions in the Fire Department~ being comparable to that of a sergeant for a second in command of each shift with a salary increase for an eight-month period of $166.00 per man or a total of $664.00 for the four men. Seconded by Commissioner Roberts and carried. Due to the title of warrant officer not being considered as appropriate~ it was recommended that a new title be determined for approval. These positions as outlined to be made ~mong individuals in the present allotted number of personnel in the Fire Department. The City Manager submitted a proposal for the employing of a qualified part-time city engineer at the rate of $5.45 per hour, After due consideration, Commissioner Baker moved to authorize the employment of the engineer on a part-time basis at the rate of $5.45 per hour with expenditures to be paid from the salary accounts as set forth in the budget for the City Engineer~ seconded by Commissioner Roberts and carried. Commissioner Higginbotham moved to authorize the necessary funds from the Contingency Account to purchase a drafting table for the City Engineer to use in the City Hall. Seconded by Commissioner Roberts and carried. On motion of Commissioner Bakery authorization was given to expend salary account funds in the Utility Administration department to employ part-time help as rewired for a temporary period.
