M. 19 66 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on March 14, 1966. present: Commissioner A. L. Wilson, Mayor " J.B. Baker " Earl Higginbotham " M.L. Raborn, Jr. " W. Vincent Roberts City Attorney Wm. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. L. Whelchel Police Chief A. S. Williams The meeting was called to order by the Chairman. The first item of business to be considered was the official signing by the City of final contracts for Lease Agreements for the Lakefront Development Project covering the mote~-restaurant complex and the marina complex, as drawn for C. E. Merrill, Jr. and A. J. Thomas, Jr., as the operation of Monroe Motels, Inc.; and Harold L. Slama as the operation of Monroe Harbour, Inc. After discussion, Commissioner Baker moved that the signing of the leases be tabled for further negotiations. Motion died for a lack of a second. Commissioner Roberts moved that the contents of the agreements for lease, as pre- pared by the City Attorney, be approved; and that they be delivered to the prospective lessees; and upon their execution and return to the City, not later than noon Friday, March 18, 1966, that the mayor and clerk.be then authorized to execute the documents; and upon fault of their return by noon Friday, the offers contained in these lease documents are withdrawn. Seconded by Commissioner Higginbotham and Carried over the dissenting vote of Commissioner Baker. Commissioner Baker's objections for the signing of the leases as presented, being for the record in words as follows: "I feel and have always felt that the proper development of our lakefront would be a tremendous asset to Sanford, and I am strongly in favor of such development, and I realize that concessions have to be made to attract interest of people who are willing to invest such large amounts of money in a motel. However, I am opposed to the terms and conditions of this proposed lease for the marina part of our project. This lease, as pre- sented, will not even cover our interest charges on the money borrowed by the City, much less reduce our principal cost. The City has negotiated with only one individual on this i!lease. As originally presented, the so-called Bankers Plan was a financially feasible pro- ject, which would reduce the capital investment and completely cover the interest charges. In my opinion, this lease is not based on sound business principals, and I feel that we should further negotiate this lease on the marina." Discussion next followed with B. C. Conkl~n of Clark, Dietz and Associates, con- sulting engineers, on possible ways to reduce the contract cost on the landfill work as bid. The {ollowing reductions were submitted for consideration: 1. Relocate b~lkhead diagonally through the southwest corner of the landfill, reducing the area by 0.4 acres and $12,000..00. 2. Relocate bulkhead on the west end parallel to the west property line but approximately 90 feet east, reducing the area by approximately 0.75 acres and $20,000.00. 3.Eliminating bulkheading on the west end and returning fill for a slope, reducing the cost by approximately $16,000.00. 4. Eliminating the bulkhead on the east for a portion and returning fill for a slgpe Where it could be extended in the future. Fha, The flushing channel could be eliminated and save $33,000.00 or substitute two culvert stubs and plug them for future use if they are desired. This would cost approximately $6,000.00. The piles on the north side in the s~ope fill could be shortened with an e~timated savings of $3,000.00 or $4,000.00, but it is not advisable. o Eliminate one of the floating piersl would save approximately $27,500.00 and could be added later if advisable. This would leave about 133 berths. An extra item that could be considered to be added later is the covering of the 20 berths. Commissioner Baker moved that the City consider and discuss with the contractor the elimination from this project the items numbered 2, t, and 5 of this contract, and number 7 when bid. Seconded by Commissioner Higginbotham and carried. Next under discussion was the request of John D. Carlton to operate a package store for the sale of alcoholic beverages, off the premises at 1303-B South Sanford Avenue, which was previously tabled~'~tthe last meeting under a public hearing. A list containShg the names and signatures of Mrs. Mary C. Stevens, Mrs. Roberta L. Gatchel, Mrs. Grayce Gregory, Warren M. and Julia G. Germond was submitted as opposing the .ocation. Mr. Carlton presented a list of some twenty signatures of residents in the areas )f Sanford Avenue, Palmetto Avenue, Celery Avenue, East 14th Street, Valencia Street, Magnolia Avenue and Plumosa Drive, who were in favor of the said operation at the Sanford Avenue ~ocation. Also present and making statements to the Commission were: Doyle G. Schwarm, 1305 Sanford Avenue~ unopposedl Marvin A. Dyal, 505 Plumosa Drive, opposed due to the school rounds being approximately one block from said location; and Mrs. Roberta Gatchel, 1220 anford Avenue, opposed. Commissioner Higginbotham moved that the request be granted for operation of a liquor package store at 1303-B South Sanford Avenue, with the City Attorney being authorized draw the appropriate ordinance for amending the designated zones in which intoxicating iiliquors may be sold to include the above mentioned location. Motion died for a lack of a ::Second. ~{ After consideration of traffic problems created, and the proximity of the public ! ~chool, Commissioner Raborn moved to deny the request for the operation of a liquor package ~Store at the location of 1303-B South Sanford Avenue. For the purpose of placing the issue n the floor for voter Commissioner Roberts seconded the motion, and the motion was carried ver the dissenting rotes of Commissioner Roberts and Commissioner Higglnbotham. On recommendation of the Zoning and Planning Commission and his willingness to :~erve~ Commissioner Roberts moved to appoint DeWitt T. Mathews, Jr., as a new member to fill !~he vacancy now existing on the 'Zoning and Planning Commission. Seconded by Commissioner aborn and carried. i! A proposal was presented from the Seminole County Humane Society for a man and ~quipment to handle all of the City's dog calls, as required~ pertaining to the capturing of Stray dogs, holding and disposing in a humane way, or finding homes, and including the inocu- [ation drives for an annual fee of $3,600.00. On recommendation of the City Manager, Commis- sioner Raborn moved to authorize the City Manager to negotiate with the County Humane Society on an annual cost basis not to exceed $3,600.00, to be paid monthly, with the City having i~he right Of a 30-day cancellation notice. Orlando, Fla. .... was further recommended that the local veterinarians be contacted regarding their co-operatior during the City inoculation drives to sell City dog licenses at their offices to facilitate dog owners from making and added trip to City Hall to acquire same. Request next submitted from Municipal Judge C. Vernon Mize, Jr., Docket Case No. 73404, Assault and Battery; No. 73438, Disorderly Conduct; and No. 73439, Disorderly Conduct and Opposing a Police Officer, that sentences of Knewling R. Howell be amended to release him from the City jail, due to ill health, to leave the City of Sanford. On recommendation of Chief of Police, Commissioner Higginbothma moved that the request be granted, seconded by Commissioner Roberts and carried. On motion of Commissioner Baker, the request of the Sanford Chamber of Commerce to draw their regular quarterly budget of $525.00 was tabled. Seconded by Commissioner Roberts and carried. Ordinance No. 883, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NUMBER 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT TRANSFERRING CERTAIN TERRITORY FROM R-1AA (SINGLE FAMILY DWELLING) DISTRICT, TO R-1 (SINGLE FAMILY DWELLING) DISTRICT; AND CERTAIN TERRITORY FROM R-1AA (SINGLE FAMILY DWELLING) DISTRICT, TO C-1 (NEIGHBORHOOD COMMERCIAL) DISTRICT; AND CERTAIN TERRITORY FROM R-1AA (SINGLE FAMILY DWELLING) DISTRICT, TO R-2 (ONE AND TWO FAMILY DWELLING) DISTRICT. placed on its first reading and read in full at regular meeting of February 28, 1966, was next placed on its final reading for passage and adoption. Commissioner Higginbotham moved to adopt said .Ordinance No. 883. Seconded by Commissioner Roberts and carried unanimously. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 883, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NLFMBER 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT TRANSFERRING CERTAIN TERRITORY FROM R-1AA (SINGLE FAMILY DWELLING) DISTRICT, TO R-1 (SINGLE FAMILY DWELLING) DISTRICT; AND CERTAIN TERRITORY FROM R-1AA (SINGLE FAMILY DWELLING) DISTRICT, TO C-1 (NEIGHBORHOOD COMMERCIAL) DISTRICT; AND CERTAIN TERRITORY FROM R-1AA (SINGLE FAMILY DWELLING) DISTRICT, TO R-2 (ONE AND TWO FAMILY DWELLING) DISTRICT. On motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, the current vouchers and payrolls were next approved as evidenced by General Fund Florida State Bank Vouchers No. 4466 through No. 4515; General Fund Sanford Atlantic National Bank Vouchers No. 11556 through No. 11756; Water and Sewer Revenue Fund Sanford Atlantic National Bank Vouchers No. 109~ through No. 1106. Upon request of the City Clerk, Commissioner Higginbotham moved that authorization be given for the Mayor, City Clerk, and City Attorney to enter Safe Deposit Box No. 177, ~Sanford Atlantic National Bank, Sanford, Florida, for examining Series "K" and "H" Bonds for reinvestment purposes, seconded by Commissioner Roberts and carried. Commissioner Higginbotham moved to approve the site of southwest corner of 24th Street and French Avenue, and to authorize the City Clerk to advertise a public hearing date for March 28, 1966, for the amending of the zoning boundaries in which liquor may be sold; this predicated on the basis that Mr. Carlton would notify the Clerk that the location was available for lease, and noti- 6tcation was made in time to advertise the Dublic hearing ten days prior to March 28, 1966. Seconded by Commissioner Baker and carried. On request of S. M. RiChard, Sr., and recommendation of the City Manager, Commis- sioner Raborn moved to authorize the City's pension allowance to Mr. RiChard be drawn in the name of his wife, Thelma RiChard, for that period he would be drawing the pension in his lifetime. Seconded by Commissioner Roberts and carried. The City Manager has been requested to serve as a committee member of the Florida League of Municipalities proposed state-wide general pension plan for municipal employees. Commissioner Baker moved to approvei~;that if the City Manager'~elt it a worthwhile program, he be allowed to serve as a member. Seconded by Commissioner Roberts and carried. After discussion, Commissioner Roberts moved to approve the City extending the City sewer line approximately 700 to 800 feet north of Silver Lake Drive in the Hunt Indus- trial Park, with Hunt to pay all costs estimated at $4,720.00. Seconded by Commissioner iRaborn and carried over the dissenting vote of Commissioner Baker on the basis that the City is not a private contractor. The City Attorney reported that he had finished research work pertaining to ilamendments with to the old Sanford Heirs and there is regard City property dedications, no iibasis to allow the City to sell the property designated as a City park at the corner of Ninth Street and French Avenue. On request of the City Manager, Commissioner Raborn moved to approve-of rescinding the City Commission's action as outlined in the minutes of February 17, 1966~ whereby the City Manager was appointed as the individual to negotiate leases under the Lakefront Develop- ment Program with private interest. Seconded by Commissioner Higginbotham and carried over the dissenting vote of Commissioner Baker. On recommendation of the City Manager, Commissioner Raborn moved to authorize the retention of street lights placed on trial basis on the south side of East First Street from Pine Avenue east %~ Mellonville Avenue, as it is a new type light providing 4,500 lumens, with an increase in electrical power cost to $28.80 per light per year~ and the street lights )n North Park Avenue from Commercial Street north to Seminole Boulevard be replaced with the ;ame type of lumen lighting. Seconded by Commissioner Roberts and carried. Letter next received by the Mayor, from the office of the Mayor of City of Three Rivers, Michigan~ requesting support of a resolution on a movement called Restore School Voluntary Prayer and Bible Reading in Public Schools. Commissioner Higginbotham moved to refer this letter to the Ministerial Association of Sanford, seconded by Commissioner Roberts and carried.
