032866 MINUTES City Commission, Sanford,: Florida, March 28 at 8 P. M. 1~ 66 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida at 8:00 o'clock P. M. on March 28, 1966. Present: Commissioner A. C. Hutchison, Jr. The Chairman called the meeting to order. The first item of business was the appearance of Harry E. Robson, Robson Sporting Goods, 504 East First Street, requesting that consideration be given to allow him a minimum area of 150 fee~ x 300 feet in the southwest corner of the boat basin inside the marina water area of the lakefront project, in which to continue to operate his marina business for docking and demonstration of boats; further, agreeing to pay the cost of installing a new type of floating dock which could be tied into any permanent fixture the City provided. ~fter discussion of the Commission's moral obligation to the private lessee, Commissioner Baker moved to obtain from the City Attorney a legal opinion on the City's further renting of space on the l~kefront. Commissioner Higginbotham moved to table the motion. Seconded by Commissioner Roberts and carried over the dissenting.vote of Commis- sioner Baker with Commissioner Raborn abstaining. Dr. John Darby and Dr. John Wilson, State Experimental Station personnel, appeared in behalf of a request that the City consider installing water mains to their new proposed location on Celery Avenue, east of their present location and outside the City limits, since sulphur wells could not be used in a new anticipated research program. Dr. John Wilson's proposal outlined their agreement that in return for the estimated installation cost of $19,589.81~ it would be recommended to the State that their present property site on the north side of Celery Avenue, within the City limits consisting of more than six acres, be donated to the City; records showing the land and buildings thereon were originally donated to the Experimental Station by the City. After discussion centering around the Experimental Station absorbing the material cost and the City furnishing labor and equipment, it was moved by Commissioner Higginbotham that the City Manager and Commissioner Baker be appointed as a committee to further negotiate with Dr. Wilosn and his staff to work out a satisfactory agreement for joint participation for both parties. Seconded by Commissioner Roberts and carried. Mrs. John C. (Sandy) Noel, as sponsor, next presented a proposal for City partici- pation in a City supported Teen Club at the Civic Center, described briefly as follows: Each person paying 50¢ for a membership card; Each person paying 50¢ admission charge; Two police- men required for supervision; Set price for a band not to exceed the limit of $400.00 (for Friday and Saturday nights); A concession; Cost of advertising (optional); Mrs. Noel to be paid $20.O0/week; Age limits 15 to 20 years of age; No alcoholic beverages, with dress casual,. City to subsidize the cost difference if revenue were insufficient. ~'~.-:', ~ The Commission told Mrs. Noel that a cost analysis had been made and with a con- servative estimate of revenue, the City would be underwriting an estimated annual cost of $20,000.00 for this one particular program, which would be a financial burden. H. 19 66 Oofllex~D_lY~~o .~ Or]~ Next appearing was William Rodgers, Chick-N-Treat manager, presenting a similar program for the teen age group at the Civic Center, with him as sponsor on his own time without pay, proposing an admission charge of $1.00; the City to furnish food which he would prepare and serve; bands of less expense; and the City to underwrite the program. The Com- mission reiterated the financial burden of such a program and costs, but agreed to give the proposal further consideration. The City Manager next presented for discussion a proposal of the County Humane Society to handle all City dog calls for the remainder of the fiscal year at an annual rate of $2,500.00, and it was agreeable with them that the fee be paid monthly and canceled if the City were not satisfied. Commissioner Baker moved to approve and accept the agreement with the County Humane Society as outlined. Seconded by Commissioner Roberts and carried. Next considered was the appearance of John D. Carlton requesting consideration to operate a bar and package store for the sale of alcoholic beverages at the location of Angel'~i Eat Shack, 2515 Sanford Avenue. Commissioner Baker moved that a public hearing be advertised for April ll, 1966, to consider the amending of the zoning boundaries designating the area for the sale of liquor to further consider Mr, Carlton's requested location, and prpperty owners within 300 feet be notified by mail of said public hearing. Seconded by Commissioner Higginbotham and carried. Consideration was next'given to an application of Johnny A. Lawrence, 1511 West 12th Street, to acquire a City occupational license to operate a 1955, 2-door Buick vehicle as a taxicab. The Police Chief reported that a scheduled meeting had been held with all City licensed taxicab operators, with a deadline date of April 12, 1966, to bring their vehicles and operation in compliance with the new taxicab ordinance. After considerable discussion on the newly adopted taxicab ordinance and requirements contained therein, Commissioner Baker moved to table the request for further consideration at the next meeting. Seconded by Commissioner Raborn and carried. Mr. K. A. Becket, representing a sign request for Jim Spencer at the location of Jim Spencer's Restaurant and Cocktail Lounge on South French Avenue and Santa Barbara Drive, presented a sketch of a 3 x 3 foot cocktail sign which could either be added as a few feet to the present entrance sign on the north end of property, or take down the existing entrance siga and erect the illuminated cocktail sign on a higher pole support. Mr. Becker stated that the Florida Sign Company was in charge of erecting his signs. After lengthy discussion, Commissioner Higginbotham moved that a variance be granted i!for the erection of the sign and a review be made of the sign ordinance for possible amend- iimen~s thereto on the basis of its being too restrictive, motion died for lack of a second. After further discussion, Commissioner Baker moved to deny the request, motion for lack of a second. Commissioner Higginbotham then moved to grant a variance for the erection of the sign, with a review of the sign ordinance in relation to amendments. Seconded by Commis- sioner Roberts on the basis that an explanatory letter be given to the Eoning and Planning Commission for such action. Motion failed with the dissenting votes of Commissioner Raborn, Commissioner Baker and Commissioner Wilson. /2O2 MINUTES City Commission, Sanford, Florida: Hatch 28 at 8 P.M. 19 66 On recommendation of~the City Manager.that additional personnel be considered for the Utility Administration Office, due to an increase in work load with four clerks unable to keep abreast, Commissioner Baker moved to approve the employing of one temporary clerk for the balance of the fiscal year, with an appropriation of $1,500.00 to be made to the respective sala~y account. Seconded by Commissioner Roberts and carried. On motion of Commissioner Baker, authorization was next given for the City Manager to advertise for bids for the purchase and installation of an air conditioning system in the Sanford Public Library, seconded by Commissioner Roberts. and carried. The City Manager presented a proposal for purchasing a parcel of land, squaring up City property, from the Florida Public Utilities Company, at a price of $440.68; $190.68 for the land and $250.00 closing cost, the latter to be deleted if the City Attorney closes the transaction. Property described as follows: Beg. at the point 275.3 feet east of the SW corder of Cedar Avenue and Sixth Street, according to E. R. Trafford's Map of the Town of' Sanford, as recorded in Plat Book l, pages 56-64, Seminole County Public Records, run thence east 22.7 feet, thence south 42 feet, thence west 22.7 feet, thence north 42 feet to point of beginning. Containing 953.4 square feet, more or less. Commissioner Baker moved to acquire the property as described, seconded by Commissioner Roberts and carried. Commissioner Raborn next moved to authorize payment to Travelers Insurance Company, in amount of $11,255.00, representing the City's share of contribution at 4% for 9 months and 5% for 3 months to cover the 1965 period for the General Employees Pension Plan, GR-665, as budgeted in Accounts 7096 and 9196; seconded by Commissioner Baker and carried. Consideration next given the request of the Rev. Lynn. H. Alford, Church of God, French Avenue and 22nd Street, for a new construction across the City's utility easement, west of Holly Avenue from 22nd Street to 24th Street, the church to pay the total cost of relaying the existing 12-inch sewer line in cast iron. On recommendation of the City Manager, Commissioner Raborn moved to approve the construction across the easement, provided the church pays the total cost of relaying the 12-inc~ sewer line in cast iron. Seconded by Commissioner Baker and carried. Water tank maintenance renewal contract proposals from jack Sharpe, Jack Sharpe, Inc., Orlando, Florida, were next submitted for consideration on the 13th Street water tank, offering a six-year contract at $600.00 per year, painting each three years, or a twelve-year ,ontract at $500.00 per year, painting each four years. Commissioner Higginbotham moved to approve and accept the six-year contract at the cost of $600.00 per year. Seconded by ]ommissioner Baker and carried. Sam Smith, lll7 West Seventh Street, next appeared, presenting to the Commission ~ signed petition requesting the City pave and install the proper drainage on West Seventh Street from Pecan Avenue west. Commissioner Baker moved to approve the paving of West Seventh ~treet west, on the basis that those having signed the petition constitute the actual property owners and understand and agree to pay their one-third pro-rata cost of $2.17 per lineal foot of their property. Seconded by Commissioner Roberts and carried. The City Manager presented for review a proposed contract from the Midway-Canaan Community Water Association, Inc., acting under the Farmers Home Administration, requesting the City to supply water to them. Clarification that: Meter testing to be only the meter at the point of supply and the City have nothing to do with all the Association's meters in their system. On request of the Commission, the City Ma.~ager presented a salary comparison review on City employees, with the exception of laborers. Due to many municipal jobs being ~omparable with other municipalities, the review was based on four surrounding communities, relative to their municipal employees as to duties and wage scales. The review reflects that ~anford's salaries are considerable lower than comparable jobs and skills in surrounding ~ommunities and within Sanford itself; and in addition to base pay, longevity is recognized in the other municipalities. The Commission agreed to take the proposal under further con- ~ideration. Next considered was the request for transfer of various funds, and on motion of ~ommissioner Higginbotham, seconded by Commissioner Raborn and carried, the following trans- fers of funds were approved: From Contingency Account No. 8150 to Street Matlerials Account No. 4725, $158.00, for cost of materials to repair sidewalk at the southeast corner of Third Street and Park Avenue. From Contingency Account No. 8150 to Police Schools and Training Account No. 2257, $500.00, regarding expenses for ten officers to attend a 224-hour recruit training course. From Contingency Account No. 8150 to Miscellaneous Supplies and Parts Account No. 4922, $227.00, for survey costs on new sanitary landfill site. From Maintenance Salary Account No. 4601 to Building Repairs Account No. 4621, $400.00, for unexpected repair at Civic Center. From Contingency Account No. 8150 to Zoo Animals Account No. 4575, $600.00, to purchase 8-year old mandrill. On motion of Commissioner Higginbotham, minutes of F~bruary lq, February 17, February 28, and March 16, 1966, were approved. Seconded by Oommissioner Raborn and carried. Commissioner Higginbotham moved that the Mayor be authorized to expend funds to attend a Community Development Management Seminar, sponsored by the' Federal Chamber of Commerce on April 5, 1966, in Atlanta. Seconded by Commissioner Raborn and carried. Under discussion of outside rentals at the Civic Center for teen age activities, other than City sponsored, the Commission returned to the proposals for a Teen Club at the Civic Center as outlined by Mrs. Noel and Mr. Rogers. After discussion, Commissioner Baker moved to regretfully deny the propositions on the basis of costs being a major consideration; use of City property that could be termed as a private undertaking; City subsidizing costs with taxpayers' money; and a preference that the City's Recreation Department pursue a similar program under City's direct super- vision on a less costly basis. Seconded by Commissioner Roberts and carried. After discussion based on a local grievence report, Commissioner Baker moved to license all cemetery monument dealers coming into Sanford to solicit, contracting jobs and daing the work; including contractors in general. H. 19 66 Higginbotham moved to authorize the Mayor and Clerk to execute a quit claim deed from the City to Price Angel on Lots 8, 9, 10, 12, and 15, Block l, palm Terrace, Sanford, Florida, according to plat thereof recorded in Plat Book ~ Pages 82 and 83 of the Public Records of Seminole County, Florida, (less right-of-way for Sanford AVenue) whereby the City sold the property for taxes in 1935 to Hr. Angel. Seconded by Commissioner Raborn and carried. Next considered was a request by W. A. Adams of Adams Transfer and Storage for a street light at the location of Commercial Street and Holly Avenue, due to recent loss of gasoline at night from his parked trucks. Commissioner Raborn moved on approval to install the light. Motion died for lack of a second. After further discussion, recommendation was made to have the entire City surveyed as to all areas of street lighting. Commissioner Higginbotham moved to approve the transfer of funds in the amount of $282.59 from Contingency Account No. 8150 to Street Lighting Account No. &641, to replace seven street lights of 2,500 lumen to 4,500 lumen on Park Avenue, Commercial to the Boule- vard, cost at $&0.57 per light fixture, including bulb and photo-cell, and placed on City- owned poles.
