M. 19. 66 The City Commission o£ the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. N. on Nay 9, 1966. Present: Commissioner A. Whelchel Police Chief A. S. Williams The meeting was called to order by the Chairman. The first item of business was a request from abutting p~operty owners and lease holders as signed by Ted Williams, Everett Harper and James C. Garner to close as a public thoroughfare the street right-of-way in front o£ Thri£twaY Food Store; a short cut-off street angling from Park Avenue south to 25th Street, lying within a City triangle abutting and east of Park Avenue, north of 25th Street. Ted Williams, representing the request before the Commission, stated that it was felt that with the closing, putting in the proper curbing, and with proper utilization of the existing exits and entrance driveways, it would eliminate a hazard o£ customer parking on the front of the store and backing out directly into a line of tra££ic on the cut-off street; also, allowing more parking and maneuvering area. After discussion, Commissioner Higginbotham moved to approve on:the basis that if the property owners are willing to pay the cost for installing necessary cumbing to close the street, the City will provide labor~ with the closing to be only on a temporary trial period. Motion.seconded by Commissioner Baker and carried. A. B. (Tommie) Peterson, Jr.~ President, Sanford Chamber o£ Commerce, nex~ pre- sented to the City Commission a 1-inch to a 20-foot scale model of the City's proposed Zoological Gardens to be located on City property in more than a lO-acre area 'tract south o£ Seminole Boulevard and west of French Avenue, to center around the plan of relocating the City's Nunicipal Zoo to the proposed site. ~[r. Peterson hoped that the model would be dis- played throughout the City and be a visual aid in use by the various civic organizations to help gain funds and donations toward the project. The City Co=miSSiOn was impressed with the model and expressed their sincere appreciation to Mr. Peterson for his idea and efforts in procuring the designed model. Next presented for consideration was a recommendation from the City Manager to update the allowed daily charge for the holding o£ animals under the existing dog ordinance, Section 5, to a charge of $1.50 per day, where at present a dog cannot be properly fed and cared for under the interpretation of the City's present ordinance o£ a $3.00 pickup charge, plus 25¢ per day that a dog is impounded. A fee o£ $1.15 per day now being charged by all three local veterinarians; and further, due to the Seminole County Humane Society now working under an agreement with the City to answer all City dog calls, their personnel requested clarification and/or verification on the amount they would be allowed to charge for the daily fee o£ dogs impounded under this agreement. After discussion, Commissioner Baker moved that the City Attorney be instructed to amend the City's Dog Ordinance, such sections applicable thereto, to reflect a daily charge o£ $1.50 for the impounding and holding o£ dogs. C)~lnnrln: l?ln_ On the motion of Commissioner Higginbotham, seconded by Commissioner Roberts and :arried, the date of Flay 25, 1966, was authorized for advertisement of a public hearing to >e held regarding amending the liquor zoning law, extending the boundaries of certain areas in which alcoholic beverages, namely liquor, may be sold, as pertaining to the request of John D. Carlton for authorization to acquire a City license to establish a bar and package operation at the location of 2401 ~rench Avenue. The next order of business was a Public Hearing as authorized at meeting o£ April 25 1966, individual notice sent to the affected parties, to consider the revocation of taxicab license No. 132, issued in the name of Jerry Bentley, for non-compliance with Ordinance No. 882, to wit; failure to operate vehicle as a taxicab. The widow of Jerry Bentley, Natherine, appeared before the Commission, stating that on the basis of Jerry Bentley being deceased, the contemplation of purchasing a new vehicle and operating it herself, she now requests consideration of a 90-day extension on the license revocation. After consideration, Commissioner Roberts moved on approval of a 90-day extension )n license No. 132, issued to Jerry Bentley, with continuation of the Public Hearing for a )eriod of 90 days in which to allow the widow of same to acquire a vehicle, meet all require- lents set forth in Ordinance No. 882, and such vehicle to be in operation as a taxicab. Seconded by Commissioner Raborn and carried. Next, a Public Hearing to consider the application o£ Johnny A. Lawrence for a taxicab license was heard. The Chairman then asked if there were anyone either for or against the issuance of such license. A group o£ ten taxicab operators appeared in behalf of the request, with nine opposing Johnny A. Lawrence's application. Fir. Collier of Yellow Cab Company appeared stating he felt the number of taxicab licenses should be kept to a minimum in order that each would )e able to earn a decent wage. Due to prior action limiting the number of licensed cabs to 24, Commissioner Raborn noved that the Public Hearing on Johnny A. Lawrence's request to acquire a taxicab license be ontinued for a period o£ 90 days to coincide with action taken regarding the license o£ 7erry Bentley, with further consideration at that time if license remains as non-complying, IIeconded by Commissioner Higginbotham and carried. . After consideration, Commissioner Higginbotham moved, seconded by Commissioner toberts and carried, to approve of monies required and paid under the Taxicab Ordinance No. 382 for application of such license the amount of $26.50 to be refunded to Johnny A. Lawrence ~ntil such time as the application can be reinstated; such action in no way to set a precedent for future applicants. Consideration next given to financing the new 1966 GMC refuse packer No. 38, as ~er budget. Commissioner Roberts moved that the Mayor and the City Clerk be authorized to ~egotiate with a Depositor-Bank o£ the City of San£ord for a two-year loan in the amount of ~8,125.05, to be paid at $4,062.52 per year plus interest, not to exceed four per cent per ~nnum. Seconded by Commissioner Higginbotham and carried. Appearing before the Commission, C. Due to rising crime rate, and the need for qualified men on the force, a realistic wage scale should be considered that would allow the policeman to tend to police duties only, without trying to meet the present day high living costs by forcing them to hold a second job on off-duty time. Howard McNulty also appeared in behalf of Mr. Mize's support. The City Commission informed Mr. Mize that they had been for some time and were presently in the midst of a salary review, attempting to summarize the costs with considera- tion for upgrading the salary scale of all employees throughout the various City Departments,:~ and would give due consideration to his request. Trafford's Map After discussion of the aforesaid Reports Nos. 66-1~6 through 66-171, and finding each building to be considered unsanitary, unsafe or dilapidated, Commissioner Baker moved to hold a public hearing to condemn same on May 23, 1966, and to authorize a notice to be placed upon each structure, and directed by registered mail to the last known address as shown by the tax assessment rolls of the City, a notice to the owner of the property involved of the ?indings of the Commission and of the proposed public hearing. Seconded by Commissioner Raborn and carried. The matter of prior action on condemned structures and time limits placed thereon by the Commission was brought to attention regarding the fact that in issuance of any building permit allows a completion period of one year to repair or demolish. After consideration, Commissioner Baker moved to approve the placing of a 90-day ~ionly time limit on all building permits issued on all buildings when applicable as a condemned structure; such 90-day limit to be retroactive as applying to those condemned structures which have already been issued a permit for repair or demolition and no action has been taken. Seconded by Commissioner Higginbotham and carried. The City Manager next presented a report on the status of three area requests for street paving as approved by the City Commission under the participation policy regarding the following streets: Locust and Chapman from First to Second Street; Grandview Avenue north of 24th Place; East 24th Place east of Sanford Avenue; and West Seventh Street. Commissioner Higginbotham moved that all three street projects be dropped due to lack of interest from the property owners. Seconded by Commissioner Roberts. Commissioner Higginbotham moved to amend the motion to eliminating the paving of Chapman and Grandview, but to proceed with paving Locust Avenue for the one block on the basis that Locust is a through street from 20th north to the downtown area. Seconded by Commis- sioner Baker an the basis that the motion include that the abutting property owners be requested to pay their pro-rata share and the City to pay their pro-rata share of the cost. Motion failed to carry over the dissenting votes of Commissioners Roberts, Raborn and Wilson. Commissioner Higginbotham moved that the City drop the Grandview and Chapman paving projects. Seconded by Commissioner Baker, with motion failing to carry over the dissenting votes of Commissioners Roberts, Raborn and Wil~son. After further discussion, Commissioner Higginbotham moved that the City of Sanford pay the entire costs of paving Locust Avenue from First to Second Street on the basis that it being a through street in the downtown area, opening it up all the way to 20th Street. Seconded by Commissioner Roberts and carried. Commissioner Higginbotham moved to approve the total costs of materials for the paving of Locust Avenue from First to Second Street be transferred from Contingency Account .~o. 8150, to Street Construction Account No. 4792. On motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, the street paving project regarding Grandview Avenue area and Chapman Avenue were cancelled. On recommendation of City Manager, moved by Commissioner Higginbotham, seconded by Commissioner Roberts and carried, authorization was next given .for payment of $4,000.00 balance regarding legal fees, appropriated in Account 1301-A, to City Attorney Wm. C. Hutchison, Jr., in defense of law actions Nos. 34?5 and 3476, ~. L. Saxon, d/b/a Saxon Termite Control vs. Warren E. Knowles and The City of Sanford, four suits. Appearing next before the Commission was Gary Pickren, Manager, A B C Ambulance Service, Deland, Florida, regarding a proposal o£ granting an exclusive franchise under a Certi£icate of Public Convenience and Necessity to operate an Ambulance Service in the City of Sanford, whereby under the new federal government law regulating minimum hourly wage laws and in particular to ambulance workers, the funeral homes in the local area were being £orced to abandon the £urnishing of ambulance service as of June 1, 1966. Also appearing in behalf of the request was William L. Gramkow, Gramkow Funeral Home, and Robert I. Brisson, Brisson Funeral Home, supporting that the local and Seminole County £unerat homes were attempting to work out an amicable and acceptable agreement to all parties before the deadline date. ? A£ter a lengthy discussion and explanation period, the City Commission advised Pickren that the proposed £ranchise would be reviewed and taken under consideration at the next regular meeting. Due to the letter of certification not having been received from the County Tax Assessor's O££ice verifying Solon Teston as the legal property owner, Commissioner Raborn moved that the first reading of the ordinance to annex propertY located at 2201 West 25th Street be tabled until the meeting of May 23, 1966. Seconded by Commissioner Roberts and carried. On motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, B. L. Perkins, Jr., was reappointed to serve on the Sanford Housing Authority Board, effective May 20, 1966, for a £ou~-year term to May 20, 1970. On recommendation o£ the City Zoning and Planning Commission, Commissioner Raborn moved to appoint ?hillip H. Logan as a member of the aforementioned Commission to fill the vacancy created by resignation of DeWitt T. Matthews. Seconded by Commissioner Roberts and carried. The City Manager next explained to ~he Commission that the City's group hospitali- Zation insurance plan was being abused by City employees by delaying claims to obtain £ull bene£its from both companies and, therefore, received money in excess of claims. A£ter lengthy discussion, Commissioner Higginbotham moved that authorization be given to Gulf Li£e Insurance Company to add a co-insurance clause, Co-ordination of Benefits Provision, to the City's group hospitalization plan in order to preclude a higher cost to the City on premium rate increase on the basis of this experience. Seconded by Commissioner Raborn and carried with Commissioner Roberts abstaining. The City Manager next recommended that consideration be given to amend the City's General Pension Plan to set the normal retirement age at 65, instead o£ 70 years as now !!written; with the employee still receiving full retirement bene£it with no increased cost to the City. 223 MINUTE'S City Commission, Sanford, Florida May. c), at 8 P. M. 1966 After discussion on the feasibility of same, Commissioner Higginbotham moved that ~uthorization be given to The Travelers Insurance Insurance Company to amend the City's ~eneral Pension Plan to allow those employees under the plan to retire at the age of 65. Seconded by Commissioner Roberts and carried. The City Manager reiterated and gave a short resume regarding the progress and )resent status, including a cost analysis, of a revised plan to update and increase the salary of all City employees, excluding labor,rs. The City Commission set an informal meeting date of Monday, May 16, 1966, for further discussion and consideration of the salary review. On recommendation of the Zoning and Planning Commission, motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, a date of May 23, 1966, was ~uthorized for advertisement of a public hearing in which to consider rezoning from R-lA (Single Family Dwelling) District to C-1 (Neighborhood Commercial) District that area on the east side of French Avenue for one lot in depth from 15th Street to 18th Street; legal descrip. tion: Lot l, 2, and 3 (less that part lying within 41.0 feet of the survey line of SR 15-A, Sec. 7715), Amended Plat of Orange HeiEhts. Next considered under a lengthy discussion was a recommendation from the City Zoning and Planning Commission, due to the fact that the sign law in unenforceable; majority of people in Sanford who have signs have violated it; the biggest Portion of the businessmen in t'he City of Sanford have ignored it and continue to ignore it; therefore, requesting that the Sign Ordinance be abolished, thereby declaring it null and void until such time there is a more equitable law written on varying types of signs as to ground, wall, aerial, etc.; and which rewriting step the Zoning and Planning Commission will undertake. On advice of the City Attorney, Commissioner Baker moved that the present Sign Ordinance remain in effect until such time a new law is written, with instructions that the Zoning and Planning Commission be directed to dr~w up the mechanics to provide the City ;ommission with the necessary preliminary law to implement the finalizing and adoption of a ~ew, more equitable and enforceable sign law. Seconded by Commissioner Roberts and carried. Under further consideration, Commissioner Roberts moved, seconded by Commissioner Higginbotham and carried over the dissenting vote of Commissioner Baker, that all signs under any controversy or violation of the present sign ordinance be held in abeyance and the City defer all legal action until such time as a new sign law is written, inasmuch as the City Commission has authorized the Zoning and Planning Commission to rewrite the law for their further consideration. On motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, current vouchers and payrolls were next approved as evidenced by General Fund Florida State Bank Vouchers Nos. 4578 through ~631; General Fund Sanford Atlantic National Bank Vouchers Nos. 119~2 through 12lA7; and Water and Sewer Revenue Fund Sanford Atlantic Natlional Bank Vouchers Nos. 1123 through 1136. Consideration was next given to a request by the Seminole High School Coach for use of the City's Stadium for football practice, since their field at. the school site is presently being overhauled with the installation of an irrigation system,~making it unplayable until next year; further, would consider using the area behind the bleachers, but were not financi- ally able to support any extra cost for such at this time. . Commissioner Raborn moved to authorize the City Manager to notify the Athletic Association that the use is allowed this Spring under the condition that the stadium field behind the bleachers, east of east bleachers, would be made available; not the actual playing field area, and such use to be at no extra charge. Seconded by Commissioner Baker and carried. Under a report of the City continuing to furnish office space, lights, heat, air conditioning, janitorial service, and liability for elderly people falling, inregards to Social Security use of the Municipal Courtroom at no cost~ Commissioner HiEginbotham moved to discontinue such practice and to notify the proper official of Social Security under General Services Administration that such space is needed, giving a 30-day notice to vacate City premises. Seconded by Commissioner Baker and carried with Commissioner Roberts abstaining. On motion of Commissioner Baker, seconded by Commi~ioner Roberts and carried, approval was next given for payment in the amount of $1,687.97, as submitted by Clark, Dietz and Associates for engineering services for March, 1966, in accordance With Schedule of Rates as outlined in Agreement dated J~ly 27, 1965, on Marina and Bo~ating Business Center on Lake Monroe on the St. Johns River-Lakefront Development Project-Landfill and Bulkheading. Martin Graham, Winn-Dixie Corporation, Jacksonville, Florida, submitted through a telephone request to the City Manager that consideration be given on the vacating and closing of Maple Avenue from 24th Place to 25th Street, to provide additional space for shopping area expansion of 40,000 square feet on their present site on the northwest corner of French Avenue and 25th Street, with need to set back to allow more parking and traffic flow. Commissioner Raborn moved that said request for ~.he vacating and closing of Maple from 2~th Place to 25th Street be denied. Seconded by Commissioner Baker and carried. On motion of Commissioner Baker, seconded by Commissioner Higginbotham and carried, approval was given to advertise a public hearing date for May 23, 1966, for consideration to vacate and abandon that portion of the north-south alley south of Commercial Street, between Commercial and First Street and between Park Avenue and Palmetto Avenue, as requested by Willie Hunt; legally described as that portion of the north-south alley lying between Lots E and F, Lakeview Park. Commissioner Higginbotham moved, seconded by Commissioner Roberts and carried, to adjourn to a Special Meeting'of May ll, 1966, at 2:00 o'clock P.
