Report No. 66-169, 911 and 913 Pine Avenue, was represented by property owner J. H. Beck. After discussion and consideration of same, Commissioner Higginbotham moved to authorize the granting of a period of 90 days in which to allow the property owner to either repair or demolish the duplex structure, under Report No. 66-169. Seconded by Commissioner Baker and carried. Report No. 66-163, 805 Pine Avenue, was represented by property owner Elsie Menendez. After consideration, Commissioner Baker moved to authorize the granting of a 90-day extension period in which to allow the owner to repair or demolish. Seconded by Commissioner Roberts and carried. On representation of property owner Howard Lee, motion of Commissioner Roberts, seconded by Commissioner Higginbotham and carried, a time period of 90 days was granted in which to repair or demolish the structure u~der Report No. 66-166, 2005 French Avenue. John Gibson next appeared representing Report No. 66-160, property located at Pine Avenue. After consideration, Commissione~aker moved to grant the 9O2 o~rner an extension period of 90 days for repair or demolition of the structure. Seconded by Com- missioner Higginbotham and carried. Appearing next in behalf of property identified as United Lumber Company, Report No. 66-157, property of Hr. William Toll, was Attorney C. Vernon Mize stating that the owner proposed to have a purchaser for the property within the near future. On motion of Commis- sioner Higginbotham, seconded bY Co~missioner Roberts and carried, a time period of 90 days was granted for the conclusion of any sale and repair or demolition of the structure. George H. Willis, Sr., represented property at 908 Elm Avenue, Report No. 66-1~9. After consideration, Commissioner Higginbothammoved to allow a time extension of 90 days in which to allow the owner to repair or demolish the building. Seconded by Commissioner Baker and carried. Report No. 66-152, 304 Sanford Avenue, was represented by its owner, Melvin Siskind. After discussion, a 90-day time period to repair or demolish was granted on the motion of Commissioner Baker, seconded by Co~missioner Higginbotham and carried. After consideration of Conde~tion Reports Nos. 66-146 through 66-171, and finding each building to be unsanitary, '~usafe, and dilapidated, Commissioner Baker moved that the buildings or structures covered by these reports be condemned and the owners given notice of 90 days to repair or remove, or give just cause why they are not repaired or removed, and after 90 days to authorize the City to remove the buildings or structures and levy a lien against the property for the cost of removing. Seconded by Commissioner Higginbotham and carried. The next order of business was a Public Hearing to consider the request of John D. Carlton for the changing of the zoning boundaries in which alcoholic beverages may be sold to include and allow the location at 2~01 French Avenue as a bar and package operation, as proposed and described in the following legal notice published in the Sanford Herald on Hay 13, 1966. H. on May 23, 1966, to to consider aa amendment to the Liquor Zoning Laws to include and allow the sale· of liquor at that certain property located at the southeast corner of 24th Street and French Avenue, more particular%y described as: Lots l, 2, 5, 4 and N 38.37 ft of Lot 5 (less R/W for Rd. 15-A) Beck's Addition, as recorded in Plat Book 5, Page lO1, Seminole ~ourut~ Records. Whelchel as City Clerk of the City of Sanford, Florida The Chairman announced that the Commission would be glad to hear from anyone in favor of, or against the amending of the liquor zoning boundaries, as advertised in the foregoing notice. G. Donald Bishop, Jr., 2404 Laurel Avenue, appeared to object to the rezoning for sale of liquor, and presented a supporting petition of objection of fourteen signatures of abutting property owners to the east of the proposed location in the 2400 Block, Laurel Avenue and Cordova Drive. After discussion, Commissioner Higginbothammoved that the proper ordinance be amended to include the location of 2401 French Avenue in the zoning boundaries in which liquor may be sold. Seconded by Commissioner Roberts, with motion failing to carry over the dissenting votes of Commissioners Baker and Wilson. After discussion, Commissioner Higginbotham moved that the matter be tabled until the arrival of Commissioner Raborn, and a full quorum would be present. Seconded by Commissioner Baker and carried. A Public Hearing was called into session next to consider the recommendation to the City Zoning and Planning Commission for rezoning of property on French Avenue fox commercial use, as proposed and described in the following legal notice published in the Saaford Herald on May 15, 1966. NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF TMM. CITY OF SANFORD, FLORIDA Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 P. H. on May 23, 1966, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: That property lying on the east side of French Avenue from 15th Street to 18th Street is proposed to be zoned C-1 (Neighborhood Commercial) District. Said property being more particularly described as follows: Lots i through 19, Amended Plat of Orange Heights, as recorded in Plat Book 4, Page 84, Seminole County Records. Whelchel As City Clerk of the City of Sanford, Florida There being no objections registered, Commissioner Higginbotham moved to authorize the City Attorney to draw an ordinance for first reading at the next regular City Commis- sion meeting, instituting the change in zoning from residential to commercial. Seconded by Commissioner Roberts and carried. Consideration was next given to a previous Public Hearing, as advertised and held on November 22, 1965, with the City Commission action to table and continue the hearing at a later dai.~e, regarding the request of Jeno F. Paulucci to close and vacate an alley within his property, described as the east-west alley lying between Lots ll and 24 and 12, 25 and 26, Block 9, Bel-Air, stituated between Washington and Jefferson Avenues and 20th and 24th Streets. Attorney Mack N. Cleveland, Jr., represented Mr. Paulucci's request for abandon- ment, stating his understanding that the residents abutting the alley were not being served by this particular alley-way; he further stated that Robert B. Axt, who preViously opposed the closing, was now withdrawing his opposition. Richard F. Mapes, 2020 Adams Avenue, appeared and registered objection to the closing on the basis of daily usage of the alley as a short cut between Hellonville and Adams, which eliminated driving around the block 'to his residence. After consideration, on motion of Commissioner Higginbotham, seconded by Commis- sioner 'Baker and carried, the City Attorney was instructed to prepare the proper ordinance for the closing and abandonment of tha~ particular alley, as described in the foregoing paragraph, with the City retaining a utility easement within said alley; ordinance to be placed on first reading at the next regular meeting. A Public Hearing was next called to consider the request of Willie .Hunt for vacating and closing the north-south alley between Rands Avenue and Palmetto Avenue, as advertised in the Sanford Herald on May 15, 1966. NOTICE OF PROCEEDING FOR VACATING AND CLOSING AN ALLEY TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on May 25, 1966, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to that certain alley, hereinafter described, to wit: That portion of that certain north-south alley lying between Lots E and F, Lakeview Park, as recorded in Plat Book 5, Page 41, Seminole County Records. Kenneth McIntosh, Chairmanof the Lake Monroe Development Beautification Committee of Seminole County Chamber of Commerce, presented a proposal for ~he City to install street lights on the lakefront along Seminole Boulevard, from Mellonville Avenue west to French Avenue and a continuation from French Avenue to Interstate 4, and the possible procurement of the land at French and 17-92 for the erection of a fountain or a lighted tower. He requested a recommendation from the City to the County asking for a transfer in use of State Road Department beautification funds from SR 46 to Seminole Boulevard. Scott Burns, Manager, Florida Power & Light Company, outlined several cost pro- posals on the Boulevard lighting using 20,000 or 7,000 lumen lighting, or both, and gave the annual power cost to the City under both City owned or company owned plans. After consideration, on motion of Commissioner Higginbotham, seconded by Commis- sioner Roberts and carried, authorization was given as follows, relative to the lighting beautification proposal, whereby the Ci~Commission approved of the recommendations as outlined by the Committee: (a) City Manager to work with the designated committeemen in charge of various details to further pursue the proposal regarding materials and cost of the lighting system. (b) Contacting of Albert Jarrell, property owner of the triangle at the intersection of French and 17-92 regarding a feasible sale price of the approximated 560 x 280 x 290 feet of land to the City relative to this particular beautification proposal. (c) The City Manager prepare the necessary letter to the County Commission endorsing by the City Commission the recommendations of this committee and requesting them to consider authorizing the transfer of State Road Department beautification funds from SR 46 to Seminole Boulevard to institute the lighting proposal on the lakefront from Mellonville to Interstate 4. Gary Pickren, Manager, A B C Ambulance Service, Deland, Florida, appeared before the Commission, stating that the proposal as presented at their prior meeting for obtaining a franchise to operate an ambulance service in the City of Sanford be withdrawn. Robert Brisson stated that the Brisson Funeral Home would not be operating ambu- lance service after June 1st. Attorney George Andrew Speer, representing Gramkow Funeral Home, stated that Gramkow would continue to furnish ambulance service after June 1st until other satisfactory arrangements could be made. A full quorum now being present, the Public Hearing on the request of John D. Carlton to operate a package store and bar at 2~01 French Avenue, was called back into session. G. Donald Bishop, Jr., reiterated his objection to the Commission. On request of the Commission and the agreement of John D. Carlton, as the new property owner, to effect a fence to create a~buffer of privacy for the residents across the west alley, the vote on the motion to approve the location for a package and bar opera- tion and authorize the City Attorney to prepare an ordinance pertaining ~o same, stands as follows on roll call: 233" MINUTES- City COmmission, Sanford,' Florida .. Commissioner Higginbotham next introduced Ordinance No. 884, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN ~ CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER, IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS. OF 1957. and same was placed on its first rea,ding and read in full. Commissioner Higginboth.am then moved on the waiVer of the requirement of the second reading of Ordinance No. 884, and that same be placed on its final passage and adoption. AREA OF TN.F. CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED MR. REINAFTER, IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. On request of the City Attorney that before the preparation of a new ordinance amending the dog ordinance to establish the daily board fee at $1.50 it would be advisable for further interpretation regarding present charges as set up for daily board, pickup fee, and particular indication to female dogs. After discussion, Commissioner Higginbotham moved that the City Attorney be iiauthorized to prepare the necessary ordinance amending the existing dog ordinance regarding ii fees there~n, and to establish a fee of $1.50 per day on all dogs, male or female, picked iup and boarded. Seconded by Commissioner Raborn and carried. Commissioner Baker moved that a $5.00 pickup charge be applicable and included in the new dog ordinance. Ho~ion died for lack of a second. On motion of Commissioner Roberts, seconded by Commissioner Reborn and carried, payment for the month of April, 1966, amount of $704.95, to A. C. Doudaey Surveyors, Inc., was authorized, as evidenced by invoice dated May 15, 1966, Job No. 156-65, applying to survey services performed on the lakefront-bulkheading-landfill project, as authorized under Schedule of Rates, Contract Agreement of J~y 27, 1965, with the City's engineering firm of 234 MINUTES City Commission, Sanford, Florida May 25 at 8 P. M. 19 66 Clark, Dietz and Associates on the Lakefront Development-Marina Project. A letter of request from owner Don W. Tauscher of Commodore Apartments was next considered for the installation of a street light on the north side of the apartment building at the corner of Onora Road and Magnolia Avenue. After discussion, Commissioner Baker moved to deny the request as there is an existing light across the street, and street lights on Onora Road need to be reviewed and possibly increased to a 4,000 or 7,000 lumen lighting and the overall plan be placed in ~he coming budget for further consideration. Seconded by Co~missioner Raborn and carried. Addendum of minutes of February l~, 1966, minutes of regular meeting of April 25, 1966, and special meeting of May 16, 1966, were next approved on motion of Commissioner Roberts, seconded by Commissioner Raborn and carried. Consideration next given to Acting City Manager appointment while the City Manager and the City Clerk are out of town May 26 through May 28, 196~. Commissioner Raborn~moved that Mary J. Harkey, secretary to the City Manager, be appointed Acting City Manager for that period. Seconded by Commissioner Roberts and carried. On motion of Commissioner Roberts, seconded by Commissioner Higginbothamand carried, the following transfer of fmuds was authorized from Contingency Account No. 8150 to City Manager Accounts as follows: Account No. 1201 - Salaries $960.00 Account No. 1212 - Furniture, Fixtures & Office Expense $809.00 (for desk, chair, 2 lights and T/W) Consideration next given to a proposed plan~of investments of the Public Improve- ment Bond Sale proceeds, placing $100,000.00 in all three depositories, all to meet highest interest rate paid, and the balance not immediately needed to be placed in U. S. Government Treasmry bill. Commissioner Raborn moved that this plan be treated the same as any other previous bond issues and finance plan in regards to capital improvements, and that the construction checking account for the lakefront project be arranged by the Finance Director as he would normally arrange the balance in the various banks. Seconded by Commissioner Baker and carried. After consideration, and on motion of the Police Chief, Commissioner Baker moved to deny the request of Lloyd Scruggs, d/b/a E & L Grocery, 1301 Celery Avenue, to change the beer and wine license to consumption on premises, seconded by Commissioner Raborn and carried. Commissioner Raborn next moved to authorize the transfer of funds within the !!Engineering Division accounts in the amount of $65.00 from Account No. 5007, Travel Expense, to Account No. 5012, Furniture, Fixtures and Office Equipment, for the purchase of an office chair. Seconded by Commissioner Baker and carried. Under discussion of a memo dated May 19, 1966, submitted by the Recreation Director, regarding the City Municipal Swimming Pools, Commissioner Raborn moved to reaffirm the City Commission's position of compliance with the Civil Rights Act~:~ of 196~.
