The City Commission of the City of Sanford, Florida, met in re~lar session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on February 13, 1967. Present: Commissioner J. B. Williams The meeting was called tO order by the Chairman. The first order of business was a continued Public Hearing of December 27, 1966, advertised in the Sanford Herald on December 19, 1966, to further consider the vacating and closing of the north-south alley lying between Commercial and Fulton Streets west'of Park Avenue and west of Pico, Masonic Lodge, and Park-Fulton buildings. Said continuation at the request of attorney for the Masonic Lodge property. The Chairman announced that the Commission would be glad to hearfrom anyone in favor of, or against, closing the alley as advertised in the aforementioned notice. Attorney Mack N. Cleveland, Jr., appeared to represent the interest of Masonic Lodge No. 62, F. & A. M., and stated that prior opposition of his clients had now been settled through a compromise with the Florida State Bank, Howard McNulty, President, to close the alley from Commercial Street north to approximately the southwest corner of the Masonic Lodge building. After discussion and there being no opposition, Commissioner Higginbotham moved to approve the abandonment and closing of that portion of the alley as agreed upon, with the City to retain all easements, and further, to authorize the City Attorney to prepare the proper ordinance for same. Seconded by Commissioner Roberts and carried. The next item of business was the holding of a Public Hearing to consider a request of Donald R. Graham, Administrator, Seminole Lodge Nursing Home, for vacating and closing the street right of way~ as advertised in the Sanford Herald on January 30, 1967. NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABANDONING A PORTION OF A STREET TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on the 13th day of February, 1967, at the City Commissioner~! Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the Public in and to that portion of a street hereinafter described, to wit: That portion of Bay Avenue lying south of the westerly extension of the southerly rightj, of way of Third Street, and north of the westerly extension of northerly right of way of Fourth Street. Fi. 19 67 345 After discussion of the platted streets and their future needs within this area, Commissioner Roberts moved that the request be denied, on the basis that the closing was not in the best interest of the citizens of the City. Seconded by Commissioner Wilson and carried. The Chairman a~nounced that the next order of business was a Public Hearing to consider the rezoning recommendation of the Zoning and Planning Commission, as advertised in the Sanford Herald on February 5, 1967. The Zoning and Planning Commission having recommended that the City Commission hold their ~ablic Hearing without benefit of the Zoning goard holding a prior Public Hearing, due to expediency being a prime factor. NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on February 13, 1967, to consider the following cha~ges and amendments to the Zoning Ordinance of the City of Sanford, Florida: The following described property, now zoned R-5 (Multiple Family Dwelling) District, is proposed to be zoned C-1 (Neighborhood Commercial) District: Parcel of land situated in the City of Sanford bounded on the north by the southerly R-W of Seminole Blvd; on the south by the northerly R-W of First Street; on the east by the westerly R-W of Fiellonville Ave; & on the west by the easterly R-W of Sanford Ave. All parties in interest and citizens shall have an opportunity to be heard at said hearing. Attorney C. Vernon Fiize, Jr., appeared, representing Col. James G. Truitt and Kenneth Fi. Leffler, Trustee, sellers of Lots l, 2 and 5, Block l, San Carlos Subdivision, explaining the proposed use of the property to be development of an international commercial office for Jeno F. Paulucci Enterprises. Floyd C. Richards, 107 North Mellonville Avenue, spoke in behalf of himself and of Thomas J. Maloney, 105 Mellonville Avenue, his neighbor, in that they were not objecting to commercial zoning of the three lots, but objected to the larger area. They questioned the future use of property now held by the radio station and the hospital within the anticipated larger area. llso appearing regarding the ~ezoning for purpose as to the height.of the proposed construction was Myron A. Reck, owner of WTRR Radio Station, relating that for a statement of record and in conjunction with the original purchase of his property, the Lot (No. 2) directly behind his radio station, and owned by the City at that particular time, carried a 99-year lease for utility easement, and that the mat for the station's antenna wires were on the property, and questioned the provisions being provided or continued for same. The City Attorney advisedMr. Reck that this was a matter between him and the present and/or future property owners, and that the City did not now hold title to the property in question. Commissioner Higginbotham then moved on the waiver of the requirement of the second reading of Ordinance No. 900, and that same be placed on its final passage and adoption. Motion seconded by Commissioner Wilson. Next submitted for discussion and read by the Chairman was a proposed draft of an ordinance to create a City of Sanford "Industrial Commission". Such a board to procure in- dustry for the City of Sanford and its environs. After discussion and clarification of several points, Commissioner Higginbotham moved to authorize the City Attorney to prepare an ordinance pertaining to same. Seconded by Commissioner Roberts and carried. After discussion, and on motion of Commissioner Roberts, seconded by Commissioner Higginbotham and carried, the following seven names were approved and appointed as charter members to the Cityof Sanford Industrial Commission: Howard H. Hodges, Howard C. McNulty, Lee P. Moore, Jeno F. Paulucci, A. K. Shoemaker, Jr., Harold L. Slama, and Ernest M. Southward. On motion of Commissioner Roberts, seconded by Commissioner Higginbotham and carried, the setting of the tenure of office for each member of the Industrial Commission was approved by a procedure of drawing same "out of a hat". After discussion and on recommendation<~of the Police Chief, Commissioner Higgin- botham moved to approve the request for transfer of alcoholic beverages licenses as follows: License No. 56, O. E. Farrell, d/b/a Arcade Package Store, 510 East First Street, to Elizabeth A. d'Aversa, d/b/a Rex Liquor S$ores, 2701-A Orlando Drive - operation of package store only. Seconded by Commissioner Roberts and carried over the opposing vote of Commissioner Wilson. On motion of Commissioner Wilson, seconded by Commissioner Roberts and carried, B. L. Perkins, Jr., was reappointed for a three year term to the Board of Adjustment, effective March l~, 1967. .After discussion and on motion of Commissioner Higginbotham, seconded by 0ommis- sioner Roberts and carried, approval was given on the request of Myron A. Reck, owner of local Radio Station WTRR, for partial use of the Youth Wing in conjunction with their spon- sorship of the annual Sanfo~ama Home and Hobby Show to be held in the Civic Center in April, 1967. Municipal Judge C. Vernon Mize, Jr., and the Police Chief next appeared to discuss the feasibility of their request to change and establish new dates and time for Municipal Court cases. The revised court schedule also being more compatible to the recent change of hours in the shifts of the police officers. The City Attorney rendered the opinion that the revised time and dates appeared feasible and warranted a trial. On motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, the revised Municipal Court schedule was approved for setting the court sessions to be held on each Tuesday and Friday at 8:00 A. H. for traffic cases, and each Wednesday at 8:00 A. M. for all other cases. The Building Official next discussed with the Commission that, as a prerequisite for participation in the Federal Aid Programs, the requirement of Housing Urban Development is that City Codes must be adopted and enforced six months prior to application for the code enforcement programs. In preparation for these programs, he outlined the need for the adoption of the authorized Southern Standard Minimum Housing Code, with the reservations; adoption of the Southern Standard Gas Code; and updating the Fire Prevention Code and the Southern Standard National Electrical Code by adopting the 1965 Editions; in addition to adopting the 1966 amendments to the presently adopted 1962-63 Edition of the Southern Stand- ard Building Code, Part III Plumbing. The Commission requested that copies of these ordinances and amendments thereto be furnished for their perusal with this work to be pursued. After discussion and on motion of Commissioner Higginbotham, seconded by Commis- sioner Roberts and carried, a verbal request from property owner Walter Allender, Route 2, Box 590, for annexation and provision of water service regarding property outside the City limits on Tangerine Avenue, area of Tangerine Avenue and Orange Avenue southeast of Sunland Estates, was denied on the basis of the lack of customer potential and the improbability of annexation to the City in the near future. A letter submitted by Mrs. Fred (Dorothy) Ganas, member of City Beautification Committee, was next discussed, wherein she recommended that future City beantification be 3et forth by professional personuel under a master beautification plan. The Commission recom- be aended that this/held in abeyance for future budget consideration and/or the possibility of ~oinciding with the professional beautification plan for the lakefront project. Commissioner Higginbotham next moved to authorize the City Attorney to prepare the lecessary documents for the 1967 Legislatiive Delegation, to eliminate court cost as a method 348 MINUTES City Commission, Sanford; Florida February 13 at 8 P. M. 1967 of contribution of the City to the Policemen's Pension Fund, and the City to supplement this fund in lieu of Court Cost. Seeonded by Commissioner Raborn and carried. Consideration next given to the report of recommendations submitted by the City Manager as to funds in various accounts of the present budget available for transfer, both to accounts which now have been overspent, and to accounts to be established creating opera- tional funds for the newly formed Sanford I~dustrial Commission. After discussion, Commissioner Roberts moved to Dransfer the following: From Contingency Account No. 8150 to: (a) Equipment Repairs & Maintenance Account No. 4319, the amount of $540.00, to cover cost of compressor (b) Furniture & Fixtures & Office Equipment Account No. 4212, the amount of $265.00, to cover cost of compressor (c) Off Street Parking Fund Account No. 8192, the amount of $426.00, to cover cost of interest on note (d) (e) Use of County Dump Account No. 4954, the amount of $860.00, for dump charges Transfer from Unappropriated Surplus Account No. 8199, the sum of $19,~89.55, to Contingency Account No. 8150. Seconded by Commissioner Raborn and carried. On motion of Commissioner Roberts, seconded by Commissioner Raborn and carried, current vo.uchers and payrolls were next approved, as evidenced by General Fund Florida State Bank Vouchers Nos. 5104 through 5152; General Fund Sanford Atlantic National Bank Vouchers Nos. 13779 through 14015; Water and Sewer Revenue Fund Sanford Atlantic National Bank Vouch- ers Nos. 1245 through 1260; Florida State Bank Municipal Improvement Construction Fund Vouchers Nos.. 59 through 61; Sanford Atlantic National Bank Municipal Improvement Construction Fund Vouchers Nos. 17 and 18. Commissioner Wilson next introduced Ordinance No. 901. entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 4, THE CODE OF THE CITY OF SANFORD1954:~ AS AMENDED SAID CHAPTER DEALING WITH ALCOHOLIC BEVERAGES, SAID AMENDMENT ADDING THERETO SECTION ~-3.1 PROHIBITING THE POSSESSION OF ALCOHOLIC BEVERAGES, AS DEFINED, BY MINORS. On motion of Commissioner Wilson, seconded by Commissioner Raborn and carried over the dis- senting vote of Commissioner Higginbotham, Ordinance No. 901 was placed on its first reading and read in full. Following a discussion of the County Commission's reply that funds were not available at this time to participate in the City-County joint street lighting proposal on Highway 17-92 around Lake Monroe, theCity Gommission instructed the City Manager to proceed with the street ligh3ing installation on Seminole Boulevard from Mellonville Avenue to Mangoustine Avenue. Consideration next given to a request for water service and annexation at lO19 Sarita Street by Mortgage Guaranty Insurance Corporation, and on motion of Commissioner Raborn, seconded by Commissioner Roberts and carried, the same was denied. Consideration next given a request to obtain an easement for a radio ground net and guy wires on the marina landfill site, and after discussion, Commissioner Raborn moved to deny the request.
