022767 MINUTES City Commission, Sanford, Florida February 27 at 8 P. M. 19 67 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P.'M. on February 27, 1967. Present: Commissioner J. B. Baker, Mayor " Earl Higginbotham " M.L. Raborn, Jr. " W. Vincent Roberts A.L. Wilson City Attorney Wm. C, Hutchison, Jr. City Clerk H. L. Whelchel Police Chief A. S. Williams Absent: City Manager W. E. Knowles The meeting was called to order by the Chairman. The first item of business was the presentation of a resolution of Kiwanis Club of Sanford by Gordon Meyer, President. The resolution was read by the Chairman, wherein the Kiwanis supported the relocation of the Municipal Zoo project as to a bigger and better new Zoological Park-Gal..dens and recommended the Commission give it priority consideration as a valuable tourist attraction. The Chairman thanked Mr. Meyer for the Kiwanis' interest and stated that the Commission would take the resolution under consideration. Next discussed was the request of E. J. Moughton, Jr. for leasing °£ the Civic Center on March 10, 1967, with alcoholic beverages privileges in conjunction with a special dinner event honoring Republican Edward Gurney. On motion of Commissioner Roberts, seconded by Commissioner Higginbotham and carried over the dissenting vote of Commissioner Wilson, approval was given for rental of the Civic Center for such use at the established rate of $250.00. After discussion, Commissioner Raborn moved that the .request of B. F. Williams, 2607 Laurel Avenue, for a street light installation in the alley between Laurel and Elm Avenues in the 2600 block, be denied. Seconded by Commissioner Higginbo~am and carried. After consideration and on motion of Commissioner Higginbotham, seconded by Commis- sioner Roberts and carried, authorization was given for payment of $17,607.9# to contractor Houdaille-Duval-Wright Company, as submitted on Invoice No. 23&82, dated February 6, 1967, on dredging and bulkheading for Lakefront Marina, for work and'~materials completed through February 6, 1967, as approved b~'the City project engineering firm Clark, Dietz and Associ- ates and the City ManAger, and as authorized under agreement for Riverport Marina, dated March 24, 1966. On recommendation of the City Manager, motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, the following City employees were approved for a salary reclassification: Greensbury Townsend, Sewer Division Willie Allen, Utility Plants From: To: From: To: Laborer 1-C ($57.38/week) Laborer 1-D (~59.50/week) Laborer 1-C ($57.38/week) Laborer 1-D ($59.50/week) After consideration and on motion of Commissioner Wilson, seconded by Commissioner Roberts and carried, the resignation of A. W. Lee, Jr., as member of the City of Sanford Zoning and Pla~ing Commission was accepted with regrets, and the City Attorney was authorized to p~epare an appropriate resolution for presentation at the next meeting regarding his years of service contributed to this Board. Consideration was next given to a request of Ellie M. Chester, Lake Mary, Florida, regarding an amendment to Section 18-34, City Code, to wit: prohibiting of minors frequenting poolrooms. M. 19 67 351 Center at 980 State Street, Sanford Shopping Plaza, with ten pool tables, and intends to cater to family or teen-age groups. No alcohol would be served or allowed on the premises, and no gambling would be allowed. He felti~that persons classified under the age of twenty-one should not be prohibited from participating in a clean family sport. After discussion and on recommendation of the City Attorney, Commissioner Higgin- botham moved that the City Attorney be authorized to prepare the proper ordinance to amend Section 18-357of the City dode with the age classification either being eliminated, or keyed to poolroom establishments which offer no sale or consumption of alcoholic beverages and no gambling on premises; and that Mr. Chester be allowed to open his business establishment on the basis of the code being so amended. Seconded by Commissioner Roberts and carried. Commissioner Higginbotham next introduced Ordinance No. 902, entiled: AN ORDINANCE OF T_M~, CITY OF SANFORD, FLORIDA, CREATING AN INDUSTR~ CON- MISSION FOR THE PURPOSES OF PROMOTING INDUSTRY IN SANFORD AND ITS ENVIRONS. and same was placed on its first reading and read in full. Commissioner Roberts then moved on the waiver of the requirement of the second reading of Ordinance No. 902, and that same be placed on its final passage and adoption. Motion seconded by Commissioner Higginbotham. Said Ordinance No. 903 was then placed on its final passage and adoption, the roll was called and the vote stands as follows: Commissioner Baker Yea " Higginbotham " Raborn " " Roberts " Wilson " Thereupon, the Chairma~announced that the City Commission of the City of Sanford, Florida, by unanimous vote had passed and adopted said Ordinance No. 903, entitled: AN ORDINANCE-OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABAndON- ING A PORTION OF THAT CERTAIN NORTH- SOUTH ALLEY IN BLOCK 1, TIER 4, E. R. TRAFFORD'S MAP OF SANFORD, IN ~ CITY OF SANFORD, FLORIDA. On motion of Commissioner Roberts, seconded by Commissioner Raborn and carried, a public hearing date was set for March 13, 1967, for consideration of abandoning and closing of the east-west alley west of Park Avenue, between the Edwards and MasonicLodge buildings, and the City Clerk authorized to advertise same. After discussion, Commissioner Higginbotham moved that the second reading of an ordinance prohibiting the possession of alcoholic beverages by minors be tabled for further and extensive study. Motion died for lack of a second. Commissioner Roberts then moved that the second reading of the ordinance prohibi- ting the possession of alcoholic beverages by minors be tabled until the next regular meeting of the Commission. Seconded by Commissioner Raborn and carried. On motion of Commissioner Raborn, seconded by Commissioner Roberts and carried, the minutes of January 23, and February 13, 1967, were approved. After consideration, Commissioner Higginbotham moved to der4y the request of the City of Miami for the City of Sanford to assist in sharing litigation expenses relative future hearings regarding rates of the Florida Power and Light Company and the Southern Bell Telephone Company. Seconded by Commissioner Raborn and carried. After consideration, Commissioner Higginbotham moved to authorize the City Attorney to draft the proper ordinances for adoption as follows: (a) Southern Standard Minimum Housing Code (with the authorized reservations) (b) Southern Standard Gas Code (c) Fire Prevention Code by adopting the 1965 Edition (d) Southern Standard National Electrical Code by adopti~g the 1965 Edition (e) 1966 amendments to the adopted 1962-63 Edition of the Southern Standard Building Code, Part III Plumbing. Above subject to the deletion of certain portions which are objectionable to the City's operation, so long as such portions which are objectionable do not jeopardize the City's qualifications under the federal aid program that the City ~s now seeking.
