050867 MINUTES City Commission, Sanford, Florida'May 8 at 8 P. M. 19 67 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on May 8, 1967. Present: Commissioner J. Butler The meeting was called to order by the Chairman. Appearing as spokesmen for a petition of request for the City to pave East 24th Place, from Sanford Avenue east to Grandview Avenue; and Grandview Avenue north of East 2&th Place, north to the dead-end~ were property owners H. L. (Brad) Foley, 2&13 Grandview Avenue, and J. Stanish, 2415 South Sanford Avenue. Mr. Foley and Mr. Stanish indicated that all property owners, with the exception of one, owning vacant land but not residing on the above named streets, were now willing to participate and pay their share of the cost by either: (a) under the City's requirement of total payment before start of the project; (b) monthly payments prorated over a period of time; (c) additional assessment to be included in their tax bill. 'The City Attorney pointed out that upon paving being deemed a necessity for the general public any abutting property owner :refusing to participate would be subject to a paving lien and same could be assessed against that particular property. After discussion, Commissioner Higginbotham moved to authorize the City Attorney and City Manager to proceed with the legal requirements as necessary for implementing assess- ment of street paving costs against the property owners in the aforementioned area and that the City's pro rata share of such paving costs be included in the 1967-68 Budget. Seconded by Commissioner Roberts and carried. After consideration and on recommendation of the City Manager, Commissioner Roberts moved to authorize the installation of three street lights on Myrtle Avenue between 26th Street and 27th Street, within a newly annexed area. Seconded by Commissioner Raborn and carried. Next under consideration was a letter from Howard Hodges, President of the Sanford Atlantic National Bank, requesting an opinion of the Commission relative to the abandonment and closing the east-west portion of the "T" alley south of the bank property. After dis- cussion of various complications, Commissioner Raborn moved to authorize the City Manager to meet with officials of the Sanford Atlantic National Bank to explain problems involved and to conduct a study with those persons concerned of the feasibility of closing same. Seconded by Commissioner Roberts and carried. Next under discussion was the information submitted by the City's insurance repre- sentative relative to an increased premium cost of $1,500.00 annually on the excess liability policy for City vehicles, allowing the limit of $900,000.00 for any one person and $700,000.00 for any one accident, giving a $1,000,000.00 coverage for bodily injury. On motion of Commis- sioner Roberts, seconded by Commissioner Raborn and carried, the City Manager was authorized to negotiate with the City's insurance representative regarding further information on same. After consideration, Commissioner Roberts moved to approve the transfer of $2,110.00 from Contingency Account No. 8150, to Refuse Account No. ~95~, to cover the expense for the balance of the 1966-67 fiscal year, for the City's use in the disposal of refuse at the County MINUTES' · City Commission, Sanford, Florida May (3 .at 8 P. After consideration and on motion of Commissioner Roberts, seconded by Commissioner Higginbotham and carried, authorization was given for payment of $23,4~9.39 to Bercleve Unifloats, Inc., as submitted on Statement No. l, dated May l, 1967, for work and materials completed through April 30, 1967, for Floating Piers and Associated Work for the Lakefront Marina Project, as approved by the City project engineering firm Clark, Dietz and Associates and the City Manager, and as authorized under Agreement for same, dated January 3, 1967. After consideration and on motion of Commissioner Roberts, seconded by Commissioner Higginbotham and carried, approval was granted for payment of $10,808.10 to Shoemaker Con- Struction Company, Inc., as submitted on Statement No. l, dated May l, 1967, for work and materials completed through April 30, 1967, on the public launching ramp for the Lakefront Marina Project, as approved by the City project engineering firm Clark, Dietz and Associates and the City Manager, and as authorized under Agreement for Miscellaneous Marina Facilities, dated March 27, 1967. Under discussion of payment of the March and April, 1967, statements submitted by the Seminole County Humane Society for dog services rendered to the City, the City Manager reported that under the prior request of the Commission, no complaints against the services of the Humane Society had been received by the respective City offices keeping such records. Commissioner Higginbotham moved that the request by the Seminole County Humane Society for payment of $~16.66 be denied. Motion died for lack of a second. Commissioner Roberts moved to authorize the payment of $~16.66 to the Seminole County Humane Society for services rendered for March and April, 1967. Seconded by Commis- sioner Raborn and carried over the dissenting vote of Commissioner Higginbotham on the basis that benefits from the payment of such monies has not been seen. Commissioner Raborn next introduced Ordinance No. 915, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABAN- DONING THOSE CERTAIN STREETS AND ALI,EYS, HEREINAFTER DESCRIBED, IN THE CITY OF SANFORD, FLORIDA. On motion of Commissioner Raborn, seconded by Commissioner Roberts and carried, Ordinance No. 915 was placed on its first reading and read in full. After consideration, Commissioner Roberts moved to approve the reappointment of Clarence L. Redding to serve as a member of the Sanford Housing Authority for a four-year term, effective May 20, 1967. Seconded by Commissioner Higginb0~tham and carried. After discussion and on motion of Commissioner Roberts, seconded by Commissioner Raborn and carried, prior action authorizing the City Attorney to prepare the appropriate resolution in support of an effort to move the State Capital to the 8enter of the state and more specifically to the City of Sanford and its environs was tabled. After consideration, Commissioner Higginbotham moved that the City Manager and City Attorney be designated the responsibility of reviewing all current bills before the State Legislature and that bills affecing local municipalities and needing their perusal be brought to their attention. Seconded by Commissioner Raborn and carried. Under prior action of April 2~, 1967, approving the expense of same, and on motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, the statement submitted for the lobbyist service of Fiack-N. Cleveland, Jr., in the amount of $150.00, regarding the City's current legislative bills before the State Legislature, was approved. Consideration next given to Florida League Fiunicipalities' increase of annual membership fees from $900.00 this past year to $1,200.00 next year. It was noted that this is the second $300.00 increase in dues in the past two years. On motion of Commissioner Higginbotham, seconded by Commissioner Raborn and carried, the City Manager was authorized to notify, in writing, Gordon T. Butler, Executive Director, Florida Municipal League, that the City of Sanford was agreeable to continuing their membership in the League only at the annual fee of $900.00. Next under discussion was the request by the State Beauticians' Conference for a rate reduction on Flay 23, 1967, from the present fee of $250.00 for any one event held at the Civic Center with the serving of alcoholic beverages. This date being in conjunction with their five-day use of the Civic Center Auditorium. After consideration, and on motion of Commissioner Roberts, seconded by Commissioner Raborn and carried, the State Beauticians' Conference was authorized use of the Civic Center and the serving of alcoholic beverages on Flay 23, 1967, at the established rate of $250.00~ Under prior action of the Commission approving the installation of whiteway street lighting on Seminole Boulevard, the City Manager pointed out that the power company's pro- posed plan had anticipated the spacing too great and the recommended design now reflects closer spacing which wmuld require additional lights and cost. After discussion, Commissioner Roberts moved to approve the additional street lighting and costs on Seminole Boulevard, from Mellonville Avenue west to Mangoustine Avenue. Seconded by Co~missioner Raborn~and carried. After Consideration and on motion of Commissioner Higginbotham, seconded by Commis- sioner Raborn and carried over the~dissenting vote of Commissioner Roberts, the request for a donation of $100.00 by the AAU Swimming Association was denied, as it would set a precedent for all other clubs in the same category.
