081467 MINUTES City Commission, Sanford, Florida August 14 at 8 P.M. .1~ 67 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. Knowles City Clerk H. L. Whelchel Police Chief Ben E. Butler The meeting was called to order by the Chairman. The first item of business was a continued discussion from two prior meetings of July l0 and July 24, 1967, relative to a site selection for the proposed Neighborhood Facili- ties Building. The City Manager reported that in making contacts to negotiate a purchase price on the proposed location of the vacant Nehi Bottling Company building, corner of Sixth Street and Pecan Avenue, a~letter had been received stating that the property had been re- cently sold at a sale price of $75,000.00. The Manager further relayed information that through a recent visit from the Neighborhood Facilities Coordinator, Department of Housing and Urban Development, Atlanta, Georgia, it was learned that if federal funding were to be considered for the proposed project that (1) there would have to be a "fixed" site location; (2) funds are available; (5) the City would be required to pay 25% of the costs of the pro- posed project; (4) applications are being accepted; (5) no assurance that application would be approved or expedited if in case this were a "quick ~eed" project. The discussion brought forth the subject that the City could not by-pass the federal requirement that sets forth the use of the building by the Community Action Programs or anti- poverty programs. Commissioner Rab~on moved that after due consideration that the City Commission go on record in that the City Commission will undertake the project of construction of a Neighborhood Facilities Building on their own and that funds be budgeted in the next 1967-68 budget for a down payment with the project to be financed over a five-year period. Seconded by Commissioner Roberts and carried. A discussion was next held regarding a letter of request from Harold L. Slama, Monroe Harbor Marina lessee, and also signed by C. E. Merrill, Jr., Holiday Inn lessee, as c:ooncurring with the request for the City to pave a City maintained and a City property area of approximately 190-car stalls parking lot on the north end of the landfill site as designa- ted on the layQut of the Lakefront Development Project-Marina-Motel complex. The City Manager stated that present plans of this particular area calls for heavy stabilization, or referred to as light paving, with the'probability of this area being used as an overflow parking area for the motel and marina. After consideration, Commissioner Higginbotham moved to pave that portion west of the marina building to the ramp. Seconded by Commissioner Roberts and carried over the dis- senting vote of Commissioner Baker on the basis that such paving costs should be handled under 1967-68 Budget Hearings. After discussion of same, Commissioner Higginbotham moved to approve that the City of Sanford allow Ashland Oil Company a permit for the installation of five 3,000 gallon fuel l~itanks, eight fuel pumps, one 5 x 30 foot sign, and a conopy over the pumps to be installed Ii!on City property west of the marina building on the Lakefront DeveLopment Project site; i:iapproximately $15,000.00 to be expended on equipment by this company. M. 19 67 411 Commissioner Roberts qualified his second by stating his opposition to the sign advertiii~g the oil company due to its size, more particularly the height of ~0 feet, and recommended that the authority to effect the sign be held in abeyance until more information and a sketch of same could be presented to the Commission. The Chairman then asked for a roll call on the vote and the Vote stands as follows: Motion failed to carry~~ Commissioner Baker Naye " Higginbotham Aye " Raborn Naye " Roberts Aye " Wilson Naye Commissioner Roberts moved that due authority be given to the appropriate individual for the installation of five tanks, eight fuel dispensers, and a canopy on City property west of the marina building on the Lakefront Development site with the mutual location approved by the City Manager and the oil company, Seconded by Commissioner Raborn and carried. Consideration was next given to a request of Harold L. Slama, lessee, Monroe Harbor, for a beer license, consumption off the premises, at the location of the Marina Facility, Lakefront?Development Project, projecting north of Seminole Boulevard. The City Attorney advised the Commission of the covenants of the Hotel-Motel Lease with regards to exclusive ~ights for the serving of alcoholic beverages and recommended that this request be checked with the motel lessee. Commissioner Raborn moved that the request for the beer license at the marina be babled until the City Attorney could further check the convenants of the hotel and marina Leases. Motion died for lack of a second. After further discussion, Commissioner Roberts moved that the request for the beer License at the Marina be denied. Seconded by Commissioner Wilson and carried. Consideration was given next to a request by the postal officials for the City to oreak out the curbing and construct ramps in the Castle Brewer Court area of the Public ~ousing Authority, to better facilitate the mailman's bicycle use in the delivery of mail in ~he project. On motion of Commissioner Higginbotham, seconded by Commissioner Roberts and ~arried, the request was denied. After consideration of a petition request by residents and property owners for installation of two street lights in the area of 1311 Olive Avenue and on recommendation of :he City Manager, Commissioner Roberts moved to approve the installation of one street light [n this vicinity. Seconded by Commissioner Raborn and carried. After discussion and on motion of Commissioner Higginbotham, seconded by Commis- sioner Wilson and carried~ the request of the Florida League of Municipalities for the City ;o advertise in the convention issue of the Municipal Record at a cost of $120.00 was denied. After consideration and on recommendation of the City Manager for the need of an ~mergency purchase for the replacement of the cash register which was completely broken down ,n the Utility Administration Office, Commissioner Roberts moved to approve the purchase of new Burroughs machine at a cost of $452.35. Seconded by Commissioner Raborn and carried. On recommendation of the City Manager and after due consideration, Commissioner igginbotham moved that two City employees in the Utility Plants Division be approved for a ~alary reclassification as follows: William E. After consideration and on recommendation of the City Manager, Commissioner Higgin- botham moved to authorize the payment of the contractors' July statements, pertaining to their respective work on the Lakefront Development Project-Marina-Motel Complex, as approved by the City project engineering firm Clark, Dietz and Associates and the City Manager, and as authorized under their respective Agreements as follows: Bercleve Uniftoats, Inc.; floating piers and piling; evidenced by Statement dated August l, 1967; amount of $~0,8~.79; agreement of January'5, 1967. Misener Marine Construction, Inc.; bulkhead-breakwater work and piling; evidended by Final Sga~ement dated July 31, 1967; Invoice No. 129; amount of $16,769.$9; letter of agreement dated October 25, 1966. Shoemaker Construction Company, Inc.; marina-miscellaneous and community facilities building; evidenced by Statement No. $ dated August $, 1967; amount of $1~,895.19; agreement of March 27, 1967. Seconded by Commissioner Raborn and carried. Commissioner Higginbotham next introduced Ordinance No. 918, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA DESCRIBED HEREINAFTER, IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 57-1815, LAWS OF FLORIDA, ACTS OF 1957. On motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, Ordinance No. 918 was placed on its first reading and read in full. Ordinance No. 917, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, REGULATING PRODUCE PEDDI~RS; DEFINING THE SAME: PROVIDING EXCEPTIONS; PROVIDING PENALTIES FOR VIOLATION. placed on its first reading and read in full at regular meeting of July 24, 1967, was next placed on its final reading for passage and adoption. After being read in full, Commissioner Rabron moved on its final passage and adoption. Seconded by Commissioner Higginbotham and carried unanimously. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 917, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, P~GULATING PRODUCE PEDDLERS; DEFINING THE SAME; PROVIDING EXCEPTIONS; PROVIDING PENALTIES FOR VIOLATION. After discussion and on motion of Commissioner Wilson, seconded by Commissioner Raborn and carried, September 11, 1967, was set as a date for the City Commission to sit as a Board of Equalization in a public hearing to receive any complaints or objections on the 1967 Tax Roll, as revaluated and prepared by the Tax Assessor, and to consider adopting said Tax Roll. On motion of Commissioner Higginbotham, seconded by Commissioner Raborn and carried, current vouchers and payrolls were next approved as evidenced by General Fund Florida State Bank Vouchers Nos. 5461 through 5523; General Fund Sanford Atlantic National Bank Vouchers Nos. 150~7 through 15223; Water and Sewer Revenue Fund Florida State Bank Vouchers Nos. 56 through 68; Sanford Atlantic National Bank Municipal Improvement Construction Fund Vouchers MINUTES City Commission, Sanford, Florida August..l~ at 8 P.M. 1967 4i3 Nos. 29 and 50; Florida State Bank Municipal Municipal Improvement Construction Fund Vouchers Nos. 95 through 108. On motion of Commissioner Roberts, seconded by Commissioner Higginbotham and carried, minutes of July 24, 1967, were approved. The Manager presented a request of Howard Monteith for the City to authorize the Florida Power & Light Company to install a City street light in the alley to the rear of his residence located at ~O1 South Mellonville Avenue, wherein Mr. Monteith would reimburse the City the electrical rate of $5.10 a month. The request was on the basis that the Power Company's policy does not permit individual street lighting contracting to illuminate private property. After consideration, Commissioner Roberts moved to approve the request with the electrical rate to be paid in advance and on an additional service charge of 10%. Motion died for lack of a second. Commissioner Raborn moved that the request be denied in that to allow same would set a precedent. Motion died for lack of a second. No further action was taken on the matter. Consideration was next given to a request of Benjamin Holliday for a time extension on the structure under Condemnation Report No. 67-178, Group 12, located at 10et West Eighth Street, in':the name of Armon and Enoch Roberts, in~:that the property is now in an estate settlement, and on motion of Commissioner Wilson, seconded by Commissioner Raborn and carried same was approved for a 90-day extension to December 26, 1967, to allow the legal owner to repair or demolish the structure. After consideration and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, approval was given for the City to expend from Contingency Account No. 8150, $285.20 for a full page color ad in the local Sanford Herald newspaper to appear in the publication of the annual Progress Edition.
