City Commission, Sanford, Florida September 25 at 8 P. M. 1967
The City Commission of the City of Sanford, Florida, met in regular session at the
City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on September 25, 1967.

The meeting was called to order by the Chairman.
The first item of business was a Public Hearing to consider the recommendation of
!the Zoning and Planning Commission for the establishing of zoning to that of C-2, General
Commercial, for City Lakefront Marina Project at Seminole Boulevard and Palmetto Avenue, as
!iadvertised in the Sanford Herald on September 15, 1967.
NOTICE OF PUBLIC HEARING OF PRGPOSED CHANGES AND
AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF
THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA.
Notice is hereby given that a Public Hearing will be held at the Commission Room
in the City Hall in the Oi~y:ioflSanfOrd, Florida, at 8:00 o'clock P. M. on September 25, 1967,
to consider the following changes and amendments to the Zoning Ordinance of the City of
Sanford, Florida:
That property lying northof Seminole BoUlevard, extending into Lake Monroe, re-
iferred to as the Lakefront Marina, presently zoned R-1AA (Single Family Dwelling) District,
lis proposed to be zoned C-2 (General Commercial) District. Said property being more particu-
'larly described as follows:
Beginning at a point 42.77 feet north of the intersection of the centerlines
of Seminole Boulevard and Palmetto Avenue according to the Plat of Lake View
Park, as recorded in Plat Book 3, Page ~l, of the Public Records of Seminole
County, Florida, said point being on the northerly line of said Lake View
Park, run S69°16'#5"E along said northerly line a distance of 176.57 feet,
thence run north ~53.~0 feet, thence run N27°36'l~"E a distance of 17.27
feet,~thence run north ~0.5~ feet, thence run east lt~l.09 feet, thence run
S69°16'~5"E a distance of 294.79 feet, thence run N20°~3'15" E a distance of
367.05 feet, thence run N69°16'~5"W a distance of 981.06 feet, thence run
S34°~3'15"W a distance of 417.23 feet, thence run S17°16'~5"E a distance of
63.00 feet, thence run S69°16'~5"E a distance of 109.96 feet, thence run
N20°~3'lS"E a distance of 9.67 feet, thence run S69~16'45"E a distance of
275.62 feet, thence run south ~8~.70 feet, thence run S69°16'~5"E a distance
of 52.22 feet to the Point of Beginning.
All parties in interest and citizens shall have an opportunity to be heard at said

The Chairman announced that the'Commission would be glad to hear from anyone in
iifavor of, or against, the zoning as advertised in the foregoing notice.
After consideration and there being no opposition, Commissioner Wilson moved to
i!approve the zoning of that particular City property as set forth., in the foregoing notice and
ito auth0rize~ the City Attorney to pr0pare the proper ordinance for same. Seconded by Commis-
!sioner Higginbotham and carried.
Appearing before the Co~mission was Mrs. Frank L. Woodruff, III, presenting for
Iconsider.ation a proposal to form a committee wherein she, Jol~m Krider, DeWitt Mathews, Dr.
iJohn Wilson, Sidney Vihlen, Jr., Randall Chase and Hrs. Donald Flamm had met and were

recommending an official appointment of a committee to act under an ordinance as a Scenic
Improvement Board to advise and formulate improvement and future plans for the beautification
of the City of Sanford, as the former committee was now inactive.
After consideration and on motion of Commissioner Roberts, seconded by Commissioner
Higginbotham and carried, authorization was given to create sucha Board, persons named above
to be appointed as charter members to this Board, and the City Attorney authorized to prepare
an ordinance pertaining to same.
Attorney S. Joe Davis, Jr., representing the owner of Lots i and 2, Block 3, Tier 5
located on the southwest corner of West First Street and Oak Avenue, appeared requesting City
assistance in obtaining title to a parcel of land immediately east of the present building
on this property and now being~maintained as~a City park, as his client has plans to renovate
the existing structure and has need for the additional property. He would deed to the City
a portion of the property for sidewalks.
Under discussion, it was pointed out there was no particular City-owned lot in-
yolked and that the area is abondoned railroad right-of-way which has reverted to the Sanford
Heirs, in addition to a City street right-of-way in the triangle of 80 feet for Oak Avenue
which extends substantially into the abandoned railroad right-of-way and the City holds a
"prescriptive right".
On motion of Commissioner Roberts, seconded by Commissioner Raborn and carried,
approval was given the Attorney to research and proceed with legality to obtain the property
for Mr. Davis' client and that at the appropriate time of consummation of mame the City would
assure co-operation in so far as the City's street or sidewalk right-of-ways were not jeop-
ardized.
After consideration of the application and on motion of Commissioner Roberts,
seconded by Commissioner Raborn and carried, approval was given for an exempt occupational
license to Albert G. Griffis, Route l, Box 138, Sanford, for peddler of vegetables, and the
license would be issued only when presentation or demonstration was given on his claim of
war disability.
After consideration and on motion of Commissioner Roberts, seconded by Commissioner
Raborn and carried, approval was given to pay $23,203.08 to Bercleve Unifloats, Inc., as
submitted on Statement dated Eeptember 19, 1967, revised by engineer, for materials and work
completed through September l, 1967, for Floating Piers and Associated Work for the Lakefront
Marina Project, as approved by the City p~o~ect engineering firm Clark, Dietz and Associates
and the City Manager and as authorized under Agreement for same, dated January 3, 1967.
Next submitted was a recommendation by the Police Chief and City Manager to imple-
ment a 2~-man volunteer Police Auxiliary for the sole purpose of control for riot, crowd,
and civil disorders. It was explained that proposed rules and regulations had been drawn
and applicants were awaiting to be c~nsidered and trained for same. After consideration and
on motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, approva~
was granted to put such a program into effect; the 20 men to have insurance coverage with the
inclusion of the $500 medical payment at an annual cost of $~I~5.00 for 20 men.
On motion of Commissioner Higginbotham, seconded by Commissioner Roberts and car-
ried, minutes of August 28, ~eptember ll, and September 13, 1967, were approved.

moved to authorize the appointments of A. Robert Kelly as Acting Director of Public Works,
and Sidney M. RiChard, Jr., as Acting Director of Utilities; these appointments to be for a
trial period of six months and respective salaries to be increased in the amount of $500.00
and reflected as follows:

After discussion relative to certain proposed 1967-68 budget expenses, Commissioner
Higginbotham moved to increase the City Manager's proposed annual salary of $18,000.00 by an
additional $1,000.00 and to increase the Commission Expense by $50.00 a month for each Commis-
sioner with the additional monies to be appropriated from the Utility Budget. Seconded by
Commissioner Roberts with motion failing to carry over the dissenting votes of Commissioner
Baker, Commissioner Raborn and Commissioner Wilson.
Commissioner Roberts moved that the salary of the City Manager be increased to the
amount of $20,000.00 annually and the additional increase be appropriated from the 1967-68
Utility Budget. Seconded by Commissioner Higginbotham and carried over the dissenting votes
of Commissioner Raborn and Commissioner Wilson.
Commissioner Roberts next introduced Resolution No. 1037, and after being read in
full, moved on its passage and adoption. Seconded by Commissioner Wilson and carried by the
unanimous vote of the Commission.
Said Resolution No. 1037 being in words and figures as follows:
A RESOLUTION OF THE CITY OF SANFORD, FLORIDA,
APPROPRIATING UNEXPENDED CASH SURPLUS ON HAND
AT THE END OF THE FISCAL YEAR 1966-1967 TO THE
DEPARTMENT OF GENERAL GOVERNMENT OF SAID CITY
FoR THE FISCAL YEAR 1967-1968 FOR USE OF THE
ORDINARY PURPOSES IN OPERATING EXPENSES OF SAID
CITY.
"i WH~_EREAS, the City Commission of the City of Sanford, Florida deems it necessary,
expedient and for the best interest of said City that any unexpended cash surplus as of
September 30, 1967, of the operating revenues of said City for the fiscal year 1966-1967,
be appropriated for the ordinary purposei and operating expenses of said City in the budget
for the fiscal year 1967-1968.
NOW, THEREFORE BE IT RESOLVED by the City Commission of the City of San~ord, Florida
that any unexpended cash su~plus as of September 30, 1967, of operating revenues of said City
for the fiscal year 1966-1967, be and the same is hereby appropriated to the Department of
General Government of said City for the ordinany purposes and operating expenses of said City
for the fiscal year 1967-68, and said cash surplus shall be incorporated in the budget of
revenues and expenditures of said City for said fiscal year 1967-1968 for the ordinary purpose
and operating expenses of said City.
BE IT FURTHF2t RESOLVED that this Resolution shall become effective as of the First
day of October, A.D. 1967.

full, moved on its passage and adoption. Seconded by Commissioner Wilson and carried by
the unanimous Tote of the Commission.

OF THE CITY OF SANFORD, FLORIDA,
ADOPTING A BUDGET OF P~VENUES AND
EXPENDITURES FOR THE CITY OF SANFORD,
FLORIDA, FOR THE FISCAL YEAR BEGINNING
OCTOBER 1, 1967, AND ENDING SEPTEMBER
30, 1968.
WHEREAS, in accordance with Section 62 of the Charter of the City of Sanford,
Florida, the City Manager of the City of Sanford, Florida, has made and submitted to the
City Commission of the City of Sanford, Florida, an estimate ~or budget of revenues and
expenditures of the City of Sanford, Florida, for the fiscal year beginning October l, 1967,
and ending September 30, 1968, such estimates or budget having been made with particular
application to the various departments of the City, a trUe copy of which is hereto attached
and by reference made a part of this Resolution; and
WHEREAS, each and every item contained and set forth in said budget prepared by
the City Manager has been carefully considered by this Commission,
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford,
Florida, that said budget as p~epared and submitted by the City Manager to the City Commissio~
be and the same is hereby adopted as the budget of the City of Sanford, Florida, for the
fiscal year beginning October l, 1967, and ending September 30, 1968.
BE IT FURTH]ERRESOLVED that upon collection of any revenues of said City, the City
Clerk shall allocate frOm each dollar collected and received, the several amounts to the
resPective funds for purposes for which the same are hereby authorized and appropriated.
BE IT FURTHER RESOLVED that this Resolution shall become effective as of the first
day of October, A.D. 1967.

wishing to upset the financial apple cart of the City, I will vote for the
waiver with the reservation that I intend to vote against the millage."
Commissioner Roberts qualified his vote as follows:
"I am of the opinion of Mr. Raborn, but in an entirely different fashion.
I think the way he wants to change it in one way, I feel as equally and
strongly in the opposite direction. However, for the purposes of keeping
the City going forward, I am going to coCpromise my position and vote 'yea'."

Commissioner Raborn and Commisssioner Roberts qualified their votes with their
previous statements. Commissioner Wilson qualified his vote on the basis of a previous
promise of the Commission made last year to go into a property tax reappraisal program with
the provision that the millage would be reduced in proportionate to the increase in valuation.
Thereupon, the Chairman announced that the City Commission of the City of Sanford,
Florida, by majority vote had passed and adopted said Ordinance No. 923, entitled:

Commissioner Roberts next introduced Resolution No. 1039, and after being read in
full, moved on its passage and adoption. Seconded by Commissioner Higginbotham and carried
by the unanimous vote of the Commission.

A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF SANFORD, FLORIDA,
ESTABLISHING DEPOSITORIES FOR CITY
FUNDS DURING THE YEAR 1967-1968.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, that THE
SANFORD ATLANTIC NATIONAL BANK, FLORIDA STATE BANK OF SANFORD, and ~ITED STATE BANK OF
SEMINO~, be and they are hereby declared to be depositories for City funds for the year
1967-1968, pursuant to requirement of the City Charter.
BE IT FURTHER RESOLVED that a copy of this Resolution shall be delivered to 'the
President of each of said institutions and that the same be spread upon the minutes of the
City Commission.
BE IT FURTHER RESOLVED that this Resolution shall become effective immediately
upon its passage and adoption.

After discussion of a possible site location on State Farmers Market property in
the area of Lake Avenue and West 13th Street for the proposed Community Facilities Building,
Commissioner Higginbotham moved that the City Manager and Commissioner Roberts be given
approval to pursue the project under federal funding assistance, and that the City Attorney
be instructed to check within the legal s0ope of the City using such property. Seconded by
Commissioner Roberts and carried..
On motion of Commissioner Raborn, seconded by Commissioner Wilson and carried,
authorization was given in that James G. Chapman, architect of plans and specifications for
the proposed Community Facilities Building Youth Center, be contacted as to a conference to
determine the present use of the plans in total or recommended modifications with no expenses
for same to be incurred by the City of Sanford.
During the period of absence of the City Manager from Sanford while attending the
annual International City Managers' Association meeting in New Orleans, Louisiana, Commis-
sioner Higginbotham moved that the City Clerk be appointed acting City Manager for the period
of October 8-12, 1967. Seconded by Commissioner Roberts and carried.
A letter of request from realtor Ernest Southward, representing property interest
of Russell Firestone for the downtown development of the former property of Strickland-
Morrison, was next considered for the closing and abandoning of the north-south alley between
Sanford and Palmetto Avenues, north of Commercial Street for a distance of 158.49 feet, and
on motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, au-
thorization was granted to set a date of October 9, 1967, for advertising of a Public Hearing
in which to further consider same.
The City Manager next submitted the following tabUlation of bids which were opened
publicly at 2:00 o'clock P. M. on September 25, 1967, for insurance coverage for death bene-
fits for firemen and police officers, as specified under Chapters 67-408 and 67-~43 of the
Florida State Statutes requiring $10,000.00 individual coverage due to accidental death in
line of duty; outlined in the specifications in the Invitation to Bid and published in the
Sanford Herald on September 15, 1967.

After discussion, Commissioner Higginbotham moved to accept the low bid of The
Travelers Insurance Company in the total amount of $621.00; but, with a stipulation that
upon the City Attorney checking the legality of the present $2,000.00 insurance coverage
being eligible toward making the total of the $10,000.00 coverage, the low.bid of Travelers
Insurance Company in the amount of $496.80 willbe accepted. Seconded by Commissioner
Roberts and carried.
After discussion of same, Commissioner Roberts moved to approve the erection of an
advertising sign by the Ashland 0il Company'on the motel-marina complex property; location
more partio~ularly being the property of the private lessee for the Monroe Harbor-Marina over
the gasoline pump island. Seconded by Commissioner Wilson and carried.
After consideration of a request presented through the City Clerk, Commissioner
Higginbotham moved to approve the granting of an exempt current occupational license to
B. F. Hills, to practice as a barber, on the basis of his physical impairments and limited
work load. Seconded by Commissioner Wilson and carried.
