The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on October 9, 1967. Present: Commissioner J. B. Wilson City Manager W. E. Knowles The meeting was called to order by the Chairman. The first item of business was the holding of a Public Hearing to consider the request of Ernest Southward, representing the Russell Firestone downtown commercial property for the closing and abandoning of a platted alley right-of-way for a distance of 158.49 feet as advertised in the Sanford Herald on September 29, 1967. NOTICE OF PROCEEDING FOR VACATING ANB CLOSING ANALLEY TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 P. M. on October 9, 1967, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to that certain north-south alley lying between Sanford and Palmetto Avenues, and north of Commercial Street. Said alley being more particularly described as follows: The south 158.~9 feet of that certain north-south alley l~ing between Sanford Avenue and Palmetto Avenue and north of Commercial Street. Persons interested may appear and be heard at the time and place above specified. City Commission of the City of Sanford, Florida By: H. L. Whelchel, City Clerk The Chairman announced that the Commission would be glad to hear from anyone i~ favor of, or against, the closing as advertised in the foregoing notice. There being no opposition and after discussion, Commissioner Higginbotham moved to approve the closing and abandoning of the alley right-of-way, the retention of a utility easement, the requirement that upon construction across the easement the sewer utility line will be replaced with cast iron pipe with cost to be borne by the property owner, and to authorize the City Attorney to prepare tke proper ordinance f-or same. Seconded by Commis- sioner Roberts and carried. Request was next presented from Captain John W. Williams, 2005 Oak Avenue, for consideration in changes of the parking restrictions of City Parking Lot No. 6, northwest corner of Park Avenue and First Street, by removing the two-hour time limit for a trial period of 90 days, and offering to the businessmen in the area a sticker which can be pur- chased at a price to be set by the City Commission permitting all day parking with no reservation of spaces and the holder taking a chance of available space. After discussion, Commissioner Higginbotham moved that the request be denied. Motion died for lack of a second. Seconded by Commissioner Raborn and carried over the motion of Commissioner Higginbotham to table said motion. After consideration, Commissioner Raborn moved to approve the reappointment of W. M. Philips to the City of Sanford Board of Adjustment for a three-year term from the date of September 8, 1967. Seconded by Commissioner Roberts and carried. Considered next was a request from Merle W. Warner, realtor, for a 60-day time extension on Condemnation Report No. 67-198, 720 Park Avenue property of Sinclair Refining Company, service station located on Lots 4 and 5, Block 9, Tier 4, in that Dr. Harold K. Ring is in the process of purchasing the property and will use the structure for his practice upon completion of renovation. Commissioner Higginbotham moved to grant the 60-day time extrusion on the foregoing described condemned property to the date of December 10, 1967. Seconded by Commissioner Roberts and carried. Consideration was next given to a letter of October 4, 1967, wherein Mason H. Wharton submitted his resignation from the Board of the City of Sanford Zoning and Planning Commission due to present heavy work commitments with the school board, and on motion of Commissioner Raborn, seconded by Commissioner Roberts and carried, same was accepted and the City Manager authorized to express regrets in a letter acknowledging recognition of past services. After consideration and on motion of Commissioner Roberts, seconded by Commissioner Raborn and carried, authorization was given to pay the amount of $2,038.05 to Bercl~ve Unifloats, Inc., as submitted on Statement dated October 3, 1967, for materials and work completed through September, 1967, for Floating Piers and Associated. Work for the Lakefront Marina Project, as approved by the City project engineering firm Clark, Dietz and Associates and the City Manager, and as authorized under the agreement for 'same dated January 3, 1967. Considered next was a request of the Orlando Sentinel newspaper relative to soli- citation of an ad in their November 19, 1967, Progress Edition at a cost of $1,100.O0 for a full page; $615.00 for a half page; and $315.00 for a quarter page ¢'overing the Lakefront Development Project Motel-Hotel Complex. On motion of Commissioner Roberts, seconded by Commissioner Raborn and carried, the request was denied on the basis that the City does not have sufficient funds appropriated in the 1967-1968 budget for same. It was recommended that the newspaper forward their request to the Sanford Industrial CommissiOn or the Seminole County Chamber of Commerce. A discussion was next held regarding a letter of request from the Chairman, Bi- Racial Committee, for the City to construct a sidewalk on West 16th Street from Southwest Road west to the Goldsboro Elementary School for the convenience of the school children now walking in the unpaved street. On motion of Commissioner Raborn, seconded by Commissioner Roberts and carried, the City Manager was instructed to prepare a proposal on the project showing estimates as follows: (1) cost of sidewalk construction; (2) cost of installing storm drainange pipe; (3) total installation cost of sidewalk and storm drainange pipe. Such cost figures to be submitted to the City Commission for further consideration of same. Rendered next was a report by the City Attorney on the present:~.;status of that property described as Lot 4, Subdivision of A. V. French, property located at Lake Avenue and West 13th Street and known more particularly as the State Farmers Market property on French Avenue, wherein a title research of such property had been completed and revealed that in MINUTES. M. 19 67 'I~otherow Office Suonly Co., Orlando, Fla. . the deed to the Agricultural Marketing Board contains the followings!; clause: "To Have And To Hold the above granted and described premises unto the said State Agricultural Marketing Board so long as used by said State Agricultural Marketing Board as site for the operations of said' Marketing Board, but in the event of abandonment by said Marketing Board of said site for its operations, the title to said Lot # shall automatically pass to the City of Sanford for such public uses as said City may determine." After discussion of same, the City Attorney was authorized to write a letter to the appropriate State Agricultural Department offiCial, Tallahassee, with a copy of the letter to Doyle Conner, Commissioner of Agriculture, to notify the officials regarding the reverter clause contained in the deed of the property and. that the City is presently considering the utilization of this particular property for the proposed construction of a Neighborhood Facilities Building. Commissioner Raborn next introduced Ordinance No. 924, entitled: AN ORDLNANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT TRANS- FERRING CERTAIN TERRITORY FROM R-1AA (SINGLE FAMILY DWELLING) DISTRICT TO C-2 (GENERAL COMMERCIAL) DISTRICT. On motion of Commissioner Raborn, seconded by Commissioner Roberts and carried, Ordinance No. 924 was placed on its first ~eading and read in full. Commissioner Roberts neXt introduced Ordinance No.. 926, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CREATING THE SCENIC IMPROVEMEI1T BOARD OF SANFORD, FLORIDA. On motion of Commissioner Roberts, seconded by Commissioner Raborn and carried, Ordinance No. 926 was placed on its first reading and read in full. After consideration and on motion of Commissioner Roberts, seconded by Commissioner Rabo~n and carried, authorization was granted to pay Shoemaker Construction Company, Inc., the amount of $11,351.79 as submitted on Requisition No. 6, dated October 3, 1967, for materials and work completed through September, 1967, on the Lakefront Marina Project, as approVed by the City project engineering firm Clark, Dietz and Associates and the City Manager, and as authorized under Agreement for Miscellaneous Marina Facilities, dated March 27, 1967. After consideration and with the recommendation of approval by the Police Chief, Commissioner Higginbotham moved the alcoholic beverage application of Gordon M. Driggers, d/b/a Gordon's Tavern, 2603 Park Drive, for an occupational license to sell beer only, conSumption on premises, be approved, seconded by Commissioner Roberts and carried. After consideration of a request from A. O. Roberts for an exempt occupational license to operate as a real estate broker on the basis of a veterans disability, the City Clerk was instructed to issue same upon presentation of proof of disability. After discussion of the request and on motion of Commissioner Roberts, seconded by Commissioner Raborn and carried, the Downtown Sanford "We Care" Merchants were authorized to utilize the sidewalks downtown on First Street as sponsors for a Sidewalk Art Display Show on October 27 and 28, 1967. On motion of Commissioner Roberts, seconded by Commissioner Higginbotham and carried, current ~ouchers and payrolls were next approved as evidenced by General Fund Florida State Bank Vouchers Nos..5569 through 5645; General Fund Sanford Atlantic National Bank Vouchers Nos. 15~37 through 15666; Water and Sewer Revenue Fund Florida State Bank Vouchers Nos. 85 through ll3; Sanford Atlantic National Bank Municipal Improvement Construc- tion Fund Vouchers Nos. 50 through 64. Submitted next was a recommendation from the Zoning and Planning Commission that property on the west side ~ Sanford Avenue between 12th and 13th Streets, legally described as Lots l, 2, 3, ~ and 5, Block l~, Tier l, E. R. Trafford's..~Map of Sanford, be rezoned from R-1 (Single Family Dwelling) District to C-2 (General Commercial) District, being an extension of commercial zoning, wherein the proposed use of the dwelling on Lot 5 would be for the operation of catering service. After consideration and on motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, authorization was given to set a public hearing date ~ concur with the next proposed adjourned meeting date of October 30, 1967, and City Clerk instructed to ~dvertise same.
