M. .19. 67 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on November 13, 1967. Present: Commissioner J. B. Baker, Mayor Earl Higginbotham " M.L. Raborn, Jr. " W. Vincent Roberts " A.L. Wilson City Attorney Wm. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. L. Whelchel Police Chief Ben E. Butler The meeting was called to order by the Chairman. The Chairman opened the meeting with the following statment of clarification: "I would like to deviate from the regular business for a moment and set the record straight on some meetings that I held the past week or two with some of the colored people of this community in which the paper stated that I suggested to them, or recommended to them, that they violate the housing laws of the City of Sanford. I would like it to be known that this is not the case. They looked at m~r zoning map and wished to know why the differential in the R-5 (One and Two Family Dwelling) District, and why it was so designated as the colore( residential area. To these people I pointed out, as has been told to us by our City Attorney, ~hat actually we did not have the authority or that the law that we have on our books could not stand up in Court. I was asked the question, 'Does this mean that we can move anywhere in town?' I told these people that the City had no authority as to where they could move within this City. I did not recommend nor suggest that they move anywhere within this City. The paper further went on to say that I recommended or stressed to these people that I would push for integration within all of our recreational activities. This is not the case. I did not do this. As a matter of fact, I spent a half hour telling this group of colored leaders in our community that I was opposed to social integration. That as long as I was here, I was going to vote against the social integration, and by social integration I was speaking of integration of our;Youth Wing. In dances and in the mixed sex where there is a social activi- ty, I was opposed. I told them that with my vote, or if my vote had any influence, that I would oppose it. In my opinion, the Sanford Herald is doing more to destroy this community, to cause confusion, and to make one group work against another group. If you will :recall, the headlines in the paper this week stated the School battles the City for the Naval Air Station property. This is far from the truth. That statement was just as false as any statement that has appeared anywhere. It was a complete lie. The School Board was contacted a number of months ago and we knew that we had buildings on this property which we felt that they could use and that would not be satisfactory for industrial development. They were aware of this. We made them aware of it; and then the paper says that we are battling for it. The~ notified us that they were going to make an inspection of the Naval Air Station. Two weeks ago, the Naval Air Station was cooperating with our Industrial Board, so far as to the equip- ment that might be left at the base; that the City might like utilization of and what we might do in an effort to retain this equipment. Because of the publicity we have received by the Sanford Herald, the Naval Air Station has closed the door in our face. This can mean considerable sums of money to the taxpayers of this community. At the present time they already have fire engines in an equipped base in Albany, Georgia. By processes of government disposal, this property could become available to the City of Sanford. We might still get it, but it can still cost us a lot of money. Three weeks ago Washington called us and told us there was a chance that we would get our EDA appropriation before the rest of the cities. 462 MINUTES City Commission, Sanford, Florida November 13 at 8 P. Orlando, The local paper was asked not to do anything about this, but they called Washington and had them so upset in the Defense Department in Washington that they called down here several times that we were going t° get our funds cut off. They were trying to do us a favor in pushing us ahead of the rest of the communities, but we were going to lose our funds if we had to spread everything we knew all over the. newspaper. We have just lost the support of Mr. Paulucci, or lost some of his support. He has still told us that he will continue to help us, but has resigned as Chairman of the Industrial Board. In my opinion, this is large- ly due to selling newspapers DY the Sanford Herald. One 6ommittee in this town is continuall pitted against another committee. The headlines are stressed to show that so-and-so blast so-and-so. People and committees in this town can't get together and can't have a discussior and just disagree. And what's more important than dissent in our Nation. Agility to speak against without undue criticism with respect for that criticism. In my opinion, there is nothing in this community that is hurting it any worse than the Sanford Herald. The desire of the Sanford Herald appears to sell newspapers at the expense of every governing body in the community. I'm pleased to say that the Hospital Board has seen fit to cut him out of their m~etings. Most everybody has had comments to make at one time or another? The usual reaction from the Sanford Herald is that we've got to sell newspapers. I think that it is time for this community to wake up to the fact that they are not going to have a good func~ tioning community until something is done about the Sanford Herald. This is not in the agenda, I have said what I wanted to say and I thank you for listening." The first item of business was the holding of a Public Hearing to consider the rezoning of property from residential to commercial, as advertised in the Sanford Herald on November 3, 1967. NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on November 13, 1967, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: That property located at 1220 Sanford Avenue, consisting of east 1/2 of block fronting on Sanford Avenue between 12th and 13th Streets, presently zoned R-1 (Single Family Dwelling) District, is proposed to be rezoned C-2 (General Commercial) District. Said prop- erty being more particularly described as follows: Lots l, 2, 5, ~ and 5, Block l~, Tier 1 E. R. Trafford's Map of Sanford All parties in interest and citizens shall have an opportunity to be heard at said hearing. There being no opposition and after consideration, Commissioner Higginbotham moved to authorize the City Attorney to prepare the proper ordinance for the rezoning of said prop- erty as set forth in legal notice. Seconded by Commissioner Raborn and carried. The next item of bUsiness was a Public Hearing to consider rezoning of that property as advertised in the Sanford !Herald on November 3, 1967. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. H. on November 13, 1967, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: That property located north of 25th Street between Hardy Road and Railroad right- of-way, presently zoned C-1 (iNeighborhood Commercial) District, is proposed to be rezoned to M-1 (Light Industrial) District. Said property being more particularly described as follows: hearing. Appearing in beEalf of the request was Rosser Elkin~, construction engineer for Rio~er Materials Corporation. He explained the use of the property would be for a concrete redi-mix operation and masonry supplies, with dust control thereon and their truck traffic generated on the 25th Streetiside of the site. After consideration and there being no opposition, Commissioner Higginbotham moved to authorize that the City Attorney be instructed to prepare the proper ordinance for the rezoning of the property as outlined in the $oregoing notice. Seconded by Commissioner Raborn and carried. ~ Consideration was next given to a request by Harold W. Barrett, President, Clibarco Houseboating Center, Winter Park, to moor houseboats at the City pZer or bulkhead on the west side of the bandshell area, Wherein this firm wou~d install their own pilings and walks. After discussion and on motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, the request was!denied on the basis that it is an indirect competitive business MINUTES City Commission, Sanford, Florida November 15 at 8 P. M. 19 67 iDotherow Office Suooly Co., Orlando~ Fla. to the marina lease operation, the community presently does not warrant two boating busines- ses on the lakefront and the bandshell area is presently being beautified as a park area. Seconded by Commissioner Roberts and carried. A written letter of request was next considered for the City to assist by furnish- ing labor and equipment for the construction of a parking lot on the property of the City- owned golf course as requested by the private leSsee, D. M. Whelchel, operating as the Mayfair Country Club, with Mr. Whelchel paying the estimated material cost of $6,000.00. After discussion and due consideration, Commissioner Higginbotham moved that the request be denied in that it is outside of the City's realm and not justifiable under the projection of the financial arrangements and capital improvements and it could establish a precedent under a long term lease. Seconded by Commissioner Roberts and carried. Considered next was a street light request from the Grace Methodist Church, located on the corner of Onora Road and Woodland Drive. After consideration and on recommendation of the City Manager and Police Chief, Commissioner Higginbotham moved that the request be granted, with authorization for the installation of two 1,O00 lumen street lights on Woodland Drive. Seconded by Commissioner Roberts and carried. After consideration of a request from Marshall Holloway, Jr., for the issuance of an occupational license to allow the sale of alcoholic beverages with consumption on premises by the Amvets Club, Post 17, at the location of 510 Cypress Avenue, and approved by the Police Chief, Commissioner Higginbotham moved that the City Attorney be authorized to prepare the proper ordinance to include this location for the sale of alcoholic beverages. Seconded by Commissioner Roberts and carried over the opposing vote of Commissioner Wilson. Consideration was next given to an application for the transfer, in name only, of the occupational license for sale of beer and wine at the Tiago Tavern, lO13 West 13th Street consumption on premises, from Charles Roy Turner, Jr., to Leroy Williams, as owner and opera- tor. On recommendation of the Police Chief, motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, same was approved. Letters of resignation from Board Members Jeno F. Paulucci and Lee P. Moore, Chairman and Secretary respectively of the City of Sanford Industrial Commission, were next acknowledged. After consideration, Commissioner Roberts moved that the resignations be accepted with regrets and that appropriate letters be forwarded expressing same in addition to a commendation for their service and endeavours for the promotion of industry while servinf as members of the Industrial Commission. Seconded by Commissioner Raborn and carried. Consideration was then given to the following names, as recommended by the Sanford Industrial Commission, to fill the two Vacancies on the board: Harold H. Kastner, Scott Burns and Carl R. Schilke. It was announced that due to other commitments, Mr. Kastner requested that his name be withdrawn as a prospective appointment. Commissioner Higginbotham moved that the names of Scott Burns and Carl R. Schilke be accepted and appointed as members to serve on the City of Sanford Industrial Commission. Seconded by Commissioner Wilson and carried unanimously. Under the discussion of the Industrial Board, Commissioner Raborn moved that the following statement be reflected in the minutes. We also recognize that accomplishments cannot be made overnight and that, contrary to published and unpublished reports, we are in accordance with their aims and desires and that we wholeheartedly concur with their actions of developing industria~ potential of the Sanford area. Seconded by Commissioner Roberts and carried unanimously.. Next presented were two statements as follows: (a) Bercleve Unifloats, Inc. - the corrected amount of $8,965.10, as submitted on Statement dated November l, 1967, for materials and work completed through October 31, 1967, for Floating Piers and Associated Work for the Lakefront Marina Project, as authorized under Agreement for same, dated January 3, 1967, and approved by City project engineering firm Clark, Dietz and Associates, and the City Manager. (b) Shoemaker Construction Company, Inc. - the corrected amount of $25,591.33, as submitted on Requisition No. 7, dated October 31, 1967, for materials and work completed through October, 1967, on the Lakefront Marina Project, as authorized under Agreement for Miscellaneous Marina Facilities, dated March 27, 1967, and approved by the City project engineering firm Clark, Dietz and Associates, and the City Manager. After consideration, Commissioner Roberts moved to pay the above two statements, seconded by Commissioner Higginbotham and carried. After discussion and reference to minutes of October 23, 1967, regarding the cancel- lation of the assessment project for paving of Grandview Avenue and 24th Place, east of Sanford Avenue,with survey and field notes completed for same, Commissioner Higginbotham moved that the surveying statement dated November 3, 1967, submitted by engineering firm Clark, Dietz and Associates in the amount of $140.00, be approved with payment authorized from Account No. 8150, Contingency. Seconded by Commissioner Raborn and carried. On request of same, Commissioner Higginbotham moved to grant authorization for the Mayor, City Attorney, City Clerk and the Auditor to enter the City of Sanford safety deposit boxes at the Sanford Atlantic National Bank for such purposes of auditing for the fiscal year 1966-67. Seconded by Commissioner Wilson and carried. Consideration was next given to the guidelines for a proposed ordinance, as recom- mended by the Zoning and Planning Commission, for the control of gasoline service station construction on a distance basis, and on motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried over the dissenting vote of Commissioner Baker, same was denied. On motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried minutes of October 9 and October 23, 1967, were approved. On motion of Commissioner Wilson, seconded by Commissioner Raborn and carried, current vouchers and payrolls were next approved as evidenced by General Fund Florida State Bank Vouchers Nos. 5646 through 5692, and Vouchers Nos. lO151 through~10301; General Fund Sanford Atlantic National Bank Vouchers Nos. 15667 through 15750; wa~er and Sewer Revenue Fund Florida State Bank Vouchers Nos. ll4 through 126; Sanford Atlantic National Ban~k Muni- cipal Improvement Construction Fund Vouchers Nos. 65 through 75. The City Manager reported that the updating of the City of SanfOrd Workable Program. as a prerequisite for projects applicable under federal funding, was now completed and ready for submission to the Department of Housing and Urban Development, Atlanta, Georgia, for recertification and that upon approval the Commission then confirms their obligation to use MINUTES City Commission, Sanford, Florida November 15 at 8 ?. On motion of Commissioner Roberts, seconded by Commissioner Raborn and carried, same was approved as submitted and for forwarding for official recertification. After consideration and on motion of Commissioner Higginbotham, seconded by Commis- sioner Roberts and carried, authorization was given for the transfer of $468.00 from Account No. 8150, C0. ntingency, to Account No. 8512, Office Equipment-Industrial 'Commission, to cover the purchase cost of a new IBM electric typewriter, as previously approved for said office. On request of the City Manager for an annual vacation period from November 14 to 20~ 1967, Commissioner Wilson moved to approve that the City Clerk be appointed Acting City Manager for said period. Seconded by Commissioner Higginbotham and carried. After discussion and consideration of a request through the Recreation Department by a Jacksonville promotor for use of the Civic Center to promote professional wrestling matches at some future date, Commissioner Roberts moved that said request be denied. Seconde~ by Commissioner Higginbotham and carried. After consideration, Commissioner Roberts moved that plans for the construction of a proposed'Goldsboro Recreational Facility-Building as prepared by Architect James Graham Chapman, project No. 64-09, issued on December 28, 1964, be a~doned and present plans to meet and work with the ArChitect be cancelled. Seconded by Commissioner Higginbotham and carried. The Chairman then related to the Commission that the following persons had been selected to serve on the Mayor's Committee, as authorized by the Commission to assist Archi- tect John A. Burton, IV, with details or needs regarding the proposed construction plans for a Neighborhood Community Facilities Building in the Goldsboro area: John Daniels, William Wright, Henry McAlister and Arthur H.
