M. 1968 495 The City Commission of the City of Sanford, Florida, met 'in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on February 12, 1968. The first item of business was a Public Hearing to consider the rezoning of county- owned property from residential to commercial for the operation of a Seminole County Vehicle Safety Inspection Station, as recommended by the Zoning and Planning Commission and as ad- tvertised in the Sanford Herald on February 2, 1968. NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND ~NDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room ?in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on February 12, 1968, i!to consider the following changes and amendments to the Zoning Ordinance of the City of :Sanford, Florida: That property located on the southeast corner of 25th Street and Grandview Avenue, ipresently zoned R-1 (One Family Dwelling) District, is proposed to be rezoned C-1 (Neighbor- Commercial) District. Said property being more particularly described as follows: Lots 1 through 9, Block 3, Palm Terrace All parties in interest and citizens shall have an opportunity to be heard at said hearing. Whelchel As City Clerk of the City of Sanford, Florida The Chairman announced that the Commission would be glad to hear f~om anyone in favor of, or against, the zoning as advertised in the foregoing notice. Seminole County Zoning Director Robert S. Brown represented the request and outlined to the Commission the coUnty's intended use of the property under a State requirement. There being no opposition and after consideration, Commissioner Higginbotham moved to authorize the City Attorney to prepare the appropriate ordinance for the rezoning of said property as set forth in the legal notice. Seconded by Commissioner Moore and carried. William Gorman, Gorman Construction Company, Orlando, Florida, appeared next to present a proposal for a 221 Program with federal funds subsidizing low cost housing for private individuals through a private contractor. Approval for such program must be given by the City Commission to the Department of Housing and Urban Development, Atlanta, Georgia, either directly, or by inclusion in the City of Sanford Workable Prggram that is now being considered for recertification. ' After discussion, Commissioner Wilson moved that the matter be taken under advise- ment and study, and be considered at the next regular meeting. Wharton, Orlando, Florida, appeared as a representative of Tamiami Trail Tours, Inc., d/b/a Tamiami Trailways, requesting support of the City Commission regarding the Company's application filed with the Florida Public Service Commission and the Interstate Commerce Commission to allow Tamiami Trailways to increase their service routes in the State of Florida. Mr. Kirby, Traffic Manager of the company, stated that the routes would connect the lower west coast of Florida with the Orlando area and offer direct service between the lower west coast and Orlando, Ocala, Winter Haven area, Cape Kennedy and Daytona Beach. R. E. Hardesty, District Marketing Supervisor, Southern Greyhound Lines, Jackson- ville, Florida, was present and voiced objection to the City supporting said Company and the services, due to duplication of Greyhound rsntes, and requested that the City remain neutral in the matter, or if the City should support the application of Tamiami Trailways~. his compan~ was prepared to request that the City support the filing of an application before the Inter- state Commerce Commission and the Public Service Commission by Greyhound Lines to extend routes in southern Florida on the west coast between St. Petersburg and Naples. Commissioner Higginbotham introduced Resolution No. 1043, and after being read in full, moved on its passage and adoption. Seconded by Commissioner Raborn and carried unani- mously. Said Resolution No. 1043 being in words and figures as follows: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANFORD, FLORIDA WHEREAS, the City of Sanford.has experienced and is experiencing a phenomenal in- dustrial and residential growth, and WHEREAS, the City of Sanford annually offers its facilities to thousands of winter visitors and tourists, and WHEREAS, for many years Tamiami Trail Tours, Inc., operating as Tamiami TrailWays, has rendered efficient motor bus transportation generally along the west coast of Florida, in61uding service between Tampa and Miami via U. S. Highway gl and via St. Petersburg; and service throughout peninsular Florida, including service between Jacksonville and Tampa, and Jacksonville and Miami via Orlando, and WHEREAS, it has come to the attention of the City Council of the City of Sanford that Tamiami Trailways has filed an application with the Florida Public Service Commission and with the Interstate Commerce Commission for authority to transport passengers, baggage, express and newspapers over various routes that will connect the lower west coast of Florida with the Orlando area; that will provide direct service between the lower west coast of Flori~ da and Orlando, Ocala, Winter Haven area, Cape Kennedy and Daytona Beach, and WHEREAS, it is necessary and essential that said applications be granted in order that public convenience and necessity be best served so that industry, residents and Visitors to this populous area may enjoy efficient passenger service between the area described above without interc.hange over the routes of Tamiame Trailways. Fla. consideration, Commissioner Higginbotham moved that the structure be removed from the con- demnation list in that it is not applicable under the Commission's intent of condemnation proceedings. Motion died for lack of a second. It was recommended that the structure be viewed personally by the City Commission, City Manager, and Building Official. Commissioner Moore moved that the City of Sanford hold demolition proceedings in abeyance at the present time on Condemnation Report No. 67-192, Standard Oil ~roperty,?and the matter be tabled for further discussion at the nex~ regular meeting of the Commission. Seconded by Commissioner Wilson and carried. After consideration, Commissioner Moore moved that Ernest M. Southward be reap- pointed t~ the Sanford Industrial Commission for a four-year term, effective February 21, 1968; and that the second appointment to this Board be held in abeyance with the Mayor writing a letter to Parker Painter, Jr., Dynatronics, requesting a recommendation of a representative from the electronics industrial firm who might accept appointment to serve on the Sanford Industrial Commission. Seconded by Commissioner Raborn and carried. A discussion was next held to consider the vacancy created by the resignation of Municipal Judge C. Vernon Mize, Jr., effective March l, 1968. Commissioner Raborn moved that the selection of a municipal judge be tabled until the next meeting of the Commission. Seconded by Commissioner Wilson and carried. Trafford's Map of Sanford 1336 Elliott Avenue, Lots 15 and 14,Block B, Buena Vista Estates After discussion of the aforesaid Reports Nos. 68-201 through 68-218 and finding each building to be considered unsanitary, unsafe or dilapidated, Commissioner Raborn moved to hold a Public Hearing to condemn same on February 26, 1968, and to authorize a notice to be placed upon each structure, and directed by registered mail to the last known address as shown by the Tax Assessment Rolls of the City, a notice to the owner of the property involved of the findings of the Commission and of the proposed hearing. Seconded by Commissioner Moore and carried. Consideration was given to a request of the Ministerial Association for a minister to give invocation before each City Commission meeting, and on motion of Commissioner Moore,~:~ seconded by Commissioner Wilson and carried, same was approved. A request submitted by the Seminole County Junior Chamber of Commerce for permis- sion to display fireworks during their Region III Conference on May 4 and 5, 1968, was next considered. On motion of Commissioner Wilson, seconded by Commissioner Raborn and carried, same was granted with the stipulation the organization furnish proof to the City, prior to the display, that they have obtained a licensed operator and liability insurance in the amov~ts of $100,000.00 and $300,000.00 with the City of Sanford as the insured. Consideration next given a bill of $784.00 for the cost of street lights at Onora Road and Sanford Avenue, presented by the City to the Seminole County Board of Commissioners, covering a four-year period. The County Commission has notified the City that they will pay half of the cost due, as the City annexed the southwesti~corner of the intersection in 1962, and are canceling their letter of agreement for the lights. It was explained that this was a County installation necessitated by the entrance of the Sanford Naval Air Station, reim- bursed under the City's street lighting contract, and that the City annexed only private property and the street right-of-way was not included. After discussion, Commissioner Raborn moved that the City Attorney be authorized to pursue the matter with the Seminole County Attorney for the collection of $784.00, and to approve that, in the future, the City maintain the said two street lights. Seconded by Commissioner Moore and carried. Consideration was next given to a letter of notice dated December l, 1967, from John W. Weldon, General Solicitor, Law Department, Seaboard Coast Line Railroad Company, Jacksonville, Florida, with reference to the proposed discontinuance of TraMs No. 75 and No. 76, serving Sanford between Jacksonville and Tampa, Florida, and a ~equest from the railroad unions of the Brotherhood of Railroad Trainmen that the City of Sanford ask for a public hearing relative to the discontinuance of the passenger service. Commissioner Higginbotham moved that no action be taken on the matter, in that the Commission is not familiar with the Railroad Company's financial status or procedure. Seconded by Commissioner Raborn and carried. Contingency Account No. 8150, to Account No. 1205, City Manager Office Supplies, to cover the cost of the additional copy work created by the preparation of the City of Sanford Workable Program and the Overall Economic Development Program. After discussion, Commissioner Wilson moved to authorize the transfer of funds in the amount of $700.00 from Contingency Account No. 8150 to Account No. 2257, Police Depart- ment Schools and Training, to cover the cost of special schooling to train an operator for the new polygraph equipment. Seconded by Commissioner Moore and carried. Consideration was next given to the installation of a new police computorized teletype system interconnecting all law enforcement agencies ~thin the Central Florida area, and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, authorization was given to transfer the sum of $415.00 from Contingency Account No. 8150 to Account No. 2208, Police Department Telephone and Telegraph, to cover the cost of same to the end of the fiscal year. Based on a State requirement and after discussion, Commissioner Moore moved to approve the transfer of funds in the amount of $460.00 from Contingency Account No. 8150 to Account No. 4026, City Shop Equipment-General, to cover the cost of setting up the proper safety vehicle inspection equipment for City fleet operators to be self-inspectors of City vehicles on a six-month periodic check, effective June l, 1968. Seconded by Commissioner Higgi~botham and carried. Consideration next given to the recommendation of the Zoning and Planning Commis- sion for rezoning from R-2 (One and Two Family Dwelling) District to that o£ R-3~(Multiple Family Dwelling) District, for that property described as Lot 45 less the east 100 feet of the north one-half, and all Lot 46, J. E. Pace's Subdivision, located west of Bay Avenue between Second and Fourth Streets, with use being for proposed construction of a nursing home. On motion of Commissioner Higginbotham, seconded by Commissioner'Raborn and carried, authorization was given to set a public hearing on February 26, 1968, to further consider said rezoning and the City Clerk to advertise same. On motion of Commissioner Higginbotham, seconded by Commissioner Moore and carried, the minutes of January 8 and January 22, 1968, were approved. Benjamin Holliday submitted a request for a time extension in order to make repairs to the structure under Condemnation Report No. 67-178, Group 12, 1004 West Eighth Street, property acquired from Armon and Enoch Roberts; and on motion of Commissioner Higginbotham, seoonded by Commissioner Wilson and carried, an extension of ninety days was granted. A discussion was next held on a report submitted by the Building Official on the condition of the structure located at 1215 French Avenue, owned by W. A. Patrick, and occu- pied by Vital Feeds of Florida, Inc., relating to the collapse of a wall and failure to monform to notices of fire and safety standards. Commissioner Moore moved that the City Attorney and City Manager be given authority to work the matter out with the owner and the occupant on correction of the existing hazards. Seconded by Commissioner Higginbotham and carried. After discussion that the City of Maitland now has in effect the so-called law of "hot pursuit" and the law being beneficial to Sanford as a neighboring city, Commissioner Wilson moved that the law be placed in the file for future legislation and reconsidered at the appropriate time. MINUTES City Commission, Sanford, Florida FebruarY 12 at 8 Po FI. 19 68 501 Consideration was next given to a letter from the Trustees of the Internal Improve- ment Fund, Tallahassee, Florida, pertaining to a question raised by the County of Seminole regarding certain street right-of-ways, namely Bay Avenue and llth Street, embraced within a legal description of property that presently is held under tax sale Certificates Nos. 470 of 1927, and 3200 of 1933. It would be necessary for the City to furnish a survey showing the ~ntire dimensions with directions for that part of the description embraced in the above mumbered tax sale certificates that lies wholly within the right-of-way of the two streets. ~he City Fianager explained that this evolved from the State owning a portion of the street right-of-ways due to a grant line survey. The Commission authorized the City Attorney to check into the matter and to submit a report at the next meeting. After consideration, Commissioner Raborn moved to approve the transfer of funds in the amount of $100.00 from Contingency Account No. 8150 to Account No. 1207, City Manager tTravel Expense, to attend the Labor-Management Seminar at the Florida State University, Tallahassee, February 18 through 21, 1968.
