The first item of business was a Public Hearing to consider the recommendation of the Zoning and Planning Commission for the rezoning of property from R-2 (One and Two Family Dwelling) District to R-3 (Multiple Family Dwelling) District, as advertised in the Sanford Herald on February 16, 1968. NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF TH~ CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on February 26, 1968, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: That property located between Second Street and Fourth Street west of Bay Avenue, presently zoned R-2 (One and Two Family Dwelling) District, is proposed to be zoned (Multiple Family Dwelling) District. Said property being more particularly described as follows: Lot 45, less the east 100 feet of the north 1/4 and all of Lot 46, J. E. Pace's Subdivision All parties in interest and citizens shall have an opportunity to be heard at said hearing. H. L. Whelchel As City Clerk of the City of Sanford, Florida The Chairman announced that the Commission would be glad to hear from anyone in favor of, or against, the rezoning as advertised in the foregoing notice. ~ohn M. Jenkins, Administrator of DeBary Manor Nursing and Convalescent Care, Retirement Life, Inc., DeBary, Florida, appeared stating that the property would be utilized for a proposed nursing home similar to the one now operated in DeBary. There being no opposition, Commissioner Higginbotham moved to authorize the City Attorney to prepare the appropriate ordinance for the rezoning of said property as set forth in the legal notice. Seconded by Commissioner Wilson and carried. The following persons appeared requesting time to repair said buildings or structures: Report No. 68-205 and No. ~8-215, represented by Attorney Mack N. Cleveland, Jr. Report No. 68-209, represented by Herbert Cherry Report No. 68-211, represented by Attorney Wm. C. Hutchison, Jr. Report No. 68-212, .represented by owner Stephen Simms Report No. 68-214, represented by Mrs. Mozelle Ware Report No. 68-217, represented by E~die Henry Report No. 68-218, represented by Mrs. Lozette T. McKay The Building Official informed the Commission that property owners under Report Nos. 68-201, 68-203, 68-204 and 68-207 were aware of the condition of said structures and were contemplating correction and had taken out permits for demolition or repairs. After consideration of each Condemnation Report Nos. 68-201 through 68-218, and finding each building to be unsanitary, unsafe, and dilapidated, Commissioner Moore moved that the buildings and structures covered by the aforesaid reports be condemned and the owners given notice of 90 days to remove or repair or give just cause why they have not repaired or removed, and a~ter 90 days, to authorize the City to remove the buildings or structures and levy a lien against the property for cost of removal. Seconded by Commissioner~i Raborn and carried. A discussion was next held on the submittal of Condemnation Report No. 68-219, on 504 MINUTES City Commission, Sanford,: Florida. February 26 at 8 P. A letter dated February 26, 1968, and signed by Orville L. Barks, M. D., was presented which stated he, as the property owner, gives his permission for the City to condemn and demolish the two story building known as the Palmetto Building at the corner of Palmetto Avenue and Second Street. After consideration of the report and the letter, Commissioner Moore moved that finding the building to be unsanitary, unsafe, and dilapidated, the City comply with the owner's request and condemn the said building or structure, and the City proceed to demolish same and levy a lien against the property for the cost of removal. Seconded by Commissioner Higginbotham and carried. Attorney Mack N. Cleveland, Jr., representing Joseph Gazil, appeared to request the closing and abandonment of the north-south alley from Third Street to Fourth Street between Cypress and Sanford Avenues. Mr Gazil has plans to construct a new supermarket on the northwest corner of Fourth Street and Cypress Avenue and utilization of the alley by paving for off-street parking. Mr. Cleveland stated that Mr. Gazil would be agreeable to the City retaining a utility easement in addition to his encasing the utility line in cast iron if future construction were ever placed over the line. After consideration and on motion of CommiSsioner Higginbotham, seconded by Commis- sioner Moore and carried, authorization was given for the City Clerk to advertise a Public Hearing on March ll, 1968, to consider the closing and abandoning of the alley. After consideration of a letter from the Department of Housing and Urban Dev~lop- merit, Atlanta, Georgia, requesting the City to make known its intent to include a rent supplement housing program in the Workable Program for the City of Sanford and now pending recertification, Commissioner Higginbotham moved to furnish The Department with a letter approving the inclusion of same and the City Manager authorized to sign the letter. Seconded by Commissioner Moore and carried. Condemnation Report No. 67-192, Group 12, Standard Oil Service Station at 301 Park Avenue, tabled at last meeting, was next reviewed. After discussion, Commissioner Higgin- botham informed the Commission that he, as a local agent for this company, would handle the matter direct with the officials of Standard Oil Company, forwarding the Condemnation Report to them. A discussion was next held on the proposed Contract for the engineering services and fees submitted by Consulting Engineering firm Clark, Dietz and Associates, for storm sewer survey or drainage study for the City of Sanford, as previously outlined and approved at meeting of January 8, 1968. The Commission discussed with the City Attorney for clarity certain word meanings regarding "survey" as set forth in the contract. The City Attorney rendered the opinion that this was standard procedure and that any subcontracting charges or extra fees that will incur liability must be first approved by the City Commission. After consideration, Commissioner Moore moved to approve the Contract as prepared and submitted by Clark, Dietz and Associates for an engineering study for a storm sewer drainage survey at a cost fee of $7,500.00 with the Mayor and City Clerk authorized to execute the Contract. The City Manager next requested the transfer of funds to gover a trip by the City Manager and the Building Official to the Federal Department of Urban Development, Atlanta, Georgia, for discussion of the recertification of the City of Sanford Workable Program, and on motion of Commissioner Wilson, seconded by Commissioner Moore and carried, the following transfers were authorized: $60.00 from Contingency Account No. 8150 to Account No. 5007, Engineering Travel Expense. $80.00 from Contingency Account No. 8150 to Account No. 1207 City Manager Travel Expense. Commissioner Raborn next introduced Ordinance No. 932, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AFIENDING ORDINANCE NIIMBER 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN C-1 (NEIGHBORHOOD COMMERCIAL) DIS- TRICT. and same was placed on its first reading and read in full. Commissioner Raborn then moved on the waiver of the requirement of the second reading of Ordinance No. 932, and that same:::be placed on its final passage and adoption. After consideration of a legislative bulletin of the proposed cigarette tax increase issued by the Florida League of Municipalities, Commissioner Higginb0tham moved to authorize the City Attorney to prepare the necessary ordinance giving the city~ of Sanford the authority to receive its proportionate share if this bill becomes effective. Seconded by Commissioner !iWilson and carried. A request of Ernest Southward, .to recess the City parkway to permit angle parking ~on the east side of Palmetto Avenue north of Commercial Street, property of Russell Firestone, ~was next considered. Commissioner Higginbotham moved this be permitted with the property owner bearing all costs and m~eting' any safety requirements as designated by the City and the City to mark off the parking spaces. Seconded by Commissioner Raborn and carried. Consideration was next given a claim for injury report submitted by Mrs. Lon (Ella) iiSimmerly, 3406 Sanford Avenue, Sanford, Florida. Mrs. Simmerly allegedly tripped on a brick i~and fell in the street at the southwest corner of East First Street and Magnolia Avenue, on lior about the end of January or first of February, 1968. The Commission took no action on the il ~claim for reimbursement of medical expenses. On motion of Commissioner Wilson, seconded by Commissioner Raborn and carried, current vouchers and payrolls were next approved as evidenced by General Fund Florida State Bank Vouchers Nos. 10725 through 10955; General Fund Sanford Atlantic National Bank Vouchers Nos. 9718 thruugh 9788; Water and Sewer Revenue Fund Florida State Bank Vouchers Nos. 155 through 168; Sanford Atlantic National Bank Municipal Improvement Construction Fund Vouchers Nos. 95 through 109. ~onsideration was next given to the selection of a new municipal judge to fill the ~ivacancy on March 1, 1968, created by the resignation of Municipal Judge C. Vernon Mize, Jr. Commissioner Raborn moved to nominate Attorney Phillip H. Logan for the position. iCommissioner Higginbotham moved to nominate Attorney Roger L. After the vote was cast and the nomination was made, Commissioner Higginbotham moved that the City Clerk be instructed to cast a unanimous vote for the nomination of Roger L. Berry for the position ~of Municipal Judge, effective March 1, 1968. Seconded by Commissioner Moore and carried. A recommendation of the Zoning and Planning Commission to allow a conditional use of a day nursery at 700 West 25th Street, zoned R-iA, was discussed and after condideration, Commissioner Raborn moved that the matter be tabled u~til the next meeting.
