The City Commission of the City of Sanford, Florida, met in regular session at the
City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on March ll, 1968.

The meeting was called to order by the Chairman.
The first item of business was a Public Hearing to consider the request of Attorney
Mack N. Cleveland, Jr., representing Joseph Gazil, Inc., for the closing and abandoning of a
l~-foot platted and open alley for utilization of off-street parking in conjunction with the
construction of a new supermarket and as advertised in the Sanford Herald on March l, 1968.
NOTICE OF PROCEEDING FOR YACATING
AND CLOSING AN ALLEY
TO WHOM IT MAY CONCERN:
You will take notice that the City Commission of the City of Sanford, Florida, at
8:00 P. M. on March ll, 1968, in the City Commission Room at the City Hall in the City of
Sanford, Florida, will consider and determine whether or not the City will close, vacate a~d
abandon any right of the City and the public in and to that certain north-south alley lying
between Third and Fourth Streets between Sanford and Cypress Avenues. Said alley being more
!iparticularly described as follows:
The north-south alley lying between Blocks 5 and 8,
Chapman and Tucker Addition.
Persons interested may appear and be heard at the time and place above specified.

The Chairman announced that the Commission would be glad to hear from anyone in
favor of, or against, the closing as advertised in the foregoing notice.
There being no opposition and after discussion, Commissioner Higginbotham moved to
approve the closing and abandoning of the alley right-of-way with a retention of a utility
easement within said area and authorization for the City Attorney to prepare the proper
ordinance for same. Seconded by Commissioner Raborn and carried.
C. A. Whiddon, Sr., Whiddon Real Estate, appeared to represent a request of his
client J. Ao Gallimore, for the City to confirm by Quit Claim Deed certain street right-of-
iways that were closed and abandoned in 195~ and de-annexed by legislation in 1935; namely,
Water Street and Pomegranite Avenue between Tamarind and Mulberry Avenues; and Mulberry Ave-
nue between Pomegranite and Jessamine Avenues. Said streets lying between West First Street
and Seminole Boulevard and west of Jessamine Avenue, contained within Block 2N, St. Gertrude
Addition to the Town of Sanford, Florida.
After discussion, Commissioner Higginbot~am moved that the Mayor be authorized to
!execute a quit claim deed covering the aforementioned street right-of-ways with stipulations
as previously discussed to be contained therein or attached thereto and set forth as follows:
1. The land of the industrial prospect or purchaser will be annexed to the
City of Sanford.
2. The industrial prospect agrees to the construction of a facility of at least
lO0,O00 square feet.

3. The industrial prospect agrees to have the facility construction substantially
underway within one year from the date of closure of the streets.
4. An escrow agreement dr~wn that the deed will be held and not used until such
time as the industrial prospect obtains the property with a proposed time
of three or five years, but that the deed will be held no longer than five
years.
5. The deed to have a reverter claUse whereby the property shall revert to the
City if the industrial prospect fails to construct an industry on the property
within a reasonable time of three or five years.
Seconded by Commissioner Wilson and carried over the dissenting vote of Commissioner Raborn.
A discussion was held next on a proposed site selection and sale prices as sub-
mitted by the Goldsboro Recreation Building Committee for the proposed construction of a
neighborhood facilities building, property legally described as Lots i through 10, Block
Tier 17, E. R. Trafford's Map of Sanford, located between Seventh and Eighth Streets and
Oleander and Mangoustine Avenues.
After consideration and on motion of Commissioner Raborn, seconded by Commissioner
Moore, authorization was given to negotiate for the purchase of the above described property,
the hiring of an appraiser, and if necessary, to proceed by eminent domain to acquire the
property.
After consideration of the request and on motion of Commissioner H~gginbotham,
seconded by Commissioner Moore and carried, approval was given to transfer,in name only,
beer and wine Licenses No. J!J~8, 301 South French Avenue; No. 1179, 329 Sanford Avenue; No.
444, lll6 Celery Avenue; and No. ll81, llO0 West 13th Street, from Joseph Gazil to Gazil,
After consideration and on recommendation of the Finance Director and City Manager,
Commissioner Moore moved to approve the purchase for retirement sixty-seven Wate~ and Sewer
Revenue Certificates of 1953, due November l, 1984, at a rate of 77.611 plus interest for
a total of $52,840.20, to be expended from Utility Surplus, Account No. 9850. Seconded by
Commissioner Higginbotham and carried.
After consideration and on motion of Commissioner Higginbotham, seconded by Co.mmis-
sioner Moore and carried, authorization was given to pay the final amount of $1,542.60 to
Bercleve Unifloats, Inc., as submitted on Statement dated February 29, 1968, said amou_ut
being a portion of retainage for materials and work completed on the pile driving portion of
the Floating Piers and Associated Work for the Lakefront Marina Project, as approved by the
City project engineering firm Clark, Dietz and Associates and the City Manager, and as author~
ized under the Agreement for same dated January 3, 1967.
Consideration was next given to a statement dated March 8, 1968, submitted by
Shoemaker Construction Company, Inc., for final payment of a retainage held pending insurancel
now cleared regarding two damaged floats, and on motion of Commissioner HiEEin~

Company the amount of $1,379.52 for materials and work completed on the Lakefront Marina
Project as authorized under Agreement for MiscellaneoUs Marina Facilities, dated March 27,
1967, and approved by the City project engineering firm Clark, Dietz and Associates, and the
City Manager.
After consideration and On motion of Commissioner Higginbotham, seconded by Commis-
sioner Moore and carried, approvalwas given to transfer the amount of $835.00 from Contin-
gency Account No. 8150 to Police Department Account No. 2201, Police Salaries, to cover the
unappropriated expense incurred on the security of the United States Vice President Hubert H.

Humphrey relative to his visit and stay in the City on March ~and 2, 1968.
Consideration was next given to the transfer of $150.00 within the Sewer Division
from Account No. 9526, Sewer Equipment-General, to Account No. 9517, Sewer Tools, and on
motion of Commissioner Moore, seconded by Commissioner Wilson and carried, same was approved.
Due to increased traffic on Seminole Boulevard, a discussion was next held on a
recommendation from the City Manager and the Police Chief for better control, and listed as
follows:
a. Seminole Boulevard made a through street with Park Avenue made a stop street.
b. The flashing beacon at the intersection of Seminole Boulevard and Park Avenue
changed to show red to the south; amber to the east and west.

Remove stop sign on Seminole Boulevard at Park Avenue and install a stop sign
on the southeast corner of the intersection.
Seminole Boulevard a through street with Palmetto Avenue made a stop street and
flashing beacon installed to designate same.
After consideration and on motion of Commissioner Higginbotham, seconded by Commis-
sioner Moore and carried, same was approved as outlined in the foregoing paragraph.
A recommendation from the Zoning and Planning Commission to allow a conditional use
in an R-lA (Single Family I~elling) District of a nursery-kindergarten at 700 West 25th Street
!was next considered, and on motion of Commissioner Higginbotham, seconded by Commissioner
Wilson and carried, same was approved under operating restrictions as follows: Limited to 50
children, Day School operation only, All area that is used by the children tO be fenced,
Loading and unloading of children to be done on Maple Avenue side only.
Commissioner Raborn next introduced Ordinance No. 956, entitled:

On motion of Commissioner Moore, seconded by Commissioner Raborn and carried, the
minutes of February 12 and February 26, 1968, were approved.
As outlined in minutes of February 12, 1968, regarding the State of Florida claim-
ing title to certain portions of the street right-of-ways of Bay Avenue due to the Grant Line
survey, the City Attorney presented a report of the findings on same, and after discussion,
the Commission authorized the City Manager to write a letter to the appropriate authority
describing therein the certain City right-of-ways as opposed to the City furnishing a survey
On same.
Frank Scott, Jr., appeared before the Commission requesting that consideration be
given to the installation of a street light in the alley between First and Second Streets
and Park and Oak Avenues. The matter was turned over to the City Manager and Police Chief
for study and a recommendation to be submitted at the next meeting.
The City Manager next brought to the attention of the Commission the Hunt Feed
Store truck unloading problem at the northwest corner of Second Street and Sanford Avenue

where semi-trailer trucks are blocking Second Street when they unload. Mr. Hunt was notified
on January 29, 1968, to eliminate or correct the practice and again in a letter of February 5,
1968, which allowed him the month of February to work out an acceptable solution. Mr. Hunt
has taken no action as of this date. The Commission authorized the City Manager and the Poli¢
Chief to work out a satisfactory solution for both the City and Mr. Hunt and bring the in-
formation back to the Commission at the next meeting.
Consideration was given to a request from Helen DeWitt, Seminole Art Association,
for use of the USO quarters in the Chamber of Commerce Building when said space is vacated,
and on motion of Commissioner Raborn, seconded by Commissioner Wilson and carried, action was
deferred with the request to be taken under advisement at the appropriate time.
CommisSioner Wilson next introduced Resolution No. 10~5, and after being read .in
full, moved on its passage and adoption. Seconded by Commissioner Higginbotham and carried~
unanimously.

On consideration of a request by the City Manager that he be relieved as an advisory
member of the Goldsboro Recreation Building Committee for the proposed construction of a
neighborhood facilities building, Commissioner Higginbotham moved to accept the resignation
~ith regret. Seconded by Commissioner Raborn and carried.
After discussion, Commissioner Raborn moved to appoint James R. Jernigan, City
~ac~ucy created by the resignation of the City Manager. Seconded by Commissioner Moore and
carried.
The Commission authorized the City Manager to contact Larry Allen regarding his
willingness to serve on the Goldsboro Reoreation Building Committee as a replacement for
member William Wright, who is now attending school out-of-state.

A request of the Circle "K" Club of the Seminole Junior College, sponsored by the
Sanford Kiwanis Club, for donated use of the Civic Center sometime in November, 1968, was
next presented. Commissioner Higginbotham moved this request be ~pproved, and be considered
in the 1968-69 B~dget with funds in the amount of $75.00 set up to cover cost of donated use
of the Civic Center for this function. Seconded by Commissioner Raborn and carried.
On motion of Commissioner Higginbotham, seconded by Commissioner Moore and carried,
current vouchers and payrolls were next approved as evidenced by General Fund Florida State
Bank Vouchers Nos. 10956 through lll82; General Fund Sanford Atlantic National Bank Vouchers
Nos. 9789 through 9855; Water and Sewer Revenue Fund Florida State Bank Vouchers Nos. 169
