032568 517 ", MINUTES City Commission, Sanford, Florida March 25 at 8 P.M. !9. 68 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on March 25, 1968. Present: Commissioner W. Vincent Roberts, Mayor Earl Higginbotham " Lee P. Moore " M.L. Raborn, Jr. " A.L. Wilson City Attorney Wm. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. L. Whelchel Police Chief Ben E. Butler The meeting was called to order by the Chairman. The Reverend A. A. Fields, First Shiloh Missionary Baptist Church, llO1 West 13th Street, appeared voicing his objection and that of his congregation against the opening of a Teen Center across the street from the church in the building known as the old Star Theater. He further stated that the proposed City funds of $100,000.00 for construction of a colored recreation building could be used for upgrading the facilities of his people through street paving, drainage, and street lighting. The Commission informed Mr. Fields that the teen club was opening under private, not City ownership, and upon the owner meeting all City codes and laws, the City could not legally refuse the issuance of a City occupational license to open and operate. Attorney C. Vernon Mize, Jr., representing property owners R. A. and Thelma D. Williams and a corporation being formed to purchase and construct federal rent supplement housing of garden type apartments with parking and playground facilities in four blocks of Block 7, Tier 17, 18, 19 and 20, Florida Land and Colonization Company Limited Map of St. Gertrude Addition, between Fifth and Sixth Streets and Pomegranite and Mangoustine Avenues, appeared to request that the 82-foot platted and unopened street right-of-ways of Mulberry, Jessamine, and Oleander Avenues withing the above described area, be vacated, abandoned and closed in conjunction with the apartment complex. After consideration and on motion of Commissioner Higginbotham, seconded by Commis- sioner Moore and carried, a public hearing was set for April 8, 1968, to further consider said;i iiclosing and the City Clerk authorized to advertise same. Consideration was given next to a recommendation of the Zoning and Planning Commis- sion for the rezoning of property as follows: 1. North half of Block 2, Tier 10, E. R. Trafford's Map of Sanford, from C-2, General Commercial, to M-l, Light Industrial. Proposed use being that of cabinet manufaaturing and warehousing. 2. Block 7, Tier 17; Block 7, less the N~ of NE~, Tier 18; Block 7, Tier 19; Block 7, Tier 20; all in the Florida Land and Colonization Co. Limited Map of St. Gertrude Addition to the Town of Sanford, from R-2 and R-5, One and Two Family Dwelling District, to R-6, Multiple Family Dwelling District. Proposed use being that of garden type apartment buildings with parking and playground facilities as a federal rent supplement housing development. iOn motion of Commissioner Higginbotham, seconded by Commissioner Moore and carried, the City Clerk was authorized to advertise the date of April 8, 1968, for a public hearing to consider ss/~e. D., for the vacating and closing of that portion of the east-west alley abutting Lots i through ll and Lots 24 and 25, Block J, First Street Extension; and on motion of Com- missioner Higginbotham, seconded by Commissioner Moore and carried, the City Clerk was authorized to advertise a public hearing April 8, 1968, for consideration of said alley closing. Under the same request, Dr. Largen requested the City to pave Lake View Avemue from East First Street to Second Street. Dr. Luis Perez was present and stated that he owned vacant property on Lake View Avenue in this area and was interested in the City paving said street. The Commission outlined the policy of abutting property o~ners paying their.pro-rata share or one-third of the paving cost and the City paying its one-third. No official action was taken on the street paving request. After consideration and on motion of Commissioner Wilson, seconded by Commissioner Moore and carried, approval was given on a salary reclassification of an employee in the Utility Department, as follows: Robert Davis, meter reader ~rom: To: D ..... $4,0~.56, annual E - $4,243.20, annual After discussion and on recommendation of the City Manager, Commissioner Moore moved that the six months acting status be removed from the classification of the Director of Public Works and the Director of Utilities and that effective April l, 1968, they be reclassified to their respective full in-grade salary and classification, as follows: A. The City Manager submitted a report that he and the Police Chief had met with Mr. Hunt, Hunt's Tuxedo Feed Store, co~ner of East Second Street and Sanford Avenue, and had worked out a possible satisfactory solution to the past practice of delivery trailer trucks blocking and creating a traffic congestion on Second Street. It was agreed that unloading would be accomplished by backing Mr. Hunt's smaller truck up to the door and then the trailer up to the small truck. On a report by a Commissioner that Mr. Hunt was not following the satisfactory solution as reported and had on March 25, 1968, blocked East Second Street on two occasions, the Commission authorized the City Attorney to handle the matter through a legal notification that the blocking of said street will either cease or ben,handled through arrest and City Court procedure. Consideration was next given to an approved expenditure item after the adoption of the 1967-68 Budget, and on motion of Commissioner Moore, seconded by Commissioner Raborn and carried, approval was granted to transfer the sum of $450.00 from Account No. 8150, Contingen. cy, to Account No. 7097, Firemen's and Policemen's Life Policies, for the annual premium of death and accident insurance to cover the 20 auxiliary police officers. Commissioner Higginbotham next introduced Ordinance No. 938, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABAN- DONING THAT CERTAIN NORTH-SOUTH ALLEY LYING BETWEEN THIRD AND FOURTH STREETS BETWEEN SANFORD AND CYPRESS AVENUES, IN THE CITY OF SANFORD, FLORIDA. and same was placed on its first reading and read in full. 519 MINUTES City Commission, Sanford, Florida March 25 at 8 F.M. 19 68 Commissioner Higginbotham then moved on the waiver of the requirement of the second reading of Ordinance No. 938, and that same be placed on its final passage and adoption. Motion seconded by Commissioner Moore. Thereupon, the question recurred on the waiver of the second reading, the roll was called and the vote stands as follows:~ Commissioner Roberts Yea " Higginbotham " " Moore " " Raborn " " Wilson " Said Ordinance No. 958 was then placed on its final passage and adoption, the roll was called and the vote stands as follows: Commissioner Roberts Yea " Higginbotham " Moore " " Raborn " " Wilson " Thereupon, the Chairman a~ounced that the City Commission of the City of Sanford, Florida, by unanimous vote had passed and adopted said Ordinance No. 938, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABAN- DONING THAT CERTAIN NORTH-SOUTH ALLEY LYING BETWEEN THIRD AND FO~ STREETS BETWEEN SANFORD AND CYPRESS AVENUES, IN THE CITY OF SANFORD, FLORIDA. Consideration was given to a request of Harold:L. Slama, lessee of the Marina Harbouril, Inc., lakefront complex, for an alcoholic beverage license to allow the sale of package beer only at the Marina site on the lakefront for consumption off the premises. On the basis of an exclusive alcoholic beverage right held under lease agreement by Monroe Motels, Inc., lakefront, a letter was submitted by said motel lessee stating approval to allow the sale of package beer at the marina-lakefront site. After discussion, Commissioner Higginbotham moved that upon said alcoholic beverage license being approved by the State, the City concurs in the issuance of a City license to Marina Harbour, Inc., for the sale of packaged beer, con* sumption off the premises. Seconded by Commissioner Moore and carried, Commissioner Wilson abstaining. A_uappraisal report on buildings and land values as prepared by John Sauls, Realtor- Appraiser, and authorized by the Commission on March ll, 1968, for that property describ-ed as Lots i through 10, Block 9, Tier 17, Seminole Park, located between Seventh and Eighth Streets and Oleander and Mangoustine Avenues, as a proposed site for a Goldsboro Recreation Neighbor- hood Facilities Building, was next reviewed. After discussion and on motion of Commissioner Raborn, seconded by Commissioner Wilson and carried over the dissenting vote of Commissioner Moore, authorization was given to proceed to acquire the entire block of of property as described in the foregoing paragraph through purchase at the figures of the appraiser and at a cost not to exceed the total ap- praisal figure of $13,~0.00. On a report regarding his willingness to serve, Larry Allen was appointed to serve on the Mayor's Committee for ~he proposed Goldsboro Recreation Building. A discussion was held regarding a letter from Sanford Pipe Line Company, Houston, Texas, dated March 5, mailed March 15, and received in the City Manager's office on March 18, 1968, for the renewal of their March 5, 1963, Right-Of-Way Agreement of five years with an option for ten additional years. Higginbotham, seconded by Commissioner Raborn and carried, the CitY Attorney was authorized to write a letter to inform said company that the agreement had expired prior to the receipt of the letter. The City Manager next presented for consideration the possibility of his visiting in the middle west several federal government closed and converted military bases that now uphold the industrial economy of their communities, to gain information that would be helpful on the Sanford Naval Air Station closure in July, 1968. Commissioner Higginbotham moved that the City Manager be authorized to visit said converted base closures and that funds for same be expended from Sanford Industrial Commission Account No. 8507, Travel Expense-Industry Cultivation.
