The City Commission of the City O.£11.Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida at 8:00 o'clock P. M. on September 9, 1968.:.. Present: Commissioner W. Whelchel Tax Assessor Max Coberly Police Chief Ben E. Butler The meeting was called to order by the Chairman. The first item of business was the City Commission reconvening from an adjourned ~~o~ ~g~ ~819T~'R~l~it as a Tax Equalization Board to receive complaints or Mack N. Cleveland, Jr., Attorney, appeared representing C'. E. Merrill, Jr:. and A. J. Thomas, owners of Monroe Motels, Inc., known as the Holiday Inn. He stated his clients' Position of disagreement in the valuation of $659,910.00 placed on said motel by the City ssessor, comparing this to actual cost of $487,088.00 for motel building nd improvements. ~ttorney Cleveland contended that under his interpretation of the Agreement, Article 7, Taxes, ~nly buildings and improvements placed on the property would be taxed. The City Attorney explained that Article 7, Taxes, in the Lease Agreement has ap- parently been misconstrued and under the State laws of taxation the City has no authority to ielete taxes on any property within the jurisdiction of the City. After discussion, Commissioner Higginbotham moved to approve amending the assessed valuation on the buildings from $557,888.00 to the actual construction cost of $487,088.00. Seconded by Commissioner Moore and carried over the dissenting vote of Commissioner Raborn. After further discussion, Commissioner Raborn moved that the assessed land valuation of $102,050.00 on the property of Monroe Motels, Inc., stand as determined by the City Tax ~ssessor. Commissioner Higginbotham moved that this motion be tabled as the land tax assess- nent is beyond the intent of the lease agreement. Both motions died for lack of a second. Commissioner Wilson moved that the land controlled by Monroe Motels, Inc., be ~mended from the present assessed valuation of $102,050.00 to a value of $60,000.00. Seconded ~y Commissioner Higginbotham and carried over the dissenting vote o£ Commissioner Raborn. C. Vernon Mize, Jr., next appeared representing Seminole Prop.er~y Management, Inc., ~wners of Sanford Plaza Shopping Center. Mr. Mize stated his client's position of disagree- sent in the valuation of $919,250.00, as it represented a 17% increase over the previous 1967 ~aluation o£ $782,950.00. After discussion, Commissioner Raborn moved that the assessed valu- ation of $919,250.00, as placed thereon by the Tax Assessor, be accepted. Seconded by Com- ~issioner Wilson and carried. Seconded by Commissioner Moore and carried. On motion of Commissioner Higginbotham, seconded by Commissioner Moore and carried, the 1968 Tax Roll was approved and the Equalization Board meeting was adjourned. Consideration was next given to bids submitted for the furnishing of dozer equipment of a crawler-tractor, as publicly opened in the City Hall at 2:00 P. Fin. , · After consideration and on recommendation of the City Manager, Commissioner Wilson moved to accept the low net bid of State Tractor and Equipment Company, Inc., in the amount of $19,000.00 for the furnishing of one International crawler-tractor. Seconded by Commis- sioner Moore and carried. A discussion was next held regarding Community Antenna Television franchise pro- posals that have been submitted from various companies, and after consideration, the Commis- sion indicated there appears to be no dire need for this type of service and no apparent ipublic demand. After consideration and on recommendation of the City Manager, Commissioner Higgin- botham moved to approve a salary reclassification for City employees, as follows: Ulysses Jackson, Laborer, Street Division From: To: Joe Smith, Laborer, Street Division William E. Consideration was next given to an oversight on various insurance premiums that were not included in the City's annual blanket policy coverage, and on motion of Commissioner Raborn, seconded by Commissioner Moore and carried, authorization was given to include and pay to Cr~mmley and Monteith, agency for Insurance Company of North America, insurance pre- $27.00 $48.00 miums and coverage, as follows: Police Boat - transportation Police pistol range Consideration was next given to. a report by the City Manager that the Sanford Flotilla Commander 41, Coast Guard Auxiliary, was now occupying and renovating the city-owned building on Seminole Boulevard and Myrtle Avenue, and on motion of Commissioner Higginbotham, seconded by Commissioner Moore and carried, the City Attorney was authorized to prepare a i!lease agreement on said building with reference to the responsibility of said organization ~ias outlined in minutes of August 26, 1968, regarding insurance coverage and maintenance of the property. After being read in full, Commissioner Raborn moved on its passage and adoption. Seconded by Commissioner Moore and carried unanimously. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 951, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER t8, THE CODE OF THE CITY OF SANFORD, FLORIDA, 1954, AS AMENDED, BY ADDING THERETO SECTION 18-30.1, TEMPORARY QUESTIONING OF PERSONS IN PUBLIC PINkCES; SEARCH FOR WEAPONS. On motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, MINUTES City Commission, Sanford, Florida September 9 ~ at 8 P. M. 1~. 68 Orlando. Fla. minutes of August 26, 1968, were approved with the correction of one misspelled word. On motion of Commissioner Wilson, seconded by Commissioner Moore and carried, current vouchers and payrolls were next approved as evidenced by General Fund Florida State Bank ~ouchers No,12204 through1239'3;~a~er and Sewer Revenue Fund Florida State Bank Vouchers Nos. 258 through 262; United State Bank of Seminole Renewal and Replacement Fund Voucher No. 45; and General Fund Sanford Atlantic National Bank Vouchers Nos. 167 through 220. A discussion was next held on the plans for pa~i~g~of~;the north-south streets in designated area number one of Georgetown, as to the engineering and survey work which will be required prior to the City Attorney preparing the legal documents for said project. After consideration, Commissioner Raborn moved to auDhorize the City Manager to retain engineering and survey services. Seconded by Commissioner Wilson and carried. After consideration and recommendation by the Police Chief of said application, Commissioner Raborn moved to approve the request for the transfer of a 1967-68 beer and wine license No. 1254 from Alberta Webber, deceased, d/b/a Busy Bee Tavern, 1007 West 15th Street, to Ransom and Pearlie Lee Brown, same address. Seconded by Commissioner Moore and carried. After consideration and on recommendation of the Police Chief, Commissioner Moore moved to approve a salary advance in the total amount of $155.00 to City employee, Francis Willi&m Smathers, Patrolman, Police Department, with said advance to be deducted in the amount of $55.25 over a period of four semi-monthly pay days. Seconded by Commissioner Wilson and carried.
