091668 575 MINUTES City Commission, Sanford; Florida r a P M. 19~ The City Commission of the City of Sanford, Florida, met in Special Adjourned Session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on September 16, 1968. Present: Commissioner W. Vincent Roberts, Mayor " Earl Higginbotham " Lee P. Moore " M.L. Raborn, Jr. " A.L. Wilson , City Manager W. E. Knowles City Clerk H. L. Whelchel Police Chief Ben E. Butler Absent: City Attorney W. C. HutChison, Jr. The meeting was called to order by the Chairman. The first item of business was to consider the request of PhilliplZeuli for annexa- tion to the City of Sanford of Lots i through ll, Vi Mar, located in the area of Dreamwold and Lake Jennie. The City Manager stated that the Seminole County School Board was desirous of annexing Seminole High School in this area. However, a sketch of the area revealed that l?here are presently seven other property owners involved and that to annex the Zeuli and .iSchool Board p~operty would require some of these property owners to agree to annexation. After discussion, Commissioner Higginbotham moved that the City Manager be authorize( to contact the property owners in the area abutting the Zeuli and School Board property seeking their interest in the annexation. Seconded by Commissioner Raborn and carried. Consideration was next given to bids submitted for the construction of a Goldsboro Recreation Neighborhood Facilities Building as publicly opened in the office of Architect John A. Burton, IV, at 2:00 P. M., September 13, 1968, and advertised in the Sanford Herald on September ll, 1968, and said bidding as approved by the Commission on August 12, 1968. BID TABULATION Manual Builders, Inc. Orlando, Florida $76,986.00 Harvey Spears Construction Company Eustis, Florida $80,000.00 Shoemaker Construction Company Sanford, Florida $85,500.00 After consideration and on the recommendation of the Architect that the low bid ihad been verified and found to be in order, Commissioner Wilson moved to accept the bid of 1 !Manual Builders, Inc., in the amount of $76,986.00 for the construction of the Goldsboro ilRecreat~.on Neighborhood Facilities Building. Seconded by Commissioner Higginbotham and icarried. Commissioner Higginbotham next introduced Resolution No. 1050, and after being read in full, moved on its passage and adoption. Seconded by Commissioner Moore and carried by the unanimous vote of the Commission. Said Resolution No. 1050 being in words and figures as follows: A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, APPROPRIATING UNEXPENDED CASH SURPLUS ON HAND AT T~ END OF THE FISCAL YEAR 1967-1968 TO THE DEPARTMENT OF GENERAL GOVERNMENT OF SAID CITY FOR THE FISCAL YEAR 1968-1969 FOR USE OF THE OR- DINARY PURPOSES IN OPERATING EXPENSES OF SAID CITY. WHEREAS, the City Commission of the City of Sanford, Florida, deems it necessary, expedient and for the best interest of said City that any unexpended cash surplus as of September 30, 1968, of the operating revenues of said City for the fiscal year 1967-1968 be iiappropriated for the ordinary purposes and operating expenses of said City in the budget for MINUTES City Commission, Sanford, Florida September 16 at 8 P. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that any unexpended cash surplus as of September 30, 1968, of operating revenues of said City for the fiscal year 1967-1968 be and the same is hereby appropriated to the Depart- ment of General Government of said City for the ordinary purposes and operating expenses of said City for ~he fiscal year 1968-1969, and saidcash surplus shall be incorporated in the budget of revenues and expenditures of said Cityfor said fiscal year 1968-69 for the ordinar~ purposes and operating expenses of said City. WHEREAS, in accordance with Section 62 of the Charter of the City of Sanford, Florida, the City Manager of the City of Sanford, Florida, has made and submitted to the City Commission of the City of Sanford, Florida, an estimate for budget of revenues and expenditures of the City of Sanford, Florida, for the fiscal year beginning October l, 1968 and ending September 30, 1969, such estimates or budget having been made with particular application to the various departments of the City, a true copy of which is hereto attached and by reference made a part of this Resolution; and WHEREAS, each and every item contained and set forth in said budget prepared by the City Manager has been carefully considered by this Commission, NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that said budget as prepared and submitted by the City Manager to the City Commis- sion, be and the same is'~hereby adopted as the budget of the City of Sanford, Florida, for the fiscal year beginning October l, 1968 and ending September 30, 1969. BE IT FURTHER RESOLVED that upon collection of any revenues of said City, the City Clerk shall allocate from each dollar collected and received, the several ~amounts to the reDpective funds for purposes for which the same are hereby authorized and appropriated. Fla. statement: Commissioner Higginbotham requested his vote be qualified with the following "Due to the fact that the State of Florida prohibits the cities from raising the millage and the City is faced with the roll back of l~ mills for next year, it becomes necessary that the City raise the necessary taxes to meet the public's services and demands and give them the services required and demanded, the City is substituting a millage increase by a refuse service charge increase of 50¢ per month on refuse collection which is the same thing as raising taxes but it is the only avenue that we have of getting the money necessary to meet our expenditures, - so, in fact, we are raising taxes." Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote had passed and adopted said Ordinance No. 954, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA~ ADOPTING A PAY SCHEDULE AND WORKING HOURS FOR THE EMPLOYEES OF SAID CITY. The City Manager next gave a report on the status of the City-County cooperative whiteway street lighting project on Highway 17-92 along Seminole Boulevard from Mangoustine Avenue to Interstate 4. The Manager and the County Engineer met today with State Road Department officials who outlined the new federal street lighting regulations, which require a 30-foot set back from edge of pavement for solid poles and a l~-foot set back from edge of pavement if break-a-way poles are used. After consideration and on motion of Commissioner Higginbotham, seconded by Commis- sioner Raborn and carried, the City Manager was authorized to write a letter to United States Senators Holland and Smathers expressing the City's opposing views to the current federal highway whiteway street lighting regulations for state highways. After consideration of a letter of request for free use, Commissioner Higginbotham moved that the City Manager be authorized to work out satisfactory leasing arrangements of the Civic Center in October, 1968, for a Jamboree by the Bowling League Association of Sanford hosting the event. Seconded by Commissioner Raborn and carried. A request wasnext presented outlining that Hulon Hale, property owner at 1312 Summerlin Avenue, has requested reimbursement from the City for the cost of surveying and locating corner survey markers which he contended were not replaced when a City Utility Ex- tension Program moved them in 1954. After consideration, Commissioner Higginbotham moved to deny tke request and to instruct the City Manager to write Mr. Hale a letter relating that the filing of claim at this time had outlived the law of limitations and the City could not be expected to assume said liability.
