M, 19. 68 1 DOqu-l~;~OW OFFICE ~U~'FLY COMFAN~ The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on September 23, 1968. Present: Commissioner W. Vincent Roberts, Mayor " Earl Higginbotham " Lee P. Moore " M.L. Raborn, Jr. " A.L. Wilson City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. L. Whelchel Police Chief Ben E. Butler The meetingwas called to order by the Chairman. The first item of business was to consider the request of Elmo Faris, d/b/a Elmo Faris Used Cars, lll9 Sanford Avenue, for an exempt occupational license on the basis that he is 62 years of age, retired, a small dealer, and operating the business more as a hobby. After consideration and on motion of Commissioner Raborn, seconded by Commissioner Moore and carried, the request was denied. Consideration was next given to a statement from the U. S. Department of Housing and Urban Development that an application for federal assistance under the low income housing program had been made for a project to be known as Palm Villa Gardens, located at Fifth Street and Pomegranite Avenue. Commissioner Wilson moved the matter be tabled until such time that a knowledgeable person regarding same could present further details, seconded by Commissioner Raborn and carried. After consideration, Commissioner Raborn moved to approve a request of the Mutual Concert Association to lease the Municipal Civic Center with alcoholic beverage privileges for the annual Champagne Ball on December 7, 1968, at the regular fee of $250.00. Seconded by Commissioner Moore and carried over the dissenting vote of Commissioner Wilson. A discussion was next held on the request of the Seminole County Junior Chamber of Commerce for free use of the Municipal Civic Center for an eight day period, March 30 through April 6, 1969, for a Beauty Pageant event. After consideration, Commissioner Raborn moved that the Municipal Civic Center be leased to the Junior Chamber for the Specified time at the sum of $261.76, with the City underwriting same as a donation to be paid from Contingency Account No. 8150, 1968-1969 Budget. Seconded by Commissioner Moore and carried. Consideration next given a petition to annex into the City that property located on the south side of Onora Road between Sanford Avenue and Highway 17-92, consisting of property owned by the Sanford Christian Church, Inc.; Pinecrest Baptist Church; William Gramkow; Ted and Selma Williams; R. W. and Dorothy Williams. Commissioner Moore moved the City Attorney be authorized to prepare an~ordinance to annex this area, seconded by Commissioner Raborn and carried. Consideration was next given to the following list of forty structures submitted:by the Building Official, which were found to be in a dilapidated, unsanitary or unsafe condi- tion, with a recommendation that condemnation proceedings be taken on same. Trafford's Map of Sanford Commissioner Raborn moved to hold a Public Hearing on October 14, 1968, to consider Reports Nos. 68-253 through 68-292 to determine the condition of the structures for condem- nation proceedings; to authorize a notice to be placed upon each structure, and directed by registered mail to the last known address as shown by the Tax Assessment Rolls of the City, a notice to the owner of the property involved of said hearing. Seconded by Commissioner Moore and carried. On motion of Commissioner Raborn, Seconded by Commissioner Wilson and carried, the minutes of August 12, 1968, were approved. Consideration was, neXt given to a Contract drawn between the City of Sanfordand ManuelBuilders, Inc., for the constmuction of the Goldsboro Recreation Neighborhood Facili- ties Building, and on motion of Commissioner Wilson, seconded by Commissioner Raborn and carried, the Mayor and City Clerk were authorized to execute said Contract. After consideration and on motion of Commissioner Moore,~seconded by Commissioner Wilson and carried, approval was granted to pay $2,015.32 to John A. Burton, IV, Architect, as submitted on statement dated September 23, 1968, for architectural services rendered to date on the Goldsboro Recreation Neighborhood Facilities Building, as authorized under Agree- ment for same dated July 8, 1968. After consideration and onmotion of Co~missioner Raborn, seconded by Commissioner Wilson and carried, approval was given to allow downtown merchant, McCrory's Store, to hold a sidewalk sale in front of the vacated Mather Building on East First Street on the dates of September 26 through 28 and October 3 through 5, 1968, with the keeping of a pedestrian pas- sageway open. The Building Official presented for consideration a proposed condemnation Report No. 68-293 covering a commercial building located at 309 South Sanford Avenue which was found to be in a dilapidated, unsanitary or unsafe condition and being a part of a building of 311 South Sanford Avenue that has been placed under prior condemnation with said addresses being a building having a partition by a main bearing wall. After discussion and on motion of Commissioner Raborn, seconded by Commissioner Moore and carried, authorization was given to include proposed Report No. 68-293 with the · '4 MINUTES City Commission, Sanford, Florida Commissioner Higginbotham next introduced Ordinance No. 955, entitled: ~N ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER ll, THE CODE OF THE CITY OF SANFORD, FLORIDA, 195~, SECTION ll-12.1 THEREOF, SUCH SECTION IMPOSING A FEE FOR THE COLLECTION OF REFUSE, AS DEFINED THEREIN, PRESCRIBING THE AMOUNT OF SUCH FEE AND DEFINING USAGES UPON WHICH SAID FEE IS BASED, AND PROVIDING FOR THE METHODS OF BILLING FOR 'THE SAME, AND THE PENALTY FOR FAILURE TO PAY SUCH FEE, SAID AMENDMENT CHANGING THE FEE FOR RESIDENTIAL OCCUPANCY AS PROVIDED IN SUBSECTIONS (a), (b)3, AND (d), AND CHANGING THE FEE FOR BUSINESS OCCUPANCY AS PROVIDED IN SUBSECTIONS (e), (f) AND (g), AND PRESCRIBING COLLECTION FEES FOR SUCH OCCUPANCY. and same was placed on its first reading and read in full. Commissioner Higginbotham then moved on the waiver of the requirement of the second reading of Ordinance No. 955 and that same be placed on its final passage and adoption, seconded by Commissioner Moore. After being read in full, Commissioner Higginbotham moved on its passage and adoption. Seconded by Commissioner Moore and carried over the dissenting votes of Commis- sioner Raborn and Commissioner Wilson. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 952, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, MAKING APPROPRIATIONS FOR THE CITY OF SANFORD, FLORIDA, FOR THE FISCAL YEAR BEGINNING OCTOBER l, 1968 AND ENDING SEPTEMBER 30, 1969. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 953, entitled: MINUTES City Commission, Sanford, Florida , September 23 at 8 P. M. 19 68 The City Manager informed the Commission that an error was made in the legal de- scription on the land exchange between the City of Sanford and William L. Kirk authorized by the Commission at the meeting of May 27, 1968. The City Attorney was instructed to submit a verification of the legal descriptions of said land exchange intent.
