The City Commission of the City of Sanford, Florida, met in Regular Adjourned Session'at the City Hall in the City of Sanford, Florida, at 8:00 o:tclock P. M. on December lO, 1968. Whelchel Police Chief Ben E. Butler Absent: Commissioner W. Vincent Roberts, Mayor The meeting was called to order by the Chairman. The first item of business was a Public Hearing to consider the recommendation of the Zoning and Planning Commission for the rezoning of property west of French Avenue from M-1 (Light Industrial) District to C-1 (Neighborhood Commercial) District and R-6 (Multiple Family Dwelling) District, as advertised in the Sanford Herald on November 29, 1968. NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on December 9, 1968, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: hearing. (a) That area bounded on the north by 8th Street; on the east by the alley between Maple and French Avenues; on the south by 9th Street; on the west by the railroad be rezoned from M-1 (Light Industrial) District to C-1 (Neighborhood Commercial) District. (b) That area bounded on the north by 9th Street; on the east by the alley between Maple and French Avenues; on the south by 12th Street; and on the west by the Oviedo Branch of the railroad, less west one- half Block 13, Tier 9, E. R. Trafford's Map of Sanford be rezoned from M-1 (Light Commercial) District to R-6 (Multiple Family Dwelling) District. Whelchel As City Clerk of the City of Sanford, Florida The Chairman announced that the Commission would be glad to hear from anyone in favor of, or against, the rezoning as advertised in the foregoing notice. Sam B. Humphries, property owner in the immediate area, spoke in favor of the rezoning. There being no opposition, Commissioner Wilson moved to authorize the City Attorney to prepare an ordinance for the rezoning of said property as set forth in the legal notice. Seconded by Commissioner Moore and carried. A discussion was next held on a letter of request from Mr. and Mrs. William Leach to reopen the public hearing and the Commission to reconsider their action of denial on No~ember 25, 1968, for the operation of a children's nursery as a conditional use in an R-lA, residential zoned district, at their address of 100 East Onora Road, Pinecrest Subdivision. Approximately twenty abutting property owners within the immediate area appeared to support the objection voiced by Mr. Reck. After consideration, Commissioner Moore moved that the request to open the public hearing for said operation be denied. Seconded by Commissioner Raborn and carried. Consideration was. next given to requests of A. J. Thomas, Jr., and Harold L. Slama, respective lessees of the Monroe Motels, Inc., and Monroe Harbour, Inc., for the City to pay the 1968 County real estate taxes on the leased properties, in the amounts of $12,076.01 and $7,295.42 respectively. Mr. Thomas based his request on the fact that there is no require- ment in the terms of the Lease Agreement that Monroe Motels is liable for payment of County taxes. Mr. Slama was present at the meeting and stated that, as owner of MOnroe Harbour, he was willing to pay taxes on the dry storage building and its improvements but felt that it was not the intent of the Lease Agreement to be taxed a total of $14,4~2.40 for City and County taxes with the County taxing the launching ramp or land and'improvements made by the City which is for public use. After discussion, Commissioner Moore moved that after the date of January l, 1969, the City Attorney be authorized to meet with the attorney for Mr. Slama and they in turn meet with the new incoming Seminole Tax Assessor to discuss the matter of the 1968 County taxes on the marina, with a report brought back to the Commission, and that the drawing of new Lease Agreements between the City and the Lessees be considered with particular foresight given to the tax responsibility. Seconded by COmmissioner Raborn and carried. After consideration, Commissioner Raborn moved to approve the payment of $10,67~.00 to Mannel Builders, Inc., Orlando, Florida, as evidenced by Certificate No. 2, dated Decem- ber l, 1968, covering construction work from October 25, 1968, to November 25, 1968, on the Goldsboro Neighborhood Recreation Facilities Bhilding, as approved by the City Manager and Architect John A. Burton, IV, and authorized under Contract dated September 24, 1968. Seconded by Commissioner Wilson and carried. After consideration, Commissioner Raborn moved to authorize the City Manager to attend an International City Managers' Association "Advanced Management Training Program" in Athens, Georgia, January 5-10, 1969. Seconded by Commissioner Moore and carried. On request of same, Commissioner Moore moved to grant authorization for the Mayor, City Clerk, City Attorney, and the Auditors to enter the City of Sanford safety deposit boxes at the Sanford Atlantic Na~,ional Bank for the purpose of auditing for the fiscal year 1967-68. Seconded by Commissioner Wilson and carried. After consideration and on motion of Commissioner Raborn, ~econded by Commissioner Moore and carried, authorization was given to transfer appropriated funds within the Public Library accounts in the amount of $20.00 from Account No. 6028, Books, to Account No. 6012, Furniture Expense and Office Equipment, to cover the price difference in the purchase of a "Record Holder". Commissioner Raborn next introduced Ordinance No. 957, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NUMBER 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN C-1 (NEIGHBORHOOD COMMERCIAL) DISTRICT, AND IN R-lA (SINGLE FAMILY DWELLING) DISTRICT. On motion of Commissioner Moore, seconded by Commissioner Wilson and carried, the minutes of November ll, November 25, December 4, 1968, were approved. A discussion was next held on the written request of the County of Seminole, through County Appraiser John A. Sauls, that the City donate by deed a 33-foot right-of-way along the west side of city-owned property of that of the Mayfair Country Club and described as the W 33 feet of the E~ of Section 4, T20S, R3OE, lying south of Paola Road (Florida State Sec- ondary Road No. S-46A) and north of Greenbriar of Loch.Arbor Section according to plat re- corded in Plat Book 14, Page 23, public records of Seminole County, Florida, and Containing 2.9 acres, more or less. The request outlined that the County is desirous of paving that road lying south of Paola Road (S-46A), and north of Greenbriar of Loch Arbor, to complete the section of road north of Lake Mary to the Paola Road. It was explained that the new water supply wells of the City are located within this particular right-of-way and that prior to any deeding, consideration needed to be given to their protection or relocation, relocation costs and the bearing of said costs. After discussion, Commissioner Moore moved that the above outlined right-of-way request be denied. Seconded by Commissioner Raborn and carried. On motion of Commissioner Wilson, seconded by Commissioner Moore and carried, cur- rent vouchers and payrolls were next approved as evidenced by General Fund Florida State Bank Vouchers Nos. 12850 through 13065; General Fund Sanf~rd Atlantic National Bank Vouchers Nos. 336 through 394; Water and Sewer Revenue Fund Florida State Bank Vouchers Nos. 305 through 315; United State Bank of Seminole Renewal and Replacement Fund Voucher No. 45; Sanford Atlantic National Bank Public Projects Fund Vouchers Nos. 124 through 131.
