092269 MINUTES City Commission, Sanford, Florida September 22 at 8:00 P.M.1969 141 OFFICE SUPPLY COMPANY The City Commission of the City of Sanford, Florida, met in regular session at the CitY Hall in the City of Sanford, Florida at 8:00 o'clock P. M. on September 22, 1969. Present: Commissioner Lee P. Moore, Mayor " Earl Higginbotham " W. Vincent Roberts " A.L. Wilson City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief Ben E. Butler Absent: Commissioner James H. Crapps The meeting was called to order by the Chairman. M. L. Raborn, Jr., owner of Raborn's Downtown Cleaners and Laundry, appeared re- garding the increased utility rate effective October l, 1969, and objected in that no provi- sion was allowed in the schedule for the higher quantity user in the bracket of lO0,000 to 250,000 gallons and over, and requested consideration that a reasonable rate be reinstated for these consumers. Mr. Raborn suggested this rate might be considered at 20¢ per thousand gallons. The Commission reviewed the water rates under discussion and herein listed, as follows: Former Rate Water Consumption Cost per l?000 gallons lO0,O01 - 250,000 20¢ 250,001 - and over 17¢ New Rate over lO0,O00 24¢ Robert Besserer, Seminole Memorial Hospital AdminiStrator, appeared and requested that the discontinued rate on 250,000 gallon water consumption be re-established in the new rate schedule at a cost of 20¢ per thousand gallons. The City Manager outlined that present water production and treatment cost to the City is approximately at the rate of 20 to 21¢ per 1,O00 gallons. Mr. Raborn further pointed out that in addition to the new water rate schedule, the sewer rate was increased from the 68% commercial rate of the water bill to 81% of the water bill, that on the basis of his August water consumption the bill amounted to $125.00 and the new rate would be $165.01. After discussion, Commissioner Wilson moved to authorize the reinsertion in the new utility rate schedule, a 250,000 gallon and over water consumption rate of 20¢ per 1,O00 gallons. Seconded by Commissioner Higginbotham. After further consideration, Co~missioner Higginbotham and Commissioner Wilson withdrew the motion. Mr. Besserer expressed that the City should not sell water at less than the cost to produce it. Commissioner Wilson moved that the above water consumption rate be reinserted in the new utility schedule at 22¢ per 1,O00 gallons. Seconded by Commissioner Higginbotham. iVoting recorded as follows: Commissioner Moore - Yea; Commissioner Roberts - Naye. The City Manager pointed out the time essence regarding technicalities of computer programming of new rates Commissioner Higginbotham moved to withdraw his second to the above motion and then moved that the revised utility rates as adopted by Ordinance No. 971, effective October l, 1969, stand and same implemented. Seconded by Commissioner Roberts and carried over the dissenting vote of Commissioner Wilson. Conside=ation was next given to street light installation request at the inter- section of Tenth Street and Cedar Avenue, and on recommendation of the City Manager and on motion of Commissioner Roberts, seconded by Commissioner Higginbotham and carried, installa- tion was authorized of two 1,O00 lumen lights in the immediate area. Consideration was next given to an exchange of letters between Municipal Judge Roger L. Berry and City Clerk H. N. Tamm, Jr., relative to the issuance of arrest warrants for municipal court, and after considerable discussion, Commissioner Roberts moved that the matter be tabled. Seconded by Commissioner Wilson and carried. On recommendation of Municipal Judge Roger L. Berry, Commissioner Roberts moved to amend the fine of $202.00 or 60 days plus 20 days straight time to a fine of $125.00 or 60 days in Case No. 88787 against Dean Merle Rudy, dated August 17, 1969, said person having served the straight time. Seconded by Commissioner Higginbotham and carried. Request next submitted by Municipal Judge Roger L. Berry to set aside the es- treature of bond in the amount of $112.00 against James L. Davis, Court Docket No. 88902, charge of Disorderly Conduct; and on motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, same was approved. Arthur P. Maheu, representing Florida Public Utilities Company as General Manager of the Sanford Gas Company, appeared to request consideration of his company leasing or purchasing the City-owned portion of the pipeline located in the public right-of-way on Seminole Boulevard and Mellonville Avenue out to the Sanford Airport (formerly Sanfor Naval Air Station and under a franchise agreement to the Sanford Pipeline Company) for use as a natural gas transmission line to the industries located on the airport property. He further requested that his home office would require the maps and/or plans of said line be made available in order to evaluate the cost of using said line and to determine the basis of leasing or purchasing same. After discussion, Commissioner Roberts moved that the City Manager be authorized to make available to the company the pipeline plans. Seconded by Commissioner Higginbotham and carried. PI. 19 69 143 DOTH~n<OW OFFICE SUFPLY COMPANX · Sanford Airport, appeared and stated that the company, in their manufacturing, is a user of a radioactive chemical of very low energy and is licensed to handle this type of material under the Atomic Energy Commission. However, the State Board of Health requires a guarantee that should the company vacate the premises without decontaminating said premises, the City of Sanford would then be held responsible for doing same. The City Attorney outlined that said operation must also comply under the Florida Statutes, as defined in Sec. 388.01, re- lating to sanitation. After discussion, Commissioner Roberts moved that the Mayor be authorized to sign a letter, written by the City Attorney, to the State Board of Health, stating that the City of Sanford is aware of said operation and accepts under bond guarantee from the company the responsibility of decontamination of the premises upon proper notification by the State Board of Health that said company has failed to do so. Seconded by Commissioner Higginbotham and carried. After consideration, Commissioner Higginbotham moved to accept with regret but with the Commission's thanks and appreciation of their past work on the City Boards, the resigna-' tion of Phillip H. Logan from the Zoning and Planning Commission, and the resignation of John Daniels, Jr., from the Zoning and Planning Commission, Bi-Racial Committee, and the Citizens Advisory Committee. Seconded by Commissioner Wilson and carried. After discussion, Commissioner Higginbotham moved that the City Manager be author- ized to advertise for open bids on the following items: three police vehicles;one, standard sedan for building official's department; one M-ton pickup truck for street department; one M-ton utility pickup truck for utility plants; one flail mower for parks department;on~ front end tractor loader for street department; gasoline and diesel fuel oil, as appropriated under the 1969-1970 Budget and outlined in specifications as submitted by the City Manager. Seconded by Commissioner Wilson and carried. The Police Chief next submitted a report of the vehicle count and usage of the City l~ased off-street parking lots, located as follows: Second Street and Sanford Avenue; Third Street and Magnolia Avenue; and Second Street and Oak Avenue, north half of lot only, with a check for a period o£ two weeks at two specific time every other day. On motion of Commissioner Roberts, seconded by Commissioner Wilson and carried, the matter was tabled in that approximately two months prior to the expiration of the individual lease, said lease be acted on at that time. On motion of Commissioner Wilson, seconded by Commissioner Higginbotham and carried~ Finance Director H. N. Tamm, Jr., was appointed acting City Manager for a period of Septem- ber 29 through October 26, 1969, during the out-of-state vacation period of City Manager W. E. Knowles. Consideration was next given to the statement, dated September l~, 1969, for the month of August, 1969, in the amount of $1,099.32, relating to the Sanford Beautification Plan as contracted through the Orange-Seminole-Osceola Planning Council and sub-contracted with the consulting firm of Wallis-Stresau & Associates; and on motion of Commissioner Roberts, seconded by Commissioner Higginbotham and carried, same was approved for payment. Peterson, associated with law offices of Cottone, Millman, Peterson and Eldridge, Washington, D. C., as evidenced on statement, dated September 5, 1969, for professional services rendered in connection with development of policy for the Sanford Industrial Commission for the months of June, July, and August, 1969, and the acquisition of the former Sanford Naval Air Station property. Seconded .by Commissioner Wilson and carried. Resolution No. 1062 was next introduced and after being read in full, Commissioner Higginbotham moved on its passage and adoption. M. 19 69 OFFICE SUPPLY COMPANY A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA AFFIRMTI~G TO THE FEDERAL AVIATION ADMINISTRATION UTILIZATION OF FUNDS BY THE CITY OF SAN- FORD FROM PROPOSED SALES OF UTILITY SYSTEMS AT THE FORMER NAVAL AIR STATION SANFORD, FLORIDA. WHEREAS, the City of Sanford, by letter dated September 22, 1969, under the signa- ture of its Mayor, has proposed to the Federal Aviation Administration a sale of the telephone and electrical syatems located on the property recently acquired by the City of Sanford, and being formerly known as NAS, Sanford, Florida; and WHEREAS, the City Commission of the City of Sanford, Florida, has determined that such sale as outlined in said letter is necessary and desirable for the orderly and proper development of said property for airport purposes; 'NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, that all proceeds derived from the sale of the existing telephone system and elec- trical system as outlined in the letter.of September 22, 1969, hereinabove described, will be committed and used by the City of Sanford for the development or renovation of the airport runway lighting system; the renovation of the airport sewage system and its direct connection into the sewage system of the City of Sanford, Florida, and for connecting a main water supply system from the City of Sanford to said property. It is a referendum of the electors and can be placed on the ballot at a general election or a special election called for that purpose. It requires a motion to'be passed by the Commission offering this act to the electors 'and directing the city clerk to run notices thereof once each week for four consecutive weeks; the first publication being a least 30 days in advance of the election where the electors will have the right to decide yea or naye. If it is placed on the ballot and it is defeated, it cannot be placed on the ballot for a period of two years. After' discussion, Commissioner Roberts moved that the Mayor and City Clerk, after preparation by the City Attorney, be authorized to sign the necessary documents to place Urban Renewal on the City election ballot for the date of December 2, 1969. Seconded by Commissioner Higginbotham and carried. A discussion was next held regarding requirement of the State Board of Health for a secondary treatment sewer plant and the only source of revenue for its cOnstruction being a "general obligation bond issue", except any funds that might be appropriated by the federal ~overnTent. Said discussion relating to a report of a t~ip by City officials to Tallahassee to answer a citation and discuss with the Air and Water Pollution authorities the matter of secondary treatment plant at an estimated cost of $1,770,000.00. It was pointed out that the plant is one of seven capital improvement projects proposed by the City Commission, in the MINUTES City Commission, Sanford, Florida S~ptember 22 at 8: 00 P. Commissioner Roberts moved to place the entire proposed capital improvement programs on the City election ballot on December 2, 1969, with a brief outline relating to the indi- vidual project and proposed cost of same and further, that the voters be informed that it is a "straw" ballot and the vote is not binding in that it is not a bond issue question and does not commit the spending money at this time. However, as improvements are needed in the future, said balloting would be used as a guide for implementation of the individual project. Seconded by Commissioner Higginbotham. and carried on Capital Improvement Projects listed as follows: ~ro~ect Drainage System (City-wide) Street Paving (Georgetwon and Goldsboro) Secondary Sewage Treatment Plant Zoo Relocation Fire Station Library City Hall and Security Complex City Hall Security Complex Total Cost $ 3,250,000.00 845,000.00 1,770,000.00 180,000.00 120,000.00 200,000.00 450,000.00 400,000,00 $ 7,213,000.00 The City Attorney next reported on authorization of September 8, 1969, to prepare an amendment to Ordinance No. 913 so that the dates of the certificate of competency will correspond with the City's fiscal year and that said amendment was not necessary since the ordinance as passed sets up a Central Contractors Examining Board which has the authority to make this change and it is only.necessary that the City Commission instruct the Central Examining Board that the City Commission did approve the change in the renewal date of said certificates, as reflected in the minutes of September 8, 1969. After consideration and on recommendation of the City Manager, on motion of Commis- sioner Higginbotham,'seconded by Commissioner Wilson and carried, authorization was given to pay the amount of $5,985.58 to Shoemaker Construction Company, Inc., for work performed from July 30, 1969 to September 19, 1969, on the construction of the dressing room addition to the Sanford Civic Center, as evidenced on Application No. 2, dated September 19, 1969, and author- ized under Contract dated June 16, 1969. Consideration was next given to the feasibility of furnishing a sewer line to the Grapeville Avenue Industrial Park area, and on motion of Commissioner Higginbotham, seconded by Commissioner Roberts and carried, the firm of Clark,Di~tZ and Associates was AUthorized to iproceed with the engineering, survey, design, construction plans, and permit work on said ~ewer line, as submitted in a prior preliminary study, for an estimated cost of $3,500.00. On motion of Commissioner HigginbOtham, seconded by Commissioner Wilson and carried, ~inutes of August 25, and September 8, 1969, were approved. After discussion and on recommendation of the City Manager, Commissioner Higgin- botham moved that the salary classification of police employee Robert Howell, effective October l, 1969, be established as Communications Clerk, E grade, at an annual salary of $5,155.00.
