M. 19. 69 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on October 13, 1969. Butler Absent: Commissioner W. Vincent Roberts City Manager W. E. Knowles The meeting was called to order by the Chairman. The first item of business was consideration of the following tabulation of bids, opened publicly at 2:00 P. M. on September 26, 1969, for the furnishing and laying of asphal- tic concrete for the paving of City streets, in accordance with specifications as published in the Sanford Herald on September 17, 1969. BID TABULATION Com_~ Cost Per Ton Basic Asphalt Corporation, Orlando $11.50 Wilkins Paving Company, Sanford $11.50' (bid made with the contractor understanding the City forces would do the sweeping) Orlando Paving Company, Orlando $11.90 Southern Paving Company, Inc., Orlando $12.00 (sent certified mail; received in City Manager's office Monday, September 29 - 9 AM) After consideration and on the basis that the specifications so specify that the contractor will prepare the surface, such as sweeping, Commissioner Higginbotham moved to accept the low bid of Basic Ashphalt Corporation, Orlando, Florida, at the cost of $11.50 per ton. Seconded by Commissioner Crapps and carried. Attorney C. Vernon Mize and ReaLtor John L. Sauls next appeared to discuss the finalization of prior action taken by the City Commission relative to the proposed con- struction of privately-owned low rent subsidy housing, namely Seminole Gardens, Inc., in the area of four blocks between Fifth and Sixth Streets and Mangoustine and Pomegranite Avenues, with specific reference made to action taken by the Commission in minutes of May 13, 1968, tabling the adoption of Ordinance No. 939, rezoning said property to R-6, and Ordinance No. 9~1, closing and abandoning certain street rights-of-way, pending final commitments by the Federal Housing Administration and other interests; and, further, such action as taken in minutes of June 24, 1969, that the City would install a water line to the property and pave West Fifth Street with the cost of the materials to be borne by the developer, and tabling said action until the matter of a pending sale of the property could be clarified relative to said property being owned by a nonprofit organization and possibly being exempt from City taxes. Mr. Mize outlined to the Commission that the agreement with the fraternal organi- zation did not materialize; the project is now under contract with a profit motivated organization in Orlando, Pine Court Corporation; commitment has been issued by the Federal Housing Administration; mortgage money has been committed by the Federal National Mortgage Association of Atlanta; and the mortgage brokers have advised that the owner can anticipate the closing of the transaction probably by the following week in Tampa, and the commitment MINUTE'S D OF CE · . City Commission, Sanford, Florida October 13 at 8:00 P. M. 19 69, has been issued for a little over a million dollars and the sale will be closed at the same time. Hr. Mize outlined that Federal Housing Administration, thus far, has been satisfied with the information that they have been able to furnish, but there will be need of further confirmation of action taken by the Commission in relation to the project. Commissioner Higginbotham questioned the stipulations that were previously discussed and proposed by the City Commission wherein the City in no way could be circumvented out of the tax money in the event that this project would be converted over to a nontaxable entity. Mr. Mize stated that the interest of the original fraternal group, Knights of Pythias, had fallen through and that the present group that the Contract is initiated with has a sub- stantial deposit and has paid their mortgage money and is not a nonprofit corporation, namely being that of the individual Hr. Earl Gorman, who could not possibly get the property exempt from taxation. Commissioner Higginbotham questioned the point of a future sale or transferring the property to a nontaxable organization. Hr. Mize stated that he had done research in this respect and had submitted a brief memo on same to the City Attorney, and it has been concluded in their opinion, that even for a nonprofit corporation or organization or for same to fall into the catagory of charitable, educational or religious corporation or organization which meets the general tax standards, that for them to have tax exemption, they would have to be using this property for one of those purposes and these particular possibilities under the program that this money is appropriated, rent supplement money mmuder the Federal Housing, is not for any of these purposes. In rendering an opinion, the City Attorney concurred with Mr. Mize's statement. After further discussion, Commissioner Higginbotham moved that all commitments as originally made by the Commission with reference to said project be carried out and that Ordinances No. 959 and No. 9~1, having had final readings at the regular meeting of May 1968, be removed from the tabling action and adopted. Seconded by Commissioner Wilson and carried. Thereupon, the Chairman announced that the City CommissiOn of the City of Sanford, Florida, by unanimous vote had passed and adopted Ordinance No. 959, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NUMBER 771 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SAN-FORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN R-6 (MULTIPLE FAMILY DWELLING) DISTRICT. and Ordinance No. 9~1, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABAN- DONING THAT CERTAIN PORTION OF MUL- BERRY, JESSAMINE AND OLEANDER AVENUES LYING BETWEEN TEE SOUTH RIGHT-OF-WAY LINE OF FIFTH STREET AND THE NORTH RIGHT-OF-WAY LINE OF SIXTH STREET, IN THE CITY OF SANFORD, FLORIDA. Consideration was next given to a request for the City to place an ad in the Annual Mail-A-Way Progress Edition of the Sanford Herald and Orlando Sentinel at a cost of $518.00 and $6~0.00, respectively. The Commission was informed that the Sanford Industrial CommiSsion at a recent meeting voted to approve the placing of an ad in each paper with cost being appro- priated in and paid from Account No. 851~, Advertising and Promotion, and on motion of Commis- sioner Crapps, seconded by Commissioner Wilson and carried, it was authorized that the City of 152 MINUTES City Commission Sanford, Florida October 1~ at 8:00 P. Nidy, Nidy Construction Company, Winter Park, Florida, outlining the conStruction of four shuffleboard courts over the top of the existing courts at a cost of $2,629.00, in addition to the City providing labor, equipment, and materi- al to remove the existing gutters, repair existing drain lines, and to install two additional drain lines Reference was made to a prior proposal of 1963 and cost as submitted by Hr. . Nidy for the reconstruction of twelve City shuffleboard courts, including all work done by said firm, versus the present cost for a number of four courts. After discussion, Commissioner Higginbotham moved that the proposal be referred bac~ to said contractor for further consideration and the City be advised with further details re- ~_~ garding the basis of the cost being three times greater than the previous quotation, in addi- tion to the City crews assisting in a certain portion of the work. Seconded by Commissioner Crapps and carried. A request by the Phi Mu Sorority of Rollins College, Winter Park, in conjunction with Stetson University, DeLand, for use of the Sanford Municipal Civic Center on October 1969, with alcoholic beverage privileges was considered, and on motion of Commissioner Crapps, seconded by Commissioner Wilson and carried, the request was denied on the basis that youths under the age of twenty-one years would be participating in the event. Request next submitted for a transfer of funds in the 1969-70 Budget in the amount of $300.00 from Contingency Account No. 8150, to Recreation Department Account No. 4221, Building Repairs and Maintenance, to cover the cost of professional services for the sanding and finishing of the stage floor in the auditorium of the Sanford Municipal Civic Center, and on motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried, same was approved. Consideration was next given to the following list of nineteen structures submitted by the Building Official which were found to be in a dilapidated, unsanitary or unsafe condi- tion, with a recommendation that condemnation proceedings be taken on same. Chappell's Subdivision Commissioner Wilson moved to hold a Public Hearing on October 27, 1969, to consider Reports Nos. 69-294 through 69-512 to determine the condition of the structures for condemna- tion proceedings; and to authorize that a notice be placed upon each structure; and directed by registered mail to the last known address as shown by the Tax Assessment Rolls of the City a notice to the owner of the property involved at said hearing. Seconded by Commissioner Higginbotham and carried. Consideration was next given to an application for an occupational license for sale of beer and wine, for consumption on premises and packaged sales, at the location of 2603 Park Drive, d/b/a Terry's Tavern by owners Kenneth R. Patterson and APdrew J. Adcock, Jr., and approved by the Police Chief, and on motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried over the diSsenting vote of Commissioner Wilson, same was approved. After discussion of a proposed contract as submitted by Datametrics Corporation, Indialantic, Florida, Commissioner Crapps moved to authorize the Mayor and City Clerk to execute same for the computer billing of the City of Sanford utility accounts. Seconded by Commissioner Higginbotham and carried. After consideration, Commissioner HigginboCham moved to authorize the payment from Public Projects Fund of a statement, dated October 10, 1969, in the amount of $158.41, from the Orange-Seminole-Osceola Planning Commission, Orlando, for services rendered for the month of September, 1969, and under Contract Agreement for the furnishing of a Sanford Beautifica- tion Plan. Seconded by Commissioner Wilson and carried. After consideration of a request from the Airport Manager, Commissioner Higginbothaa moved to authorize the transfer of accounts of the fiscal budget year 1968-69 of the Sanford Airport, as follows: $100.00 from Account No. 8655, Radio Equipment and Repair to Account No. 8684, Utilities $525.00 from Account No. 86-9, Engineering Services~ to Account No. 8627, Taxiway, Runway Upkeep & Repair $ 50.00 from Account No. 86-9, Engineering Services to Account No. 8608, Telephone & Telegraph $ 50.00 from Account No. 89-5, Repairs to Water Mains to Account No. 8998, Utility - Use of City Staff Seconded by Commissioner Crapps and carried.
