M._19~ The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on November 24, 1969. Present: Commissioner Lee P. Moore, Mayor " James H. Crapps Earl Higginbotham " W. Vincent Roberts A.L. Wilson City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief Ben E. Butler The Meeting was called to order by the Chairman. The first item of business was the consideration of a request from Bruce J. Bauder, Treasurer of Bauder Associates, Inc., frozen food storage and processors, ~O1 Nest 13th Street, for the utilization of street right-of-way to construct an 8xl6-foot loading dock and parking ramp on Elm Avenue for the purpose of backing in and unloading of large trailer trucks and to eliminate the present traffic hazard. He stated there is a 27-foot parkway from the edge of the building to the curb, and after construction of the dock there would still be an ll-foot parkway that would not be utilized. After discussion, Commissioner Higginbotham moved on approval of the request with the stipulation that, upon any future need of the City for use of this right-of-way of Elm Avenue, that the loading dock and ramp would be subject to removal by the property owner at the request of the City. Seconded by Commissioner Crapps and carried. Consideration next given to the proposals submitted by Robert Ko Nidy, Nidy Con- struction Company, Winter Park, Florida, for construction of shuffleboard courts, as follows: (a) Proposal of September 24, 1969 Four courts at a cost 6f $2,629.00 (b) Proposal of November 10, 1969 Four courts at a cost of $2,180.00, with certain exceptions (c) Proposal of November 20, 1969 Two courts at a cost of $1,105.00 and on motion of Commission Wilson, seconded by Commissioner Higginbotham and carried over the dissenting vote of Commissioner Moore, the Commission approved the proposal of November l0 1969, for construction of four courts and a transfer of funds in the amount of $2,180.00 from Contingency Account No. 8150 to Parks and Cemetery Account No. ~166, Repairs-Shuffleboard Courts. Consideration was next given to request presented at the City Commission Meeting of November 10, 1969, by the Merchants Division of the Seminole County Chamber of Commerce for the City to subsidize the operation of a public bus service of Sanford Transit Company for a period of one year in a sum not to exceed $12,000.00, wherein the matter was held in abeyance pending an opinion from the City Attorney On the use of public funds to underwrite a portion of prospective losses for a private enterprize. The City Attroney referred to Article VII, Section l0 of the ConstituDion of 1968, and gave the opinion that such indemnity on the part of the City would be an unlawful pledge of public credit from its inception and that any ex- penditure of public funds incident to such indemnity, would be an unlawful expenditure; and, that there is no valid way that the City of Sanford may undertake the proposal as presented. Thereupon, the matter was referred back to'the petitioner. Gordon Meyer was present to reiterate the request for sidewalk construction on 27th Street from the Pinecrest Elementary School east to Sanford Avenue, portions being outside the City limits. '1.-. 165 The City Manager was instructed to obtain a report on the actions of the County Commission on the matter after their meeting on November 25th, and to submit this to the City Commission at the meeting on December 8, 1969. Bids submitted and publicly opened on October 31, 1969, for equipment of a front end loader-tractor, and tabled at meeting of November 10, 1969, was next considered. Baaed on demonstration, performance, service and parts availability, the following recommendation was submitted by the City Manager: P~.iorit~ Ma.k.e 1 Hough 2 Michigan 5 John Deere Net Bid $26,252.72 26,000.00 21,952.00 After disoussion and on motion of Commissioner Crapps, seconded by Commissioner Roberts and carried, all bids were rejected and the City Manager was authorized to readvertise for bids on same. Consideration was next given to a recommendation of the Sanford Industrial Commis- sion that pre-payment monies in the amount of $15,000.00, collected on the leases of buildings at the Sanford Airport, be invested with $10,000.00 for one year and $3,000.00 for ninety days The City Manager reported that the Federal Aviation Administration Auditor requires that all "airport funds" be handled as "City fundS", and on motion of Commissioner Roberts, seconded by Commissioner Higginbotham and carried, the City Clerk was authorized to invest said funds. The City Manager reported that the local office of Southern Gulf Utilities had in- formed him that the home office had indicated they desired to assess a fee to the City for the collection of the sewer charges for connections in Fairlane Estates Subdivision (Park Ridge). Reference was made to an Agreement of June 8, 1969, in which there was no collection fee stipu. lated. After discussion, Commissioner Crapps moved to authorize the City Attorney to prepare a quit claim deed tendering the gravity sewer collection system within the Fairlane Estates Subdivision (Park Ridge), situated outside the City limits west of US Highway 17-92 and south of Lake Ma~y Boulevard on Lake Minnie, from the City of Sanford to Ecological Science Corpora- tion, successors to Southern Gulf Utilities Company, a private utility corporation serving said subdivision with a water system. Seconded by Commissioner Roberts and carried. It was pointed out that the sewer pumping station, detention tanks, and the eight-inch force main connecting to the City of Sanford sewer system was not included in this deed. After discussion, Commissioner Crapps moved to authorize the City Manager to explore the possibility of a sale of the City-owned water and sewer utility systems serving the Sun- land Estates subdivision situated outside and south of the City limits on the east side of US Highway 17-92. Seconded by Commissioner Higginbotham and carried over the dissenting vote of Commissioner Roberts. After consideration, Commissioner Crapps moved to authorize payment from Pub. lic Projects Fund of a statement, in amount of $$15.81,from the Orange-Seminole-Osceola Planning Commission, for services rendered in the month of October, 1969, under Contract Agreement for the furnishing of a Sanford BeautifiCation Plan. Seconded by Commissioner Higginbotham and carried. Request next submitted by Judge Berry for a transfer of funds in amount of $75.00 from Contingency Account No. 8150 to Municipal Court Account No. 2107, Travel Expense, to cover additional travel expenses; and on motion of Commissioner Roberts, seconded by Commis- MINUTES City Commission, Sanford, Florida November 2# at 8:00 P. After consideration, Commissioner Roberts moved to authorize a Public Hearing to be held on December 8, 1969, to consider proposed Projects Nos. 16-5 and 1~..-6 of the Housing Authority of the City of Sanford, Florida, and to authorize the City Clerk to issue proper notices. Seconded by Commissioner Higginbotham and carried. Consideration was next given to the recommendation of the Zoning and Planning Com~ mission for the rezoning from M-l, Light Industrial, to C-2, General Commercial, District, that area from French Avenue west to Mangoustine Avenue and from Seminole Boulevard south to Fulton Street; and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, a Public Hearing was authorized to be held on December 8, 1969, to consider same Consideration next given to the enforcement of the ordinance pertaining to vacant lot cleaning and/or mowing, and the City Attorney rendered an opinion that the law is en- forceable upon it being determined that the condition of vacant property is detrimental as it relates to the health, welfare, morals, and safety of the general public and not the constant individual harassment of one property owner against his neighbor's property. On motion of Commissioner Higginboth~se~onded~:by Commissioner Roberts and carried, the aforementioned opinion was determined to be the.policy of the City, including the stipulation .that the complaint must be in writing. Consideration was next given to a letter of resignation, effective January l, 1970, from Clifford W. McKibbin, Jr., as a member of the City of Sanford Zoning and Planning Com- mission and the Sanford Industrial Commission, and on motion of Commissioner Wilson, seconded by Commissioner Roberts and carried, said resignation from the two boards was accepted with regrets and an appropriate commendation was recommended to be presented. After consideration of the signed petitions, Commissioner Higginbotham moved to approve the annexation of property into the corporate limits of the City of Sanford, as follows: (a) Lots 6, 7, 8, 10, ll, Block 15, Dreamwold; located on French Avenue south of Santa Barbara Drive, owned by George D'Giovanni. (b) Lot I and 2, Block 8, Pine Level; located on the SE corner of West 18th Street and Peach Street, owned by Gussie Lee Comer. and the City Attorney was authorized to prepare the appropriate ordinancefor said annexation, Seconded by Commissioner Roberts and carried. A discussion was next held relating to annexation petitions on file and signed by various property owners throughout the Mayfair Section, the area more particularly described as being located east of Virginia Avenue, between Seminole Boulevard and Fourth Street, and on motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried, approval was given for the City Manager to contact by letter the property owners within the area who have not signed annexation petitions, to determine if their interest is to have their made a part of the City. M.19 69 DO~It~QW Ol~I~ SI~PPL~ {~I~MPANY After discussion, Commissioner Wilson moved to authorize the Mayor.to sign a letter setting forth that the City of Sanford endorses the proposed program of the local Seminole Community Action, Office of Economic Opportunity, to apply to the Department of Housing and Urban Development for federal funds to provide a community development corporation for the provision of employment opportunities for the disadvantaged.: Seconded by Commissioner Higginbotham and carried.
