The City Clerk reported that the first public hearing to consider same had been tab- led at meeting of October 13, 1980, pending a recommendation from the Planning and Zoning Commission. Commissioner Fart moved to remove from table consideration of rezoning the Hid- den .Lake PUD property. Seconded by Commissioner Stenstrom and carried. On recommendation of the Planning and Zoning Commission, Commissioner Fart moved to authorize the City Attorney to prepare the proper ordinance to rezone the parcels designated A-2-_l, B-3 and D, lying north of Airport Boulevard as advertised, and to table consideration of the balance of the parcels for 30 days. Se- conded by Commissioner Keith and carried over dissenting vote of Commissioner Stenstrom. Commissioner Stenstrom moved to remove from table, consideration of a request from Harcar, In to reduce the utility connection fee for a proposed 240,000 square foot commer- cial building to be consCructed on Cornwall Road. Seconded by Commissioner Fart and carried. Mr. Ken Sand.n, 2432 Mellonville Avenue, Sanford, appeared to support the request and stated that they woUld like the fee reduced from $26,400.00 to approximately $5,000.00. Commissioner Farr moved to deny the request. Seconded by Commissioner Stenstrom and carried over dissenting vote of Commissioner Keith. SITPPT,Y COMPANY The City Manager reported that the U. S. Congress has not approved Revenue Sharing funds for FY 1980-81, and that Sanford had prepared the 1980-81 budget utilizing Federal Rev- enue Sharing funds, which would effect the scheduling of increases proposed for January 1, 1981. The Mayor stated he had asked the City Manager for a list by position title, showing present salaries, the salary as recommended by the Staff Study, the salary ~recommended by the Department of Commerce, and the proposed salary as recommended by the Staff~, effective January i, 1981. Request submitted from G. Troy Ray, Seminole County Tax Collector~, for refund in amount of $38,81 for Fruit Growers Express, for Aggregate Tangible Personal Property Tax for tax years 1976 through 197~, and approved by the State of Florida Department of Revenue. Com- missioner Stenstrom moved to authorize same. Seconded by Commissioner Farr and carried. On motion of Commissioner Stenstrom, seconded by Commissioner Keith and carried, Re- solution No. 1285 was read in full and adopted. Said resolution being in words and figures as follows: A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, APPROPRIATING UNEXPENDED CASH SURPLUS ON HAND A~T END OF THE FISCAL YEAR 1979-1980 TO THE DEPARTMENT OF GENERAL GOVERNMENT OF SAID CITY FOR THE FISCAL YEAR 1980-1981 FOR USE OF ORDINARY PURPOSES IN OPERATING EXPENSES OF SAID CITY. WHEREAS, the City Commission of the City of Sanford, Florida, deems it necessary, expedient, and for the best interest:~of said City that any unexpended cash surplus as of September 30, 1980 of the operating revenues of said City for the Fiscal year 1979-1980 be appropriated for the ordinary purposes and operating expenses of said City in the Budget for the fiscal year 1980-1981. ~ NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, that any unexpended cash surplus as of September 30, 1980 of operating revenues of said City for the fiscal year 1979-1980, be and the same is hereby appro- priated to the Department of General Government of said City for the ordinary purposes and operating expenses of said City for the fiscal year 1980-1981, and said~Cash Surplus shall be in- corporated in the budget of revenues and expenditures of said City for said fiscal year 1980-1981 for the ordinary purposes and operating expenses of said City. M. 19 80 follows: Budget: see page 430 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, ADOPTING A FINAL BUDGET OF REVENUES AND EXPENDITURES FOR THE CITY OF SANFORD, FLORIDA, FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1980, AND ENDING SEPTEMBER 30, 1981; AND CAPITAL BUDGET WHEREAS, in accordance with Article VI of the Charter, as amended, of the City of Sanford, Florida, the City Manager of the City of Sanford, Florida, has made and submitted to the City Commission of the City of Sanford, Florida, an estimate for budget of revenues:and expenditures of the City. of Sanford, Florida, for the fiscal year beginning October 1, 1980, and ending September 30, 1981, and a Capital budget, such estimates or budget having been made with particula~ application to the various departments of the City, a true copy of which is hereto attached and by reference made a part of this Resolution; and WHEREAS, each and every item contained and set forth in said budgets prepared by the City Manager has been carefully considered by this Commission; and WHEREAS, the City Commission of the City of Sanford, Florida did adopt by resolution a tentative budget at the regular meeting on October 13, 1980, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, that said budget as prepared and submitted by the City Manager to the City Commission, be and the same is hereby adopted as the finaI budget for the City of Sanford, Florida, for the fiscal year beginning October 1, 1980 and ending September 30, 1981; and the Capital budget, as prepared and submitted by the City Manager to the City Commission, be and the same is hereby adopted. BE IT FURTHER RESOLVED that, upon collection of any revenues of said City, the City Clerk shall allocate from each dollar collected and received, the several amounts to the respective funds for purposes for which the same are hereby authorized and approved. Tom Hickson, from Fire Lieutenant D to E, $17,868.59 annual. The City Manager reported estimated costs to repair McCracken Road as follows: To reconstruct and widen to 24 feet: $35,781.09. To reconstruct and widen to 20 feet: $23,636.40. The Commission took no action. Commissioner John G. Morris submitted a request that his letter of resignation from the Sanford City Commission be effective October 31, 1980. Johnny Lee Smith, 1510 West 13th Street, appeared and stated someone poured gas in his house and set it on fire, and requested an investigation of the incident. He stated he felt the fire may have been set as a reprisal because he talked to the Sanford Police Depart- ment about problems on West 13th Stmeet. The City Manager reported that the Fire Department and the Police Department were handling the inquiry. The City Attorney reported he had received a request for settlement in amount of $3,480.00 from Ken Mclntosh, Attorney, representing Henry Wright, for carpet and other fur- nishings damaged when the sewer backed up in his house, because excessivelyheavy rains had flooded the system. He stated if the matter was not settled, the City would be sued for dam- ages. The Commission reiterated that the City was not at fault, that the back-up was caused by heavy rains, not a fault with the sewer system. Commissioner Stenstrom requested the City Manager to talk to Roger Neiswender about having a bus stop at Jewel T and Fairway Market, near 27th Street and U. S. Highway 17- 92, instead of further south at the ABC Lounge and Western Sizzler Restaurant. There being no further-:~business, the meeting was adjourned.
