Commissioner Stenstrom moved, to authorize the City Attorney to prepare the proper ordinance to annex same. Seconded. by Commissioner Farr and. carried. Commissioner Farr moved to authorize mobile trailer signs for the Central Baptist Church, Optimist Club of Sanford and An Occasional Piece Antiques, and.to deny the request from Arthur Treacher's Seafood Restaurant. Seconded by Commissioner Keith and carried. Recommendations dated November 21, 1980 .submitted from the Planning and Zoning Com- mission as follows: RECOMMENDATION 1. Recommend denial of a request to rezone the unplatted area of Hidden Lake PUD south of Airport Blvd.,Public Hearing tabled from Sept. 18, 1980 meeting. Reason: Owners Don .Bales and. Commissioner Stenstrom moved to authorize a public hearing to be held December 8, 1980, to consider Item (2). Seconded by Commissioner Keith and carried. On recommendation of the Planning and Zoning Commission, Commissioner Stenstrom moved to remove from table a public hearing tabled at regular meeting of October 27, 1980, and to deny the rezoning of unplatted property in Hidden Lake PUD lying south of Airport Bou- levard. Seconded. by Commissioner Keith and carried. Commissioner Farr moved to remove from table, consideration of a light at the Cham- ber of Commerce parking lot. Seconded. by Commissioner Keith and carried. Commissioner Keith moved to authorize installation of a timer to control the light at the proper times. Seconded by Commissioner Stenstrom and carried. WHEREAS, the City Commission of the City of Sanford, Florida, adopted. M. 19 80 MIDHTATE LEGAL ~UPPLY GOMPANY A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, ADOPTING AMENDMENTS TO THE OPEN SPACE STANDARDS OF THE REVIEW PROCEDURES AND STANDARDS FOR SITE DEVELOPMENT PLAN REVIEW. WHEREAS, ~Ordinance No; 1530, dated October 27, 1980, was Passed and adopted, by.the~City~Commission of th~ City of San~rd~ Florida, which said Ordinance rescinded Ordinance No. 1500, which amended the Open Space Standards of the Review Procedures and Standards for Site Development Plan Review;.and, WHEREAS, it is necessary that a Resolution be adopted in order to properly amend the current standards in order to provide for the payment of money in lieu of dedication of property at the option of the City Commission of the City of Sanford, Florida,and further, for payment of money in situations whereby a building permit is issued for the construction of a dwelling house in a subdivision which has been previously platted, NOW, THEREFORE., BE IT RESOLVED BY. THE-CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, as follows: 1. Paragraphs Six (6) and Seven (7) of the Open Space Standards of the Review Procedures and Standards for Site Development Plan Review, be and the. same~are.hereby amended to read as follows: "6..Where a proposed subdivision is too. small.to provide adequate open space according to these standards, payment in lieu of.dedication shall be made to the City in the amount equal to the appraised value of the property determined in (4) above. 7. The City shall have the option to require either the dedication of open space or payment of money equal to the appraised value. In the event payment is required the money derived from such payment shall be used by the City for the development or purchase,of parks." 2. That an additional Paragraph, be and the same is hereby added, to the Open Space Standards referred to above, said Paragraph to be numbered Eight(8) and shall read as follows: "8. In the event a building permit is issued for construction of a dwelling in an existing subdivision where payment of money or dedication of land has not occured by the devel- oper, the applicant for the building permit shall pay a fee of Seventy~Five and No/100 ($75.00) Dollars for each such permit, The money derived therefrom shall be used to purchase, or develop parks in the City at such times and places as determined by the City Co~m~ission." M. 19 80 On motion of Commissioner Keith, second:ed by Commissioner Stenstrom and carried, Minutes of November 10, 1980 were approved. ~Request submitted from Lake Monroe Harbor, Inc., Joe Maino and Chuck Volk, owners, for indication from the City of interest to sponsor an industrial development bond issue for proposed improvements at the Marina, and for which,the City would not be responsible for is- sue, nor liable for payment. Mr. Bill Hart, Vice-President, FlagShip Bank of Seminole, was present and stated that a Jacksonville law firm has indicated that this project was acceptable'under Sec. 159.27 FS and that his organization has a strong interest in helping Monroe Harbour with financing these improvements. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize the City to be the sponsoring agency fbr the industrial bond issue. Seconded by Commissioner Keith and carried.. The City Manager reported that Mr.:Tom Binford, Central Florida Bench Company, had contacted the City and submitted a proposed contract for the City to lease benches from his company, on which he would sell advertising space. The City Manager further reported that the City has contacted other cities and obtained copies of agreements and that the City will have a new and better agreement for bid ~w~t~:.tabulations to be submitted at December 22, 19- 80 meeting. ~-'~:,: : Commissioner Stenstrom moved to'table'consideration 'of same. On recommendation of the City Manager, Co~c~cLissioner Stenstrom moved to authorize a street light at 116 North Jessamine Avenue. Seconded by Commissioner Keith and carried. On recommendation of the City Manager,. Commissioner Fart moved to authorize transfe~ in amount of $4,650.00 from Utility Renewal and Replacement to replace the pump bowl in Well #7 in Well Field#l. Seconded by Commissioner Stenstrom and carried. On recommendation of the City Manager, Co~mxxissioner Keith moved to authorize the City Attorney to prepare the proper reSolution to show support for the Hospital Corporation of America's plan for construction of a new hospital and to authorize the Mayor to execute. same. The City Manager submitted copies of ordinances from Leon Countyand from the City of Tallahassee, regulating the purchase by secondhand dealers, of precious metals. The City Manager reported that the City has follow- ed normal condemnation proceedings as outlined by state statutes. The Commission authorized the City Attorney to contact Mr. Jones and inform him the City is following proper procedures, and what action the City will take if the situation is not corrected. Letter of resignation submitted by~G. William Braceland, Building Official, effec- tive November 2'8, 1980. Commissioner Keith moved to authorize the City.Attorney to prepare the proper resolution commending Mr. Braceland for his service. Seconded by Commissioner Stenstrom and carried.~ The City Manager'repOrted that due to many recent sales in the area, new appraisals are needed on land required for sewer plant expansion, and that Mr. John Sauls had been em- ployed to prepare the appraisals, for.total amount of $600.00, and same was approved by the Commission. Petition submitted requesting the City Commission to remove the Commissioners of the Sanford Housing Authority,. and reinstate.~Tom Wilson as Executive Director of the Sanford Housing Authority. The Mayor explained that the City Commission appoints the Board, and does have the authority to remove members of the board, with cause after a public hearing, but there was not sufficient evidence at this time to do so. Mr. Ted Brunell, Apartment 5, Monroe Terrace, asked why Tom Wilson was fired. The Mayor stated that the City Commission did. not know. Reverend Doctor,. 818 OrangeAvenue~, Sanford, asked if the Commission had the author- ity to allow Tom Wilson a rebuttal. The City Attorney stated this question should be direct- ed to the Sanford Housing Authority. Ms. Buratti, 94 Redding Gardens, appeared and stated she would like to know why Tom WilsOn was fired. Mr. A. G. DeLattibeaudiere, 807½ Sanford Avenue, appeared and stated he understood the Commission's position in this matter, and that he did not agree with the action of the Sanford Housing Authority. The Mayor stated that he understood that the Mayor and :City Clerk' as members of the Firemen's Relief and Pension Fund and the Policemen's Pension Fund, and the members of the Civil Service Board are not covered by liability insurance, and they should have some of liability coverage. The City Manager stated that the Mayor and City Clerk as Fire and. Po- lice Pension Board members are covered Under the Unimark-McDonald errors and ommissions pol- icy, and that the Civil Service Board is not actually a part of the City. Commissioner Fart moved to authorize the City Manager to contact the insurance Comp- any to make sure that the Mayor and City Clerk and other members of the Fire and Police Pen- sion Boards are covered, and if they are not covered, to obtain the necessary insurance cov- erage, and if the Civil Service Board members are not covered, to obtain the necessary in- MINUTES City Commission, San£ord, Florida November 24, at 7:00 P. The Commis- sion approved same. The City Manager submitted a copy of a letter to Tom Rucker, regarding Mr. Rucker's Option to Purchase City propertY. He Stated that plans have been submitted showing construc- tion of dwelling units on the property, to be ,constructed in phases. He. further stated that since the construction was planned in phases, all of the property might not be developed, and. this was not what the City Commission intended when they agreed to sell the property, and that he had. requested, the Planning and Zoning Commission to hold in abeyance any site ap- proval until all aspects are clarified. Request submitted frOm ROger Neiswender, County Administrator, for the Commission to submit the name of a nominee for appointment to the.Seminole Community Action Board of Directors. The Commission stated it would consider same,~after the December, 1980 election. The City Manager was authorized to obtain cost figures for a bicycle rack, to be installed downtown, near the Library.
