Smith, who signed thg Oath and Acceptance of Office and was seated as City Commissioner of the City of Sanford, Florida. City Commission, Sanford, Florida December 22, at 7: 00 P. bi. 19 80 746 Baywood Circle Sanford, Florida, 32771 Dec. 17, 1980 To: Sanford City Commission Reference: Proposed Ord. 1Skil - Purchasing precious metals within the City limits. I have read the proposed ordinance ~1541 and would like to present this letter for your consideration when the second reading is voted upon. I am a precious metal dealer who resides in.the county but conducts business Within the.Sanford City limits and Volusia County. I am licensed in both areas and fully comply wi~h State law requiring the reporting of purchases to the Sheriff's Dept. of the respective counties. This new ordinance, although its intentions are good, will have a two-fold effect upon the small~inessmen'like myself. First, it requires that I hold the precious metals I buy for 10 days. The price'of gold changes sometimes as much as $100.00 or more during this period. If this law is enacted it will take the small businessman out.of the realm of a business buying at~a set percentage of profit, and makes him a speculator on the gold market. Since this is my only source of income, I personally do nat wish to speculate with my family livelihood. .' Secondly, I have approximately $1,000 capital wi%h which I buy .gold. I buy and sell every few days at a given percent of profit and hopefully make $800.00 per month at which time I ~ay my monthly bills and start over again. If you pass this ordinance and I buy $1000 worth' of.gold on a weekend, my profit would be approx. $200.00. To have to hold this purchase for l0 days would put me out of business the' other 8 days. This law would limit my income to less than $500.00 a month assuming the gold price remained the same. Although it would not affect large dealers who hmve several hundred thousand dollars to work with and ca~ hold it until the price is up., it would put me and mmaller dealers like me out of business, because we would not be able to make a living. I started the business so that I would not be on unemployment after I lost my position as a driver. Your ordinance would effectively shut down myself and others who operate legally, Just to attempt to s~op crimes. It will not alleviate the criminal element~whc will only steal the items and move them to an area that does not have..this law or they will sell it to a dealer who~does not comply with the law.and who will not maintain records of all sales. Another section of the ordinance prohibits the removal of the items from the city limits of Sanford for 10 days. Since I must take the items ~ buy home with me for safe keeping and the fact that I live in the county would put me in violation of the ordinance on every business day. I hope that this letter will get you .to reconsider the ordinance in the light of the legitimate small businessman. There must be other means that law enforcement can use to stop criminal acts than creating a blanket law that hurts legitimate businessmen in the area. If observed from another view the law will not prevent the crimes and will' make it mo~e difficult for law en$~rcement to locate the persons selling stolen property since they would take it to other areas of the state or county to sell it or sell it to someone they know who buys stolen property. ~, in effect, the only thing I can see that will definitely happe~ with the passage of this ordinance is to put the small businessman like myself out of work. v ,.,~,,~ .~u *~ v~,, e~n~d~r this when votin~ 'on the ordinance. Employees who are required to work an official City holiday will receive pay for a normal days work and either additional vacation days, or in some cases, paid compensation. E. Temporary and part time employees who are not regular employees will not be paid for official City holidays except when their normal City duty falls on the holiday. Fe Stand-by personnel who are called out on a holiday shall receive one-half (½) their base pay in addition to the normal holiday pay. This applies only to thQse employees who normally receive paid holidays. Ge The Refuse crews which work on a holiday shall be paid. their normal pay for that day and an additional eight (8) hours of pay at their normal hourly rate. He stated that this is a good time to ask SEEDCO to intervene~.and recommended the City request SEEDCO to come into the case and possibly enter a separate action in their own name. The City Manager reported, that he had been inquiring of intervention of SEEDCO for the past few weeks, and. they say they want to be on the City side.
